Norfolk Island Employment Rules 2020

Several defined terms from the Act are incorporated by reference rather than re-defined in the Rules. These include "Employment Liaison Officer", "permanent incapacity", and "public scheme" (section 4). Readers must consult the Act itself to understand those terms.

The concept of "periodical compensation" under section 30 of the Act relates to ongoing payments made to an injured employee who has suffered a loss or diminution of capacity to earn. The $3,000 figure prescribed in section 5 of the Rules operates as a threshold in the formula set by subparagraph 30(4)(b)(i): the exact operative effect of that threshold depends on the Act's surrounding text, but its function is to calibrate how the periodical payment is calculated relative to the employee's pre-injury earnings position.

"Permanent incapacity" is a defined term in the Act, covering injury that results in lasting loss of working capacity. Section 6 prescribes $300,000 as the ceiling for lump-sum compensation under paragraph 32B(2)(b). The size of that cap signals the outer boundary of the scheme's exposure for any single claimant and has obvious actuarial consequences for how the public scheme prices its membership fees.

The "public scheme" concept under section 39B of the Act is a pooled workers-compensation arrangement administered by the Employment Liaison Officer. Employers may apply to join this scheme rather than arranging their own workers compensation cover. Section 8 of the Rules governs both the admission criteria and the fee formula. Admission is discretionary: the Employment Liaison Officer must assess four factors going to the applicant employer's risk profile, being accident history, first-aid facilities, accident prevention awareness, and standard of administration. The underlying concern, made explicit in section 8(1), is whether the employer's claims risk "would be likely to prejudice the operation of the scheme so as to require higher membership fees for employers". This is a straightforward risk-pooling rationale: high-risk entrants impose costs on lower-risk members.

The fee formula in section 8(2) is usage-based: $0.30 per employee-hour worked during each calendar month of membership. There are no flat fees, no minimum premiums, and no apparent adjustment for industry risk beyond the admission-stage assessment. This per-hour structure ties the employer's cost directly to the size of their workforce and working hours, which is administratively simple but does not differentiate by injury risk within the pool once admitted.

"Independent medical examinations" under section 47A allow the Employment Liaison Officer or the employer to require an injured employee to submit to medical assessment to verify ongoing incapacity. The fortnightly minimum interval prescribed in section 9 protects employees from being subjected to examinations that are more frequent than once every two weeks.

The Rules apply to employers and employees operating on Norfolk Island under the Employment Act 1988 (Norfolk Island). That covers the island's private sector, small businesses, accommodation operators, retail traders, and any other enterprises that engage staff. Given Norfolk Island's population of roughly 1,700 people and its economy centred on tourism, hospitality, and small-scale trade, the number of affected employers and employees is small in absolute terms.

The Employment Liaison Officer is directly affected as the administrator of the public scheme and decision-maker for admission applications and internal reviews. The 14-day determination period under section 11 imposes a procedural deadline on that officer's internal review function.

Injured employees are affected through the compensation thresholds (sections 5 and 6) and the medical examination frequency cap (section 9). The $300,000 permanent incapacity cap defines the maximum lump-sum recovery available, which is a material limit for any claimant suffering a serious permanent injury.

Employers who are members of the public scheme face the per-hour fee structure in section 8(2). Those who are not members of the scheme, or who are refused admission, must arrange their own workers compensation coverage or face liability under the Act's direct compensation provisions, which is where the $2,000 threshold in section 7 becomes relevant to determining when the liability-to-pay provisions are engaged.

Employers as a class bear the record-keeping burden imposed by section 10. This applies retrospectively in a limited sense: section 12 extends the record-keeping obligation to training given, injuries occurring, and information provided within the three years before commencement, as well as to post-commencement events. Employers who did not previously maintain structured records of first-aid training and workplace injuries therefore face a retroactive compliance obligation for recent historical records.

The primary employer duties created or confirmed by the Rules are:

Record-keeping: under section 10(1)(a), employers must maintain three categories of records. A record of the date and particulars of all first-aid training given to employees. A record of the date and particulars of each workplace injury, unless the Act's subsection 53(3) reporting obligation applies. A copy of any information provided to the Minister under subsection 53(3). These records must be kept for the duration of the employment relationship and for three years after employment ceases (section 10(1)(b)).

