Nature Conservation Regulation 2015

The regulation relies on and references several core statutory concepts found in the Act and the Legislation Act 2001. The regulation does not redefine those core concepts, but it prescribes particular applications of them.

• Reserve, special purpose reserve, and map-based prescription: Section 5 prescribes the special purpose reserves set out in schedule 1. The regulation adopts the Act’s definition of reserve and ties "special purpose reserve" to land reserved in the territory plan, using Planning Act 2023, section 385(d) as the operative link (s 5(2)). Schedule 1 identifies reserves by map number and district, and schedule 1, part 1.2 contains the map divisions for each listed reserve.

• Suitability information about persons and activities: The Act requires "suitability information" for licensing decisions. The regulation prescribes the particulars that constitute suitability information for a person (s 6) and for an activity (s 8). For persons, the prescribed matters include qualifications, training, knowledge and experience relevant to the activity, and, in defined circumstances where the activity involves a specially protected species or protected native species, the person’s associations with research organisations for scientific purposes or Aboriginal community membership for practice of Aboriginal tradition (s 6(a)-(b)). For activities, the regulation prescribes procedural and biosecurity items such as methods of killing and carcass disposal, methods of taking animals, facilities and care for kept animals, whether an animal was captive-bred when sold, transportation methods for imports/exports, genetic characteristics and disease status for release from captivity, objectives for archaeological excavations in wilderness areas, and details of scientific research where that is the purpose (s 8(a)-(h)).

• Activities that are unsuitable for licensing: Section 7 prescribes a list of activities that would be unsuitable for a licence because they would constitute specified offences under the Act, such as damaging native trees in wilderness areas (s 144), taking fallen timber in wilderness areas (s 146), selling or exporting protected plants without plant tags (s 149, s 152), making roads in wilderness areas (s 223), using motor vehicles off road in wilderness areas (s 224), excavating in wilderness areas without a licence for non-archaeological purposes (s 225), and divulging protected information (s 364). Where an activity would constitute one of these offences, it is prescribed as unsuitable (s 7).

• Licence conditions and notifications: The regulation imposes notification requirements for licences authorising clearing native vegetation in a reserve and for damaging land in a reserve, both requiring the licensee to tell the conservator before starting (ss 9-10). For licences authorising keeping animals for public display, the licence is subject to compliance with a risk management plan approved by the conservator (s 11). These are statutory conditions placed on distinct licence types under the Act, specified here.

• Record-keeping: The regulation specifies precise record fields for licence categories, including keeping animals (s 12), keeping live fish (s 13), selling or exporting native plants (s 14), and selling or exporting protected invertebrates (s 15). Records must include counts, species, sex (subject to a limited exception where sex cannot be ascertained without handling, s 12(4)), names and addresses of transfer recipients or suppliers, dates of acquisition, death, escape, transfer or export, and totals of items sold or exported. The regulation cross-references the Act’s definition of "sell" as including "offer for sale" (see the note in s 14 and the Act reference).

• Interplay with other statutory instruments: The Dictionary section confirms that terms used in the regulation have the same meaning as in the Act (Dictionary note 3), and it points to the Legislation Act for definitions of "must" and "may" (Dictionary note 2). The reserves prescription specifically ties to the Planning Act 2023 (s 5(2) and schedule 1 references), signalling that planning designations determine the legal status of the listed areas.

These concepts frame who decides key questions (the conservator for licences and approvals), what must be supplied and retained by applicants and licensees, and which activities are excluded from licensing because they would be unlawful under the Act.

The regulation touches a limited but identifiable set of participants.

• Licence applicants and licensees: Individuals and entities who apply for or hold licences under the Nature Conservation Act are primary actors affected by ss 6-15. Applicants must provide the prescribed suitability information about themselves and their proposed activity (ss 6, 8). Once licensed, these persons are required to comply with conditions such as precommencement notification for clearing or damaging reserve land (ss 9-10), compliance with approved risk management plans for public display animals (s 11), and detailed record-keeping obligations for animal keeping, live fish, plant sales/exports and protected invertebrate sales/exports (ss 12-15). Record-keeping requires capturing personal data of counterparties (names and addresses), species, dates, and transfers.

