Natural Resources Management (Central Adelaide—Prescribed Wells Area) Regulations 2007

Prescribed wells. Under regulation 4, wells situated in the Central Adelaide Prescribed Wells Area (including those drilled after the regulations commenced) are “prescribed wells”. That status is the trigger for the application of parts of the Act dealing with water management authorisations, and it defines the scope of the transitional regime. The area itself is defined by reference to a deposited plan (GRO Plan No 327/2005), as varied by a 2007 amendment.

Establishment period and prescribed period. The establishment period (1 July 2002 to 1 December 2005) is the timeframe during which water use could be established for purposes of determining “future requirements” under the modified allocation provisions. It is not a period in which free taking is allowed; rather, it sets the historical baseline. The prescribed period (1 December 2005 to the third anniversary of the regulation’s commencement, i.e., approximately June 2010) is the period during which section 124(4) operates without exclusion. That subsection likely allowed ongoing use without immediate authorisation, smoothing the transition from unregulated to regulated status. The dates matter for determining who qualifies as an eligible applicant and what water use history can be relied upon.

Eligible applicant. This is the central legal category created by regulation 7(10). It comprises two types of persons: (a) someone who would have been an “existing user” under section 164N(10) of the unmodified Act but for the operation of section 164N(11) - a provision that apparently disqualified certain users from being recognised as existing users; and (b) a person who satisfies the Minister that they are a successor in title to the land or interest in land of a person in category (a). Importantly, a person ceases to be an eligible applicant if they do not make the necessary application before the expiration of the prescribed CAPWA extended application period. The definition excludes anyone whose application for a water management authorisation in the area has already been refused under the unmodified Act.

Prescribed CAPWA extended application period. This period is defined in regulation 7(10) as either (a) the period of six months commencing on the commencement of the 2017 variation regulation (which was 1 December 2017) or (b) a longer period if the Minister determines that exceptional circumstances exist in a particular case. This is a strict deadline: failure to apply within that window disqualifies the applicant permanently. The period has already expired (as of mid 2018), so the only remaining possibility is an individual extension for exceptional circumstances, a matter entirely within the Minister‘s discretion.

Water access entitlement. Under the modified section 164N(2), the entitlement is defined as a share of a consumptive pool that, in the Minister’s opinion, will meet any one or more of the applicant’s future requirements. Those future requirements are based on (a) reasonable requirements during the establishment period, (b) requirements for a development, project or undertaking to which the applicant was legally committed or had committed significant financial resources during the establishment period, or (c) in the case of successors, the predecessor’s commitments. The entitlement is not a simple historical grandparenting; it is an opinion based assessment by the Minister, subject to discretionary reduction.

Unmodified Act. This term in the regulations means the Natural Resources Management Act 2004 without the modifications made by the 2017 variation to section 164N. It is used to define who would have qualified as an existing user under the standard rules, and to preserve the effect of certain provisions (such as the ability to allocate excess water under the ordinary water allocation plan).

The regulations directly affect a relatively narrow and historically defined group: persons who used water from prescribed wells in the Central Adelaide area during the establishment period (2002-2005) but who were not recognised as “existing users” under the standard allocation process due to the operation of section 164N(11) of the Act. This group may include agricultural, commercial or industrial water users whose use was overlooked or deemed ineligible at the time the area was prescribed. Their successors in title are also affected, as they can step into the eligibility if they can prove the chain of title.

Beyond the direct beneficiaries, the regulations affect every other water user in the Central Adelaide Prescribed Wells Area. Because the Minister may proportionally reduce all entitlements if the aggregate of granted entitlements exceeds the resource‘s capacity (regulation 7(3)), existing authorisation holders face the risk that their share of the consumptive pool will be cut to accommodate the newly recognised eligible applicants. That risk is not hypothetical: it depends on the Minister’s assessment of the resource’s capacity, which must include an evaluation of ecosystem needs. The consultative process under the Minister‘s duty to prepare a public report on ecosystem water needs will affect all stakeholders.

The Minister and the Department for Environment and Water (or its equivalent) are the primary administrators. They must assess applications, determine future requirements, consider reductions, prepare reports, and defend decisions in the ERD Court. The regulations impose no compliance burden on persons outside the Central Adelaide area, but for those within it, the main burden falls on the eligible applicants who had to assemble evidence of water use from over a decade ago to meet the Minister’s assessment criteria.

