sec.74 Taking of plant during harvest period

This section applies if— the holder of a protected plant growing licence is authorised to take a particular authorised plant under the licence; and a harvest period is declared for the particular authorised plant. The holder, or a relevant person for the holder, may take the authorised plant under the licence only— during the harvest period; and by complying with the conditions stated in the harvest period notice for the harvest period. However, subsection (2) does not apply if— the authorised plant taken is a whole restricted plant; and the holder or relevant person takes the authorised plant under the licence by way of operational salvage. s 74 amd 2022 SL No. 166 s 32 (sec.74-ssec.1) This section applies if— the holder of a protected plant growing licence is authorised to take a particular authorised plant under the licence; and a harvest period is declared for the particular authorised plant. (sec.74-ssec.2) The holder, or a relevant person for the holder, may take the authorised plant under the licence only— during the harvest period; and by complying with the conditions stated in the harvest period notice for the harvest period. (sec.74-ssec.3) However, subsection (2) does not apply if— the authorised plant taken is a whole restricted plant; and the holder or relevant person takes the authorised plant under the licence by way of operational salvage.