• Conservator and regulatory officers: The conservator (a role defined in the Act, referenced throughout the regulation; see s 6 note and s 11) decides whether to accept suitability information, to approve risk management plans, and receives mandatory notifications required under ss 9-10. The regulation also prescribes items the conservator may inspect, for example the place where an animal is to be kept (see s 8 note). Enforcement officers will use the records prescribed in ss 12-15 to investigate compliance and alleged offences.

• Land managers and users in prescribed special purpose reserves: The schedule prescribes specific reserves (schedule 1, part 1.1 and 1.2). Anyone intending to clear native vegetation, damage land, undertake excavations, or otherwise conduct regulated activities in those reserves must account for the licence conditions and the list of activities that cannot be licensed because they would constitute offences (s 7; ss 9-10). The reserve prescription affects local councils, agencies, contractors and commercial operators who work on or near these parcels.

• Aboriginal communities and research organisations: The regulation explicitly requires information about a person’s association with research organisations for scientific purposes, and Aboriginal community membership where the activity involves Aboriginal tradition and protected species (s 6(b)). This places a compliance-facing requirement on applicants whose activity touches protected species and Aboriginal tradition, and it potentially affects the evidentiary burden of establishing cultural authority or scientific affiliation in licence applications.

• Traders in native plants and protected invertebrates, and aquaculture operators: Sellers and exporters of native plants, protected invertebrates and live fish are required to keep specified transaction-level records, including recipient details and species information (ss 13-15). Commercial operators in those markets must maintain records that would support compliance verification.

• The public and stakeholders interested in reserve management: The identification of special purpose reserves in schedule 1 alters which parcels of public land are subject to the Act’s reserve management planning. Stakeholders, including recreational users and nearby landowners, are affected by the legal status and management rules that flow from those designations (s 5 and schedule 1).

Who pays and who bears compliance costs. Licensees and applicants carry private compliance costs: preparing suitability information, maintaining and storing records, complying with risk management plans, and providing pre-start notifications. The conservator and government agencies carry administrative costs to process additional information, approve risk plans, inspect facilities, and enforce recordkeeping obligations. Traders must absorb record-keeping systems and potential audit burden. The mapping of reserves imposes opportunity costs for land users because certain activities are regulated or excluded within those mapped areas.

The regulation creates both affirmative duties and procedural rights, linked to licence processes and reserve status.

Key duties

• Provide prescribed suitability information when required by the Act: Section 6 requires applicants to provide their qualifications, training, knowledge and experience relevant to the activity, and, for activities involving specially protected or protected native species with certain purposes, association with research organisations or Aboriginal community membership (s 6(a)-(b)). Section 8 requires precise information about the activity, including methods, facilities, transport, genetic/disease status in releases, archaeological objectives, and research details (s 8(a)-(h)).

• Do not seek licences for activities that are unsuitable: Section 7 prescribes that an activity is unsuitable for a licence if it would constitute an offence under enumerated Act sections, such as making a road in a wilderness area or using a motor vehicle off-road in a wilderness area. This flows to applicants as a duty to avoid seeking licences for such activities.

• Notify the conservator before starting certain licence activities within reserves: If a licence authorises clearing native vegetation or damaging land in a reserve, the licensee must tell the conservator before commencing the activity (ss 9-10).

• Comply with conservator-approved risk management plans for public display animals: Licences authorising keeping animals for public display are subject to compliance with an approved risk management plan (s 11).

• Keep and retain records in prescribed form: The regulation imposes specific record-keeping duties depending on licence type. For keeping animals, licensees must keep species, sex and counts, and acquisition, death/escape and transfer data, with a limited exception for sex where it cannot be ascertained without handling (s 12(2)-(4)). Live fish licensees must keep species records and acquisition, transfer and export details (s 13). Sellers/exporters of native plants and protected invertebrates must record recipient details, dates and species, and totals (ss 14-15).

Procedural rights and constraints

• Conservator discretion and licensing process: The regulation frames requirements that the conservator will use in exercising licensing discretion, such as assessing suitability information and approving risk management plans (s 6, s 11). Applicants have the procedural right to submit the prescribed information; the text does not specify appeal rights or processes, those remain in the Act.

