Native Title (South Australia) Regulations 2016

The instrument operationalises several core procedural concepts used by the State in managing native title matters. The main concepts, and the regulatory mechanics that implement them, are:

• State Native Title Register content and management: Regulation 5 prescribes mandatory items the Register must contain for recorded decisions and for registered claimant applications. For decisions that find native title exists the Register must include the identity of the common law holders, the nature and extent of rights and interests conferred, and the name and address of any body corporate representing the common law holders, noting if it holds title in trust (r 5(1)(d)-(e)). For claimant applications the Register must record filing and registration dates, land description, claimed holders and rights that can prima facie be established (r 5(2)). The Registrar has power to note applications that are not registered unless so defective that they cannot properly be noted (r 5(3)) and to alter or remove notes in accordance with the rules (r 5(4)). The Registrar may also include other details at discretion (r 5(5)).

• Procedural notice and time limits: Regulation 9 imposes detailed notification duties. On receipt of an application of specified types, the Registrar must promptly notify the State Minister and the relevant representative Aboriginal body, and in many cases all persons who hold or may hold native title, registered interest holders, mining tenement holders, the local council and the Commonwealth Minister. Public notice must be published in general newspapers for the area and in a relevant special-interest Aboriginal publication, in prescribed print size (r 9(2), (4), (7)). Notices must contain a clear area description, details of the application and how to obtain further information, and must inform interested persons that they may apply to the Court to be joined within three months after service and publication requirements are completed (r 9(6)(a)-(b)). The same three-month rule appears in relation to notices of hearings (r 10(2)). The Registrar must keep records of completion dates for service and publication (r 9(8), r 10(3)).

• Registered representative concept and safeguards: The regulations define who can be nominated as the registered representative of native title holders and what that role entails. Eligibility requires the body corporate to be an Aboriginal association under the Corporations (Aboriginal and Torres Strait Islander) Act 2006, incorporated to perform representative functions and have members who are proposed to be recognised as native title holders (r 12). The regulations divide functions according to whether the representative holds native title in trust (r 13(a)) or acts as agent/representative without holding title in trust (r 13(b)). Both forms must consult with common law holders (r 13(a)(v), r 13(b)(iii)) and hold and apply money on trust as directed by common law holders (r 13(a)(iv), r 13(b)(ii)).

• Consultation and consent standard: Regulation 14 requires the registered representative to ensure common law holders understand and consent to proposed dealings that will affect native title. The representative must consult and consider the views of the relevant representative Aboriginal body, and where appropriate inform common law holders of those views. Consent must be obtained by either a decision-making process recognised by the traditional laws and customs of common law holders or by a process agreed and adopted by the common law holders (r 14).

• Evidentiary short-cuts: Regulation 15 makes a certificate signed by at least five members of a registered representative, or a certificate and supporting certificate from the representative Aboriginal body, prima facie proof that consultation and consent requirements have been met, in the absence of proof to the contrary (r 15(1)-(3)). The regulation sets membership composition rules for signatories, and provides that certified copies have the same status as originals in proceedings (r 15(2), (5)).

• Amendment constraints: Regulation 8 permits amendment of applications in various respects but bars adding new land unless the amendment is to a claimant application and the amendment includes land covered by another claimant application with which the application is combined (r 8(3)). Substitution of a registered representative requires an affidavit by the new representative stating factual basis of their authority (r 8(4)). Amendments to applications recorded or noted on the State Native Title Register must be noted on the register (r 8(6)).

• Cross-jurisdictional notification: The Registrar must forward copies of specified applications and key events to the Commonwealth Registrar as soon as practicable, and notify the Commonwealth Registrar of registered claims, amendments, withdrawals, proposed hearing dates and Court decisions, including information recorded in the State Register (r 11).

• Service where identity uncertain: Regulation 16 prescribes publication as a method of service for right to negotiate notices where existence of native title or identity of holders is uncertain. Publication must be made in general newspapers that circulate in the area and in a relevant special-interest publication and must include prescribed information (r 16(1)-(2)).

Together these concepts create a regime where administrative record-keeping, publication and limited evidentiary devices support the State Registrar, registered representatives and courts in processing native title applications and dealings. The regulations focus on process, notice and proof rather than redefining substantive title or compensation principles.

