This Bill creates and redefines several operational legal concepts. The following definitions and concept clarifications are grounded in the text.

• Standard application and standard conditions. The Bill repeatedly uses the term "standard application" and "standard conditions". The new deemed-approval mechanisms operate for "standard applications" and approvals are "subject to the standard conditions for the relevant activity" (EPA s 169A(2); s 170(2)). The Bill does not redefine "standard application" in the text provided; readers must rely on existing EPA definitions and administrative practice to identify which activities are treated as standard. The effect is that an application meeting the statutory label of "standard" draws a pre-set set of conditions which are imposed by operation of the Act (s 204(3) confirms the standard-condition status).

• Registered suitable operator. New section 169A makes automatic approval contingent on the applicant being a "registered suitable operator" or being granted registration at the time the applicant lodges an application under the registration pathway (s 169A(1)(b)(i)-(ii)). The term "registered suitable operator" appears in schedule 4 (definition amended in Schedule 1 item 11), which ties suitable-operator status to chapter 5A, part 4 rather than the previous cross reference. The Bill therefore privileges operator registration status as the gateway to automatic treatment.

• Administering authority and chief executive. The administering authority is the decision-maker for environmental authorities under the EPA. The chief executive is given explicit operational control over electronic systems: in the EPA, the chief executive must approve any electronic system intended to automatically issue an environmental authority for a s 169A standard application and must "take all reasonable steps" to ensure compliance (s 555(1)-(2)). The NCA mirrors this with new s 143BA(1)-(4) and provides that an authority automatically dealt with by an approved system is taken to have been dealt with by a decision of the chief executive (s 143BA(3)).

• Deemed decision / deemed dealt with. For mining-lease standard applications, if the administering authority fails to decide within the statutory decision window, the application is taken to be approved on standard conditions and the decision is taken to have been made on the last day of the period (EPA s 177(2)(a)-(b)). Similarly, under NCA s 143BA(3) an authority automatically dealt with by an approved system is taken to have been dealt with by a decision of the chief executive. The EPA also includes validation provisions that take prior automated approvals as decisions of the administering authority (s 824(2)(a)-(b)).

• Electronic system and automated system. The Bill uses "electronic system" and "automated system" as operational terms. An "automated system" is defined for the validation provision in EPA s 824(4) as an electronic system operated from time to time by a person performing a function under the Act for an administering authority. The NCA uses the term "automated system" to mean an electronic system operated by public service employees of the department (NCA s 220(5)). The EPA introduces an approval rule for automatic issuance systems (s 555(1)) and clarifies permitted electronic lodgement under s 553.

• Relevant authority / regulation authority. Under the NCA, a "relevant authority" means a licence, permit or other authority under the Act, with exceptions for those for which the chief executive cannot delegate (s 143B(3)(a)-(b)). The NCA also creates "regulation authority" as a licence, permit or other authority mentioned in a regulation made under the relevant Act (s 220(5)-(6)). Those terms are important because regulations may prescribe types of authorities that may or may not be automatically dealt with by electronic systems (s 143B(1)).

• Eligibility criteria. New EPA s 204(2) imposes a condition that the holder take "all reasonable steps" to ensure the activity complies with the eligibility criteria for the activity. The Bill does not itself redefine the eligibility criteria; they remain a matter of existing EPA definitions and administrative thresholds. The condition, however, is made statutory and is treated as a standard condition (s 204(3)).

• Validation and transitional concepts. EPA ss 824-825 and NCA ss 220-221 create statutory validations that treat past automated acts as if properly decided at the relevant time. "Relevant time" is defined contextually as the time the authority was purportedly issued or dealt with by the automated system (EPA s 824(4); NCA s 220(5)). These provisions also say things done or omitted that would have been valid had the acts been lawful are taken always to have been valid (EPA s 824(3); NCA s 220(4)).

• Interaction with infringement enforcement. EPA s 811 is amended so that a reference to a proceeding for an offence includes action by way of an infringement notice under the State Penalties Enforcement Act 1999 for a "relevant infringement notice offence provision" and provides that past actions taken under that scheme are taken to have always been valid (s 811(2A), (3A), and the new definition in s 811(4) insertion).

These core concepts structure how an application moves through the statutory process and how electronic and automated systems are authorised, operated and retrospectively validated.

The Bill touches several different groups and roles. The statutory text identifies who takes decisions, who may receive automatic approvals, and who must manage and validate automated systems. The following list sets out the affected actors and the provisions that change their legal positions.