• Limited exception on sex-recording: For animal-keeping records, a licensee is not required to record sex where determining sex would necessitate handling the animal (s 12(4)). This is an explicit allowance that reduces handling burden and potential welfare impacts.

• Rights implicit in statute for inspection: The regulation notes that the conservator may inspect a place where animals will be kept, which implies an inspection power for the regulator as part of licence compliance (s 8 note referencing s 272 of the Act).

• Integration with planning and reserve designations: The list of special purpose reserves gives legal certainty as to which parcels are subject to reserve-management rules under the Act; rights and duties connected to reserve status follow the Act and the planning instrument (s 5; schedule 1).

Operationally, duties fall largely on licensees and applicants, while rights are procedural (the ability to submit required information) and constrained by conservator discretion. The regulation sets mandatory documentary obligations that will be used to monitor compliance and support enforcement.

The regulation itself prescribes behaviours and record-keeping obligations rather than creating discrete, new criminal offences inside the regulation text. Enforcement and penalties arise by reference to the Act’s offence provisions, which the regulation both references and supports.

• Offences referenced as unsuitable activities: Section 7 lists Act offences the engagement in which would make an activity unsuitable for a licence. Those Act provisions carry their own penalties; the regulation’s effect is to preclude licensing where those offences would otherwise apply. Relevant Act sections cited in s 7 include sections 144, 146, 149, 152, 223, 224, 225 and 364. The regulation does not substitute or modify those penalties, it prescribes licensing ineligibility where those offences would be involved.

• Record-keeping and licence-condition compliance: Sections 9-11 and 12-15 impose mandatory duties on licensees and applicants. Non-compliance with licence conditions or record-keeping obligations will be actionable under the Act’s compliance and enforcement framework, which is not reproduced in the regulation text. The instrument itself does not state the specific penalties for failing to notify the conservator, failing to comply with a risk management plan, or failing to keep records; those outcomes are governed by the Act’s enforcement provisions.

• Penalty unit values for the republished law: The republication front matter states penalty unit values that applied on the republication date: $160 for an individual and $810 for a corporation, as provided by the Legislation Act 2001, s 133. This note informs the dollar value of statutory penalties under the Act to the extent they are expressed in penalty units; the regulation relies on that framework.

• Enforcement actors and mechanisms: The conservator is central to enforcement insofar as receiving notifications, approving risk management plans, and inspecting kept-animal facilities (see s 8 note about inspection under Act s 272). The regulation’s record obligations create an evidentiary trail that enforcement officers may require or inspect; disclosable entries such as names and addresses of recipients, dates, species and transfer details materially assist investigations.

• Protected information and privacy: Section 7(g) cites section 364 (Offences, use or divulge protected information) as one of the Act offences whose engagement would make an activity unsuitable for licensing. The regulation therefore interacts with statutory restrictions on protected information, which may limit how records are used and disclosed during enforcement processes; the regulation itself does not define procedures for handling protected information.

• No discrete civil penalty or administrative monetary penalty provisions in the regulation: The regulation does not itself create administrative fines or civil penalties; it prescribes obligations whose breach would attract penalties under the Act. To determine specific fine levels for particular breaches, one must read the Act’s offence schedule and apply the penalty unit values noted in the republication.

In practice, the regulation channels enforcement through licence conditions and records, increasing detectability of non-compliance and aiding prosecution or administrative enforcement under the Act, subject to the conservator’s and enforcement agencies’ resource choices.

The regulation is tightly cross-referenced to the Nature Conservation Act 2014, the Legislation Act 2001 and the Planning Act 2023. It functions as a detail-setting instrument for the Act and depends on definitions and authorities in those statutes.

• Nature Conservation Act 2014: The regulation is made under that Act, and many of its sections are expressly linked to specific provisions of the Act. For example, s 5 addresses the Act’s definition of "reserve" (Act s 169), s 6 and s 8 implement the Act’s requirements for "suitability information" (Act ss 266-269 equivalents referenced), ss 9-11 impose conditions described in Act s 274, and ss 12-15 implement record-keeping referred to in Act s 306. The Dictionary confirms terms used in the regulation have the same meaning as in the Act (Dictionary note 3). Consequently, obligations and sanctions sit within the Act’s broader statutory architecture and enforcement regime.

