Norfolk Island Customs Ordinance 2016

The Ordinance is short in structure but dense in effect because it imports, adapts and selectively excludes large tranches of Commonwealth customs law for Norfolk Island. The central legal concepts to understand, taken from the Ordinance itself, are as follows.

• Applied customs law: the Ordinance defines "applied customs law" to mean a Commonwealth law in its application to the Territory under the Ordinance (s 4). The operative mechanism is statutory adoption: the Customs Act 1901, associated regulations and specified instruments apply "as if they were laws of the Territory", subject to the modifications in the Schedules (s 7(1)-(2)).

• Territorial localisation: the applied laws are to be read as local laws, with explicit substitutions (s 7(2)). Notably, the Ordinance substitutes local institutional references for federal ones (see Schedule 1 items 1-3 and s 8). This reshapes jurisdictional and adjudicative nodes: Division 1B Judges and Magistrates become local court officers (Schedule 1 items 1-2).

• Scope limitation: the Ordinance explicitly excludes application "to the extent that [the laws] deal with duties of customs" (s 7(1)). That carve‑out remains on the face of the Ordinance; the rest of the Customs Act and regulations (as modified) are applied.

• Form vs statement dichotomy: the Schedules repeatedly convert prior references to "electronically" into a dual pathway "by document or electronically" (Schedule 1 items 8-52). They require documentary communications to be in approved forms and submitted to an officer "doing duty" at the relevant port/airport or in relation to outturn or movement reporting (see Schedule 1 items 8(3A), 11(3A), 13(4A), 20(5A), 26(2A), 38(2B)). Electronic communications are governed by "approved statements" and by IT requirements if the Comptroller‑General determines them (Schedule 1 items 8(3B), 13(4B), 24, 39, 52, 54).

• Authentication and attribution of electronic communications: the Ordinance modifies the IT determinative power (s 126DA) and substitutes an authentication rule (s 126DB as replaced) that presumes an electronic communication to be made by a named person in specified circumstances unless the person adduces contrary evidence (Schedule 1 items 54-56). The requirements for electronic communications include containing the person’s signature and meeting any IT requirements that the Comptroller‑General may determine (Schedule 1 items 24, 39, 52).

• Reporting nodes and actors: the Ordinance names specific relevant persons who may make reports or be recipients of reports, for example stevedores, depot operators, other persons whose particulars have been communicated by an aircraft operator, persons in charge of Customs places (Schedule 1 item 22). Many reporting obligations are to be communicated to an officer doing duty in relation to reporting at a port or airport or related to import entries or movement (Schedule 1 items 8(3C), 11(3C), 13(4A), 38(2BA)).

• Delegation architecture: the Comptroller‑General may delegate functions (excluding section 179) to the Secretary or other officers of Customs (s 9(1)). Delegation to officers is subject to written directions from the Comptroller‑General, and subdelegation by the Secretary is permitted with the requirement that directions given by the Secretary not be inconsistent with the Comptroller‑General's directions (s 9(2)-(6)). A function performed under subdelegation is taken to have been performed by the Comptroller‑General for the purposes of the law (s 9(6)).

• Repeal and removal of certain regulatory material: the Schedules repeal specified sections and whole Parts in the applied laws (Schedule 1 items 57-59; Schedule 2 item 2; Schedule 3 item 1). The practical consequence is that certain federal procedural regimes are not part of the Territory regime as established by this Ordinance.

These are the structural concepts the rest of the applied customs texts will operate within once the Ordinance is read together with those laws, as required by s 7(2). Practitioners should read the modified provisions in Schedule 1 alongside the full Customs Act and the other applied instruments to see imported substantive duties, offences and penalties; the Ordinance is largely a localisation and procedural reshaping instrument rather than a freestanding code of obligations.

The Ordinance changes who must comply with customs law within Norfolk Island by importing Commonwealth customs statutes and adapting them to the Territory, and by defining who may act under delegated powers. The affected parties, as enumerated or clearly implicated by the Ordinance, are:

• Norfolk Island people and businesses that deal with import, export, movement and reporting of goods: by importing the Commonwealth Customs Act and regulations as Territory law (s 7(1)), the Ordinance places Norfolk Island traders, freight forwarders, exporters and importers within the applied customs regulatory framework unless a provision specifically excluded (e.g. "to the extent they deal with duties of customs") applies.