• Applicants for environmental authorities. Persons and entities lodging "standard applications" are the primary cohort affected. If the applicant is a registered suitable operator, or if the applicant simultaneously applies for registration and receives notice of registration approval per the prescribed registration pathway, the applicant is taken to have had the standard application approved on the day the decision stage starts for a wide class of standard applications (EPA s 169A(1)-(2)). Applicants for mining-lease-related standard applications are affected by the mining-specific rules in s 170 and the deemed-decision mechanism in s 177.

• Registered suitable operators and registration applicants. Being a registered suitable operator is a gateway to automatic approval for standard applications under s 169A. The Bill amends the definition cross-reference for "registered suitable operator" into chapter 5A, part 4 (Schedule 1 item 11), so entities that either hold or seek registration under that chapter get privileged process treatment.

• Administering authority. The administering authority remains the statutory decision-maker for environmental authorities. The Bill imposes explicit duties on the administering authority, notably to issue an environmental authority or PRCP schedule within the period stated in section 196 after a decision is taken or taken to have been made (EPA s 195(2)). For mining-lease standard applications the administering authority must (absent a qualifying submission) decide for approval subject to standard conditions (s 170(2)).

• Chief executive. The Bill gives the chief executive gatekeeping and oversight roles for electronic systems that perform automatic dealing with authorities. In the EPA the chief executive must approve an electronic system before it may be used to automatically issue environmental authorities for standard applications mentioned in s 169A, and must take all reasonable steps to ensure operation complies with the Act (EPA s 555(1)-(2)). The NCA contains an analogous requirement and adds that a relevant authority automatically dealt with by an approved system is taken to have been dealt with by a decision of the chief executive (NCA s 143BA(1)-(3)).

• Public service employees / persons operating automated systems. The Bill recognises that electronic and automated systems may be operated by public service employees or persons performing functions for an administering authority (EPA s 824(4); NCA s 220(5)). Those operators and their employing agencies are implicated by the chief executive's supervisory duty and the obligation to keep systems compliant.

• Holders of environmental authorities. Once issued, environmental authorities for standard or variation applications include a statutory standard condition requiring the holder to "take all reasonable steps" to ensure the activity complies with eligibility criteria (EPA s 204(2)-(3)). Authority holders thus carry an ongoing compliance duty.

• Persons who made or received actions under past automated systems. The Bill validates past automated decisions and issuances made before commencement, treating them as ministerial or administrative decisions for continuity and compliance purposes (EPA ss 824-825; NCA ss 220-221). Those individuals and entities are affected by the retrospective legal treatment.

• Parties subject to infringement notices. EPA s 811 is amended to make clear that certain offence provisions can be the subject of infringement notices under the State Penalties Enforcement Act 1999, and that actions already taken under that Act are validated as if the new rule had always been in force (s 811(2A), (3A)).

• Persons seeking internal review. The NCA amends internal review procedures to limit the persons who may deal with an internal review application for a relevant authority taken to have been dealt with by an automatic system. For an original decision taken to be dealt with by the chief executive under s 143BA(3), an authorised person may deal with the internal review application; for other original decisions a reviewer must be a person who did not make the original decision and who holds a more senior office (s 143G(3)(a)-(b)).

Who pays and who decides. The text establishes who decides (administering authority and chief executive, depending on the legal act), and who bears operational costs. The Bill does not expressly impose new fee regimes or application charges, but it assigns costs of governance, approval and oversight of automated systems to the chief executive and operational costs of ensuring compliance to authority holders (EPA s 555(2); s 204(2)). Entities seeking automatic approval benefit procedurally from faster or deemed approvals, while administering agencies must manage oversight and issuance duties.

Who benefits and who bears risk. Applicants meeting the registration and standard-application criteria directly benefit from earlier or automatic approvals (EPA s 169A). The administering authority and the chief executive bear oversight and process risks associated with automated systems and with ensuring statutory compliance. Parties that relied on automated decisions prior to commencement receive legal certainty due to validation (EPA s 824; NCA s 220).

The Bill alters the statutory duties of decision-makers, the rights and legal status of automated decisions, and the compliance obligations of authority holders. The following are the principal duties and rights created or modified by the text, with section references.

Duties on the administering authority and chief executive

• Approve and issue, and meet statutory timeframes. When the administering authority is taken to have decided to approve a standard application under s 169A, or actually decides to approve an application under the Act, it must issue an environmental authority or draft PRCP schedule within the period stated in s 196 (EPA s 195(2)(a)-(b)). That issuing duty applies both to decisions taken by the authority and to certain decisions taken to have been made by operation of the Act.