• Planning Act 2023: Section 5(2) explicitly defines "special purpose reserve" for the regulation by reference to land reserved in the territory plan under the Planning Act 2023, s 385(d). This means that whether an area is a special purpose reserve, for the purposes of the Act and this regulation, depends on planning designations in the territory plan. Changes to planning instruments, or to the Planning Act, can therefore change which lands are captured as reserves. The scheduling of maps in schedule 1 ties legal status of listed parcels to that planning designation.

• Legislation Act 2001: The regulation uses definitions like "must" and "may" as explained in the Legislation Act, and the republication note references penalty unit values under the Legislation Act, section 133. The Dictionary also states that terms used in the regulation have the same meaning that they have in the Nature Conservation Act 2014, with cross-references to Legislation Act definitions (Dictionary notes 1-3). The Legislation Act’s editorial and republication rules are applied to this republished instrument, as described in the front matter.

• Interaction with other regulatory regimes: The regulation’s requirements to record names and addresses of buyers, sellers and recipients for plants, invertebrates and animals will intersect with privacy, biosecurity and trade laws where transfers cross jurisdictions or where other agencies have interest (for example, in movements involving biosecurity risk). The regulation does not displace other legislative requirements; it sits alongside them.

• Planning and land-use consequences: Because reserve designation depends on the territory plan, land-use approvals, development permits and planning overlays administered under the Planning Act may have consequential effects on what activities are lawful or licensable under the Nature Conservation Act and this regulation, particularly for activities involving clearing or damaging native vegetation in a reserve (ss 9-10). The regulation does not itself vary planning instruments, but it relies on them for land-identification.

• Administrative law and review: The conservator’s decisions to approve risk management plans or to accept suitability information will be administrative decisions under the Act. Rights of review, merits review, or judicial review are not spelled out in the regulation; they are provided by the Act and the general administrative law framework. This instrument provides the factual predicates that administrators use.

Practitioners need to read the Act, the Planning Act 2023 and the Legislation Act 2001 alongside this regulation to see the full legal effect, because the regulation prescribes details that only operate when read with enabling statutory powers and definitions.

The regulation’s endnotes record a sequence of amendments since the original 2015 instrument; the republication consolidates those changes up to 27 November 2023. The instrument itself indicates which provisions were amended and by which amending instrument.

Key chronological points

• Original notification and commencement: Nature Conservation Regulation 2015 SL2015-23 was notified on the legislation register on 2 July 2015, with most provisions commencing on 3 July 2015 (endnotes 3).

• 2017 amendments: The Planning, Building and Environment Legislation Amendment Act 2017 A2017-3 made amendments that affected schedule 1 part 1.1 (special purpose reserves). The legislation history identifies that schedule 1 part 1.1 was amended by A2017-3, section 8, and that Woodstock West Special Purpose Reserve (schedule 1 div 1.2.16) was substituted by A2017-3 section 9 (endnotes 3 and 4). The republished instrument records the effect and the dates in the legislation history; particulars of what the replacement map or list entailed are contained where those amending provisions are cited.

• 2021 amendment regulation: The Nature Conservation Amendment Regulation 2021 (No 1) SL2021-8 affected the schedule, specifically substituting the Molonglo River Reserve map at schedule 1 division 1.2.9 (endnotes 3 and 4). That instrument was notified 13 May 2021, with the remainder commencing 14 May 2021.

• 2023 consequential amendments: The Planning (Consequential Amendments) Act 2023 A2023-36, schedule 1 part 1.48, inserted amending provisions; schedule 1 and s 5 were amended with effect 27 November 2023 for the particular provision s 5 (see amendment history which records s 5 amendment by A2023-36 amdt 1.277). The legislation history and amendment history in the endnotes show that s 5 (defining what is a reserve) was amended by A2023-36. The commencement dates are set out in endnotes 3 and 4.