The regulations identify a defined group of actors and affected stakeholders, and allocate roles and duties among them. The primary actors and the ways the text affects them are:

• The Registrar: multiple duties are placed on the Registrar. The Registrar must maintain the State Native Title Register with prescribed information (r 5). On receipt of certain applications the Registrar must give notice and send copies to the State Minister and relevant representative Aboriginal body, and in many cases to persons who hold or may hold native title, registered interest holders, holders of mining tenements, local councils and the Commonwealth Minister (r 9(2), (4)). The Registrar must publish public notices in prescribed media and print size (r 9(7)), keep public inspection records of completion dates for service and publication (r 9(8), r 10(3)), forward copies to the Commonwealth Registrar (r 11(1)), and notify the Commonwealth Registrar of claims registered, amendments, removals, withdrawals, proposed hearing dates and Court decisions (r 11(2)). The Registrar may waive or reduce inspection fees on account of poverty or other proper reasons (r 6(2)), and may include other details on the Register as considered appropriate (r 5(5)). The Registrar must also follow rules when altering or removing notes of applications (r 5(4)).

• Claimants and applicants: persons bringing applications for native title declaration, variation or revocation, applications for compensation, and applicants to amend earlier applications are subject to form, amendment and notice rules. Applications that are set out in Schedule 1 must be made in that form (r 7). Amendments are constrained by the limits in r 8, including the bar on adding new land in most circumstances (r 8(3)). Applicants should expect public notice and potential joinder applications by interested persons within the three month period specified in r 9(6)(b).

• Registered representatives and bodies corporate: bodies nominated as registered representatives must meet eligibility criteria in r 12. They must perform specified functions in r 13, which differ depending on whether they hold title in trust. They must undertake consultation and secure consent before dealing with native title (r 14), keep or provide certificates regarding consultation and consent (r 15), and, if substituted, the new representative must supply an affidavit stating the factual basis of their authority to act (r 8(4)).

• Common law holders: common law holders of native title are the group the registered representative must consult and obtain consent from for dealings affecting native title. The regulations require representatives to ensure the common law holders understand proposed dealings and to secure consent using either traditional decision-making processes or agreed processes adopted by the group (r 14). Common law holders are also potential signatories to certificates under r 15, and specific composition rules apply to signatories (r 15(2)).

• Relevant representative Aboriginal bodies: these bodies must be consulted and their views considered by registered representatives before dealings (r 14(a)(i)). The Registrar must notify the relevant representative Aboriginal body on receipt of applications (r 9(2)). A certificate claiming that the representative Aboriginal body was consulted must be accompanied by a certificate from an authorised member of that body (r 15(3)).

• Interested persons as defined: regulation 3 defines interested person broadly, including the registered representative, persons whose interests would be affected (explicitly including persons proposing to carry out mining operations), the representative Aboriginal body, the State Minister, the Commonwealth Minister, and local council where the land is situated. These persons have statutory rights and obligations to receive notices and to apply to be joined in proceedings (r 9, r 10).

• Mining tenement holders and those with registered interests in land: the Registrar must give notice to any person holding a mining tenement or other registered interest in the land for many classes of applications (r 9(4)(a)(ii)-(iii)). The regulations specifically cross-reference proceedings under the Mining Act 1971 and the Opal Mining Act 1995 as contexts where r 10 does not apply (r 10(4)(c)-(d)).

• State and Commonwealth Ministers and local councils: the State Minister is designated as the Attorney-General (r 4(b)), and the Commonwealth Minister is designated as the Commonwealth Minister under the Acts Interpretation Act cross-reference (r 4(a)). Both must be notified of applications and of the Registrar’s actions in many circumstances (r 9(2), (4), r 11). Local councils for the area are included among those entitled to notice (r 9(4)(a)(iv), r 10(1)(d)).

• The public and specific readerships: publication rules require that notices be published in newspapers that circulate generally throughout the area and in relevant special-interest publications that cater mainly for Aboriginal peoples and circulate in the geographical area (r 9(7)). The public can inspect records the Registrar keeps of completion dates (r 9(8), r 10(3)). Persons with a substantial interest may request certified copies of certificates under r 15(4).

By structuring notice, register content and representative eligibility, the regulations allocate costs of attention and compliance. Registrars and registered representatives bear administrative burdens of record-keeping and evidence production. Claimants, potential claimants and commercial parties such as mining proponents are obliged to monitor State notices and may need to apply for joinder within a defined period. The regulations also create legal entitlements to be informed and to seek joinder, which changes behaviour around monitoring and legal risk assessment for parties with registered interests in land.

