Norfolk Island Administrator Ordinance 2016

The Ordinance rests on a small set of core legal concepts that structure the Administrator’s office and its relationship with the Commonwealth Minister and the Governor‑General.

Office by statute: The Administrator is a statutory office created by the Ordinance, “there is to be an Administrator of the Territory” (s 6). That office receives its practical authorities through powers conferred by or under laws in force in the Territory; the Ordinance does not itself list the substantive powers but requires the Administrator to exercise powers conferred by territorial law (s 8(1)).

Appointment and tenure: Appointment is by the Governor‑General by written instrument (s 7(1)). The Administrator holds office on a full‑time basis (s 7(2)) and “during the Governor‑General’s pleasure” (s 7(3)). The text includes a note on reappointment pointing to section 33AA of the Acts Interpretation Act 1901 applying because of section 8A of the Interpretation Act 1979 (Norfolk Island), indicating that certain interpretative and appointment rules in the Acts Interpretation Act 1901 are relevant through the local Interpretation Act (note to s 7).

Ministerial directions and control: The Ordinance makes the Administrator subject to written directions from the responsible Commonwealth Minister in the exercise of powers and performance of functions conferred “by or under a law in force in the Territory” (s 8(1)). Directions can be general or specific (s 8(2)). The Minister may further require, by written notice to the Administrator, that for specified powers or functions the Administrator must notify the Minister of any intention to exercise the power and must do so a specified number of days beforehand (s 8(3)). Those provisions create a statutory supervisory mechanism through written directions and written notices.

Restrictions on outside employment: The Administrator is prohibited from engaging in paid employment outside the duties of office unless the responsible Commonwealth Minister approves such employment (s 9). That provision sets a formal approval gate for any remunerated external activities.

Administrative terms and conditions: Where an Act or the Ordinance does not cover particular matters, the responsible Commonwealth Minister determines the Administrator’s “terms and conditions” in relation to those matters (s 11). This delegates control over residual employment conditions to the Minister.

Acting arrangements: The responsible Commonwealth Minister may appoint an acting Administrator during vacancies or during periods of absence or inability of the Administrator, by written instrument (s 12(1)). The Ordinance preserves the effect of actions taken by an acting appointee and the incumbent’s own powers, providing that the acting exercise of functions during absence does not affect the Administrator’s separate exercise of powers (s 12(2)). The notes reference sections of the Acts Interpretation Act 1901 that have rules for acting appointments, as applied through the Interpretation Act 1979 (note to s 12).

Interpretive framework: The Acts Interpretation Act 1901 is expressly declared not to apply to this Ordinance (s 5). The accompanying explanatory note states that the Interpretation Act 1979 (Norfolk Island) applies instead and that it is through section 8A of that Act that certain provisions of the Acts Interpretation Act 1901 apply. The Ordinance therefore sits within a local interpretative regime rather than directly within the federal Acts Interpretation Act, with cross‑references available by the Norfolk Island Interpretation Act.

Administrative procedure and formality: The Ordinance prescribes key actions as requiring written instruments or written notices: appointment by written instrument (s 7(1)), directions and notices by the responsible Commonwealth Minister in writing (s 8(1), s 8(3)), resignation by written notice to the Governor‑General (s 10(1)), and acting appointments by written instrument (s 12(1)). The use of writing formalises the supervisory relationship and creates documentary records for appointment, directions, approvals and resignations.

Collectively, these concepts configure an office that is full‑time, ministerially supervised, removable at pleasure, and embedded in a statutory interpretive regime specific to Norfolk Island. The Ordinance sets procedural gates rather than detailing substantive powers, by tying the Administrator’s exercise of powers to existing Territory laws and to written ministerial directions.

Primary officeholder: The Administrator, defined and appointed under the Ordinance, is the principal subject. The Administrator’s employment status, duties, and constraints are set out in the Ordinance: appointment by the Governor‑General (s 7(1)), full‑time service requirement (s 7(2)), tenure during pleasure (s 7(3)), resignation mechanics (s 10), prohibition on outside paid employment without approval (s 9), and the obligation to act in accordance with ministerial directions when performing powers conferred by Territory law (s 8(1)-(3)).