• Commencement edits: The instrument notes that s 2 was omitted (s 2 om LA s 89(4)) as part of the amendment history (endnote 4).

Editorial republication and notes

• The Parliamentary Counsel’s Office republishes authorised copies incorporating amendments and editorial changes. The "About this republication" front matter explains that editorial changes under the Legislation Act 2001, part 11.3 do not change legal effects, but the republished text includes the consolidated amendments up to the stated effective date (27 November 2023). The republication lists legislation history and amendment history in endnotes 3 and 4, which provide the primary references for verifying when and by which instruments changes were made.

Practical import of amendment history

• The schedule of reserves has been adjusted by successive amendments, showing the list of reserved parcels is subject to legislative updates in response to planning or policy needs. The regulation’s reliance on the Planning Act 2023 for the legal definition of "special purpose reserve" means future planning-act amendments or plan changes could trigger further regulation amendments or re-listing of reserves.

• Because the regulation prescribes specific administrative requirements linked to Act provisions, any amendment to the Act that alters those cross-references would likely require consequential amendments to this regulation, as has occurred in the 2017, 2021 and 2023 instruments recorded in the endnotes.

For precise historical wording and map substitutions, practitioners should consult the listed amending instruments (A2017-3, SL2021-8, A2023-36) and the consolidated republished text on the ACT legislation register, as recorded in the endnotes.

The republished regulation and its endnotes do not record any litigation or judicial interpretation specific to this regulation. The instrument provides the legislative text, amendment history and republication notes, but it does not include references to court decisions or case law.

What this absence means in practice

• No recorded cases in the instrument does not mean that the Act or the subject areas governed by the regulation have never been litigated. It only indicates that this republished legislative instrument does not itself document or summarise judicial decisions. To find litigation that interprets or applies provisions of the Nature Conservation Regulation 2015, practitioners must search judicial databases and decisions referring to the Nature Conservation Act 2014 and this regulation.

• Relevant judicial review or appeals would typically arise from administrative decisions made under the Act that use this regulation as an operative instrument. Examples of decisions that may be litigated include licence refusals or approvals, conditions imposed by the conservator (such as risk management plans), enforcement actions for alleged breaches of record-keeping or licence conditions, and disputes about whether a parcel of land qualifies as a special purpose reserve under the Planning Act and the regulation’s schedule. The regulation itself does not report these cases.

How to research judicial treatment

• Search the ACT courts and tribunals databases and AustLII for decisions referencing the Nature Conservation Regulation 2015, the Nature Conservation Act 2014, and specific Act sections cited in the regulation (for example, the sections listed in s 7 that render activities unsuitable). Administrative law challenges will arise in the Supreme Court of the ACT for judicial review or in specialist tribunals for merits review where statutory rights permit.

• When looking for precedents about record-keeping, conservator discretion, or reserve definitions, examine both Act-based decisions and decisions applying the Planning Act 2023 definition of reserves, because the reserve status is defined by the Planning Act and the regulation references that link.

Because the regulation’s text alone does not include litigation history, users should undertake targeted case-law searches to identify any judicial interpretations that bear on the meaning of prescribed suitability information, the limits of conservator discretion, the legal effect of the schedule maps, or the enforcement of record-keeping obligations.

This regulation contains a number of detailed, concrete traps for the unwary practitioner, applicant, licence-holder or land user. The following points collect those operational risks and practical pitfalls, each tied to the regulating text.

1. Licence applicants must supply specific, operational details, not vague statements. Sections 6 and 8 require particulars such as qualifications and explicit procedures for killing, taking, transporting, disposing and releasing animals, plus facility care procedures and genetic/disease status for release from captivity (s 6; s 8(a)-(f)). Submitting high-level, non-specific statements risks refusal on suitability grounds because the conservator will be assessing technical and biosecurity matters.

2. Activities that would otherwise be unlawful cannot be cured by requesting a licence. Section 7 prescribes that if an activity would constitute an offence under certain sections of the Act, it is unsuitable for a licence. This is not a list of discretionary prohibitions; it tells practitioners that licences cannot be used to authorise activities that would amount to those enumerated offences (s 7). Applicants must check the Act provisions cited in s 7 when proposing activities in wilderness areas or involving protected species.

