sec.248 Unauthorised flying of aircraft or recreational craft

A person must not fly any type of aircraft or recreational craft over a protected area, or part of a protected area, stated in schedule 7 , part 1 , column 1 at a height less than the minimum height stated opposite the area or part in schedule 7 , part 1 , column 2. Maximum penalty—120 penalty units. Also, a person must not fly any type of aircraft or recreational craft over a protected area, or part of a protected area, stated in schedule 7 , part 2 , column 1 at a height less than the minimum height stated opposite the area or part in schedule 7 , part 2 , column 2 during the period stated opposite the area or part in schedule 7 , part 2 , column 3. Maximum penalty—120 penalty units. Subsections (1) and (2) do not apply to— an aircraft that is a drone; or See section 250 about the unauthorised possession and operation of drones. a person flying aircraft or recreational craft over a protected area, or part of a protected area, if the flying— is necessary for carrying out an emergency or rescue activity; or is authorised by the written approval of the chief executive. This section does not apply in relation to a special wildlife reserve or nature refuge. Maximum penalty—120 penalty units.
