40D Mess debts (1) Subregulation (2) applies if: (a) a member owes an amount as a debt to a body that: (i) operates a mess or a canteen; or (ii) provides a similar service; and (b) the Commonwealth pays part or all of the amount on behalf of the member. (2) The amount paid by the Commonwealth is a debt due by the member to the Commonwealth. (3) Without affecting its right to recover an amount payable under this regulation by other means (for example, in a court of competent jurisdiction), the Commonwealth may recover the amount by deducting it from the member’s salary and allowances.