• Stevedores, depot operators and persons in charge of Customs places: the Ordinance expressly names "relevant persons" who may be subject to reporting and disclosure obligations (Schedule 1 item 22). That list includes stevedores and depot operators, and it extends to "other person" whose particulars are communicated to the Department by an aircraft operator under s 64AAC (Schedule 1 items 10, 17, 22).

• Operators of aircraft and ships: multiple modifications require that documentary reports be communicated "to the Department by sending or giving it to an officer doing duty in relation to the reporting of ships or aircraft at the port or airport of arrival" (Schedule 1 items 8(3A), 11(3A)). The operator of an aircraft also has a role in communicating particulars of depot operators or other persons to the Department, which expands exposure to carriage‑side reporting obligations (Schedule 1 items 10, 22, 23).

• Officers of Customs and the Comptroller‑General: the Ordinance recognises and empowers officers to receive documentary reports, to exercise delegated powers and to give and receive directions (s 9(1)-(6); Schedule 1 items 8(3C), 11(3C), 13(4A)). The Comptroller‑General retains central control via delegation powers and the ability to determine IT requirements (s 9; Schedule 1 items 24, 39, 52, 54).

• The Secretary of the Department administered by the Customs Minister: the Secretary may receive delegations from the Comptroller‑General and may subdelegate to officers of Customs, subject to directions and constraints (s 9(1)(a), 9(3)-(6)). The Ordinance also defines "Secretary" in s 4.

• The Customs Minister and the administering Department: references to "Minister" and "Department" in the applied laws are reinterpreted as the Customs Minister and the Department administered by that Minister respectively, in their Norfolk Island application (s 8).

• Persons making self‑assessed clearances, movement applications, cargo reports and other customs communications: the Schedules explicitly modify many sections (for example, ss 64AAB, 64AAC, 64AB, 64ABAA, 71AAAF, 71M, 119E) to establish documentary and electronic pathways and particular submission and signature requirements (Schedule 1 items 8-13, 20, 24-26, 38-39, 52). These obligations fall on parties who normally make such communications: importers, carriers, depot operators and their agents.

• Legal authorities in Norfolk Island courts: the Ordinance redefines the judicial actors applicable under the applied Customs Act provisions (Schedule 1 items 1-2). This affects how disputes and certain offences are heard , for example, references to Division 1B Judges and Magistrates are tied to Norfolk Island courts rather than Commonwealth courts.

Who does not gain direct new exposure from the text: the Ordinance expressly excludes parts of the Customs law that "deal with duties of customs" from application in the Territory (s 7(1)). Therefore, matters strictly concerning liability for duties may remain outside the Ordinance’s application depending on the content of the applied laws. The source text does not specify other territories or external ports; its focus is on Norfolk Island.

In summary, the Ordinance affects the full range of supply‑chain actors operating on Norfolk Island that interact with customs processes , carriers, depot operators, importers, exporters, stevedores , together with the local legal and administrative apparatus that will receive reports and exercise customs powers. It centralises control of procedural formality and electronic authentication with the Comptroller‑General, the Secretary and officers of Customs (s 9; Schedule 1 items concerning IT requirements).

The Ordinance itself is largely an instrument of application and adaptation; it does not restate the substantive customs duties and rights in full. However, it imposes concrete procedural duties and specifies certain rights and institutional allocations by modifying the Customs Act and regulations for Norfolk Island. The duties and rights that arise directly from this Ordinance and its Schedules are:

• Duty to use approved forms for documentary submissions: where the applied customs law permits communications "by document or electronically", the Ordinance repeatedly requires documentary reports and declarations to be in an "approved form" and to contain information required by that form and to be signed as specified by the form (see Schedule 1 items 8(3A)(a)-(e), 11(3A)(a)-(e), 13(4A)(a)-(e), 20(5A)(a)-(e), and similar provisions). The duty is specific: a documentary report "must be in writing" and "be in an approved form" and "be communicated to the Department by sending or giving it to an officer doing duty" (see Schedule 1 item 8(3A)(a)-(c)).

