sec.348 Giving of return of operations
A person required to give a return of operations for an animal authority must, unless the person has a reasonable excuse, ensure a return of operations is given, in the approved form, to the chief executive— for each prescribed period for the authority; and within 10 business days after each prescribed period for the authority ends. Maximum penalty—120 penalty units. Subsection (1) applies even if no relevant event for the return of operations happened during the prescribed period. However, subsection (1) does not apply if a provision of a conservation plan— states when a return of operations must be given for an animal authority and the period for which it must be given; and provides for an offence applying to a person contravening the provision. See the Nature Conservation (Estuarine Crocodile) Conservation Plan 2018 for when a return of operations for a harvesting licence for estuarine crocodile eggs must be given and the period for which it must be given. See the Nature Conservation (Macropod) Conservation Plan 2017 for when a return of operations for particular animal authorities for macropods must be given and the period for which it must be given. A return of operations given to the chief executive under this regulation is the property of the State. In this section— prescribed period means— for a standard licence—each period of 1 year starting after the licence is granted or automatically issued; or for a specialised licence or an advanced licence—each period of 3 months starting after the licence is granted or automatically issued; or for a dealer licence, a farming licence, an educational purposes permit or a research permit— each period of 1 year starting after the licence or permit is granted; or if the licence or permit ends within a year mentioned in subparagraph (i) —the period starting on the day the year started and ending on the day the licence or permit ends; or for a harvesting licence, a damage mitigation permit, a flying-fox roost management permit or a least concern animal collection authority— each period of 3 months starting after the licence, permit or authority is granted; or if the licence, permit or authority ends within a 3-month period mentioned in subparagraph (i) —the period starting on the day the 3-month period started and ending on the day the licence, permit or authority ends; or for a permit to keep— if the holder of the permit is required to keep a record for the permit— each period of 1 year starting after the permit is granted; and if the permit ends within a year mentioned in sub-subparagraph (A)—the period starting on the day the year started and ending on the day the permit ends; or otherwise—each day an animal kept under the permit dies or escapes. relevant event , for a return of operations, means an event the particulars of which must be included in the return. s 348 amd 2025 SL No. 125 s 34 s ch 1 pt 1 (sec.348-ssec.1) A person required to give a return of operations for an animal authority must, unless the person has a reasonable excuse, ensure a return of operations is given, in the approved form, to the chief executive— for each prescribed period for the authority; and within 10 business days after each prescribed period for the authority ends.
