sec.312 Other aircraft
A person in control of an aircraft, other than a helicopter, must not, without a reasonable excuse— bring the aircraft closer to a marine mammal than the prescribed distance for the aircraft; or bring the aircraft to a position that would cause a moving marine mammal, if the mammal continued its direction of movement, to become closer to the aircraft than the prescribed distance for the aircraft. Maximum penalty— if the prescribed distance applies as a result of a marine mammal special management declaration—165 penalty units; or otherwise—120 penalty units.