Responsible Commonwealth Minister: The Ordinance repeatedly places decisionmaking power and control with the responsible Commonwealth Minister. The Minister gives written directions that bind the Administrator in exercising powers and functions under Territory laws (s 8(1)-(2)), may serve written notices requiring prior notification and advance notice before particular exercises of power (s 8(3)), must approve any outside paid employment by the Administrator (s 9), determines residual terms and conditions not covered by an Act or the Ordinance (s 11), and appoints acting Administrators (s 12(1)). The Minister thus has multiple levers over the Administrator’s conduct and contractual terms.

Governor‑General: The Governor‑General is the formal appointing and receiving authority. Appointment is made by written instrument issued by the Governor‑General (s 7(1)), and resignations are given to the Governor‑General, taking effect when received unless a later date is specified (s 10(1)-(2)). The Administrator holds office during the Governor‑General’s pleasure (s 7(3)), so the Governor‑General is the formal source of tenure.

Territory laws, officials and third parties exercising or affected by the Administrator’s powers: The Administrator must exercise powers and perform functions conferred “by or under a law in force in the Territory” (s 8(1)). Therefore, any person or entity whose rights, obligations or administrative interactions depend on those territorial laws will be affected indirectly by the relationship between the Administrator and the Minister. The Ordinance does not enumerate those Territory laws; it prescribes how powers under those laws are to be exercised with ministerial oversight.

Potential external employers and commercial counterparties: The prohibition on paid outside employment without Ministerial approval (s 9) affects persons or entities who might otherwise contract with or employ the Administrator outside the office. Any arrangement to engage the Administrator for paid work will require ministerial consent.

Acting appointees and staff: Persons appointed to act as Administrator under s 12 are affected; the Minister may appoint them during vacancies or absences, and the Ordinance clarifies that the acting exercise of powers does not negate exercises by the substantive Administrator (s 12(2)). Staff and contractors supporting the Administrator will be affected indirectly by ministerial directions and by the terms and conditions which may be set by the Minister for matters not provided in an Act or the Ordinance (s 11).

Interpreters and administrators of law: The Ordinance interacts with the Interpretation Act 1979 (Norfolk Island) and by note disapplies the Acts Interpretation Act 1901 directly (s 5 and accompanying note). Persons concerned with statutory interpretation, drafting, or litigation will need to work within the Norfolk Island interpretive framework referenced by the Ordinance.

Legal advisers and compliance officers: Those tasked with ensuring that the Administrator complies with the Ordinance must monitor written directions, notices, approvals and acting appointments, because the Ordinance requires formal written instruments for appointment, directions, notice requirements and resignation (s 7(1), s 8(1), s 8(3), s 10(1), s 12(1)). They must also track residual terms and conditions set by the responsible Commonwealth Minister under s 11.

Citizens and entities of the Territory: Although not named expressly, residents and entities within Norfolk Island whose interactions with government depend on powers vested in the Administrator will be affected by any ministerial direction that alters how those powers are exercised. Because the Ordinance ties the Administrator’s exercise of territorial powers to ministerial directions (s 8(1)), third parties dealing with decisions under territorial law may experience changes in administrative practice driven by the Minister’s directions.

In sum, the Ordinance primarily affects the Administrator, the responsible Commonwealth Minister, and the Governor‑General in their formal roles, and indirectly affects staff, acting appointees, persons engaged in contracts with or seeking employment with the Administrator, and any third party whose rights are governed by territorial laws administered through the Administrator.

The Ordinance defines a compact set of duties, obligations and statutory entitlements for the Administrator and sets out corresponding powers for the responsible Commonwealth Minister and the Governor‑General. The duties and rights are procedural and supervisory rather than substantive.

Duty to act in accordance with written directions: The principal substantive duty is that the Administrator “must exercise all powers, and perform all functions, that are conferred on him or her by or under a law in force in the Territory in accordance with such written directions (if any) as are given to him or her by the responsible Commonwealth Minister under this subsection” (s 8(1)). This duty is mandatory; the statutory wording uses “must”, so written ministerial directions are binding when issued under s 8(1). Directions may be general or specific (s 8(2)), which confers flexibility on the Minister to shape how powers are exercised.

