sec.155 Existing permit continues in effect until renewal request is decided
This section applies if— the holder of an existing permit makes a renewal request for the permit; and the renewal request has not been decided before the end of the term of the existing permit. The existing permit continues in effect from the day it would otherwise have ended until the day on which the earliest of the following happens— the renewal request is decided; the renewal request is withdrawn; the day that is 3 months after the day it would otherwise have ended. However, if the chief executive renews the existing permit, the new permit is taken to have had effect immediately after the existing permit would otherwise have ended. Subsection (2) does not stop the existing permit from being suspended or cancelled under this regulation. (sec.155-ssec.1) This section applies if— the holder of an existing permit makes a renewal request for the permit; and the renewal request has not been decided before the end of the term of the existing permit. (sec.155-ssec.2) The existing permit continues in effect from the day it would otherwise have ended until the day on which the earliest of the following happens— the renewal request is decided; the renewal request is withdrawn; the day that is 3 months after the day it would otherwise have ended. (sec.155-ssec.3) However, if the chief executive renews the existing permit, the new permit is taken to have had effect immediately after the existing permit would otherwise have ended. (sec.155-ssec.4) Subsection (2) does not stop the existing permit from being suspended or cancelled under this regulation.
- (a) the holder of an existing permit makes a renewal request for the permit; and
- (b) the renewal request has not been decided before the end of the term of the existing permit.