Finally, the regulations indirectly affect prospective buyers of land in the area. Because water entitlements under this scheme are non transferable except via succession, and because the extended application period has largely expired, any person acquiring land in the Central Adelaide Prescribed Wells Area cannot rely on these transitional provisions to obtain a water right. They must instead apply under the normal Act provisions, which may involve purchase or a competitive allocation process. This reduces the attractiveness of land that depends on water from prescribed wells, potentially lowering its market value.

The primary right created by these regulations is the right of an eligible applicant to apply for and be granted a water management authorisation without paying a purchase price. That right is conditional on making the application within the prescribed CAPWA extended application period (or a Minister granted extension). The authorisation itself is not automatic: the Minister determines the water access entitlement after consulting the applicant. The applicant has the right to be consulted and to have their future requirements considered under the criteria in regulation 7(2).

The eligible applicant also has the right to appeal any determination or decision of the Minister under subsections (1), (2) or (2a) of the modified section 164N to the ERD Court. This includes the decision to grant or refuse the application, the amount of the entitlement determined, or the decision to grant a lesser entitlement under the Minister‘s discretionary grounds. Notably, the Minister’s decisions under subsection (3) (proportional reduction due to resource capacity) or subsection (8) (allocation of excess) are not expressly appealable under this provision, though general administrative review may be available.

The Minister has several duties and powers. The Minister must consult the applicant before making a determination under subsections (2) and (2a). Where the aggregate of entitlements exceeds the resource’s capacity, the Minister must reduce each entitlement either proportionately or under a scheme set out in regulations (though no such scheme exists in these regulations). Before determining the capacity of the resource, the Minister must prepare a report assessing the need for water of ecosystems that depend on the resource and make that report publicly available. This duty imposes a procedural obligation that can be scrutinised by affected parties.

Critically, the Minister holds a very broad discretion to grant a lesser entitlement than would otherwise apply under the standard criteria. The permitted grounds include: (a) that the Minister considers it appropriate based on the activities conducted at the time of the application on the land; (b) that the land to which the application relates has been divided and the application is for only a portion; and (c) “such other ground as the Minister thinks fit”. The last ground is essentially unfettered, subject only to the requirement that the Minister not act arbitrarily or for an improper purpose. This discretion creates significant uncertainty for applicants, who cannot predict the outcome even if they meet the standard criteria.

These regulations themselves do not create any new offences or penalties. Enforcement is left to the parent Act. The Natural Resources Management Act 2004 contains penalties for taking water without a water management authorisation, for exceeding authorised volumes, and for breaches of licence conditions. Since these regulations modify the allocation process but do not exempt anyone from the requirement to hold an authorisation after the prescribed period ended, any person who does not obtain an authorisation (including those who were eligible but failed to apply in time) is potentially liable for unauthorised taking.

The practical enforcement risk for non complying water users is that the Minister may issue stop orders, require restoration, or initiate prosecution under the Act. The regulations’ transitional provisions (section 124(4) being not excluded) applied only during the prescribed period (which ended around June 2010). After that, all water takers in the Central Adelaide Prescribed Wells Area must hold a valid authorisation. The eligible applicant scheme in regulation 7 was a belated window of opportunity, but any use outside that window without authorisation is an ongoing contravention.

For eligible applicants who did apply in time, the penalty for failure to comply with conditions of any granted authorisation is the same as for any other authorisation holder under the Act. Non compliance could lead to cancellation or variation of the entitlement. Additionally, if an applicant obtained an authorisation based on the Minister‘s assessment of future requirements and then used water for a different purpose, the Minister could potentially argue that the authorisation was issued on a mistaken basis, though the regulations do not expressly provide for revocation in such circumstances.

The appeal mechanism to the ERD Court provides a forum for challenging Ministerial decisions, but it does not impose penalties. The costs of litigation are borne by the parties, which may deter smaller water users from contesting adverse determinations. The regulations impose no civil penalties for misrepresentation in the application process; however, the parent Act likely contains offences for providing false or misleading information.

These regulations are subordinate legislation under the Natural Resources Management Act 2004 (SA). They operate only within the defined Central Adelaide Prescribed Wells Area and only in relation to wells that are “prescribed wells”. All other provisions of the Act continue to apply unless expressly modified. The key interaction is with section 164N of the Act: the regulations modify that section for this specific area, creating a special allocation regime that displaces the ordinary process for the class of eligible applicants. Where the modified section is inconsistent with the unmodified version, the modified version prevails (regulation 7(2)).