Obligation to comply with pre‑notification requirements: The responsible Commonwealth Minister may, by written notice, require the Administrator to notify the Minister of the Administrator’s intention to exercise a specified power or perform a specified function and to do so at least a specified number of days beforehand (s 8(3)(a)-(b)). Where such a notice is issued, the Administrator must comply with its procedural preconditions before exercising the power in question.

Full‑time service obligation: The Administrator is required to hold office on a full‑time basis (s 7(2)). This is a condition of office rather than a discretionary matter. The Ordinance does not supply a definition of “full‑time”; however, the requirement is explicit and categorical.

Prohibition on outside paid employment without approval: The Administrator “must not engage in paid employment outside the duties of his or her office without the responsible Commonwealth Minister’s approval” (s 9). This is an obligation that requires the Administrator to obtain ministerial consent prior to undertaking any remunerated external activities. The duty is framed using “must not”, making it prohibitory.

Resignation procedure: The Administrator has the right to resign by giving the Governor‑General a written resignation (s 10(1)). The resignation takes effect on the day the Governor‑General receives it, or on a later specified day in the resignation (s 10(2)). This sets the administrative mechanics for voluntary departure.

Tenure and removal: The Administrator holds office during the Governor‑General’s pleasure (s 7(3)). That phrase establishes no fixed term in the Ordinance and implies that tenure may be ended by the Governor‑General, subject to constitutional and interpretive constraints that are not elaborated in the text. The Ordinance also notes that for reappointment, section 33AA of the Acts Interpretation Act 1901 applies because of section 8A of the Interpretation Act 1979 (note to s 7), indicating that rules on reappointment are regulated by interacting interpretive provisions outside the Ordinance.

Ministerial rights over contractual terms: The responsible Commonwealth Minister determines the Administrator’s other terms and conditions in relation to matters not covered by an Act or the Ordinance (s 11). That clause gives the Minister standing to set any residual employment conditions not otherwise prescribed by statute or the Ordinance.

Acting appointment and preservation of powers: The responsible Commonwealth Minister may appoint a person to act as Administrator during a vacancy or during periods of absence or inability (s 12(1)). The Ordinance provides that the exercise of powers and performance of functions by an acting Administrator “during the absence of the Administrator from duty or from the Territory does not affect the exercise of any power or the performance of any function by the Administrator” (s 12(2)). That protects the legal validity of both acting and incumbent actions when they occur respectively.

Formalities: The Ordinance prescribes formal, written instruments or notices for appointment, direction, notification, resignation, and acting appointment (s 7(1), s 8(1), s 8(3), s 10(1), s 12(1)). These formalities create procedural rights to documentary evidence and create clear records of decisions and approvals.

Interpretive frame and limitation: The Ordinance disapplies the Acts Interpretation Act 1901 (s 5), while indicating the Interpretation Act 1979 (Norfolk Island) applies instead. The Ordinance therefore relies on the local interpretation regime to clarify rights and duties where necessary.

Notice‑based procedural control: The Minister’s ability to require prior notice for specific exercises of power (s 8(3)) can be read as creating a right for the Minister to be informed and to interpose administratively prior to certain actions by the Administrator. The Ordinance does not elaborate consequences for non‑compliance with such a notice, but the mandatory language of other provisions suggests that failure to comply would place the Administrator in breach of statutory duties.

Collectively, these provisions define statutory obligations for the Administrator to follow ministerial directions and procedural notices, to perform duties full time, to avoid external paid employment without approval, and to submit resignations in writing. The Ordinance confers appointment and supervising powers on the Governor‑General and the responsible Commonwealth Minister, and delegates residual employment terms to the Minister.

The Ordinance contains no express penalty clauses, criminal offences, civil fines, or detailed enforcement mechanisms. There is no provision in the text that prescribes pecuniary penalties, imprisonment, administrative fines, or other statutory punishments for breaches of the obligations set out in the Ordinance. The enforcement architecture in the Ordinance is therefore predominantly administrative and institutionally based rather than penal.