• Duty to communicate documentary reports to an officer doing duty: the Ordinance repeatedly prescribes the route of documentary submissions, requiring they be given to an officer doing duty in relation to reporting at the relevant port or airport or in relation to outturn reports (Schedule 1 items 8(3A)(c), 11(3A)(c), 13(4A)(c), 20(5A)(c), 26(2A), 38(2BA)).

• Duty of signature on both documentary and electronic communications: documentary submissions must be "signed in a manner specified in the form" and electronic communications must "contain the signature of the person who makes it" (Schedule 1 items 8(3A)(e); 24; 39; 52). The Ordinance also ties the validity of electronic signatures to any IT requirements determined under section 126DA (Schedule 1 items 24, 39, 52, 54-56).

• Duty to meet IT requirements if they are determined: the Comptroller‑General may determine IT requirements; where those requirements are determined, communications made electronically must meet them (Schedule 1 items 24, 39, 52, 54-56). Importantly, the Ordinance modifies the mandatory nature of that determination: section 126DA is amended from a "must determine" to a "may determine" power, changing a duty on the Comptroller‑General into a discretion (Schedule 1 item 54).

• Duty related to authentication and notification of security breaches: the modified authentication rule in section 126DB provides that, subject to meeting IT requirements where determined, an electronic communication is taken to be made by a person unless that person had notified the Department of a breach of security before the communication (Schedule 1 items 54-56). That creates an implied preventive duty on users to notify breaches to avoid automatic attribution, where the provisions apply.

• Duty to follow reporting hierarchies and disclosure to relevant persons: the Comptroller‑General may approve different forms/statements for different classes of persons (Schedule 1 item 21(6)), and officers may disclose cargo reports to relevant persons (Schedule 1 item 21(7)). A "relevant person" is defined and includes stevedores, depot operators and persons in charge of Customs places (Schedule 1 item 22).

• Right to delegates and subdelegates to act under authority: the Comptroller‑General has the right to delegate functions and powers (s 9(1)), and the Secretary may subdelegate any functions delegated to the Secretary (s 9(3)). A function exercised under subdelegation is taken to have been exercised by the Comptroller‑General (s 9(6)), which keeps administrative acts within the Comptroller‑General’s legal umbrella.

• Duty of compliance with directions by delegates: officers acting under delegation must comply with written directions of the Comptroller‑General (s 9(2)); officers acting under a Secretary's subdelegation must comply with written directions of the Secretary, but the Secretary must not give directions that are inconsistent with the Comptroller‑General's directions (s 9(4)-(5)). This establishes a chain of command and a duty to follow internal directional instruments.

• Right to local adjudicative routes: the modification of judicial definitions to local courts (Schedule 1 items 1-2) reassigns which judicial officers hear matters under the applied Customs Act provisions in Norfolk Island.

• Duty not to expect Chapter 2 of the Norfolk Island Criminal Code to apply to applied customs offences: section 6 expressly disapplies Chapter 2 of the Criminal Code 2007 (Norfolk Island) to offences against an applied customs law. That affects how criminal liability and sentencing might be processed, although the Ordinance does not restate penalties , those will be in the applied Commonwealth instruments as modified.

In sum, the Ordinance creates specific procedural duties about how communications must be made and authenticated, where documentary submissions must be delivered, who may be held responsible, how electronic attribution operates, and how administrative powers may be delegated and directed. The Ordinance does not itself create a new catalogue of substantive customs offences and duties beyond these procedural and institutional changes; those remain in the applied Commonwealth laws, which must be read with the Schedule modifications.

The Ordinance sets up the institutional and procedural environment for enforcement rather than specifying a novel penalty regime. The enforcement architecture and penalty consequences must be inferred from the fact that Commonwealth customs laws apply in the Territory as modified. From the Ordinance’s text, the following enforcement‑relevant points appear.

• Offences under applied customs law are not governed by Chapter 2 of the Norfolk Island Criminal Code: section 6 states that Chapter 2 of the Criminal Code 2007 (Norfolk Island) does not apply to offences against an applied customs law. Practically, this means the local Criminal Code’s general provisions for offences (found in Chapter 2) are displaced for customs matters; the applied Commonwealth provisions, as modified, will determine whether an act is an offence and the applicable criminal processes (s 6).