3. Reserve status depends on the territory plan, not just the schedule. While schedule 1 lists special purpose reserves, section 5(2) ties "special purpose reserve" to the Planning Act 2023, section 385(d). That means a parcel’s legal status can change if the territory plan or Planning Act changes, and the schedule may be updated by subsequent amending instruments (s 5(2); endnotes 3-4). Practitioners should verify current reserve status through the territory plan and the most recent amending instruments.

4. Notification obligations are timing-critical. Licences authorising clearing of native vegetation and damaging land in a reserve require the licensee to tell the conservator before starting (ss 9-10). The text does not define a minimum notice period, so "before starting" is a strict temporal obligation that can be interpreted narrowly in enforcement or review. Failure to give the required pre-start notice may render the licensee non-compliant even if the activity is otherwise licensed.

5. Risk management plan approval can be a gating requirement for public display. Licences to keep animals for public display are subject to compliance with a plan approved by the conservator (s 11). Approval is a precondition to lawful display; operating while awaiting or without approval exposes the licensee to enforcement action. The regulation leaves the content and assessment criteria of such plans to the conservator’s process under the Act.

6. Record-keeping includes personal data and operational detail. Sections 12-15 require names and addresses of counterparties, species, dates and totals. This creates storage, privacy and data-security obligations for licensees; these obligations are not elaborated in the regulation but the data will be discoverable in enforcement or disclosure processes (ss 12-15). Practitioners should implement record-keeping systems and policies to retain and protect this data.

7. Sex recording exception is narrow. Section 12(4) allows omission of sex only where it is not possible to ascertain sex without handling the animal. That is a narrowly framed exception; it will not cover cases where non-invasive methods could determine sex, nor will it relieve licensees of making reasonable efforts to determine sex where practical (s 12(4)).

8. "Sell" includes "offer for sale" , implications for listings, advertisements and brokers. The note in s 14 refers to the Act, s 126, clarifying that market activity includes offers. Sellers, platform operators, brokers and market participants need to treat offers as falling within the record-keeping obligations for plant sales and exports (s 14 note).

9. Archaeological excavation in wilderness areas: different evidentiary standard. Section 8(g) prescribes that activities involving excavation in a wilderness area for archaeological investigation must specify objectives and expected contribution to understanding Aboriginal prehistory or Australian history. The regulation thus distinguishes archaeological excavation from other excavation purposes which are treated as unsuitable activities (s 7(g); s 8(g)). Applicants must tailor suitability information to academic or heritage research standards.

10. Amendments over time change the list of reserves. The schedule has been amended multiple times (see amendment history in endnotes 3-4). Practitioners cannot rely on a printed copy without verifying the latest republication and any uncommenced or subsequent amending instruments; the front matter warns that uncommenced amendments are underlined in the legislation history and accessible on the register.

These are not abstract cautions; each is grounded in the regulation’s specific text. Addressing these gotchas requires concrete administrative steps: precise documentation, pre-start planning, secure records systems, and verification of land status with planning registers.

Compliance follows clearly from the regulation’s prescriptions. The steps below set out a practical compliance checklist tied to the relevant sections.

1. Verify reserve status before planning activity:

   • Check whether the parcel falls within a special purpose reserve listed in schedule 1 or has reserve status in the territory plan under the Planning Act 2023, s 385(d), because reserve status triggers the s 9-10 notification obligations and may affect licensability (s 5(1)-(2); schedule 1).
   • Consult the most recent amending instruments listed in the endnotes to confirm the current schedule and maps (endnotes 3-4).

2. For licence applications, compile prescribed suitability information about the person:

   • Provide evidence of qualifications, training, knowledge and experience directly relevant to the proposed activity, including CVs, certificates, training records, and references as needed (s 6(a)).
   • If the activity involves a specially protected or protected native species and the purpose is scientific research, supply documentation of association with relevant scientific research organisations, such as institutional affiliation or supervised project descriptions (s 6(b)(i)).
   • If the activity involves practising Aboriginal tradition, supply evidence of membership of the Aboriginal community in the ACT or surrounding region, as relevant (s 6(b)(ii)).