Administrative controls and remedial mechanisms evident in the text:

• Tenure during Governor‑General’s pleasure: The Administrator “holds office during the Governor‑General’s pleasure” (s 7(3)). This provision operates as an administrative removal mechanism rather than a penal sanction. If the Governor‑General, acting in accordance with constitutional and applicable rules, removes the Administrator, that would terminate the appointment. The Ordinance does not specify procedures, reasons, or notice for removal in the text itself, nor does it prescribe consequences for removal.
• Ministerial directions and procedural notices: The responsible Commonwealth Minister may give written directions that the Administrator must follow when exercising territorial powers or performing functions (s 8(1)-(2)). The Minister may also require prior notification and a specified waiting period before particular actions (s 8(3)). Compliance with written directions and notices is presented as an obligation, but the Ordinance does not state the operational remedies for non‑compliance, such as voiding acts, injunctive relief or penalty. It does, however, provide the administrative tools available to the Minister to supervise and control the Administrator’s conduct.
• Approval gate for outside employment: The Administrator “must not engage in paid employment outside the duties of his or her office without the responsible Commonwealth Minister’s approval” (s 9). The text imposes a prohibitory duty, but does not specify statutory sanctions for conducting outside paid employment without approval. The remedy implied by the instrument is administrative oversight and the Minister’s control over terms and conditions (s 11), and potential removal given tenure at the Governor‑General’s pleasure (s 7(3)).
• Acting appointments and continuity protections: The Minister can appoint acting Administrators for vacancies and absences (s 12(1)). The Ordinance ensures continuity and legal certainty by providing that actions taken by an acting Administrator during the Administrator’s absence do not affect actions taken by the Administrator (s 12(2)). This reduces the risk of legal challenge to acts performed under the office by clarifying their concurrent validity.

Absence of express enforcement provisions means that enforcement of the Ordinance’s obligations would be effected by the formal controls embedded in appointment, approval and direction mechanisms, rather than by statutory penalties. Because the Ordinance requires written forms for directions, notices, appointments and resignations (s 7(1), s 8(1), s 8(3), s 10(1), s 12(1)), non‑compliance would be evidenced through documentary records and could be addressed by administrative action by the Minister or the Governor‑General.

The Ordinance’s notes reference interpretive and procedural provisions in the Acts Interpretation Act 1901, as applied through the Interpretation Act 1979 (Norfolk Island) (note to s 7 and note to s 12). These cross‑references suggest that where questions of appointment, reappointment or acting appointments arise, rules in those Acts may supply additional procedural or remedial detail not contained in the Ordinance itself. The Ordinance, however, does not itself append or restate any such rules, and the text supplied contains no case references, enforcement orders, or other adjudicative mechanisms.

In short, enforcement under the Ordinance is implemented through administrative instruments, appointment, directions, approval, and removal, rather than through express penal sanctions in the Ordinance text. Any further enforcement mechanisms would depend on the interaction of this Ordinance with other laws and interpretive rules referenced by the Ordinance, notably the Interpretation Act 1979 (Norfolk Island) and the Acts Interpretation Act 1901 to the extent specified by that local Interpretation Act.

The Ordinance is explicit that it operates within an existing statutory framework and that it does not itself define all relevant legal rules. Several provisions and notes bring other legislation into the interpretive and operational field.

Source of authority: The Ordinance is made under section 19A of the Norfolk Island Act 1979 (s 3). That establishes the statutory power under which the Ordinance was enacted. The Ordinance therefore functions as a subordinate law created pursuant to that enabling provision.

Territorial powers and functions derive from Territory laws: The Administrator’s duty is to exercise all powers and perform functions “that are conferred on him or her by or under a law in force in the Territory” (s 8(1)). The Ordinance does not itself enumerate those powers; the substantive authority for decisionmaking will be found in the various Territory laws that confer powers on the Administrator. Practitioners must therefore consult the operative Territory statutes and instruments that delegate or confer functions on the Administrator to understand the full scope of the office.

Interpretation Acts and cross‑application: The Ordinance expressly provides that the Acts Interpretation Act 1901 does not apply to this Ordinance (s 5). The accompanying note clarifies that the Interpretation Act 1979 (Norfolk Island) applies instead and that it is through section 8A of that Act that certain provisions of the Acts Interpretation Act 1901 apply. The notes to s 7 and s 12 refer to specific sections of the Acts Interpretation Act 1901 (sections 33AA, 33AB and 33A) as applying by virtue of section 8A of the Norfolk Island Interpretation Act. Those cross‑references indicate that appointment, reappointment, and acting appointment rules found in the Acts Interpretation Act 1901 are relevant to understanding timelines, reappointment procedures, and the legal effect of acting appointments, but only insofar as the Norfolk Island Interpretation Act brings them into play. The Ordinance itself does not restate those federal provisions.

