sec.162 Chief executive may enter into agreement

The chief executive may, for the State, enter into an agreement (a commercial activity agreement ) with a person authorising the conduct of a commercial activity in a protected area, or part of a protected area, other than in a special wildlife reserve or nature refuge. The chief executive may enter into the commercial activity agreement in any of the following ways— by using an expression of interest process under part 2 ; by using an application process under part 3 ; by otherwise entering into the agreement with the holder of a commercial activity permit for the activity for the area. The commercial activity agreement may be combined with— a commercial activity agreement entered into by the person under the Marine Parks Regulation 2017 , section 52 ; or a commercial activity agreement entered into by the person under the Recreation Areas Management Act 2006 , section 69 . (sec.162-ssec.3) The commercial activity agreement may be combined with— a commercial activity agreement entered into by the person under the Marine Parks Regulation 2017 , section 52 ; or a commercial activity agreement entered into by the person under the Recreation Areas Management Act 2006 , section 69 .

• (a) by using an expression of interest process under part 2 ;
• (b) by using an application process under part 3 ;
• (c) by otherwise entering into the agreement with the holder of a commercial activity permit for the activity for the area.
