39 Revocation and cessation of nomination
(1) If: (a) a nomination under subsection 37(2) or 38(2) is in force in relation to a registered biodiversity project; and (b) one of the project proponents for the registered biodiversity project, by written notice given to the Regulator, revokes the nomination; the nomination ceases to be in force. (2) If: (a) a nomination under subsection 37(2) or 38(2) is in force in relation to a registered biodiversity project; and (b) the nominee ceases to be one of the project proponents for the registered biodiversity project; the nomination ceases to be in force.
Note: If a registered biodiversity project that has multiple project proponents ceases to have a nominee, and no new nominee is nominated, the Regulator may cancel the project’s registration from 90 days after the cessation (see rules made for the purposes of section 42).