The regulations allocate specific duties to public officers, registered representatives and applicants, and create rights for interested persons and common law holders. The principal duties and rights are:

Registrar duties and discretions:

• Maintain the State Native Title Register with specified information for each recorded decision and each registered claimant application: decision-maker identity, decision date, land description, description of matters decided and, where native title exists, identity of common law holders, nature and extent of rights and name and address of a representative body corporate with notation if held in trust (r 5(1)-(2)).
• Note claimant applications and, subject to rules, alter or remove notes if defective or otherwise (r 5(3)-(4)).
• Include such other details about claims and decisions as the Registrar thinks appropriate (r 5(5)).
• On receipt of certain applications, give notice and send copies to the State Minister and the relevant representative Aboriginal body, and in many cases to all who hold or may hold native title, registered interest holders, mining tenement holders, local councils and the Commonwealth Minister, as soon as practicable (r 9(2), (4)).
• Give public notice in prescribed media and print size, and keep public inspection records of completion dates for service and publication (r 9(7), r 9(8)).
• Notify the Commonwealth Registrar of specified applications and events as soon as practicable and forward application copies and supporting documents (r 11(1)-(2)).
• Keep records of hearing notice service completion dates (r 10(3)).
• Fix and charge inspection fees equal to the fee under the Environment, Resources and Development Court Act 1993 for inspection under s 47(1) of that Act, and exercise discretion to waive or reduce fees for poverty or other proper reasons (r 6(1)-(2)).

Registered representative duties and rights:

• Eligibility to be a registered representative is limited to a body corporate that is an Aboriginal association under the Corporations (Aboriginal and Torres Strait Islander) Act 2006, incorporated to perform representative functions and whose members are proposed to be recognised in a native title declaration as holders (r 12).
• Functions vary by whether the representative holds title in trust:
  • If holding in trust, the representative must act as trustee, deal with native title as trustee under Commonwealth or State law (including entering ILUAs under Commonwealth Act), protect and enforce rights including compensation, hold and apply money on trust as directed by common law holders, consult with common law holders in accordance with r 14 and perform other functions directed by common law holders (r 13(a)).
  • If not holding in trust, the representative acts as agent/representative, holds money on trust as directed, consults with common law holders under r 14 and performs other functions as directed (r 13(b)).
• Before dealing with native title or acting in a way that will affect native title, the representative must ensure common law holders understand the proposed dealing and consent to it by consulting the representative Aboriginal body and, where appropriate, informing the common law holders of that body’s views, and by securing consent through traditional decision-making or processes agreed and adopted by the common law holders (r 14).

Applicant and claimant duties and rights:

• Use a prescribed form where the form is set out in Schedule 1 (r 7).
• Amend applications in accordance with r 8, including limitations on adding new land (r 8(1)-(3)). Substitution of registered representative requires an affidavit by the new representative stating the factual basis for their authority (r 8(4)). The Registrar may still accept amendments while considering a claimant application (r 8(5)), and amendments must be noted on the Register where an application is recorded or noted (r 8(6)).

Rights of interested persons and procedural rights:

• An interested person may apply to the Court to be joined as a party, typically within three months after all requirements for service and publication of the notice have been completed for non-claimant applications, or within three months after completion of service for claimant applications (r 9(6)(b)). The same three-month period applies to hearing notices for persons not parties to proceedings (r 10(2)).
• Notices must state that a native title declaration may be made even though no person claiming native title is joined as a party, and must warn that there can be only one native title declaration for an area and that failing to become a party may remove later opportunity to have the Court take a person’s claim into account (r 9(6)(c)(i)-(ii), r 9(6)(e)(ii)-(iii)).
• Persons with substantial interest may request certified copies of the consultation and consent certificates held by a registered representative, and the representative must supply certified true copies on written request (r 15(4)). Such certified copies have the same status as originals in proceedings (r 15(5)).

Evidentiary rights and presumptions:

• A certificate signed by at least five members of a registered representative certifying that common law holders were consulted and consented, or that the representative Aboriginal body was consulted and its views considered, will, in the absence of proof to the contrary, be taken as proof of the matters certified (r 15(1)). Composition rules for signatories are specified (r 15(2)-(3)).

Other duties and interactions:

• The Registrar must publish prescribed notices in specified publications and maintain records of completion dates, and must notify the Commonwealth Registrar of specified events and decisions (rr 9, 11). The regulations also require notice procedures where native title is uncertain via publication, containing prescribed information (r 16).

The regulations therefore create a suite of administrative duties for the Registrar and corporate and consultative duties for registered representatives, together with time-limited procedural rights for interested persons to join proceedings and evidentiary presumptions for certificates of consultation and consent.

The regulations themselves do not create express criminal offences or monetary penalties. Enforcement largely operates through administrative obligations on the Registrar, evidentiary presumptions in Court proceedings and the access to judicial processes for interested persons. Key enforcement and practical compliance mechanisms in the text are:

• Court joinder and proceedings: Regulation 9 requires notices to inform interested persons that they may apply to the Court to be joined within three months after all service and publication requirements are complete for most applications, and within the same three-month timeframe after service of notice of registration results for claimant applications (r 9(6)(b), r 9(3)-(5)). Regulation 10 imposes the same timeframe for interested persons to apply for joinder after notice of a hearing (r 10(2)). The right to apply for joinder is the principal procedural enforcement mechanism for protecting persons whose interests may be affected.

