Native Title (Indigenous Land Use Agreements) Regulations 2024

The Regulations define three categories of ILUA by reference to the Native Title Act. A body corporate agreement is an ILUA entered into by a registered native title body corporate (RNTBC) under s 24BA of the Act. An area agreement is an ILUA made by the native title group for the area under s 24CA. An alternative procedure agreement is an ILUA that can be made where there is no native title determination or registered claim, using the process in s 24DA. The Regulations also introduce the concept of a complete description in relation to an area. Under s 6, a complete description requires both a written description that allows the boundaries of the area (and any excluded subareas) to be identified, and a map showing those boundaries. This dual requirement replaces any informal or purely textual description and forces applicants to produce a professionally prepared map, which adds cost but improves certainty for third parties and the Registrar. The Regulations also reference several key registers and bodies: the Register of Indigenous Land Use Agreements (where ILUAs are registered), the National Native Title Register (which records final determinations), and the Register of Native Title Claims (for claims not yet determined). The Native Title Registrar is the decision-maker on registration, and representative bodies (native title representative bodies or service providers) have specific notification and certification roles. The concept of an application objecting against registration of an alternative procedure agreement is central to s 8 and Form 1. An objector must be a person claiming to hold native title in all or part of the area covered by the agreement. The objection must be made within the notification period set by the Registrar and must include a statement of reasons why registration would not be fair and reasonable. This mirrors the grounds the Registrar considers under the Act when assessing alternative procedure agreements. The Regulations also distinguish between types of ILUAs for the purpose of required documentation: for example, area agreements require a copy of any certification from representative bodies under s 24CG(3)(a) (s 7(2)(l)), while body corporate agreements and area agreements require statements about notifying representative bodies if those bodies are not parties (s 7(2)(k)). This tiered approach reflects the different levels of procedural protection the Act provides for each ILUA type.

The Regulations directly affect any person or entity that proposes to apply for registration of an ILUA after 1 October 2024. This includes registered native title bodies corporate (RNTBCs) entering body corporate agreements, native title groups entering area agreements, and parties (which may include the Commonwealth, a State or Territory, or a government authority) to alternative procedure agreements. The Regulations also affect representative bodies, because applicants for area agreements must certify that representative bodies have been notified or must certify the agreement itself (s 7(2)(k) and (l)). Representative bodies that are not parties to an ILUA still have a statutory role: they must be informed of the intention to enter the agreement, and the applicant must provide a statement confirming that notification occurred. The Native Title Registrar is the primary administrative recipient of the prescribed documents and information and must assess whether the application complies with the Regulations before registering the agreement. The Regulations also affect persons who wish to object to the registration of an alternative procedure agreement: they must use the prescribed Form 1 and provide a statement of reasons. Such objectors are typically native title claimants who assert an interest in the area but were not party to the agreement or are not satisfied with its terms. The broader class of native title holders and common law holders may be affected indirectly, because the quality of the application documents (especially the complete description) determines the accuracy of the Register and hence the reliance that third parties (such as miners, developers, or government agencies) can place on it. Economically, the Regulations impose a compliance burden on ILUA applicants. The cost of preparing maps, obtaining extracts from the National Native Title Register or Register of Native Title Claims, and compiling signed statements from each party is non-trivial. For small native title groups without easy access to legal or surveying services, this burden may increase the effective price of entering an ILUA, potentially reducing the number of agreements concluded. Conversely, the clear documentation requirements may reduce post-registration disputes and lower the risk of challenges from third parties, creating a trade-off between upfront compliance costs and long term certainty. The Regulations also affect legal practitioners and consultants who advise native title groups, as they must ensure all prescribed documents are included to avoid rejection or delay. The repeal of the 1999 Regulations means that any application lodged under the old regime that was not finalised by 1 October 2024 may now be governed by the new requirements, creating transitional uncertainty (though the Regulations are silent on this point).