• Decide mining-lease standard applications. For standard applications relating to mining leases, the administering authority must decide to approve the application subject to standard conditions (EPA s 170(2)). The authority may deviate only to the limited extent in s 170(3), which requires a properly made submission that relates to the subject of the standard condition and permits departures only in relation to that subject.

• Oversight of electronic systems. The chief executive must approve the use of any electronic system intended to automatically issue environmental authorities for standard applications mentioned in s 169A before it is used for that purpose (EPA s 555(1); NCA s 143BA(1)). The chief executive must take all reasonable steps to ensure the approved system operates and continues to operate in compliance with the Act (EPA s 555(2); NCA s 143BA(2)). The approval requirement applies whether the system is to issue, grant, amend, cancel or renew relevant authorities as prescribed by regulation (NCA s 143B(1)-(3)).

• Record-keeping and reasonable steps. While the Bill does not specify details of record-keeping, it makes clear that the chief executive's duty extends to taking all reasonable steps to maintain compliance. Where systems have been approved before commencement, the Bill treats them as continuing approvals until the chief executive cancels them (EPA s 825(2); NCA s 221(2)).

Duties on applicants and authority holders

• Eligibility and reasonable steps. Any environmental authority or draft environmental authority issued for a standard or variation application is taken to include a condition requiring the holder to "take all reasonable steps" to ensure the activity complies with the eligibility criteria for the activity (EPA s 204(2)). That condition is a standard condition (s 204(3)). The Bill therefore imposes an ongoing, statutory compliance obligation on holders of such authorities.

• Registration gating. Applicants who wish to benefit from automatic-approval pathways must be a registered suitable operator or have a contemporaneous application and approval for such registration under the specified registration pathways (EPA s 169A(1)(b)(i)-(ii)). The Bill moves the cross-reference for the definition into chapter 5A, part 4 (Schedule 1 item 11), reinforcing registration as the administrative gate.

Rights and procedural mechanisms

• Right to make submissions. The statute preserves the right for interested persons to make properly made submissions. For mining-lease standard applications, a properly made submission that specifically addresses the subject of a standard condition can support a decision to vary that standard condition under s 170(3). The Bill does not otherwise remove existing rights to make submissions; it constrains the circumstances in which submissions can alter standard conditions for mining leases.

• Deemed decisions and legal status of automated acts. Where the administering authority fails to decide within the statutory period for a mining-lease standard application, the application is taken to have been approved on standard conditions and the decision is taken to have been made on the last day of the period (EPA s 177(2)(a)-(b)). Under NCA s 143BA(3), a relevant authority automatically dealt with by an approved electronic system is taken to have been dealt with by a decision of the chief executive. The validation provisions treat prior automated issuances as if they were lawfully made decisions at the relevant time (EPA s 824(2)(a)-(b); NCA s 220(2)).

• Internal review rules. The NCA modifies who may deal with internal review applications. For original decisions about relevant authorities taken to be dealt with by a decision of the chief executive under s 143BA(3), an authorised person may handle the internal review; for other decisions, a reviewer must be a person who did not make the original decision and who holds a more senior office (NCA s 143G(3)(a)-(b)). This structures review capacity relative to automated or deemed decisions.

Interaction with infringement enforcement

• Infringement notices for specified provisions. EPA s 811 is amended so that references to proceedings for offences include, for certain "relevant infringement notice offence provisions," action by way of an infringement notice under the State Penalties Enforcement Act 1999, and provides transitional validation for actions under that scheme taken before the amendment (s 811(2A), (3A)). The new definition links which offence provisions are covered to the State Penalties Enforcement Regulation 2014 schedule references as they stood immediately before the commencement (s 811(4) insertion).

Overall the Bill reallocates certain procedural and compliance duties between applicants, administering authorities and the chief executive, converts some discretionary acts into statutory or deemed outcomes in specified circumstances, and integrates electronic systems into the statutory decision-making framework with express approval and oversight duties for the chief executive.

The Bill does not create new penalty categories in the text supplied, but it alters enforcement mechanics and the practical legal effects of administrative acts. The following points describe the enforcement-related mechanisms and their statutory bases.