• Evidentiary effect of certificates: Regulation 15 provides that a certificate signed by at least five members of a registered representative, or combined certificates including an authorised certificate from a relevant representative Aboriginal body, are to be taken as proof of consultation and consent "in the absence of proof to the contrary" (r 15(1)-(3)). This evidentiary rule reduces transactional friction by allowing registered representatives to present a formal evidentiary document to courts and other decision-makers as prima facie proof. The provision simultaneously leaves open the ability to challenge the certificate by adducing contrary proof, which preserves judicial scrutiny.

• Administrative record-keeping and notice publication: The Registrar is required to keep records of service and publication completion dates for each claimant application and for other applications (r 9(8)), and records of hearing notice service completion dates (r 10(3)). These records are necessary for determining when the three-month joinder window begins and ends. Failure to publish properly, or to maintain records, would affect the running of statutory timeframes and could be relied upon in Court applications, effectively enforcing notice obligations through procedural consequences.

• Fee and fee waiver: Regulation 6 fixes inspection fees to the amount set under the Environment, Resources and Development Court Act 1993 and permits the Registrar to waive or reduce those fees on account of poverty or other proper reasons (r 6(1)-(2)). The fee regime is thus an enforcement mechanism for cost recovery but it also includes a discretion addressing access concerns.

• Regulatory limitations with legal consequences: Several provisions generate practical consequences if not followed. For example, r 8(3) prevents an application being amended to include an area of land not covered by the original application unless specific conditions are met. If an applicant attempts to extend area contrary to r 8(3), the amendment will be invalid under the regulation and could be rejected or treated as defective. Substitution of a registered representative without the affidavit required by r 8(4) will not meet the regulations’ requirements for substitution. The regulations do not themselves set penalties for non-compliance, but failure to comply will affect legal standing, the validity of processes, and the evidence available in Court.

• Interaction with Commonwealth Registrar and other authorities: The Registrar must notify the Commonwealth Registrar of specified events and forward copies of specified applications as soon as practicable (r 11). That notification creates interoperability and administrative oversight between State and Commonwealth registers; failure to notify could impede federal processing or trigger further administrative action.

• Exclusions and limitation of application: Regulation 10(4) lists specific proceedings in which the regulation does not apply, including matters where notice has already been given under regulation 9, and certain proceedings under the Land Acquisition Act 1969, Mining Act 1971 and Opal Mining Act 1995. These exclusions channel enforcement into other statutory frameworks for those matters.

In sum, enforcement in these regulations is procedural and administrative rather than penal. The principal sanctions available are procedural: evidentiary presumptions, the ability for interested persons to obtain joinder within fixed periods, the registration or de-registration of claims on the State Register, and the practical consequences of failing to comply with requirements that affect legal standing and the admissibility or persuasiveness of evidence in Court.

The regulations operate as subordinate rules to the Native Title (South Australia) Act 1994 and are tightly cross-referenced to Commonwealth and State statutes. The interaction with other laws is explicit in multiple provisions:

• Native Title (South Australia) Act 1994 (the Act): The regulations are made under the Act and implement many of the Act’s procedural provisions. For example, r 6 refers to the Act’s s 17(3) in setting the fee for inspection of the State Native Title Register; r 8 makes provision for amendment of applications for native title declarations and compensation; r 9 implements notice requirements for applications that the Act characterises as involving native title questions; and r 16 implements service where the existence of native title or identity of native title holders is uncertain, for the purposes of s 30(1)(a)(i) of the Act. The regulations refer directly to the Act in their scope and purpose.

• Commonwealth Native Title Act 1993: The regulations incorporate concepts and cross-references from the Commonwealth Act. Regulation 4(a) designates the Commonwealth Minister applicable, in relation to s 207A of the Commonwealth Act, via s 19A of the Acts Interpretation Act 1901 (Cth). The regulations refer to Commonwealth Act concepts such as indigenous land use agreements and the section 24FA protection regime for non-claimant applications, with direct references to ss 24FA, 24FB and 24FE of the Commonwealth Act in r 9(6)(d). Regulation 13 explicitly cites the Commonwealth Act as an example of the law under which a representative holding native title in trust might enter into an indigenous land use agreement to surrender or authorise acts affecting native title (r 13(a)(ii)). These cross-references align State procedural rules with Commonwealth substantive and procedural native title frameworks.

• Corporations (Aboriginal and Torres Strait Islander) Act 2006 (CATSI Act): Regulation 12 requires that an eligible registered representative be an Aboriginal association under the CATSI Act, be incorporated under that Act for the purpose of performing representative functions and have membership composed of persons proposed to be recognised as native title holders. This ties representative eligibility to the CATSI corporate form and the regulatory regime governing Indigenous corporations.

