What it does
These regulations adapt how section 164N of the Natural Resources Management Act 2004 applies to a class of users called "secondary existing users" in specified parts of the Mount Lofty Ranges. The instrument is short. It gives the short title (regulation 1), sets commencement at 31 January 2013 (regulation 2) and, most substantively, declares that for the purposes of section 232(1)(b) of the Act, section 164N applies to secondary existing users with a set of specified variations (regulation 3(1) and (2)). The variations treat a secondary existing user as if they were an existing user for the purposes of section 164N, but alter timing references, insert a new Ministerial discretion to grant a lesser water access entitlement, modify the effect of subsection references, and make a late-application consequence explicit (reg 3(1)(a) to (g)).
Mechanically, the regulations do the following. They substitute the phrase "secondary existing user" into references to "existing user" in section 164N (reg 3(1)(a)). They replace the section 164N(1)(a) time reference so that the 6 month application window runs from the commencement of these regulations, rather than from the Gazette publication of the prescribed resource regulation (reg 3(1)(b)). They expand the subsection cross-reference in section 164N(1)(b) to include a newly inserted subsection (2a) (reg 3(1)(c) and (f)). They alter the water access entitlement wording so that subsection (2) is subject to the substitute subsection (2a) (reg 3(1)(d)). They insert subsection (2a) expressly giving the Minister power to grant a lesser entitlement to secondary existing users, and specify three potential grounds for a lesser grant: the activities conducted on the land at application time, that future requirements relate to land that has been divided and the application relates only to a portion, or any other ground the Minister thinks fit (reg 3(1)(e)). They also vary the application of section 164N(11) so a person ceases to be a secondary existing user if they do not make the necessary applications under section 164N(1) within six months after commencement of these regulations (reg 3(1)(g)). In addition, the regulations treat successors in title to such users as secondary existing users, with textual substitutions ensuring that a successor’s entitlement is calibrated to the reasonable requirements of the original secondary existing user (reg 3(2) and (4)). Definitions of "designated area" and "secondary existing user" are provided in reg 3(3) and (4).