Infringement notices, validated and made explicit

• EPA s 811 is amended to treat proceedings for particular offences as including infringement notice action under the State Penalties Enforcement Act 1999 for offences that are "relevant infringement notice offence provisions" (s 811(2A)). The insertion defines a "relevant infringement notice offence provision" by reference to offences that, immediately before commencement of the amending Act, were mentioned in the State Penalties Enforcement Regulation 2014, schedule 1 entry for the EPA (s 811(4) insertion). This ties the scope of infringement-notice enforcement to the regulatory schedule in force at that earlier time. The amendment further validates any action already taken under the State Penalties Enforcement Act 1999 before the new subsection commenced, by treating that action as always having been valid (s 811(3A)).

Administrative enforcement via authorities

• Issuance and cancellation processes. The Bill clarifies issuing duties and timing. Once a decision is made or taken to be made, the administering authority must issue the environmental authority to the applicant within the period stated in s 196 (EPA s 195(2)). While the Bill replaces the heading for termination rules and revises cancellation references in schedule 1 (Schedule 1 items 10 and others), it does not alter the substantive sanctions framework contained elsewhere in the EPA. The practical enforcement effect is that prompt issuance of authorities must follow from approvals or deemed approvals, and any delay may accordingly have procedural implications.

Ongoing compliance conditions and scope for compliance enforcement

• Standard condition requiring reasonable steps. Every environmental authority or draft environmental authority issued for a standard or variation application is taken to include a condition requiring the holder to take all reasonable steps to ensure the activity complies with eligibility criteria (EPA s 204(2)-(3)). This creates an express statutory compliance duty whose breach may be enforced through the Act's usual compliance and enforcement mechanisms. The Bill does not specify the enforcement steps in relation to this condition, but it creates a discrete, readily-identifiable standard-condition obligation.

Legal status of automated decisions and enforcement consequences

• Automatic and deemed decisions treated as decisions. The Bill's validation provisions treat authorities purportedly issued by automated systems before commencement as having been issued by the administering authority at the relevant time (EPA s 824(2)(b), NCA s 220(2)). Under NCA s 143BA(3), an authority automatically dealt with by an approved system is taken to have been dealt with by a decision of the chief executive. These provisions change enforcement posture by conferring a clear legal character on automated acts: they are decisions for the purposes of administrative law and enforcement, not merely machine outputs without legal effect.

Internal review and procedural avenues

• Limits on who can deal with internal review. The NCA amends s 143G to limit which officers can deal with applications for internal review depending on whether an original decision is one taken to be a decision of the chief executive under s 143BA(3) or another original decision. For decisions taken to be those of the chief executive, an "authorised person" can deal with the review; for other decisions, only a person who did not make the original decision and who holds a more senior office may (NCA s 143G(3)(a)-(b)). This exercises administrative control over the composition of reviewers and could affect internal review outcomes and timelines.

Interaction with other enforcement schemes

• Preservation of interpretative and criminal-law principles. The amendments to s 811 explicitly state the new paragraphs do not limit the Acts Interpretation Act 1954, section 20, and apply despite the Criminal Code, section 11 (EPA s 811(3)). This preserves established interpretative and criminal-law doctrines while expanding the route of enforcement for selected offences to infringement notices.

What the Bill does not change in enforcement

• It does not itself add new offence provisions or alter penalty levels in the text supplied. It reallocates how some offences are processed (infringement notices) and creates enforceable statutory conditions on environmental authorities. The Bill also does not alter judicial review rights explicitly, but it affects procedural starting points and the legal character of decisions for review purposes by treating automated decisions as decisions of the administering authority or chief executive (EPA s 824(2); NCA s 143BA(3)).

Overall the Bill centralises the legal status of automated administrative acts, expands the route of infringement notice enforcement for certain EPA offences, and imposes an explicit compliance duty on holders of standard-authority approvals. Enforcement mechanisms remain those established in the principal Acts and supporting regulations, but the procedural locus and timing of enforcement-relevant decisions are recalibrated by these amendments.

The Bill explicitly links to, relies upon and modifies the operation of other statutory instruments and existing statutory frameworks. The key interactions are with the State Penalties Enforcement Act 1999 and its regulations, existing EPA and NCA provisions on delegation and prescribed provisions, and the internal administrative law framework within the Acts.