• Environment, Resources and Development Court Act 1993: Regulation 6 fixes the fee for inspection of the State Native Title Register at the amount set under the Environment, Resources and Development Court Act 1993 for inspection of material under s 47(1) of that Act. The regulation therefore borrows an existing fee scale from another State statute rather than setting a new fee schedule in the native title regime (r 6(1)).

• Local Government Act 1999: The definition of "interested person" in r 3(f) incorporates the council as defined in the Local Government Act 1999. Regulation 9 and r 10 require notice to the council of the area in which the land is situated (r 9(4)(a)(iv), r 10(1)(d)).

• Acts Interpretation Act 1901 (Cth): Regulation 4(a) uses a Commonwealth Acts Interpretation Act cross-reference to identify which Commonwealth Minister is the designated Commonwealth Minister for purposes of the Act and these regulations.

• Land Acquisition Act 1969, Mining Act 1971 and Opal Mining Act 1995: Regulation 10(4) carves out proceedings where its notice provisions do not apply, specifically naming proceedings under Division 1 of Part 4 of the Land Acquisition Act 1969, Part 9B of the Mining Act 1971 and Part 7 of the Opal Mining Act 1995. Those statutory regimes will therefore govern notice and process in those contexts rather than r 10.

• Commonwealth Registrar processes: Regulation 11 requires the State Registrar to forward copies of specified applications and to notify the Commonwealth Registrar of registered claims, amendments, removals, withdrawals, hearing dates and Court decisions. This creates administrative interaction between State and Commonwealth registries.

• Commonwealth rules on right to negotiate: Regulation 16 implements service requirements for right to negotiate notices where native title existence or identity of holders is uncertain, by prescribing publication requirements and the information to be published. This is a means of conforming to the procedural requirements for "right to negotiate" notices under the Commonwealth scheme, referenced through s 30(1)(a)(i) of the Act.

Taken together, the regulations do not operate in isolation. They embed State administrative practice within the Commonwealth native title architecture and link representative organisations to the CATSI corporate form. They also repurpose fee schedules from another State statute to set inspection charges. The cross-references create several implementation dependencies: State Registrar notifications to the Commonwealth Registrar, the need for Indigenous corporations under CATSI Act to be able to appear as registered representatives, and alignment of notice mechanisms with Commonwealth right to negotiate and protections such as s 24FA. Consequently a practitioner must be aware of the specified Commonwealth and State statutes when applying these regulations in practice, since compliance requires navigational competence across multiple statutory frameworks.

This instrument commenced on 1 September 2016 (r 2) and is the principal set of Native Title (South Australia) Regulations made in 2016 (Principal regulations 2016 No 194). Schedule 2 of the 2016 regulations expressly revokes the Native Title (South Australia) Regulations 2001 (Schedule 2, item 1). The legislative history section in the text records the Gazette notice (Gazette 18.8.2016 p3236) and confirms the commencement date, via r 2.

Mechanically, the 2016 Regulations therefore replaced the prior regulatory instrument made in 2001. The 2016 instrument’s table of contents and text indicate a consolidated approach to key matters: register content (r 5), fees (r 6), forms (r 7), amendment constraints (r 8), notification and service requirements (rr 9-11, 16), representative eligibility and functions (rr 12-15), and revocation of the 2001 Regulations (Schedule 2). The regulations do not include later amendment schedules or subsequent amending instruments within the text provided. The legislative history as printed in the statutory instrument records only the principal regulations and commencement particulars.

Practically, when advising or complying with these regulations a practitioner should note:

• The 2016 Regulations are the operative instrument from 1 September 2016, replacing the prior 2001 Regulations. Any references in earlier materials to the 2001 Regulations will need to be checked against the 2016 text for any changes in procedure, notice content, evidentiary requirements or registered representative criteria.
• The regulations cross-reference Commonwealth statutes and other State statutes whose own amendment histories may affect application of these regulations. For example, changes to the Corporations (Aboriginal and Torres Strait Islander) Act 2006, the Commonwealth Native Title Act 1993, the Environment, Resources and Development Court Act 1993 or the Local Government Act 1999 could alter the practical operation of provisions in these regulations. The 2016 text itself does not list subsequent amendments or replaced clauses beyond revoking the 2001 instrument.

No amending regulations or additional schedules appear in the provided text. The legislative history indicates the instrument’s origin and Gazette publication details but contains no record within the text of later amendments. For up-to-date practice, users must check the consolidated statutes and any later amending instruments published on the official legislation site.

The text of these regulations does not record any judicial decisions or litigation history. The instrument does not name or cite cases; it only cross-references statutory provisions in the State and Commonwealth legislative frameworks. Therefore, the regulations, as printed here, contain no internal litigation history to report.