• Penalties present in the applied laws apply unless excluded: the Ordinance brings the Customs Act 1901 and selected regulations into force in the Territory "as if they were laws of the Territory" (s 7(1)). Therefore, penalties and enforcement mechanisms contained in those Commonwealth laws (for example civil penalties, criminal penalties, seizure and forfeiture, detention powers) will generally apply in the Territory, subject to the local modifications in the Schedules and the express exclusion of provisions that "deal with duties of customs" (s 7(1)). The Ordinance itself does not recast or remove substantive penalty provisions except where the Schedule expressly repeals or modifies particular sections (see Schedule 1 items 57-59).

• Administrative enforcement via officers of Customs: the Ordinance centres officers of Customs as the receiving, enforcing and directing authority. It requires documentary reports to be handed to an officer doing duty and grants the Comptroller‑General delegation powers to delegate functions and powers to officers, subject to written directions (s 9(1)-(2); Schedule 1 items 8(3A)(c), 11(3A)(c), 13(4A)(c)). Enforcement action that relies on receiving reports, examining goods, executing searches or detaining goods will therefore be operationalised through these officers, under the applied laws.

• Attribution and evidentiary consequences for electronic communications: the replacement section 126DB (Schedule 1 items 54-56) creates a presumption that an electronic communication is taken to be made by the person identified unless they gave prior notice of a security breach or, where IT requirements have been determined, the communication meets those requirements and no prior breach notification was given. That has evidentiary and enforcement effects: where an electronic report triggers a compliance inquiry or a penalty, the modified 126DB governs attribution of the communication to a person in absence of contrary evidence.

• Officer disclosure powers: officers may disclose cargo reports to relevant persons for the purpose of enabling them to communicate outturn reports (Schedule 1 item 21(7)). Disclosure authority may be relevant when enforcing reporting obligations and checking compliance across parties such as stevedores and depot operators.

• Removal or repeal of federal procedural parts that may have contained enforcement detail: the Schedules repeal Divisions 3-5 of Part XI of the Customs Act and other parts and sections (Schedule 1 items 57-59; Schedule 2 item 2; Schedule 3 item 1). Where those parts contained enforcement or procedural protections or steps, their repeal will alter the enforcement landscape in the Territory. The Ordinance does not restate what is removed; practitioners must cross‑check the repealed provisions in the source Commonwealth text to see what enforcement pathway is changed.

• Delegation and internal control over enforcement: the Comptroller‑General’s delegation power (s 9) together with the requirement that officers comply with written directions (s 9(2), 9(4)) centralises enforcement discretion within the Customs administrative hierarchy. Delegated officers act under Comptroller‑General or Secretary directions; functions exercised under subdelegation are treated as done by the Comptroller‑General (s 9(6)), which preserves legal continuity for enforcement acts.

The Ordinance therefore leaves the body of offences and penalties to the applied Commonwealth customs law, but it configures who executes enforcement, how documentary and electronic communications are authenticated for enforcement and evidence, and which parts of federal procedure no longer apply because they were repealed. To determine specific monetary penalties, time bars, or sentencing consequences, consult the applied Customs Act and regulations as modified by the Schedules.

This Ordinance deliberately positions Commonwealth customs law within the Norfolk Island legal environment and creates specific cross‑references to other laws. The direct interplays in the text are:

• Authority base under the Norfolk Island Act 1979: the Ordinance is made under section 19A of the Norfolk Island Act 1979 (s 3). That locates the instrument’s source of power in the Commonwealth’s Norfolk Island governance statute.

• Interpretation Act relationship: section 5 states that the Interpretation Act 1979 (Norfolk Island) does not apply to this Ordinance. The explanatory note clarifies that the Acts Interpretation Act 1901 applies instead because the Ordinance is a legislative instrument for the purposes of the Legislation Act 2003 (see note to s 5). The net effect is that federal interpretive rules govern the Ordinance rather than the local Norfolk Island Interpretation Act.

• Displacement of local Criminal Code provisions: section 6 expressly disapplies Chapter 2 of the Criminal Code 2007 (Norfolk Island) for offences against an applied customs law. This means that, for customs offences, standard local Criminal Code provisions (for example definitions and general provisions in Chapter 2) do not apply; the applied Commonwealth provisions will provide the criminal law framework for those offences (s 6).