Interaction with State Penalties Enforcement Act 1999 and its regulation

• EPA s 811 amendments integrate the State Penalties Enforcement regime into the EPA enforcement architecture for selected offences. A reference to "a proceeding for the offence" now includes, for an offence against a "relevant infringement notice offence provision," action by way of an infringement notice under the State Penalties Enforcement Act 1999 (EPA s 811(2A)). The Bill specifies that the State Penalties Enforcement Regulation 2014 applies as if it had not been amended by the amending Act when used for that purpose. The new definition of "relevant infringement notice offence provision" links the provision to the State Penalties Enforcement Regulation 2014, schedule 1 entry for the EPA as it stood immediately before the commencement (EPA s 811(4) insertion). Thus, the Bill incorporates existing infringement notice regime mechanics by cross-reference rather than rewriting them.

Delegation and prescribed provisions framework

• The NCA's new section 143B authorises regulation to prescribe types of relevant authorities that may be automatically issued, amended, cancelled or renewed by operation of an electronic system (NCA s 143B(1)(a)-(c)). That power is constrained by subsection (2), which allows the Minister to recommend the making of a regulation under subsection (1) only if the Minister is satisfied that prescribing the matter would not have a detrimental effect on achieving the object of the Act (NCA s 143B(2)). The NCA also defines "relevant authority" to exclude a licence, permit or other authority that is the subject of a prescribed provision for which the chief executive may not delegate powers under s 141(2) (NCA s 143B(3)(b)). Those references mean the Bill interacts with existing delegation limits and policy objectives in the framework of the principal Act.

• The EPA equivalents are similar in spirit: the chief executive must approve an electronic system before it automatically issues environmental authorities for specified standard applications (EPA s 555(1)) and must take all reasonable steps to ensure the system operates in compliance with the EPA (s 555(2)). The validation provisions in both Acts take past automated acts performed under previous approvals and treat them as if made under the new approval scheme (EPA s 825; NCA s 221).

Interaction with administrative law and decision-review pathways

• By treating automated issuance as a decision of the administering authority or the chief executive (EPA s 824(2); NCA s 143BA(3)), the Bill places automated acts within the ordinary administrative law framework for judicial review and internal review. The NCA clarifies internal review handling by specifying who may deal with certain internal review applications (NCA s 143G(3)). That amendment interacts with the Acts' existing internal review and external review pathways. The Bill does not remove judicial review rights in the text provided, but the starting point for review will be the statutory characterisation of an automated act as a decision.

Validation provisions and other Acts

• The Bill contains validation provisions that treat acts done or omitted under automated systems as having always been valid and lawful as if they were decisions of the administering authority or chief executive (EPA s 824(3); NCA s 220(4)). Those provisions state that anything done or omitted to be done that would have been valid had the decision been lawfully made is taken to have been valid. That interacts with other legislation insofar as subsequent reliance upon those earlier acts by third parties is now supported by express statutory validation.

Regulatory instruments and statutory cross-references

• Several provisions refer to regulations and to other statutory provisions. For example, the definition in EPA s 811(4) ties which infringement notice provisions are covered to the State Penalties Enforcement Regulation as it existed immediately before the amending Act. The NCA's regulation power to prescribe relevant authorities that may be automatically dealt with (NCA s 143B(1)) implicates future subordinate instruments. Schedule 1 amends several headings and cross-references within the EPA (Schedule 1 items 1-11), which may affect interpretative reading of the EPA.

Preservation of interpretative and criminal-law doctrines

• EPA s 811(3) provides that subsections (2) and (2A) do not limit the Acts Interpretation Act 1954, section 20, and apply despite the Criminal Code, section 11. That preserves general interpretative principles and the Criminal Code's territorial application rule where relevant.

In short, the Bill integrates automated decision-making into the administrative and enforcement fabric by cross-referencing existing enforcement schemes, embedding approvals and oversight into chief-executive duties, preserving delegation boundaries, and validating prior automated acts so other statutes and private parties can rely upon them as lawful decisions.

The Bill itself sets out commencement dates and which provisions take effect when. The text does not record legislative history prior to this Bill, and so amendment history here refers only to the internal sequencing and the Bill's staged commencement structure and the specific insertions and replacements enacted.

Commencement structure

• Section 2 sets out the commencement dates. It specifies that part 2, division 3 (which includes the automatic approval provisions for standard applications, e.g. s 169A and related provisions), part 3 (the Nature Conservation Act amendments), and schedule 1 commence on the day that is 28 days after the date of assent (s 2). Division 2 of part 2 (which contains certain amendments such as the s 811 amendment regarding infringement notices) is set out to commence on assent; the Bill labels that "Division 2 Amendments commencing on assent" in the Part 2 table of contents (pp 4-5). The Bill therefore phases in its measures: some come into force immediately on assent, others after the 28-day delay.