The regulations also interact with section 124 of the Act (taking water). By not excluding the operation of section 124(4) (regulation 6), they ensure that during the prescribed period, persons could take water without an authorisation if they complied with pre existing licence or plan conditions. This transitional provision is now spent, as the prescribed period ended in 2010. However, the interaction is relevant for determining historical use patterns that feed into the assessment of future requirements under the eligible applicant scheme.

Water allocation plans made under the Act apply in the area. Regulation 7(8) provides that if the quantity of water available for allocation exceeds the aggregate of entitlements under the modified scheme, the Minister may allocate the excess “in accordance with the unmodified Act and the relevant water allocation plan”. That means the normal competitive or priority processes in the plan govern any surplus water, not the transitional rules. Conversely, if there is a shortfall, the Minister may reduce entitlements proportionately, overriding any normal allocation rules in the plan.

The regulations may interact with the Water Act 2007 (Cth) if the groundwater resources of Central Adelaide are part of a declared water resource under the Basin Plan, or if they are subject to Commonwealth water trading rules. The regulations themselves do not mention Commonwealth law, so any interaction would be indirect and depends on factual overlaps. For most users, the state regime will be the primary legal framework.

Finally, the appeal provisions create an interaction with the Environment, Resources and Development Court Act (SA), which governs the procedures and powers of the ERD Court. Appeals under regulation 7(6) are limited to decisions under subsections (1), (2) or (2a) of the modified section 164N; they do not cover proportional reductions under subsection (3). That limitation means a person affected by a proportional reduction must rely on general judicial review (e.g., under the Administrative Decisions (Judicial Review) Act 1977 (SA)) rather than the statutory appeal mechanism.

The regulations were originally made in 2007 as the Natural Resources Management (Central Adelaide , Prescribed Wells Area) Regulations 2007 (No 164 of 2007) and commenced on 7 June 2007. Shortly after, on 5 July 2007, variation regulations (No 198 of 2007) amended the definition of the “Central Adelaide Prescribed Wells Area” by altering the reference to the deposited plan (GRO Plan No 327/2005, as varied). That same variation also omitted a former regulation 2 (which had likely contained commencement or definition provisions), under the Legislation Revision and Publication Act 2002.

The most significant amendment came with the Natural Resources Management (Central Adelaide , Prescribed Wells Area) Variation Regulations 2017 (No 206 of 2017), which commenced on 1 December 2017. This variation inserted regulation 7 in its entirety, creating the modified section 164N and the eligible applicant scheme. Before 2017, the regulations contained only the declaration of prescribed wells, the prescription of periods, and the non exclusion of section 124(4). There was no allocation mechanism for excluded users. The 2017 variation was a belated response to a gap in the original regime, providing a limited window for persons who had been excluded by section 164N(11) to obtain authorisations.

The legislative history also notes that earlier versions of the regulations (historical versions) exist but are not set out. The current text reflects the consolidation after the 2017 variation. There have been no further amendments since. The regulations remain in force, though the key operative provisions (the extended application period) have now expired. The Minister‘s power to grant a longer period in exceptional circumstances remains available, but the standard six month window closed in mid 2018.

The source text does not cite any specific cases that have been decided under or in relation to these regulations. It is therefore necessary to note that there is no publicly recorded litigation mentioned in the official instrument. This may be because the regulations have been rarely litigated, perhaps due to the narrow class of affected persons and the fact that the 2017 variation introduced the allocation scheme only recently. However, the absence of recorded cases does not mean there have been no disputes; it may simply reflect that any challenges have been resolved at the administrative level or that the ERD Court decisions are not routinely reported.

The potential for future litigation is significant given the broad ministerial discretion, especially the power to reduce entitlements on “such other ground as the Minister thinks fit”. That standard is wide enough to attract challenges on grounds of unreasonableness, improper purpose, or failure to consider relevant matters. Similarly, the Minister‘s assessment of “future requirements” based on the applicant’s reasonable needs during the establishment period (2002-2005) invites disputes over evidence, valuation of commitments, and the projection of future demands. The ERD Court, in exercising its appeal jurisdiction, may be called upon to interpret these provisions in the years ahead.

Another area ripe for litigation is the Minister‘s determination of the resource’s capacity and the consequent proportional reduction of entitlements under regulation 7(3). Although that decision is not appealable under regulation 7(6), it may be challengeable by way of judicial review. The requirement to prepare a report on ecosystem water needs and make it publicly available creates a procedural duty that, if breached, could ground an application for review. Any reduction that disproportionately affects one class of user without clear justification could also be contested.