The Regulations impose several duties on parties applying to register an ILUA. Under s 7(2), the applicant must provide a comprehensive set of documents and information: the name and address of each party, identification of any representative body as a party, whether a government entity is a party, the operational period of the agreement (if any), details of any associated written agreements, the location of any statements in the agreement that relate to future acts or surrender of native title (referencing specific paragraphs of the Act), a copy or extract of any approved determination of native title for an RNTBC, a signed statement from each party consenting to the application, a complete description of the area covered (including a map), and if extinguishment by surrender is involved, a complete description of the affected subarea. Additional duties depend on the ILUA type: for body corporate and area agreements, the applicant must provide a statement about notifying representative bodies (s 7(2)(k)); for area agreements, a copy of any certification from representative bodies (s 7(2)(l)); for area and alternative procedure agreements, details of any conditions imposed under s 251BA of the Act on the authority to make the agreement, plus an extract from the Register of Native Title Claims (s 7(2)(m)); and for any agreement where an RNTBC is a party and the agreement gives effect to a native title decision, a certificate under reg 9 of the Native Title (Prescribed Bodies Corporate) Regulations 1999 (s 7(2)(n)). These duties are not elective: the Registrar cannot register the ILUA unless all prescribed items are provided. The rights of applicants are implicit: they have the right to have their application processed by the Registrar once the prescribed documents are submitted. The Regulations also grant a right to persons claiming native title to object to registration of an alternative procedure agreement by using Form 1. That right is conditional on the person being a person claiming to hold native title in all or part of the area, and on providing a statement of reasons and the notification day. The Registrar then must consider the objection under the Act. The Regulations create no new rights for applicants to challenge a refusal of registration; those rights exist under the Native Title Act itself (such as merits review or judicial review). The duty to provide signed statements from each party ensures individual accountability and reduces the risk that a person is listed as a party without consent. However, this requirement may be administratively onerous where an ILUA has dozens or hundreds of members of a native title group sign as parties. The Regulations also give the Registrar the ability to publish the names and contact addresses of parties (noted at s 7(1) Note 2, referencing ss 24BH, 24CH, 24DI of the Act), which raises limited privacy concerns but enhances transparency.

The Regulations themselves do not create any penalty provisions, offences, or civil penalty regimes. Enforcement of the registration requirements is indirect: the Native Title Registrar will not register an ILUA unless the application is accompanied by the prescribed documents and information. In effect, the sanction for noncompliance is rejection of the application or a direction to provide missing material. The Regulations are therefore a procedural gatekeeper rather than a punitive instrument. However, the underlying Native Title Act contains penalties for making false or misleading statements in connection with an application (see generally the Criminal Code and provisions of the Act), although the Regulations do not cross reference those. The prescribed objection form (Form 1) requires a statement of reasons, but the Regulations do not penalise an objector for filing an objection that is later dismissed as groundless; the only cost is the time and effort spent preparing the form. The Native Title Registrar has powers under the Act to require further information, but the Regulations do not specify any penalty for failing to respond to such a request. The repeal of the 1999 Regulations (Schedule 2) might affect transitional enforcement: any application that was in progress under the old rules but not completed before 1 October 2024 is now subject to the new requirements, but the Regulations do not provide a grace period. This could lead to a situation where an applicant who had substantially complied with the 1999 Regulations finds that new documents (such as a complete description with a map, or a signed statement from each party) are now required, causing delay and additional expense. That is not a penalty in the legal sense but functions as a regulatory cost. The absence of penalties in the Regulations themselves means that enforcement relies entirely on the Registrar’s administrative discretion and the applicant’s desire to achieve registration. There is no mechanism for third parties to enforce compliance with the Regulations; a person who believes that an application is incomplete cannot bring an action directly under the Regulations. Instead, they could potentially raise the issue in a court challenge to the validity of the registration, but that is a remedy under the Act or general law, not the Regulations. From an economic perspective, the lack of penalties for noncompliance (other than rejection) means the Regulations have a low deterrence effect against careless or incomplete applications, but the cost of resubmission creates a private incentive to get it right the first time.