• Conduit to Commonwealth departmental structures: section 8 makes clear that within the applied customs laws a reference to the "Minister" means the Customs Minister, a reference to the "Department" means the Department administered by the Customs Minister, and "Australia" or "the Commonwealth" where used geographically is to be read as the Territory (s 8). This aligns the applied customs laws with the Commonwealth ministerial and departmental structure rather than local Norfolk Island ministerial structures.

• Interaction with Commonwealth customs instruments: the Ordinance imports the Customs Act 1901 and specified regulations and instruments, but it also contains a saving rule in s 7(4): if there is a locally in‑force instrument under subsection 4A(1) or (1A) of the Customs Act 1901 (NI) approving a form or statement for a matter and there is an instrument of the kind referred to in s 7(1)(e) in relation to that matter, then the latter instrument does not apply in the Territory (s 7(4)). That provides a priority for local instruments where present.

• Repeal of federal Parts and sections: the Schedules repeal Divisions 3-5 of Part XI of the Customs Act, section 270 and other sections/parts in the regulations (Schedule 1 items 57-59; Schedule 2 item 2; Schedule 3 item 1). These repeals alter which federal procedural or international obligations apply by removing certain federal material from the Territory’s customs regime. Practitioners must check the content of those repealed Parts in the Commonwealth texts to understand which interactions are lost.

• Cross‑reference to Customs Tariff Act 1995 for classification: section 7(3) states that goods have the same tariff classification as they would have if classified under a tariff classification under the Customs Tariff Act 1995, for the purposes of the applied customs laws. This imports the Commonwealth tariff classification framework into the Territory’s customs application for classification purposes.

• Delegation and administrative law overlay: the Comptroller‑General’s delegation power (s 9), and the Secretary’s ability to subdelegate (s 9(3)), operate within the applied customs law framework and the broader Commonwealth administrative law context implied by use of federal departmental terms (s 8). The Ordinance also preserves the Comptroller‑General’s centrality by treating acts done by delegates under subdelegation as acts of the Comptroller‑General (s 9(6)).

• Relationship to reporting and operational ports/airports: the documentary submission rules repeatedly require submissions to be given to an officer "doing duty in relation to the reporting of ships or aircraft at the port or airport of arrival" or "doing duty in relation to import entries or to the movement of goods subject to customs control" (Schedule 1 items 8(3A)(c), 11(3A)(c), 13(4A)(c), 38(2BA)). This ties the applied customs law to physical port/airport operations and officer presence, rather than to mail or other indirect submissions alone.

Overall, the Ordinance integrates Commonwealth customs law into Norfolk Island’s legal structure but overrides specified local laws (interpretation and parts of the local Criminal Code), channelises ministerial and departmental references to Commonwealth actors, and provides for local superseding instruments where made. It imports tariff classification rules from the Customs Tariff Act 1995 and removes certain federal Parts, thereby altering how the customs system interfaces with other statutes and procedures in the Territory.

The instrument’s own text provides a limited amendment history because it is an originating Ordinance with an explicit commencement note. The facts that appear in the source text are:

• Title, number and date: Norfolk Island Customs Ordinance 2016, Ordinance No. 8, 2016. The Ordinance is signed and dated 5 May 2016 by the Governor‑General on the advice of the Federal Executive Council (front matter).

• Authority for making: the Ordinance is made under section 19A of the Norfolk Island Act 1979 (s 3). The front matter records the Ministerial command as by Paul Fletcher, Minister for Territories, Local Government and Major Projects.

• Commencement: section 2(1) sets the commencement for the whole of the Ordinance to be 1 July 2016. The commencement table explicitly states that "The whole of this Ordinance" commenced 1 July 2016 and that the table relates only to the provisions "as originally made" (s 2(1) and the note following the table).

• No later amendments recorded in the text: the source text contains a note under the commencement table that the table relates only to provisions "as originally made" and "will not be amended to deal with any later amendments of this Ordinance." The Ordinance as provided does not include any subsequent amendment entries or dates beyond the original making and commencement.