Despite the absence of named cases in the instrument, several provisions are likely to be influential in litigation or procedural disputes because they allocate evidentiary presumptions, timeframes for joinder and precise notice procedures that will be relevant in contested proceedings. Specific features of the regulations that practitioners are likely to find material in litigation include:

• The three-month joinder period: Regulations 9(6)(b) and 10(2) prescribe a three-month window for interested persons to apply to be joined after completion of service and publication requirements. Disputes may arise about when service and publication requirements were "completed", and the Registrar is required to keep records of completion dates (r 9(8), r 10(3)). These records will typically be the focal point in any litigation about timeliness.

• Evidentiary status of consultation and consent certificates: Regulation 15 makes certificates signed by at least five members of a registered representative prima facie evidence of consultation and consent in the absence of proof to the contrary. In litigation, parties will likely contest the sufficiency and authenticity of certificates and seek to introduce contrary evidence, raising disputes about the weight to be given to such certificates and about the sufficiency of the procedural steps they purport to document.

• Amendment constraints and standing: Regulation 8(3) bars amendment of an application to include additional land not covered by the original application except in specific claimant application circumstances. Litigation could arise where parties dispute the validity of an amendment, whether an amendment adds new land, or whether the conditions of r 8(3) are satisfied. The requirement for an affidavit by a substituted representative under r 8(4) may also be tested in Court if substitution is contested.

• Notices and content of public statements: Regulation 9 mandates specific content for public notices, including statements regarding the finality of native title declarations and the potential for section 24FA protection for non-claimant applications. Litigation may arise over whether notices complied with the format and content requirements, and the legal consequence of any non-compliance for the ability of interested persons to be joined or to have their claims considered.

• Interaction with Commonwealth provisions: Because the regulations explicitly incorporate and refer to Commonwealth native title concepts, litigation that involves federal statutory protections or the interaction of State and Commonwealth regimes could engage the notification obligations to the Commonwealth Registrar under r 11. In such cross-jurisdictional disputes the timing and completeness of notifications may be material.

While the instrument itself contains no cases, the procedural devices and time limits set out in the regulations are the types of matters that typically feature in contested native title litigation. When advising litigants or preparing procedural motions it will be necessary to establish the Registrar’s public inspection records for completion dates, the content and timing of notices, the form and signatory composition of any certificates of consultation and consent, and compliance with the amendment and substitution affidavit requirements. Because the regulation gives certificates a prima facie evidentiary status, litigants will need to plan how to challenge or reinforce such certificates with contemporaneous documentary or witness evidence. The lack of penalties in the regulations means that most disputes will be resolved through judicial remedies available under the Act and ordinary procedural remedies in the Court rather than by administrative sanctions specified in the regulations.

The regulations contain several provisions that create practical pitfalls, timing traps and evidentiary chokepoints. Below is a list of specific "gotchas" drawn from the text, with the statutory provision referenced and the mechanism by which it creates risk:

• Three-month joinder window and record evidence (r 9(6)(b), r 9(8), r 10(2), r 10(3)): Interested persons have three months after completion of service and publication requirements to apply for joinder, and the Registrar keeps the record of when those requirements were completed. If the Registrar’s record is incomplete or inaccurate, an interested person’s ability to apply in time may be compromised. Practitioners must therefore obtain and archive the Registrar’s completion records promptly. Relying on informal notice or late discovery of the Register entry risks losing the right to apply for joinder.

• One native title declaration only warning in notices (r 9(6)(c)(ii), r 9(6)(e)(iii)): Public notices must state that there can be only one native title declaration for an area and that failure to join proceedings may foreclose later opportunities for the Court to take a person’s claim into account. A person who misses the joinder window may thereby lose further procedural opportunities. The notice content places a functional onus on persons with potential claims to monitor public notices closely.

• Amendment limitation on adding land (r 8(3)): An application may not be amended to include an area of land not covered by the original application unless the amendment is to a claimant application and the amendment includes land covered by another claimant application with which the application is combined. This is a strict constraint on expanding claims by amendment. Lawyers must plan initial claimant area carefully and, where necessary, combine claimant applications to permit later area additions. Attempting to add land without satisfying r 8(3) risks invalid amendments.

• Substitute representative affidavit requirement (r 8(4)): When substituting the registered representative, the new representative must supply an affidavit stating the factual basis on which it is asserted the representative is authorised to act. Failure to produce an adequate affidavit risks rejection of the substitution and potential procedural challenges to transactions entered into under the substituted authority.

• Eligibility rules for registered representative bodies (r 12): Only an Aboriginal association under the CATSI Act, incorporated for the purpose of performing representative functions with membership composed of persons proposed to be recognised as native title holders, qualifies. A prospective representative that is not a CATSI corporation or whose objects do not explicitly include representative functions cannot be nominated as a registered representative. Careful corporate governance drafting is required to ensure objects and membership composition meet r 12.

