sec.238 Particular applications to be decided by chief executive
This section applies if— a person makes an application for a prescribed authority under section 235 ; and the authority cannot be issued to the person by the operation of the authority management system under section 236 . As soon as practicable after the application is made, the person must be given a notice, whether by the operation of the authority management system or in another way, stating— the prescribed authority cannot be automatically issued to the person; and the application must be decided under part 2 by the chief executive. Part 2 applies in relation to the application as if it were made— under section 239 to the chief executive for the grant of the prescribed authority; and on the day the notice was given to the person under subsection (2) . However, section 239 (2) does not apply in relation to the application. s 238 amd 2023 Act No. 23 s 247 sch 1 s 29 sub 2025 SL No. 125 s 10 (sec.238-ssec.1) This section applies if— a person makes an application for a prescribed authority under section 235 ; and the authority cannot be issued to the person by the operation of the authority management system under section 236 . (sec.238-ssec.2) As soon as practicable after the application is made, the person must be given a notice, whether by the operation of the authority management system or in another way, stating— the prescribed authority cannot be automatically issued to the person; and the application must be decided under part 2 by the chief executive. (sec.238-ssec.3) Part 2 applies in relation to the application as if it were made— under section 239 to the chief executive for the grant of the prescribed authority; and on the day the notice was given to the person under subsection (2) . (sec.238-ssec.4) However, section 239 (2) does not apply in relation to the application.
- (a) a person makes an application for a prescribed authority under section 235 ; and
- (b) the authority cannot be issued to the person by the operation of the authority management system under section 236 .