Relationship with the Norfolk Island Legislation Amendment Act 2015: The commencement table ties the Ordinance’s commencement to the commencement of Part 1 of Schedule 2 to the Norfolk Island Legislation Amendment Act 2015 (s 2 and the commencement table). This indicates a legislative sequencing and suggests that the Ordinance forms part of an integrated legislative package that restructured Norfolk Island governance; practitioners need to review the 2015 Amendment Act and its Schedule 2 to see related changes and transitional arrangements that may affect the Administrator’s role.

Governor‑General and Commonwealth Minister powers: The Ordinance creates a tripartite relationship among Territory laws that create powers for the Administrator, the Governor‑General as appointing authority, and the responsible Commonwealth Minister who can issue directions, notices, and set terms and conditions. The Ordinance therefore overlays Commonwealth executive supervisory power on the Administrator’s exercise of Territory law powers. The precise boundary between ministerial directions under this Ordinance and the statutory powers conferred by specific Territory laws will be determined by those territorial statutes and by any interpretive rules in the Norfolk Island Interpretation Act; this Ordinance requires compliance with ministerial directions but does not itself resolve potential conflicts between direction and a specific territorial statutory duty.

Administrative instruments and forms: The Ordinance specifies that appointment, directions and acting appointments are to be made by written instrument or written notice (s 7(1), s 8(1), s 8(3), s 12(1)). These formalities will interact with any record‑keeping, publication or tabling requirements in other laws or governance instruments applicable to Norfolk Island appointments.

Residual terms and conditions: Section 11 vests the responsible Commonwealth Minister with the power to determine “other terms and conditions (if any) in relation to matters not covered by an Act or this Ordinance.” That clause creates a locus for the Minister to set contractual or administrative terms that might otherwise be specified in employment instruments or in a separate determination under broader Commonwealth human resources rules. The intersection between those ministerial determinations and any applicable Commonwealth employment law or public sector standards will require cross‑checking other statutes and policies.

Absence of direct penal interplay: The Ordinance contains no explicit penalty or enforcement provisions that interact with other laws. Where enforcement or judicial review of the Administrator’s acts is sought, relevant procedures and remedies will be governed by the laws under which a particular power was exercised and by general administrative law principles, not by penalty clauses in this Ordinance.

Overall, the Ordinance establishes procedural relationships and supervisory controls, and leaves substantive powers to be located in Territory laws. It references the local Interpretation Act rather than the federal Acts Interpretation Act directly, and it ties commencement to another specific Commonwealth Act. Effective legal work will therefore require consulting the Norfolk Island Act 1979, the Interpretation Act 1979 (Norfolk Island), the Norfolk Island Legislation Amendment Act 2015 (Schedule 2), and the particular Territory laws that confer powers on the Administrator.

The text supplied is the Ordinance as made in 2016, and it includes commencement information and a note about the table being limited to the original provisions. The Ordinance’s commencement clause and table state that “the whole of this Ordinance” commences at the same time as Part 1 of Schedule 2 to the Norfolk Island Legislation Amendment Act 2015; the commencement date entry in the supplied table is 1 July 2016 (s 2 and the commencement table). The commencement table includes an explicit note: “This table relates only to the provisions of this Ordinance as originally made. It will not be amended to deal with any later amendments of this Ordinance.” That indicates the table is a record of the original commencement and cautions readers that subsequent amendments, if any, will not be reflected in that table in this text.

The Ordinance contains no in‑text amendment provisions, expiry clauses or saving provisions beyond the ordinary terms. There are also notes that certain provisions of the Acts Interpretation Act 1901 apply by virtue of the Interpretation Act 1979 (Norfolk Island), as is relevant to appointment and acting appointment rules (notes to s 7 and s 12). Those notes are interpretive cross‑references rather than amendments.

Because the supplied instrument is self‑contained as originally enacted, and because the commencement table is explicit that it records only original commencement details, the text does not show any subsequent amendment history. The Ordinance does not include a schedule of amendments or revised text indicating later alterations. The absence of amendments in the provided text should not be read as proof that no amendments exist; rather, it reflects that the instrument as presented contains only the original enactment material, including commencement details tied to the Norfolk Island Legislation Amendment Act 2015.