• The Schedules are the vehicles for local modification at the time of enactment: Schedules 1-3 contain numerous specific repeal and substitution entries to modify the Customs Act 1901, the Customs Regulation 2015 and the Customs (International Obligations) Regulation 2015 for Norfolk Island application. These changes reflect the content of the Ordinance as made on 5 May 2016 and coming into force 1 July 2016.

Because the source material provided is the Ordinance as made, there is no textual record within the document of later amendments, repeals, or consolidations. The document’s own note signals that later federal or local changes will not be recorded in the commencement table. For a complete amendment history beyond the making text in this document, practitioners must consult consolidated legislative databases or subsequent instruments outside the text provided here.

The Ordinance text provided contains no litigation history, case citations, or references to judicial consideration. The instrument does not name any judicial decisions or describe disputes arising under it. The only judicial references are definitional: the Customs Act 1901 (NI) as modified refers to Division 1B Judges and Magistrates recharacterised for Norfolk Island (Schedule 1 items 1-2), but these are institutional substitutions and not litigation references.

Given the absence of cases or litigation commentary in the text, the following are the only source‑grounded statements that can be made on litigation history from the Ordinance:

• The Ordinance does not record any court challenges, judicial interpretations, or case law relating to its provisions.

• Parties seeking judicial clarification of the Ordinance’s application would need to bring matters to the Norfolk Island courts designated by the modified definitions in Schedule 1 (for example, a Division 1B Judge is redefined as a Judge of the Supreme Court of Norfolk Island) (Schedule 1 items 1-2). That indicates where litigation under the applied Customs Act provisions will be heard in the Territory.

Any actual litigation history (cases, appeals, judicial reviews) post‑enactment is not contained in the source text and therefore is not described here. Users requiring any court decisions that interpret or apply the Ordinance must consult judicial databases or court records outside the source text provided.

The Ordinance is primarily an application and modification instrument. Several specific features of its drafting and the interplays it creates produce practical risks and compliance traps; these are set out below and are stated with direct reference to the source text.

• Documentary submissions must be given to an officer doing duty at the port/airport or relevant reporting point: many provisions require that documentary reports "be communicated to the Department by sending or giving it to an officer doing duty in relation to the reporting of ships or aircraft at the port or airport of arrival" (Schedule 1 items 8(3A)(c), 11(3A)(c), 13(4A)(c), 20(5A)(c)). Practitioners and firms that assume delivery by post, email or courier without explicit acceptance by an officer risk non‑compliance if the applied customs text requires physical handover to an officer doing duty. The Ordinance’s language is precise about the recipient and the point of delivery.

• The dual pathway (documentary or electronic) is not symmetrical: a documentary submission must be in an approved form and delivered to an officer doing duty and signed in the manner specified; an electronic submission must comply with approved statements and any IT requirements determined under section 126DA (Schedule 1 items 8(3A)-(3B), 24, 39, 52). However, section 126DA’s amendment changes the Comptroller‑General's obligation from "must determine" to "may determine" IT requirements (Schedule 1 item 54). That means an electronic channel may lack specified IT standards until the Comptroller‑General exercises discretion to determine them, which can create uncertainty about what electronic submissions must meet at any given time.

• Automatic attribution of electronic communications unless a security breach is notified: the modified s 126DB provides that, subject to meeting IT requirements where determined, an electronic communication is taken to be made by a particular person unless that person notified the Department of a breach of security before the communication (Schedule 1 item 55). Without proactive notification systems and monitoring, persons could find themselves legally attributed to electronic statements they did not authorise, unless they can "provide evidence to the contrary", which the provision references. The burden of proving contrary evidence is left to the person.

• Significant procedural repeal without detail in the Ordinance: the Schedules repeal whole Divisions and Parts from the Customs Act and regulations (eg Divisions 3-5 of Part XI and Part 13 of the Customs Regulation 2015) (Schedule 1 items 57-58; Schedule 2 item 2). The Ordinance does not reproduce the repealed material, so whether those repeals remove procedural protections, appeal rights or specific enforcement steps is not apparent from the Ordinance alone. Practitioners must compare the original Commonwealth text to the modified Norfolk Island text to identify what procedural pathways were removed and how that changes compliance risk.