Inserted, replaced and amended provisions

• EPA insertions and replacements. The Bill inserts new subdivision 1A into chapter 5, part 5, division 2 of the EPA (s 5 inserts subdivision 1A, including s 169A). It replaces existing sections 170, 177, 195 and 204 with new text (ss 6-9). It amends s 553 to expand lodging by electronic system (s 10), and inserts a new s 555 to regulate electronic systems for automatic issuance (s 11). It also inserts a new chapter 13, part 34 containing validation and transitional rules ss 824-825 (s 12). Schedule 1 contains other amendments to EPA text such as heading changes, cross-reference updates and textual substitutions (Schedule 1 items 1-11).

• NCA replacements and insertions. Part 3 replaces NCA s 143B with a new provision authorising regulations to prescribe authorities that may be automatically dealt with (s 16). It inserts a new s 143BA establishing the chief executive approval requirement and confirming that automatically dealt-with authorities are taken to be decisions of the chief executive (s 16). It amends s 143A to clarify that the false or misleading document offence applies to documents given by any means including electronic systems (s 15). Section 143G (internal review) is amended to clarify who may deal with reviews where the original decision is one taken to be the decision of the chief executive (s 17). The Bill also inserts new part 12, division 9 into the NCA containing validation and transitional provisions (NCA ss 220-221) (s 18).

Validation and transitional provisions

• EPA s 824 validates environmental authorities purportedly issued by automated systems before commencement, taking the applications to have been approved and the authorities to have been issued by decisions of the administering authority and treating acts done in reliance as always lawful (s 824(1)-(3)). Section 825 takes pre-commencement chief executive approvals for electronic systems to be approvals under new s 555(1) until the chief executive cancels such approval (s 825(1)-(2)). NCA ss 220-221 perform equivalent validation and transitional roles for "regulation authorities" and pre-commencement approvals.

Consequential amendments

• Schedule 1 contains a number of textual changes to the EPA that reflect the insertion, replacement and reclassification work done by the Bill. Those include changing subdivision headings, replacing "automatic" with "deemed" in headings, adjusting cross-references to s 170(3), amending the wording of procedural timeframe references to include "or taken to be made" (s 196(e) change), replacing "given" with "issued" in s 203(3), and changing the cross-reference for "registered suitable operator" from s 318I(1)(b) to chapter 5A, part 4 (Schedule 1 items 1-11).

What the Bill does not record

• The Bill text does not contain legislative history prior to these amendments, no previous amending Acts are recited, and there are no policy memoranda or reasons included in the text supplied. The only explicit timing and sequencing information is the commencement schedule in s 2 and the internal "commencing on assent" versus "commencing 28 days after assent" divisions indicated in part 2.

Readers who require a fuller amendment pedigree or policy exposé must consult parliamentary papers, second-reading speeches or explanatory memoranda that are not contained in the Bill text supplied. The Bill's own amendment history is therefore limited to the structural changes and commencement timetable it creates.

The Bill text contains no reported cases, judicial decisions, or prior litigation history. It does not cite any judicial authority or past litigation that prompted or shaped the drafting. Accordingly, there is no litigation history recorded within the Bill to summarise.

The statute's mechanics, however, create clear legal questions and procedural contours that are likely to be litigated once the provisions operate in practice. The Bill itself affects litigation-related variables in ways that bear scrutiny, with references and provisions that may become the focus of litigation:

• Deemed decisions and review periods. The EPA's new deemed-decision rule for mining-lease standard applications states that if the administering authority does not decide within the period required under subdivision 1, the authority is taken to have decided to approve the application on the standard conditions and that the decision is taken to have been made on the last day of the period (EPA s 177(2)(a)-(b)). That statutory characterisation will determine when limitation periods for judicial review begin to run and whether applicants, submitters or third parties have standing to challenge administrative inaction or the content of a deemed approval. The Bill does not vary judicial-review rights in the text supplied, but the timing and identification of decisions will be dispositive in litigation about timeliness and remedies.

• Legal status of automated acts. Both the EPA and the NCA contain validation provisions treating automated acts done before commencement as decisions made by the administering authority or chief executive (EPA s 824(2)(a)-(b); NCA s 220(2)). Those retrospective validations could be litigated where third parties allege procedural unfairness or failure of statutory consideration prior to the automated act. The validation sections answer some of those questions by taking matters required to have been considered by the chief executive as taken to have been considered at the relevant time (NCA s 220(3)). Whether that statutory deeming will be challenged for jurisdictional error or other judicially reviewable grounds will be a matter for courts.

