What it does
This instrument recognises the North Queensland Land Council Native Title Representative Body Aboriginal Corporation as the representative Aboriginal/Torres Strait Islander body for a defined area in northern Queensland under subsection 203AD(1) of the Native Title Act 1993. The recognition takes effect on 1 July 2023 and ceases at the end of 30 June 2026, a three-year period. The area is described in Schedule 1 using a combination of local government boundaries, river centrelines, geographic coordinates, and the outer limit of Australia’s Exclusive Economic Zone. The instrument itself is a legislative instrument, not an amendment Act; although section 5 refers to schedules that may amend or repeal other instruments, the only schedule (Schedule 1) is a description of area and does not amend anything. The instrument’s sole operative provision is section 6, which confers recognition. It does not create offences, impose fees, establish new tribunals, or appropriate funding. Its mechanical effect is to designate a single corporate entity as the gateway for native title services within the mapped region. The recognition period is fixed, meaning the body must seek re-recognition before 1 July 2026 or lose its status. The area description incorporates data from multiple sources: Queensland Department of Natural Resources and Water (2007-2008), Geoscience Australia (2003), and the National Native Title Tribunal (2008). It references the Geocentric Datum of Australia 1994 coordinate system. The description uses both cadastral and topographic data, including former local government boundaries (e.g. the former Nebo Shire Council) that may no longer be in current administrative use. This creates a potential gap between the legal description and contemporary administrative boundaries. The instrument does not specify the functions of a representative body; it merely triggers the application of the Native Title Act’s provisions governing such bodies. The practical consequence is that any native title claimant or holder within the area must engage with the North Queensland Land Council for assistance, funding, and representation in claims, determinations, and future act processes under the Native Title Act.
