What it does
This legislative instrument formally recognises the Kimberley Land Council Aboriginal Corporation (ICN 21) as the Representative Aboriginal/Torres Strait Islander Body for a defined Kimberley area under the Native Title Act 1993. The recognition is made under section 203AD(1) of the Native Title Act 1993 (the Act), as stated in section 3 of the instrument. Section 6 records the operative recognition: "For subsection 203AD(1) of the Act, the Kimberley Land Council is recognised as the Representative Body for the area described in Schedule 1." The instrument fixes the period of recognition in section 7: the recognition takes effect on 1 July 2023 and ceases at the end of 30 June 2026, expressly tying the recognition period to subsection 203AD(2) of the Act.
Mechanically the instrument performs four discrete actions. First, it identifies the Kimberley Land Council by name and corporate registration (see the definition in section 4). Second, it defines the geographical scope of the recognition by reference to a detailed boundary description in Schedule 1, which uses terrestrial internal borders, local government area boundaries, particular native title claimant application boundaries, and maritime limits including the outer limit of Australia’s exclusive economic zone and adjacent area boundaries under the Petroleum (Submerged Land) Act 1967 (see Schedule 1, para 1 and para 2). Third, it provides commencement information in section 2, including a commencement table that records that "the whole of this instrument" commenced on 1 July 2023. The instrument also includes the standard note that data in column 3 of the commencement table is not part of the instrument (s 2(2)). Fourth, section 5 explains the usual machinery clause: any instrument specified in a Schedule to this instrument is amended or repealed as set out in that Schedule; in other words, Schedules may contain consequential amendments to other instruments.