These Regulations are made under the Native Title Act 1993 (Cth) and expressly reference multiple provisions of that Act. The definitions in s 5 adopt the Act’s meanings for terms such as indigenous land use agreement, National Native Title Register, Register of Indigenous Land Use Agreements, registered native title body corporate, Registrar, and representative body. The Regulations implement the application requirements that are left by the Act to be prescribed: subsections 24BG(2), 24CG(2) and 24DH(2) each state that an application for registration must be accompanied by the documents and information prescribed by the regulations. Therefore the Regulations fill a gap left by the primary legislation. They also interact with the Native Title (Prescribed Bodies Corporate) Regulations 1999. Section 7(2)(n) of these Regulations requires, in certain circumstances, a certificate under regulation 9 of those 1999 Regulations as part of the application. This cross referencing means that RNTBCs must comply with both sets of regulations when entering a body corporate agreement that gives effect to a native title decision. The 1999 Regulations impose consultation and consent requirements on prescribed bodies corporate before they make such decisions. The certificate is evidence of that process. If those 1999 Regulations are amended or replaced, this cross reference would need updating. The Regulations also interact with the Native Title Act’s provisions on the role of representative bodies. For area agreements, the Act at s 24CG(3) requires that the application either be certified by all representative bodies for the area or include a statement explaining why certification is not needed. The Regulations at s 7(2)(l) require a copy of any such certification. Similarly, s 7(2)(k) requires statements about whether representative bodies were informed of the intention to enter the agreement. These provisions ensure alignment with the representative body framework under the Act. The Regulations do not directly interact with State or Territory native title legislation, but the application process is a Commonwealth one regardless of where the land is located. The complete description requirement (map and written description) will need to comply with any mapping standards that the Registrar adopts, and those standards may reflect state surveying laws. The Regulations are also silent on interactions with the Freedom of Information Act 1982 (Cth) or privacy legislation, though the Registrar’s practice of publishing names and addresses of parties (as noted in the Regulation) will need to be consistent with those laws. The repeal of the 1999 Regulations (Schedule 2) is itself an interaction: any decisions or applications made under the old regime that are not saved will be governed by these new Regulations, creating a sudden shift in legal requirements on the commencement date.

The Native Title (Indigenous Land Use Agreements) Regulations 2024 are a new instrument that repeals and replaces the Native Title (Indigenous Land Use Agreements) Regulations 1999. The 1999 Regulations had been in force for over 25 years and presumably had been amended multiple times, though the text provided does not list those amendments. The current Regulations were made on 12 September 2024 by the Governor General on the advice of the Federal Executive Council and commence on 1 October 2024. There is a single commencement table indicating that the whole instrument commences on that date. The note to the table states that it will not be amended to deal with later amendments, which is standard drafting language. The Regulations do not contain any transitional provisions, savings, or application rules. This means that any application for registration of an ILUA that was made before 1 October 2024 but not yet determined by that date may be affected by the repeal of the 1999 Regulations. However, the Regulations do not state whether the old or new rules apply to pending applications. This gap creates legal uncertainty for applicants who had relied on the 1999 requirements and may have prepared incomplete applications under the old regime. In the absence of transitional provisions, the general principle is that procedural amendments apply to applications made after commencement, but if the application is a pending proceeding, a court might apply the new law unless to do so would be unfair or retrospective. Because the Regulations are procedural rather than substantive, they are more likely to apply to pending applications, but that is not certain. The instrument also includes a Schedule 2 which repeals the whole of the 1999 Regulations. No amendments are made to any other legislative instruments. The Regulation itself is made under the Native Title Act 1993, and any future amendment to the Act or to the Regulations will require a further amending instrument. As of the date of making, there is no amendment history for this instrument, because it is new. Future amendments might address the transitional issue, clarify the complete description standard, or adjust the list of prescribed documents.

The Regulations are new (commenced 1 October 2024) and therefore have no litigation history as of the date of the source text. However, it is possible to anticipate potential areas of legal challenge. The most likely ground for challenge is procedural noncompliance: a party whose ILUA application is rejected by the Registrar for failing to provide a prescribed document may seek judicial review of that decision under the Administrative Decisions (Judicial Review) Act 1977 (Cth) or the Native Title Act’s own merits review provisions. If the Registrar’s interpretation of “complete description” (s 6) is disputed, a court may need to decide whether a map that is inaccurate or insufficiently detailed meets the requirement. Another potential area of litigation is the objection process for alternative procedure agreements. The prescribed Form 1 requires a statement of reasons why it would not be fair and reasonable to register the agreement. The Registrar might accept or reject an objection based on the sufficiency of that statement. A person whose objection is dismissed could argue that the Registrar applied an overly strict standard not supported by the Regulations or the Act. The Regulations themselves do not create a direct right of appeal; any challenge would rely on the broader review framework. There is also the possibility of a constitutional challenge if the Regulations are alleged to exceed the regulation making power under s 211 of the Native Title Act, though that is unlikely because the Regulations closely track the heads of power in the Act. Litigation could also arise from the interaction with the Native Title (Prescribed Bodies Corporate) Regulations 1999, especially if a certificate under reg 9 is not recognised by the Registrar. The fact that the Regulations repeal the 1999 Regulations without transitional provisions may lead to litigation from applicants who had relied on the old regime and suffered detriment. A court might be asked to determine whether the new Regulations apply to applications lodged but not determined before commencement, and whether the lack of transitional provisions is unreasonable or procedurally unfair. Because the Regulations are new, no case law has yet interpreted their requirements. Legal practitioners should monitor decisions of the Native Title Registrar and any subsequent court rulings. The volume of ILUA registrations (hundreds across Australia) means that disputes are likely within a few years.

