sec.106 Definitions for part

In this part— associate , of a person whose suitability to hold a protected area authority is being considered, means— if the person is a corporation—each executive officer of the corporation; or if the person is an individual—another person who— is, or is intended to be, regularly or usually in charge of the individual’s activity or business, or proposed activity or business, that relates, or is intended to relate, to the authority; or regularly directs staff for the activity or business in their duties; or is, or is intended to be, in a position to control or substantially influence the activity or business, or proposed activity or business. relevant day , for a person, means— for deciding whether or not the person is a suitable person to hold a protected area authority—the day the person made the application for the authority under division 2 ; or for deciding whether or not the holder of a protected area authority is not, or is no longer, a suitable person to hold the authority—the day the decision is made.

• (a) if the person is a corporation—each executive officer of the corporation; or
• (b) if the person is an individual—another person who— (i) is, or is intended to be, regularly or usually in charge of the individual’s activity or business, or proposed activity or business, that relates, or is intended to relate, to the authority; or (ii) regularly directs staff for the activity or business in their duties; or (iii) is, or is intended to be, in a position to control or substantially influence the activity or business, or proposed activity or business.
• (i) is, or is intended to be, regularly or usually in charge of the individual’s activity or business, or proposed activity or business, that relates, or is intended to relate, to the authority; or
• (ii) regularly directs staff for the activity or business in their duties; or
• (iii) is, or is intended to be, in a position to control or substantially influence the activity or business, or proposed activity or business.
• (i) is, or is intended to be, regularly or usually in charge of the individual’s activity or business, or proposed activity or business, that relates, or is intended to relate, to the authority; or
• (ii) regularly directs staff for the activity or business in their duties; or
• (iii) is, or is intended to be, in a position to control or substantially influence the activity or business, or proposed activity or business.
• (a) for deciding whether or not the person is a suitable person to hold a protected area authority—the day the person made the application for the authority under division 2 ; or
• (b) for deciding whether or not the holder of a protected area authority is not, or is no longer, a suitable person to hold the authority—the day the decision is made.
