Commonwealth legislation
This Act has been repealed and is no longer in force. It is retained for historical reference.
These Regulations set technical safety standards for life‑saving and fire‑fighting equipment on Australian‑registered and interstate sea‑going ships: what boats, life‑jackets, buoyant apparatus, rocket line‑throwing gear, pumps, hoses and extinguishers must be carried, how they must be constructed, stowed, tested and inspected. They affect shipowners and masters (who pay for, fit, certify and maintain equipment) and give the Director/Deputy Director power to approve alternatives or grant exemptions, creating predictable compliance and inspection obligations for commercial operators.

(4) (a) Where the life-boats carried under sub-regulation 2 (a) of this regulation do not furnish sufficient accommodation for the total number of persons carried, or which the ship is certified to carry, whichever number is the greater, then arrangements shall be made to the satisfaction of the Director to carry such additional life-boats as are required to make up the deficiency in such manner that they can be stowed without in any way impeding the prompt handling of the life-boats carried under sub-regulation (2) (a) of this regulation, and the buoyant apparatus carried under sub-regulation (3) of this regulation, or the marshalling of the persons on board at the launching stations or their embarkation. So far as practicable without creating such impediment, these additional life-boats shall be distributed as follows:—
(i) One additional life-boat under each set of davits;
(ii) Other additional life-boats, stowed on the deck or bridge, or poop, so as to be available as far as practicable for use on either side of the ship, and so secured that they will have the best chance of floating free of the ship if there is no time to launch them.
Buoyant apparatus, instead of additional life-boats, in special cases.
(b) Where the Director is satisfied that in a ship of this class launched before 1st January, 1925, it is not possible to carry, in the manner provided in sub-regulation (2) (a) of this regulation and paragraph (a) (i) of this sub-regulation, life-boats in such numbers and capacity as would be sufficient to accommodate the total number of persons carried, or which the ship is certified to carry, whichever number is the greater, he may allow additional approved buoyant apparatus to be carried in lieu of life-boats sufficient for those persons for whom accommodation is not provided in life-boats: Provided that no buoyant apparatus shall be allowed on a ship of this class in lieu of a life-boat required by these Regulations unless the total cubic capacity of the life-boats is at least equal to the greater of the two following amounts:—

Number of sets of davits to be provided.
6.(1) A ship of this class shall, subject to the provisions of Regulation 95, be provided, in accordance with its length, with the number of sets of davits specified in column A. of the table in Schedule I:
Provided that no ship shall be required to have a number of sets of davits greater than the number of boats required to accommodate the total number of persons which is carried, or which the ship is certified to carry, whichever number is the greater, and provided further that the Director may, where it appears to him necessary, having regard to the height at which the boats are carried above the centre of the load-line disc, and to the other circumstances of the case, require a ship of this class to carry in lieu of, or in addition to, davits, some other approved form of launching appliances, or such arrangements for launching boats as may be, in his opinion, effective.
Number of life-boats to be carried.
(2) (a) Each set of davits shall have a life-boat of Class I. attached to it, and of these life-boats at least the minimum number specified in Column B of the Table in Schedule I. shall be open boats.
(b) Any additional life-boats which may be required to make up the total life-boat accommodation required by sub-regulation (4) of this regulation may be boats of Class I. or Class II.
Buoyant apparatus, additional to life-boats, to accommodate 25 per cent. of persons carried.
(3) On and after the 1st day of July, 1925, a ship of this class shall carry, in addition to the life-boats required to be carried under the last preceding sub-regulation, approved buoyant apparatus conforming to the conditions detailed in regulation 75, sufficient to support 25 per cent. of the total number of persons which is carried, or which the ship is certified to carry, whichever number is the greater.
Additional life-boats required, and how to be carried.
(i) One additional life-boat under each set of davits;
(i) Seventy-five per cent. of the total capacity required to accommodate all the persons carried; or
(ii) The minimum capacity required by column C. of the table in Schedule I.
Life-boats and buoyant apparatus to accommodate all persons carried at any period of voyage.
(5) The master or owner of a ship of this class claiming to carry, on any voyage, fewer life-boats or, in the case of a ship coming under the provisions of sub-regulation (4) (b) of this regulation, fewer life-boats and approved buoyant apparatus, than will provide sufficient accommodation for all the persons for which the ship is certified, must declare, at the principal port in a State, before the Deputy Director, or, at a port other than the principal port, before the sub-Collector of Customs for the port, before the time of clearance, that the life-boats or the life-boats and approved buoyant apparatus, as the case may be, actually carried will be sufficient to accommodate all persons who will be carried at any time during the voyage to oversea ports and the voyage back to the Commonwealth, or between Australian ports, as the case may be, and that, in addition, approved buoyant apparatus will be carried sufficient for 25 per cent. of all such persons, as required by sub-regulation (3) of this regulation.
In the case of a ship coming under the provisions of sub-regulation (4) (b) of this regulation, and claiming to carry fewer life-boats and approved buoyant apparatus than will provide accommodation for all the persons for which the ship is certified, a further declaration must be made by the master or owner that the total cubic capacity of the life-boats actually carried is not less than is required by sub-regulation (4) (b) of this regulation: Provided that no greater number of life-boats need be carried than is sufficient to accommodate all the persons carried.
Class I. life-boats or motor life-boats to be carried and equipped with wireless telegraphy and searchlights.
7. (1) This regulation shall apply to foreign-going ships and to Australian-trade ships only.
Provided that in its reference to Australian-trade ships, this regulation shall apply only to Australian-trade passenger ships whose keels are laid after this regulation comes into force.
(2) On and after the 1st July, 1925, where the number of life-boats required to be carried by a ship is more than ten, one of them shall be fitted with an approved wireless telegraphy installation. Where the number of life-boats is more than fifteen, one of them shall be a motor boat, fitted with an approved wireless telegraphy installation complying with the provisions of regulation 37 of these Regulations, and where the number is more than twenty, two of them shall be motor boats so fitted. All such motor boats shall, in addition, be fitted with searchlights approved by the surveyor.
Motor life-boats carried instead of Class I. life-boats.
