sec.363 Proceedings for recovery
This section applies in relation to a person who has not paid a fee. A proceeding may be started against the person, for the recovery of the fee, or part of the fee, whether or not— a prosecution has been started against the person for an offence relating to the failure to pay the fee; or the person has been convicted of an offence relating to the failure to pay the fee. (sec.363-ssec.1) This section applies in relation to a person who has not paid a fee. (sec.363-ssec.2) A proceeding may be started against the person, for the recovery of the fee, or part of the fee, whether or not— a prosecution has been started against the person for an offence relating to the failure to pay the fee; or the person has been convicted of an offence relating to the failure to pay the fee.
- (a) a prosecution has been started against the person for an offence relating to the failure to pay the fee; or
- (b) the person has been convicted of an offence relating to the failure to pay the fee.
