What it does
The Natural Resources Access Regulator Regulation 2023 is a machinery regulation that fills in operational details left open by the Natural Resources Access Regulator Act 2017 (the NRAR Act). It performs three main mechanical functions. First, section 4 modifies certain references in the Water Management Act 2000 so that where that Act refers to the Minister in sections 353E and 362C, those references are construed as including the Natural Resources Access Regulator. This expands the Regulator's standing in enforcement and recovery contexts. Second, section 5 prescribes additional categories of information that must be recorded on the Regulator's register kept under section 12A of the NRAR Act. The register must now include the identity of persons convicted of Water Management Act offences with particulars of penalty and consequential orders, the identity of persons who have contravened a civil penalty provision with orders made under section 370R, particulars of compliance audits under section 326A, injunctions under section 335, remedial orders under section 336, authorised measures under section 336A, the identity of persons giving written undertakings under section 336E with reasons for acceptance, and particulars of fees, charges or administrative penalties recovered under section 362C. Third, section 6 and Schedule 1 prescribe the entities that constitute "relevant agencies" for the purposes of the NRAR Act's information-sharing provisions. The schedule lists agencies across all Australian jurisdictions: ACT, Commonwealth, New South Wales, Queensland, South Australia, Tasmania, Victoria and Western Australia. The New South Wales list is extensive, including multiple state departments, local councils, the NSW Environment Protection Authority, IPART, NSW Police, Rural Fire Service, State Emergency Service, Forestry Corporation, and Dams Safety NSW. The regulation also repeals and replaces the 2018 regulation, with a savings provision ensuring that acts, matters or things that had effect under the old regulation continue under this one.