For practitioners requiring the current statutory position, the Ordinance itself directs attention to external instruments and Acts: the Norfolk Island Act 1979 as the enabling statute (s 3), the Interpretation Act 1979 (Norfolk Island) as the interpretive regime (s 5, note), and the Norfolk Island Legislation Amendment Act 2015 for the timing context (s 2, commencement table). To determine whether the Ordinance has been amended since its original making, one must consult official consolidated legislative databases or the Commonwealth Gazette entries that record subsequent amendment instruments; such sources are not contained within this text.

In short, the provided Ordinance text records the original 2016 enactment and commencement details and contains no expressed amendments in the text supplied. The commencement table warns that it is not updated for later changes, so users should not assume the supplied text reflects later legislative amendments.

The Ordinance text supplied contains no references to any litigation, judicial interpretation, court decisions, or tribunal determinations concerning its provisions. There are no case names, reported decisions, or citations in the instrument. The explanatory notes attached to certain sections point to interpretive statutes (for example, references to sections of the Acts Interpretation Act 1901 applying by virtue of the Interpretation Act 1979), but the Ordinance does not record any judicial treatment of those cross‑references or of the Ordinance’s substantive rules.

Because the text contains no litigation history, it provides no judicially established principles or precedent on topics such as the scope of ministerial directions under s 8, the limits of the prohibition in s 9 on outside employment, the meaning of “full‑time basis” in s 7(2), or the consequences of non‑compliance with notice requirements under s 8(3). Similarly, the Ordinance contains no recorded disputes about acting appointments under s 12 or about the application of the Norfolk Island Interpretation Act as the interpretive regime.

Practitioners seeking case law on any of the Ordinance’s provisions must therefore look outside the instrument to relevant court decisions, administrative law authorities, and decisions interpreting comparable provisions in other instruments or statutes. The Ordinance itself points to other statutes for interpretive rules, which may have generated litigation not referenced here; those materials are not included in the text provided.

In summary, the Ordinance as provided has no litigation history recorded within it. Any assessment of how courts have treated the Ordinance’s themes, such as ministerial direction over territorial executives, the limits on outside employment, or the legal effects of acting appointments, must be founded on external case law and judicial materials not present in the supplied text.

This short Ordinance contains several structural provisions that produce practical hazards or traps for administrators, advisers and third parties if they are not carefully observed. The following points are drawn directly from the Ordinance text and the explanatory notes attached to it.

Ministerial directions are binding and broad: Section 8(1) requires the Administrator to exercise territorial powers and perform functions “in accordance with such written directions (if any) as are given to him or her by the responsible Commonwealth Minister under this subsection.” The mandatory “must” language and the absence of substantive limits on the content of directions mean that the Administrator’s practical discretion is susceptible to written instruction. Advisers should note that directions can be general or specific (s 8(2)). Failure to comply with a written direction would place the Administrator outside the Ordinance’s required mode of conduct.

Procedural preconditions can be imposed for individual actions: The Minister may, by written notice, require the Administrator to notify the Minister and to wait a specified number of days before exercising a specified power or function (s 8(3)). That provision acts as a procedural stop or pre‑clearance mechanism for targeted decisions. The Ordinance does not specify consequences for ignoring such a notice, so the Administrator’s breach would be evidenced administratively and may lead to ministerial or Governor‑General action rather than automatic statutory invalidity under the Ordinance. Practitioners must track any such notices closely.

Full‑time requirement without definition: The Administrator must hold office on a full‑time basis (s 7(2)). The Ordinance provides no definition of “full‑time” nor does it set hours, duties or leave arrangements. This gap creates potential ambiguity when determining the compatibility of other duties, approved outside employment, secondments, or overseas travel, and it places weight on ministerial determinations under s 11.

Outside employment requires prior approval: Section 9 prohibits paid employment outside the duties of office without the Minister’s approval. There is no process specified for seeking or granting such approval, and no standards or timelines are set in the Ordinance. Practitioners should not assume implied approvals or permissive retentions; written Ministerial approval is required to avoid statutory non‑compliance.