3. For licence applications, compile prescribed suitability information about the activity:

   • Where the activity might kill a native animal, detail the method of killing and carcass disposal arrangements (s 8(a)(i)-(ii)).
   • Where the activity involves taking a native animal, describe capture methods and minimisation of harm (s 8(b)).
   • Where keeping native animals is proposed, prepare facility plans, standard operating procedures for care, staffing qualifications, enrichment and welfare regimes, and biosecurity measures; expect conservator inspection (s 8(c) and note).
   • For sales of animals, declare whether animals were bred in captivity (s 8(d)).
   • For import/export of animals, specify transport methods and carriers (s 8(e)).
   • For release from captivity, document genetic characteristics and disease-free status, supported by testing where relevant (s 8(f)).
   • For archaeological investigations in wilderness areas, prepare a research plan specifying objectives and anticipated contribution to Aboriginal prehistory or Australian history (s 8(g)).
   • For scientific research purposes, provide full project details including methodology, ethics approvals and expected outputs (s 8(h)).

4. Avoid proposing activities that are unsuitable for licensing:

   • Review the list in s 7. Do not seek licences for activities that would amount to those criminalised by the Act, such as damaging native trees in wilderness areas, illegally taking fallen timber, making roads in wilderness areas, or using motor vehicles off-road in wilderness areas (s 7(a)-(g)).

5. Prepare to notify the conservator where required:

   • If a licence authorises clearing native vegetation or damaging land in a reserve, build into project timelines the requirement to tell the conservator before starting (ss 9-10). Because the regulation uses "before starting", allow sufficient lead time and document the notification with date/time stamps and copies of the materials supplied.

6. For public display of animals, obtain and comply with a risk management plan:

   • Before public display, submit a risk management plan for conservator approval and ensure operational compliance thereafter (s 11). Maintain change-control processes so the plan remains up to date and approvals are current.

7. Implement record-keeping systems that meet prescribed fields and retention:

   • For keeping animals (not fish), record total numbers, species, sex (except where sex cannot be ascertained without handling), acquisition details (supplier name, address, date), deaths or escapes (date, species, sex), and transfers (recipient name and address, date, species and sex) (s 12(2)-(3), (4)).
   • For live fish, record species of each fish, acquisitions (supplier name/address and date and species), transfers (recipient name/address, date, species), and exports (recipient name/address, date, species) (s 13(1)-(2)).
   • For sale or export of native plants, record recipient name/address, date of sale/export, species, and total number sold/exported (s 14(2)-(3)).
   • For sale or export of protected invertebrates, maintain equivalent recipient, date, species, and total counts (s 15(2)-(3)).
   • Ensure records are timestamped, securely stored, and retrievable for audit or enforcement. Implement privacy safeguards for personal data (names/addresses) to the standard required by privacy law, noting the regulation does not specify retention periods.

8. Train staff and contractors on procedural compliance:

   • Ensure personnel involved in operations, procurement, transfers, and record maintenance understand the regulatory fields and the treatment of "sell" as including "offer for sale" (s 14 note), so that advertising or online offers trigger record obligations.
   • Create checklists for pre-start notifications, conservator communications, and risk-plan compliance.

9. Coordinate with planning and other regulatory processes:

   • For works in or adjacent to a prescribed reserve, consult the Planning Act 2023 and territory plan to identify overlapping approvals, because reserve designation underlies the regulation’s application (s 5(2)).
   • Check for other applicable regimes (biosecurity, trade, animal welfare) that may require parallel compliance.

10. Maintain audit trail for conservator interactions:

    • Keep copies of suitability information submitted, correspondence with the conservator, notifications under ss 9-10, approved risk management plans, and records of inspections. These documents will be critical in the event of questions on compliance or administrative review.

By following these steps and referencing the specific statutory pillars listed in the regulation (ss 5-15 and schedule 1), applicants and licensees can structure administrative processes to meet the regulation’s requirements. Where the Act leaves discretion to the conservator, practitioners should document decisions and the factual bases for submissions to reduce administrative risk.