• Local redefinition of judicial actors changes forum and possibly procedural rules: re‑defining Division 1B Judges and Magistrates as local Supreme Court Judges and Petty Sessions Magistrates (Schedule 1 items 1-2) transposes federal judicial references into local courts. That affects where proceedings are brought and which judicial procedures apply. Where federal practice diverges from local practice, unintended procedural frictions could occur.

• Delegation lines may concentrate discretion: the Comptroller‑General may delegate to the Secretary or another officer, but officers exercising functions under delegation must comply with written directions of the Comptroller‑General (s 9(2)), and the Secretary may subdelegate with the requirement that the Secretary not give directions inconsistent with Comptroller‑General directions (s 9(3)-(5)). In practice this concentrates operational control with the Comptroller‑General and the Secretary, which can create single points of administrative direction affecting many local actors; the Ordinance provides no statutory timetable or consultation requirement for directions.

• "Except to the extent that they deal with duties of customs" carve‑out: section 7(1) excludes provisions that "deal with duties of customs" from the laws applied in the Territory. That phrase is not further explained in the Ordinance and may produce uncertainty about which taxation/duty provisions apply. Cross‑reference to the imported Customs Act and the Customs Tariff Act 1995 (for classification, s 7(3)) is necessary to determine the boundary, but the Ordinance itself leaves room for interpretation.

• Definitions may create ambiguity between Commonwealth and local terms: the Ordinance defines "officer of Customs" by reference to the Commonwealth definition (s 4, Schedule 1 item 3: "an officer of Customs within the meaning of the Customs Act 1901 (Commonwealth)"). This means a person may be an "officer of Customs" under Commonwealth law even where local appointment or functions differ. That reliance on external definitional content requires careful reading of the Commonwealth definition in the context of local practice.

• Administrative burden on small local operators: the requirement for approved forms and the handover to officers doing duty may impose practical compliance costs on small Norfolk Island operators who must physically interface with an officer at ports/airports or otherwise obtain approved forms. The Ordinance does not contain tailored exemptions or scaled obligations for small operators in its text.

These "gotchas" stem directly from the text of the Ordinance and the Schedules: the specific handover routes, the documentary/form versus electronic/statement regime, the optional nature of IT requirement determination, the attribution rule for electronic communications, the repeals and the delegation architecture. Practitioners should not assume symmetric operational parity between Norfolk Island customs processes and Commonwealth mainland processes without reading the modified provisions in the applied laws.

Compliance under this Ordinance requires both (a) understanding which substantive customs provisions from the Customs Act and the relevant regulations apply in the Territory after the Schedules’ modifications and (b) meeting the procedural and documentary requirements that the Ordinance itself prescribes. The following checklist and steps, tied to the specific source provisions, are the concrete compliance actions the source text sets out.

1. Identify whether the substantive provision you are concerned with is part of the "applied customs law."

   • Consult section 7(1) to confirm that the Customs Act 1901, the Customs Regulation 2015, the Customs (International Obligations) Regulation 2015 and specified instruments apply in the Territory "as if they were laws of the Territory," subject to the Schedules. Note the exclusion for provisions that "deal with duties of customs" (s 7(1)).

2. Read the applied law together with the Schedule modifications.

   • The Schedules (1-3) modify definitions, reporting requirements and sections; for example Schedule 1 contains numerous substitutions regarding documentary and electronic communications and modifies sections such as 64AAB, 64AAC, 64AB, 64ABAA and 71AAAF (Schedule 1 items 8-13, 20, 26). For each substantive obligation (eg cargo reports, self‑assessed clearance declarations), read the base Commonwealth provision and the corresponding Schedule item to determine the Norfolk Island version.

3. Use approved forms for documentary submissions and approved statements for electronic submissions.

   • The Ordinance requires documentary communications to be in an "approved form" and electronic communications to follow an "approved statement" where applicable (Schedule 1 items 8(3A)(b), 8(3B); see parallel items for other kinds of reports). Ensure you obtain and use the current approved form or statement relevant to the class of report.

4. Deliver documentary reports to the correct officer at the correct place.

   • Documentary reports must "be communicated to the Department by sending or giving it to an officer doing duty in relation to the reporting of ships or aircraft at the port or airport of arrival" or similar specified duty contexts (Schedule 1 items 8(3A)(c), 11(3A)(c), 13(4A)(c), 20(5A)(c), 26(2A), 38(2BA)). Confirm who is "doing duty" at the relevant port or airport and obtain a receipt or written acknowledgement where possible.