Residual terms and conditions are ministerially controlled: Section 11 gives the responsible Commonwealth Minister the power to determine “other terms and conditions (if any) in relation to matters not covered by an Act or this Ordinance.” That language can reach many employment‑related matters that the Ordinance does not explicitly address, including potentially remuneration, allowances, office arrangements, or confidentiality terms, subject to whatever constraints other applicable Acts or policies impose.

Tenure at pleasure: The Administrator holds office during the Governor‑General’s pleasure (s 7(3)). That expression indicates there is no fixed term set out in the Ordinance and that removal may be effected by the Governor‑General; the Ordinance does not set out a removal process nor does it record grounds or protections. Advisers should note that any protections, notice periods, or compensation for early termination would need to be sought in the enabling Act, other statutes, or ministerial determinations; the Ordinance itself is silent.

Interpretation Act interplay: Section 5 disapplies the Acts Interpretation Act 1901 and notes instead that the Interpretation Act 1979 (Norfolk Island) applies, and that certain provisions of the Acts Interpretation Act 1901 apply through s 8A of the Norfolk Island Interpretation Act. This layered interpretive regime can create analytical complexity. For example, the notes to s 7 and s 12 identify specific sections of the Acts Interpretation Act 1901 (ss 33AA, 33AB, 33A) as relevant by operation of the Norfolk Island Interpretation Act. Practitioners need to consult those Acts to resolve questions about appointments and acting appointments; failing to do so may lead to mistakes about reappointment or acting appointment rules.

Acting appointment continuity: Section 12(2) states that exercise of powers by an acting Administrator during the absence of the Administrator “does not affect the exercise of any power or the performance of any function by the Administrator.” That language safeguards the legality of both acting and incumbent actions, but advisers should note that it may complicate sequencing and record‑keeping, especially for decisions taken near the time of departure or return. Clear documentary trails will be important.

Commencement linkage: The Ordinance’s commencement is tied to Part 1 of Schedule 2 to the Norfolk Island Legislation Amendment Act 2015 (s 2); the table records a commencement date. Failure to consider that linkage could lead to misreading when the Ordinance took effect relative to other legislative changes affecting Norfolk Island.

Absence of penalties or enforcement detail: Because the Ordinance lacks express sanctions or remedies, it may be unclear what consequences attach to non‑compliance. Practitioners should not presume statutory penalties; administrative remedies, removal, or remedies available under the territorial statutes under which a particular power was exercised are the realistic recourse.

Documentary formality requirements: Several measures require written instruments or notices (s 7(1), s 8(1), s 8(3), s 10(1), s 12(1)). Failure to use the required written form could invalidate an appointment or direction, or at a minimum create evidentiary difficulties. Ensure written forms are used, lodged, and retained.

In short, the “gotchas” flow from broad ministerial control, procedural preconditions that can be imposed for particular decisions, gaps in definition and process for approval of outside employment, and the layered interpretive regime. Practical compliance therefore requires vigilant attention to written directions, notices, approvals and acting instruments, and cross‑checking of the enabling and interpretive Acts referenced by the Ordinance.

Compliance with this Ordinance is primarily about observing the procedural and formal requirements it prescribes, and about respecting the written supervisory instruments issued by the responsible Commonwealth Minister and the Governor‑General. The following checklist sets out practical steps and routines that an incumbent Administrator, prospective appointee, responsible Commonwealth Minister, and legal or administrative advisers should implement to meet the Ordinance’s obligations as set out in the text.

1. Confirm valid appointment by written instrument

• Ensure any appointment to the office is effected by a written instrument issued by the Governor‑General, as required by s 7(1).
• Retain the written instrument, and publish or file it as needed under separate statutory publishing or record‑keeping regimes, noting that the Ordinance itself requires written appointment (s 7(1)).

2. Observe full‑time duty requirement

• Ensure the Administrator understands that the office “holds [office] on a full‑time basis” (s 7(2)). Establish clear internal policies and job descriptions documenting expected hours, duties and availability. Because the Ordinance does not define “full‑time”, coordinate with the responsible Commonwealth Minister under s 11 if clarification of hours, leave or secondment arrangements is required.