Given the limited time window for applications (which closed in 2018), the volume of future litigation may be low unless the Minister grants extensions for exceptional circumstances in the future. Past decisions granting or refusing such extensions could also be subject to challenge on the basis that the Minister misapplied the “exceptional circumstances” test.

The most significant trap is that the extended application period under regulation 7 has expired. The standard period was six months from 1 December 2017, meaning it closed in June 2018. Any person who would have been an eligible applicant but missed that window has lost their right to the guaranteed entitlement without purchase price. The only remaining avenue is for the Minister to determine that exceptional circumstances justify a longer period in a particular case, but that is entirely discretionary and there is no guidance on what counts as “exceptional circumstances“. The applicant bears the burden of persuasion, and the Minister has no obligation to grant any extension.

The definition of “eligible applicant” is narrow and excludes anyone whose application for a water management authorisation has already been refused under the unmodified Act. This means that if a person attempted to apply under the normal provisions after 2005 and was rejected, they cannot use the special scheme even if they meet the other criteria. The regulations do not provide for review of such refusals.

The entitlement is based on the Minister’s opinion of the applicant’s “future requirements”, not on historical use. Applicants who used large volumes during the establishment period but cannot demonstrate that those volumes were “reasonable” or related to committed projects may receive a much smaller entitlement than they expected. The Minister can also reduce the entitlement on “such other ground as the Minister thinks fit“, a power almost entirely unreviewable on its face. The applicant has no right to a minimum entitlement.

Proportional reduction under regulation 7(3) applies to all entitlements - both those granted under the modified scheme and those granted under the unmodified Act. An existing user who has held an authorisation since the prescribed period may see their entitlement cut because of additional allocations to eligible applicants. There is no compensation for this reduction. The Minister must prepare a report on ecosystem needs, but there is no requirement to consider the economic impact on existing users.

The right to appeal is limited. Appeals lie only against decisions under subsections (1), (2) or (2a) of the modified section 164N. A decision under subsection (3) to reduce entitlements proportionately or to allocate excess water under subsection (8) is not within that appeal right. A person affected by those decisions must rely on general judicial review, which may be more costly and have stricter standing requirements.

The regulations do not specify the form of the water management authorisation. It could be a water licence, a permit, or another form under the Act. The conditions attached to the authorisation are not set out in these regulations; they will be determined by the Minister under the Act. Applicants should not assume that the authorisation will be perpetual or that it will be transferable without further approval.

For any person who was in the class of eligible applicants and still hopes to use the exceptional circumstances extension, the first step is to contact the Minister (or the Department) and argue that their circumstances meet the exceptional threshold. This would require documentary evidence showing why the application could not be made within the six month window. The agency will likely demand a detailed explanation and supporting documents. There is no guarantee of success.

If an eligible applicant made a timely application (i.e., by June 2018), they must have provided evidence of their water use during the establishment period (1 July 2002 to 1 December 2005) and of any commitments to projects or developments made during that period. This evidence could include invoices, water meter records, contracts, development approvals, financial statements, and correspondence. The applicant should also be prepared to justify that their future requirements are reasonable in the Minister’s view. It is prudent to obtain an independent assessment of projected water needs based on the land use at the time of application.

Successors in title must prove the chain of title from the original eligible applicant, as well as that predecessor’s eligibility. This requires copies of land title records, sale contracts, and evidence that the predecessor would have qualified as an eligible applicant (i.e., that they were excluded by section 164N(11) of the unmodified Act). The Minister must be satisfied; the applicant should submit a comprehensive bundle of evidence.

All applicants who were granted an authorisation must comply with its conditions, including any metering, reporting, and volume limits. Non compliance could lead to enforcement action under the Act, including suspension or cancellation of the authorisation.

For water users in the Central Adelaide Prescribed Wells Area who are not eligible applicants, the appropriate pathway is to apply under the normal Act provisions for a water management authorisation, which may require payment of a purchase price or participation in a competitive allocation process. These users should check the relevant water allocation plan for the area to understand the rules for new and existing entitlements.

Given that the extended application period is closed and the regulations are unlikely to be amended again, the best compliance strategy for most stakeholders is to ensure they hold a valid authorisation under the current Act and to monitor any future Ministerial decisions regarding proportional reductions, which could affect their entitlement. Regular consultation with the Department and participation in the public report process under regulation 7(4) is advisable. Legal advice should be sought before appealing any Ministerial decision, given the complexity of the appeal provisions.
