What it does
This instrument formally recognises the Northern Land Council (NLC) as a Representative Aboriginal/Torres Strait Islander body for a defined geographic area under the Native Title Act 1993. Mechanically, the instrument does four things.
First, it declares its name (s 1). Second, it specifies commencement: the whole instrument takes effect on 1 July 2024 (s 2, commencement table). Third, it states its legal authority: the instrument is made under subsection 203AD(1) of the Native Title Act 1993 (s 3). Fourth, it gives the substantive recognition and its temporal limits: clause 6 recognises the NLC as the Representative Body for the area described in Schedule 1 (s 6), and clause 7 fixes the recognition period as commencing 1 July 2024 and ceasing at the end of 30 June 2030 (s 7).
The instrument is compact: it contains a small set of defined terms (s 4), a mechanism for implementing schedule amendments (s 5) and a Schedule (Schedule 1) that describes the geographic coverage of the recognition. The Schedule expresses boundaries by reference to other statutory definitions and published boundary lines, including the Central Land Council boundary (as published in the Australian Government Gazette), adjacent‑area boundaries in the Petroleum (Submerged Land) Act 1967, and the concept of the exclusive economic zone as defined in the Seas and Submerged Lands Act 1973 (Schedule 1, paras 1-2). The definition section formally links the term Northern Land Council used in the instrument to the body established under s 21 of the Aboriginal Land Rights (Northern Territory) Act 1976 (s 4).
The instrument does not itself set out the substantive legal powers, duties or procedures that attach to a Representative Body under the Native Title Act. It is a narrow statutory instrument that records recognition and fixes the area and dates; it therefore operates as a legal fact , that the NLC is recognised for the specified area and period , with the substantive consequences to be found in the Native Title Act and any other laws that govern Representative Bodies.