• Consultation and consent process requirements (r 14): The representative must consult the relevant representative Aboriginal body and ensure that common law holders consent through traditional decision-making mechanisms or an adopted process. Failure to follow r 14’s two-step process (consult, and secure consent by an appropriate process) could leave a dealing vulnerable to challenge. The regulation mandates both a consultation step and a specified form of consent process, which may be demanding to document.

• Composition and minimum number for consultation certificates (r 15(1)-(3)): A certificate must be signed by at least five members of the registered representative. If fewer than five members are common law holders, the certificate must include those holders; otherwise signatories must each be common law holders. In small groups or fragmented membership structures finding five appropriate signatories with the required composition may be difficult. Certificates signed by fewer than five persons will not attract the presumptive evidentiary effect in r 15(1).

• Prima facie evidence clause still rebuttable (r 15(1)): The certificates are proof "in the absence of proof to the contrary". This means certificates simplify proof but do not make the underlying facts immune from challenge. Practitioners should still preserve primary evidence (minutes, attendance lists, contemporaneous communication) to both defend certificates and to challenge others’ certificates.

• Public notice format requirements (r 9(7), definition of "relevant special-interest publication"): Notices must be published in a general newspaper circulating throughout the area and in a relevant special-interest publication that caters mainly for Aboriginal peoples, circulates in the area and is published at least monthly. In remote or offshore contexts identifying an appropriate general newspaper and special-interest publication may be nontrivial, and failure to publish in the correct outlets could render service defective. The regulation also mandates "prescribed print size", defined as at least as large as editorial text, adding a formatting constraint that must be observed.

• Fee linkage to another Act (r 6(1)): The inspection fee equals the fee set under the Environment, Resources and Development Court Act 1993 for inspection under s 47(1) of that Act. Practitioners cannot rely on a figure in these regulations alone and must check the other Act or current fee schedules. Although the Registrar may waive fees on account of poverty (r 6(2)), without a waiver inspection may incur cost.

• Registrar discretion over Register details and notes (r 5(4)-(5)): The Registrar may remove or alter notes in accordance with the rules and may include other details about claims and decisions as thought appropriate. This creates a locus of administrative discretion that may affect parties’ expectations about the public record. Interested persons should not rely on the Register alone without confirming entries and the reasons for any alterations.

• Required notice content for non-claimant applications and s 24FA protection warning (r 9(6)(d)): For non-claimant applications the notice must state that the area may be subject to section 24FA protection unless covered by a relevant native title claim after three months. Practitioners must ensure notices include this specific statutory language to trigger or inform the protection regime. Failure to include it could affect the statutory consequences intended by the Commonwealth scheme.

• Exclusions in r 10(4): Regulation 10 does not apply to hearings in certain contexts including hearings under parts of the Mining Act and Opal Mining Act. Parties involved in those regimes must look to the specific procedural requirements of the excluded Acts rather than relying on r 10’s notice rules.

Practically, these gotchas mean careful attention to the Registrar’s records, to the signatory composition of consultation certificates, to prescribed publication outlets and formats, to the exact wording required in notices, to corporate objects and membership when establishing a registered representative, and to the consequences of late or defective service. Missing the three-month joinder window, failing to comply with r 14 consultation mechanics, lacking proper affidavits for substituted representatives, or mispublishing a notice are discrete, documentable risks that can have decisive legal consequences.

This section lists concrete steps and checklists for compliance with the regulations for the main actors: the Registrar, applicants/claimants, registered representatives, relevant representative Aboriginal bodies and interested persons. Each step ties back to the regulation cited.

For the Registrar (administrative checklist):

• Maintain the State Native Title Register with the mandatory fields listed in r 5(1)-(2). Ensure entries for decisions include decision-maker, date, land description, description of matters decided, and where native title exists, descriptions of common law holders, the nature and extent of rights and name/address of any representative body corporate with notation if held in trust (r 5(1)-(2)).
• Where claimant applications are received, create a note on the Register unless the application is so defective that it cannot properly be noted, and ensure notes can be altered or removed under the applicable rules (r 5(3)-(4)).
• On receipt of applicable applications, promptly give notice and send a copy of the application and accompanying documents to the State Minister and the relevant representative Aboriginal body (r 9(2)), and in non-claimant cases give notice to all who hold or may hold native title, persons with registered interests, mining tenement holders, the local council and the Commonwealth Minister and give public notice (r 9(4)-(5)).
• Prepare public notices for publication in general newspapers for the area and in relevant special-interest publications, ensuring the print size meets the "prescribed print size" standard (r 9(7)). Include in notices the details required by r 9(6)(a)-(b) and any specific statements required for claimant, non-claimant or compensation applications (r 9(6)(c)-(e)).
• Keep, and make available for public inspection, precise records of the dates on which all service and publication requirements were completed for each application and each hearing for which notice must be given (r 9(8), r 10(3)). Timestamped logs and copies of published notices are necessary evidence.
• Send copies of specified applications and supporting documents to the Commonwealth Registrar "as soon as practicable" and notify the Commonwealth Registrar of registered claims, amendments or removals, withdrawals, proposed hearing dates with a brief description of the native title question, and Court decisions including registry information (r 11(1)-(2)).
• When charging inspection fees, apply the fee set under the Environment, Resources and Development Court Act 1993 for inspection under s 47(1), and be prepared to consider waiver or remission on grounds of poverty or other proper reasons (r 6(1)-(2)).