Accident notification: where an employee suffers death or permanent incapacity arising from employment, the employer must complete Form 1 (Schedule 1) and provide it to the Minister within 7 days of the event becoming known to the employer. The form collects extensive information: full employer and employee details, earnings history including non-cash benefits over the prior 12 months, precise circumstances of the accident, witness names, nature of injury, and a signed declaration of truth. The instruction on the form that machinery must not be repaired or modified before inspection in cases of serious injury involving machinery has evidentiary and safety-investigation significance.

Scheme participation criteria: employers seeking to join the public scheme must satisfy the Employment Liaison Officer across the four criteria in section 8(1). There is no right of admission; it is discretionary. The test is forward-looking, asking whether claims risk "would be likely to prejudice" the scheme.

Employees' rights include the substantive compensation entitlements prescribed by the Act and calibrated by the Rules' dollar figures (sections 5 and 6), and the procedural protection against excessive medical examinations (section 9, minimum fortnightly interval). The 14-day internal review period in section 11 gives employees a defined window within which to expect a decision on review applications, though the Rules do not specify the consequences of a failure to determine within that period.

The Rules prescribe no penalties of their own. Enforcement of the obligations they create, including the record-keeping requirements and the notification obligations, is governed by the Act. The Rules function purely as delegated legislation prescribing operational details; the Act carries the enforcement architecture.

The practical consequence of non-compliance with record-keeping under section 10 is unclear from the instrument itself. The significance of the Form 1 notification requirement is that failure to notify within 7 days leaves the employer exposed to whatever consequences the Act attaches to that obligation. Given the Act is the authoritative source on penalties, any analysis of enforcement consequences requires reading the Act alongside the Rules.

The $2,000 threshold prescribed in section 7 for the purposes of paragraph 37AA(b) of the Act appears to trigger or calibrate when the liability-to-pay provisions become operative. Again, the Act determines what consequences follow from crossing or not crossing that threshold.

The only procedural sanction visible in the Rules is the implied one for admission to the public scheme: an employer with a poor accident history, inadequate first-aid facilities, weak accident prevention awareness, or poor administration standards may be refused admission (section 8(1)), meaning they must self-insure or make alternative arrangements. That is a market-access consequence rather than a penalty in the traditional sense.

The instrument is made under the Employment Act 1988 (Norfolk Island) (section 3). Every operative provision of the Rules ties back to a specific subsection or paragraph of that Act. The Rules have no free-standing operation; they exist only to supply the numbers and forms that the Act requires to be prescribed.

The commencement of the Rules is linked to the Norfolk Island Continued Laws Amendment (Employment) Ordinance 2020, which is itself a Commonwealth ordinance made under the Norfolk Island Act 1979 (Cth). That ordinance amended or adapted the preserved Norfolk Island employment law to bring it into step with current Commonwealth policy settings for the territory.

The broader constitutional context is the Norfolk Island Act 1979 (Cth), which governs the island's legislative and administrative framework following the 2015 reforms that ended the island's internal self-government. The Employment Act 1988 (Norfolk Island) persists as a continuing law under that framework.

The instrument does not engage directly with Commonwealth workplace relations law, including the Fair Work Act 2009 (Cth) or the Safety, Rehabilitation and Compensation Act 1988 (Cth). Norfolk Island's employment law has historically operated separately from the mainland system, though the 2015 integration reforms have progressively brought island governance closer to Commonwealth norms. The Rules sit within the pre-integration island law framework as it has been adapted, not within the Commonwealth's national employment system.

No reference is made in the Rules to tax law, corporations law, migration law, or any other Commonwealth or state legislative scheme.

The source instrument records no amendment history. As at the date of making (25 November 2020), the Rules appear to be an original instrument rather than a consolidation of earlier amendments. The commencement table note states explicitly that it "will not be amended to deal with any later amendments of this instrument", which is standard drafting practice for commencement tables but confirms the instrument was newly made rather than re-made. No prior version of the Norfolk Island Employment Rules is referenced in the instrument, and the source provides no information about predecessor instruments or earlier prescription of the dollar amounts now fixed by sections 5, 6, and 7. Whether equivalent amounts were previously prescribed under an earlier instrument or under now-repealed Norfolk Island legislation is not determinable from this source.