• Internal review composition and process. The NCA limits who may deal with internal reviews in respect of decisions taken to be those of the chief executive under the new automatic-dealing scheme (NCA s 143G(3)). Whether that constrains merits-review rights or procedural fairness in particular cases may be litigated if aggrieved persons contend that the internal-review composition produced a bias or was insufficiently independent.

• Infringement notice validation and criminal procedure interactions. EPA s 811 inserts references to infringement notice enforcement for certain offence provisions and validates actions already taken under the State Penalties Enforcement Act 1999 prior to the amendment (s 811(3A)). Litigation could arise if affected parties challenge the retrospective application of enforcement steps or argue that procedural protections were insufficient for enforcement actions taken earlier.

• Standard condition obligations. The statutory condition requiring holders to take all reasonable steps to ensure compliance with eligibility criteria (EPA s 204(2)) creates a compliance standard that could be the subject of enforcement proceedings or civil litigation where compliance is contested. Courts may be asked to interpret what "all reasonable steps" requires in particular contexts.

Because the Bill formalises automated decision-making and gives it the statutory character of a decision of an administering authority or the chief executive, future litigation is more likely to focus on the content of decision-making, the adequacy of procedures, the sufficiency of the chief executive's oversight of electronic systems, and the proper construction of the validation provisions. The Bill does not itself provide litigation outcomes or examples; those will arise once the provisions are operational and tested in administrative and judicial contexts.

The Bill contains several technical and procedural features that create important operational and legal consequences. These are not interpretations of policy but direct consequences of the statutory wording that practitioners and administrators should note.

Timing of deemed approvals and the decision stage start

• EPA s 169A(2) takes a standard application to have been decided and approved "on the day the decision stage starts" when the applicant is a registered suitable operator or has an approved simultaneous registration. Practitioners should note that the trigger is the "decision stage starts", not the day of lodgement or the day of issuance. The Bill does not define "decision stage" within the inserted subsection, so reliance must be placed on existing EPA procedure definitions and the administrative record to identify that day. The consequence is that the timing for rights to object, seek review, or measure statutory periods may hinge on administrative definitions and records of when the decision stage began. There is potential for disputes about the correct starting moment.

Limited scope for varying standard conditions for mining leases

• For mining-lease standard applications, s 170(3) permits deviation from standard conditions only if a properly made submission was made "relating to the subject of a standard condition" and any differing conditions relate only to that subject. That is a narrow exception. Applicants and submitters should be aware that broad or general submissions are unlikely to support an alteration of standard conditions; submissions must specifically address the subject matter of a condition to be effective.

Obligation to "take all reasonable steps" is open-textured

• EPA s 204(2) imposes a standard condition that the holder must take "all reasonable steps" to ensure the activity complies with eligibility criteria. That phrase is deliberately open-textured and will be interpreted in context. It creates a compliance obligation whose contours will be shaped by administrative guidance and potentially by court interpretation. Holders should document steps taken and be ready to justify their reasonableness.

Automated system approval and supervisory obligations

• Chief executive approval is required before an electronic system may be used to automatically issue environmental authorities for specified applications (EPA s 555(1); NCA s 143BA(1)). The chief executive must "take all reasonable steps" to ensure continued compliance (EPA s 555(2); NCA s 143BA(2)). The "take all reasonable steps" duty is a positive operational obligation. Agencies using automated systems will need operational controls, audits, and ongoing reviews to show compliance with the statutory duty. Where pre-commencement approvals existed, the Bill deems them to be approvals under the new scheme until cancelled (EPA s 825(2); NCA s 221(2)). Practitioners should note that a system that was previously running without robust controls is now expressly governed by this statutory duty.

Validation provisions and retrospective effect

• EPA s 824 and NCA s 220 validate prior automated acts and take them to have been lawfully done by the administering authority or chief executive. While this protects third parties and cleans up past automated outputs, it also makes it harder to challenge prior automated acts on the basis that they were not decisions. Moreover, those provisions take matters that "would have been valid and lawful" as always having been valid, which may preclude relief in some circumstances. Parties affected by prior automated decisions should examine the validation wording closely and consider how it alters possible remedies.

Infringement notices and the regulatory schedule link

• EPA s 811(2A) and the new definition of "relevant infringement notice offence provision" link infringement-notice applicability to how the State Penalties Enforcement Regulation 2014, schedule 1 mentioned the EPA immediately before the amending Act. That means the scope of infringement notices is tied to prior regulatory listings and may not align with current regulatory practice unless regulations are updated. Practitioners should check the relevant schedule entries as they stood immediately before the Bill's commencement to identify which offences are affected.