5. Ensure documentary signatures meet the form’s specifications.

   • Documentary reports "must be signed in a manner specified in the form" (Schedule 1 items 8(3A)(e), 11(3A)(e), 13(4A)(e), 20(5A)(e)). If the form specifies a particular signing protocol, comply with that protocol. Keep original signed copies as evidence.

6. For electronic communications, check IT requirement determinations and signatures.

   • The Ordinance requires that electronic communications "contain the signature of the person who makes it" and, if IT requirements have been determined under section 126DA, that the communications meet those requirements (Schedule 1 items 24, 39, 52). As section 126DA is modified to be discretionary (Schedule 1 item 54), check whether the Comptroller‑General has in fact determined IT requirements before relying solely on electronic submission. If requirements exist, implement and audit systems to meet them.

7. Monitor and promptly notify breaches of security affecting electronic communications.

   • Under the modified s 126DB (Schedule 1 items 54-56), an electronic communication may be attributed to you unless you had notified the Department of a breach of security before the communication. Maintain procedures for immediate detection and notification of security breaches to preserve the ability to rebut attribution where necessary.

8. Identify who the "relevant person" is for your cargo or outturn reporting chain and coordinate disclosures.

   • The Ordinance defines "relevant person" to include stevedores, depot operators and persons in charge of Customs places, and permits officer disclosures of cargo reports to those relevant persons to enable outturn reports (Schedule 1 items 21(7), 22). Coordinate reporting lines and ensure information is available to the Department and to those relevant persons as required.

9. Track delegation lines and comply with written directions from delegates.

   • The Comptroller‑General may delegate functions and powers to the Secretary or other officers (s 9(1)). Officers exercising delegated functions must follow written directions from the Comptroller‑General (s 9(2)), and officers under Secretary subdelegation must comply with Secretary directions that are not inconsistent with Comptroller‑General directions (s 9(3)-(5)). When dealing with officers, request and retain copies of any written directions that affect the officer’s decision or action where relevant.

10. Confirm classification and tariff treatment.

• For classification purposes, the Ordinance adopts tariff classification under the Customs Tariff Act 1995: goods have the same classification as if classified under that Act (s 7(3)). Make classification determinations consistent with that Act and retain documentary evidence supporting the classification.

11. Review repeals and omitted procedures.

• Because the Schedules repeal specific federal Parts and sections (Schedule 1 items 57-59; Schedule 2 item 2; Schedule 3 item 1), check whether those repeals remove procedures or remedies you previously relied upon (for example appeal pathways or specific procedural safeguards). Where repeals remove a federal process, identify the replacement or absence of that process in the modified regime.

12. Maintain records and evidence of compliance.

• Keep copies of approved forms, approvals for any electronic statement systems, confirmations of delivery to an officer doing duty, evidence of signature compliance, and records of any notifications of security breaches. These records support rebuttal of attribution under s 126DB (as modified) and evidence compliance with documentary requirements.

13. Coordinate with carriers, depot operators and stevedores.

• Because the Ordinance places specific obligations on these actors (Schedule 1 item 22) and allows disclosure between officers and relevant persons (Schedule 1 item 21(7)), ensure contracts and operational arrangements assign responsibilities for producing and handing over documentary reports and for electronic submissions.

14. Seek local legal confirmation where ambiguity exists.

• The Ordinance modifies definitions and deletes certain federal sections; when there is doubt about whether a provision "deals with duties of customs" and thus falls outside the applied law, or when the repeal of a federal process suggests lost procedural protection, obtain authoritative legal advice or seek a ruling from the Comptroller‑General or local courts (bearing in mind the local judicial actors now specified in Schedule 1 items 1-2).

By following this procedure list and tying each action to the relevant provision(s) identified above (for example s 7 for scope; Schedule 1 items 8, 11, 13, 20 for documentary submission conditions; Schedule 1 items 24, 39, 52, 54-56 for electronic authentication), a person or business operating on Norfolk Island will align with the procedural duties the Ordinance imposes and put themselves in a position to demonstrate compliance under the applied customs regime.