The source instrument names no cases. No litigation is referenced, cited, or discussed anywhere in the Rules or the Schedule. Given the instrument's nature as a short delegated legislation instrument confined to numerical prescription and procedural forms, it is unsurprising that no judicial or tribunal history is embedded in it. Whether the Act itself or earlier iterations of these prescribed amounts have been the subject of litigation on Norfolk Island or in any reviewing court is not determinable from this source alone.

Several features of the Rules warrant close attention from practitioners and employers.

The retroactive record-keeping obligation in section 12 is easily overlooked. The section extends the section 10 requirements to training, injuries, and notifications that occurred within the three years before commencement. An employer who did not maintain structured first-aid training records or injury logs before the Rules commenced may already be in breach as of commencement. The practical difficulty is that records from the pre-commencement period may no longer exist, creating a compliance gap that cannot be remedied retrospectively. The Rules do not address this impossibility.

The Form 1 notification deadline of 7 days runs from when the death or permanent incapacity "became known to the employer", not from the date of the accident itself. This formulation means the clock starts when the employer has actual knowledge of the event, which in cases of gradually manifesting permanent incapacity may create uncertainty about exactly when the 7-day period began. The form's instruction to use block capitals and leave no blank spaces (substituting "N/A" where inapplicable) is mandatory in its own terms; a carelessly completed form may raise questions about compliance with the notification obligation.

The per-hour fee formula in section 8(2) ($0.30 per employee-hour per month) appears straightforward, but the phrase "other than any part of the month for which the employer is not a member of the scheme" requires pro-rating in the month of joining or leaving. Employers who change membership status mid-month must calculate partial-month hours accurately.

The medical examination frequency cap in section 9 sets a floor on the interval, not a ceiling on the total number of examinations. An employee can still be subjected to examinations indefinitely, as long as no two examinations are less than a fortnight apart. The protection is therefore weaker than it might appear: over a prolonged incapacity, a fortnightly examination regime could still be burdensome.

The $300,000 permanent incapacity cap in section 6 is a fixed nominal dollar amount with no indexation mechanism visible in the Rules. In real terms, the value of that cap will erode over time with inflation unless the Rules are periodically amended. Practitioners advising seriously injured claimants should note this as a hard ceiling.

The four admission criteria in section 8(1) for the public scheme are assessments of probability, not binary pass/fail tests. The Employment Liaison Officer's decision is structured as a prediction about whether the employer's claims risk "would be likely to prejudice" the scheme. That standard is inherently judgement-based and may produce inconsistent outcomes across applicants with similar risk profiles. There is no guidance in the Rules on how the four criteria are to be weighted relative to each other.

Employers operating on Norfolk Island should take the following steps to achieve compliance with the Rules.

Establish or audit injury and training records immediately. Section 10 requires records of all first-aid training (dates and particulars), all workplace injuries arising from employment (dates and particulars), and copies of any notifications provided to the Minister. These records must cover the three-year period before commencement under section 12, so historical records should be reconstructed or documented to the extent possible.

Maintain those records for the correct duration. For current employees, records must be kept throughout the employment. For former employees, records must be retained for three years after the employment ends (section 10(1)(b)).

Prepare Form 1 readiness. Employers should have the accident report form available and understand the 7-day notification obligation triggered when an employee death or permanent incapacity becomes known to them. The form requires detailed earnings information including non-cash benefits over the prior 12 months, so maintaining up-to-date earnings records is a precondition for being able to complete the form accurately under time pressure. Where machinery is involved in a serious injury, do not allow repairs or modifications before inspection.

For employers in or considering the public scheme, track employee hours monthly. The fee calculation under section 8(2) requires an accurate count of hours worked by each employee during each calendar month of membership. Payroll systems should generate this figure routinely.

Employers applying for admission to the public scheme should present documented evidence going to the four criteria: a clean accident history, adequate first-aid facilities, a demonstrable accident prevention programme, and well-maintained administrative systems. The Employment Liaison Officer's assessment is predictive and risk-focused, so proactive risk management documentation strengthens an application.

Where an employee is subject to ongoing medical examination under section 47A of the Act, note the minimum fortnightly interval. Scheduling an examination sooner than two weeks after the previous one would breach section 9. Employers and the Employment Liaison Officer should record examination dates to ensure the interval is respected.

For internal review applications, note the 14-day determination period under section 11. Applicants should confirm receipt of their application to start the clock running clearly, and follow up if no determination is issued within the prescribed period.