Internal review handling

• The NCA amends s 143G so that an authorised person may deal with internal reviews for original decisions about relevant authorities taken to be decisions of the chief executive under s 143BA(3). For other original decisions, the internal reviewer must be someone who did not make the original decision and who holds a more senior office (NCA s 143G(3)). That shapes who can be asked to conduct internal review and may produce unexpected internal-review routes for decisions arising from automated systems.

Cross-reference and drafting changes may alter operational reading

• Schedule 1 contains a number of consequential changes affecting headings, cross-references and wording (e.g. "given" replaced by "issued", "automatic" replaced by "deemed" in headings, cross-reference modification for registered suitable operator). Even where these appear purely editorial, they can change the interpretative frame for users and administrators. For example, the change in s 196(e) to include "or taken to be made" broadens the events covered by the issuance timing rule (Schedule 1 item 8).

No fees or formal procedural guidance inserted

• The Bill does not set out fees, forms beyond the existing "approved form" cross-references, or technical standards for electronic systems. The legal permission to operate automated systems and the chief executive's duty to take reasonable steps to ensure compliance will require practical subordinate instruments and administrative practice to be meaningful. Until those are issued, agencies and regulated parties face operational uncertainty.

In short, the Bill changes the legal character and timing of many administrative acts, embeds chief-executive oversight of automated systems with a statutory "reasonable steps" duty, and validates prior automated actions. Each of those changes creates operational and legal points that require attention to administrative records, regulatory schedules, and internal controls.

This section sets out concrete compliance steps and operational controls that flow directly from the Bill's provisions. It is framed to help applicants, authority holders, administering agencies and IT/system operators take measures that align with statutory duties and minimise legal risk. Each step references the relevant textual provision.

For applicants (standard applications and mining-lease applicants)

• Confirm whether the application is a "standard application" within the EPA framework and whether the activity is excluded from the automatic-approval rule (EPA s 169A(1) excludes mining-lease standard applications from that provision). For mining-lease applications, treat s 170 as the operative decision rule.

• If seeking automatic approval under s 169A, either hold registered suitable operator status or ensure registration is applied for simultaneously under the registration pathway and that the applicant receives notice under the registration process confirming approval per s 169A(1)(b)(ii). Keep contemporaneous records of the registration notice referenced in s 169A(1)(b)(ii).

• For mining-lease standard applications, lodge any submissions that seek to alter standard conditions in a targeted way. s 170(3) permits differing conditions only when there was a "properly made submission" relating to the subject of the standard condition, and only to the extent of that subject. Draft submissions to specifically address the subject matter of the standard condition you want varied.

• Maintain evidence showing when the "decision stage" starts, because s 169A(2) deems approval on that day. Agree documentable administrative markers with the administering authority if possible, and preserve timestamps and system logs.

For authority holders and operators

• Implement compliance programs that document the "reasonable steps" taken to ensure eligibility-criteria compliance (EPA s 204(2)). The phrase is open-textured; record staff duties, training, monitoring activities, audits, and corrective actions. Use decision logs, monitoring instrumentation, sampling results, corrective action reports, staff training logs and procedures manuals as evidence of having taken reasonable steps.

• If a holder receives an environmental authority that was issued automatically or deemed issued, treat it as a decision for administrative purposes and follow its conditions. The Bill takes such issuances to be decisions of the administering authority or chief executive (EPA s 824(2); NCA s 143BA(3)).

For administering authorities and the chief executive

• Before deploying an electronic system to automatically issue environmental authorities for standard applications, obtain express approval from the chief executive as required by EPA s 555(1) or, in the NCA context, ensure a chief-executive approval under s 143BA(1) exists. Maintain documentation of the approval decision and the scope of the approval.

• Establish and operate governance controls so the chief executive can "take all reasonable steps" to ensure the approved electronic system operates and continues to operate in compliance with the Act (EPA s 555(2); NCA s 143BA(2)). "Reasonable steps" should encompass periodic audits, monitoring of error rates, exception handling and manual override protocols, security and authentication, staff training, change-control procedures, backup and recovery, and a maintenance schedule. Where systems were approved prior to commencement and are taken to be approved under the new provision, assess those systems against the new governance expectations and remediate gaps promptly (EPA s 825(2