For applicants and claimants (practical steps):

• Use any form set out in Schedule 1 where required, and include all information and supporting documents required by that form (r 7). If Schedule 1 contains forms for specific applications, file the prescribed form to avoid rejection for non-compliance.
• Before seeking to amend an application, check r 8(3) regarding the bar on including new land areas. If expansion is necessary, structure amendments as claimed in r 8(3)(a)-(b) for claimant applications combined with other claimant applications covering the area. Where substituting a registered representative, prepare and file an affidavit by the new representative asserting the factual basis of its authority (r 8(4)).
• If pursuing an application that will require the Registrar to give public notice, anticipate the three-month joinder timeframe and factor it into negotiation and settlement planning (r 9(6)(b)). Ensure that notices and any statements made in public reports match the statutory content requirements for notices to avoid challenges to service sufficiency (r 9(6)(a), (c), (d), (e)).

For bodies seeking to be a registered representative (corporate and governance steps):

• Incorporate as an Aboriginal association under the Corporations (Aboriginal and Torres Strait Islander) Act 2006 and ensure the corporate objects explicitly include performing the functions of a registered representative of native title holders (r 12(a)-(b)). Ensure the membership comprises persons proposed to be recognised in a native title declaration as holders (r 12(c)).
• Draft governing documents that enable the body to hold funds on trust, to invest or apply money as directed by common law holders, to enter into ILUAs if authorised, and to consult and obtain consent in the form required by r 14 (r 13(a)(iv)-(vi), r 13(b)(ii)-(iv)).
• Maintain a roster and governance process to ensure at least five properly qualified members are available to sign consultation and consent certificates in accordance with r 15(1)-(3). Keep contemporaneous minutes, attendance sheets and records of consultations that can support or rebut certificates.

For registered representatives carrying out dealings:

• Prior to any dealing that will affect native title, ensure compliance with r 14: consult and consider the views of the representative Aboriginal body for the area, give notice of those views to common law holders where appropriate, and secure consent through either traditional decision-making mechanisms or agreed processes adopted by the common law holders (r 14).
• Prepare certificates under r 15 and ensure the signatory composition complies with r 15(2). If certifying that the representative Aboriginal body has been consulted, obtain the authorised member’s certificate from that body to accompany the representative’s certificate (r 15(3)). Be ready to supply certified true copies to persons with a substantial interest on written request (r 15(4)-(5)).
• Keep documentary proof of consultation steps and any decisions made under traditional or agreed processes so that certificates can be supported in the event of challenge.

For relevant representative Aboriginal bodies:

• Respond to consultation requests from registered representatives, provide authorised certificates when requests are made, and keep records of consultations and the body’s considered views to facilitate the preparation of certificates under r 15(3).

For those affected such as mining companies, councils and registered interest holders:

• Monitor the State Native Title Register and public notices, including publication in relevant special-interest publications as well as general circulation newspapers, because notices will be published in both types of media and may trigger a three-month joinder window (r 9(7), r 9(6)(b)).
• Where project timing is sensitive, obtain the Registrar’s public inspection records to confirm the date when the joinder window began to run (r 9(8)) and consider timely applications to be joined if the project may be affected by a native title claim.

For all actors:

• Preserve contemporaneous records of service, publication and consultation, because the regulations make those records determinative of timeframes and provide for certificates to operate as prima facie evidence but still subject to contradiction by other proof (rr 9, 10, 15).
• Check fees and fee-waiver policies that derive from another statute, the Environment, Resources and Development Court Act 1993, to budget for inspection costs, and consider requesting a waiver if poverty or other proper reasons apply (r 6(1)-(2)).

Compliance relies on precise administrative steps: correct use of forms where Schedule 1 prescribes them (r 7), timely and correctly worded publication and service (r 9, r 16), proper corporate eligibility and evidence for registered representatives (r 12-15), and careful handling of amendments and substitutions (r 8). Documentation is the crucial compliance tool; save copies of notices, affidavits, certificates and the Registrar’s records because the regulations make those documents central to establishing procedural compliance.