3. Follow written directions from the responsible Commonwealth Minister

• Create a formal process to receive, record, and comply with written directions under s 8(1). Maintain a secure and searchable register of all written directions, including dates issued and the specific powers or functions to which they relate.
• Where directions are general, develop internal guidance about how to operationally implement them across multiple territorial powers. Where directions are specific, treat them as binding instructions for the specified powers (s 8(2)).

4. Monitor for written notices imposing pre‑notification requirements

• Track written notices under s 8(3) that require notification and a minimum notice period before exercising specified powers. Establish an internal calendar and clearance workflow to ensure that any required notice period is met, and retain copies of the notices and evidence of compliance.

5. Obtain ministerial approval before any outside paid employment

• Before accepting any paid external work, submit a written request to the responsible Commonwealth Minister and obtain written approval, as required by s 9. Retain approval records. Do not undertake any paid outside employment without this written approval.

6. Manage resignation and termination mechanics

• If resigning, submit a written resignation to the Governor‑General, noting that it takes effect when received unless a later date is specified (s 10(1)-(2)). Maintain proof of delivery and acceptance. For administrative removal or termination, consult the Governor‑General’s office and legal advisers because the Ordinance provides tenure “during the Governor‑General’s pleasure” (s 7(3)) but does not specify removal procedures.

7. Ensure other terms and conditions are documented

• For matters not covered by an Act or the Ordinance, seek written determinations from the responsible Commonwealth Minister under s 11. Obtain clear written statements of terms and conditions, including remuneration, allowances, reporting obligations, leave, confidentiality, or post‑employment restrictions where relevant. Retain these determinations as part of the employment record.

8. Acting appointments and continuity planning

• Where a vacancy, absence or inability is anticipated, coordinate with the responsible Commonwealth Minister to have a written instrument appointing an acting Administrator as necessary (s 12(1)). Establish handover protocols and ensure the acting appointment instrument is retained. Note that actions taken by an acting Administrator do not affect the Administrator’s own actions when absent (s 12(2)); keep contemporaneous records to reconcile decisions taken during the acting period and the substantive Administrator’s subsequent actions.

9. Use written form for all required communications

• The Ordinance mandates written instruments and notices in multiple places. Implement document control protocols to ensure appointments, directions, notices, approvals and resignations are in writing, authenticated, dated and securely retained (s 7(1), s 8(1), s 8(3), s 10(1), s 12(1)).

10. Map powers to territorial laws

• Because the Administrator’s substantive powers are those conferred “by or under a law in force in the Territory” (s 8(1)), compile and maintain a legal inventory of all territorial statutes, regulations and instruments that confer powers or functions on the Administrator. Review each instrument to determine whether ministerial directions under the Ordinance may alter how those powers are exercised. Keep legal advisers involved in assessing potential conflicts between a written ministerial direction and a territorial statutory duty.

11. Consult the interpretive Acts

• Note that the Acts Interpretation Act 1901 does not apply to this Ordinance (s 5). Consult the Interpretation Act 1979 (Norfolk Island) and its section 8A, and identify any provisions of the Acts Interpretation Act 1901 that apply through that vehicle. This will be relevant for appointment, reappointment, acting appointment rules and other interpretive questions referenced in the notes to s 7 and s 12.

12. Record and disclose appropriately

• Given the Ordinance’s reliance on written directions and approvals, maintain an auditable record trail. Where statutory or policy obligations require publication or tabling of appointments, directions or delegations, ensure compliance with those external requirements; the Ordinance itself requires written form but does not specify publication.

13. Obtain legal advice for borderline issues

• Seek legal advice on ambiguous areas such as the definition of “full‑time”, the scope of ministerial directions in relation to specific territorial statutory duties, the implications of failing to comply with a notice under s 8(3), and the scope of the Minister’s determinations under s 11. Because the Ordinance is silent on sanctions, legal advice will also be necessary where there is a risk of disciplinary or removal proceedings.

14. Internal control for third‑party interactions

• For counterparties interacting with decisions made under territorial law by or through the Administrator, verify whether ministerial directions or prior notices affect the decision in question, and request sight of relevant written directions or notices if necessary to confirm the Administrator’s authority to act in a particular way.

Following the above steps implements the Ordinance’s documentary and procedural requirements, mitigates the principal compliance risks evident in the text, and creates the administrative conditions for lawful exercise of the Administrator’s functions under territorial law.