The Regulations contain several traps that applicants and objectors should not overlook. First, the complete description under s 6 requires both a written description and a map showing boundaries. A map alone may be insufficient if the written description does not allow identification of excluded areas; conversely, a written description without a map is also noncompliant. The requirement for a map is absolute even if the area is small and easily described. Second, the signed statement by each party agreeing to the application (s 7(2)(h)) must be obtained from every party, including government entities. A government authority may need internal approval and a specific signatory, which can cause delays. Third, for agreements that involve extinguishment of native title by surrender (s 7(2)(j)), the Regulations require a complete description of the particular subarea being surrendered, separate from the area description for the whole agreement. This can catch applicants who assume one map covers everything. Fourth, the requirement under s 7(2)(e) to disclose any other written agreement made between some or all parties in connection with the act to which the ILUA relates is broad. It could capture side letters, memoranda of understanding, or separate development agreements. Failing to disclose such an agreement may later be used to challenge the validity of registration. Fifth, for area agreements, s 7(2)(l) requires a copy of any certification from representative bodies under s 24CG(3)(a). If the applicant instead relies on the alternative pathway (statement under s 24CG(3)(b)), the certification must still be provided if it exists. However, if no certification was obtained, the applicant must include the required statement and grounds, but the Regulations do not explicitly require a separate document for that; the statement must be somewhere in the application materials. Sixth, the Regulations at s 7(2)(m)(i) require details of any conditions imposed under s 251BA of the Act on the authority to make the agreement. This is relevant for area and alternative procedure agreements. If the native title group imposed conditions on the authority to negotiate (e.g., a requirement that members vote in a certain way), those conditions must be disclosed. Seventh, the objection form (Form 1) includes a field for the notification day; the objector must obtain that date from the Registrar’s notice. If the objector enters an incorrect date, the application may be rejected. Also, the form requires the objector to state whether they claim native title in all or part of the area; ambiguity here could affect standing. Eighth, the Regulations have no transitional provisions. Any application prepared under the 1999 Regulations but not lodged by 30 September 2024 must comply with the new requirements. Even if only one document is missing (e.g., the map), the application may be refused. Ninth, the requirement for a certificate under the Native Title (Prescribed Bodies Corporate) Regulations 1999 (s 7(2)(n)) may surprise RNTBCs that thought they only needed the certificate for internal purposes, not as part of the ILUA registration application. Tenth, the address for each party (s 7(2)(a)) will be published by the Registrar (see Note 2), which may raise privacy concerns for individual native title holders. Applicants should consider using a care of address or a representative’s address.

To comply with the Native Title (Indigenous Land Use Agreements) Regulations 2024, an applicant seeking registration of an ILUA should follow a systematic process. First, identify the type of ILUA: body corporate agreement, area agreement, or alternative procedure agreement. This determines which specific additional requirements apply. Second, gather the core documents and information listed in s 7(2)(a) to (n). The applicant must prepare a complete description of the area under s 6, which means engaging a qualified surveyor or cartographer to produce a written boundary description and a map. The map should show the entire area and any excluded subareas clearly. Third, obtain a signed statement from each party agreeing to the application being made (s 7(2)(h)). For large native title groups, this may require a meeting or resolution and a designated signatory. Ensure that the statement is dated and that the signatory has authority. Fourth, if any party is a representative body, identify that in the application (s 7(2)(b)). If a government entity is a party, note that (s 7(2)(c)). Fifth, if there is an approved determination of native title for any RNTBC party, obtain a copy or an extract from the National Native Title Register (s 7(2)(g)). Sixth, for body corporate and area agreements where no representative body is a party, prepare a statement confirming that at least one representative body was informed of the intention to enter the agreement (s 7(2)(k)). Seventh, for area agreements, obtain certification from all representative bodies for the area, or if that is not possible, prepare the required statement under s 24CG(3)(b) of the Act and include it as part of the application (s 7(2)(l) read with Note 1). Eighth, for area and alternative procedure agreements, obtain details of any conditions imposed under s 251BA of the Act on the authority to make the agreement, and obtain an extract from the Register of Native Title Claims for each party that is a registered native title claimant (s 7(2)(m)). Ninth, if an RNTBC is a party and the agreement gives effect to a native title decision, obtain a certificate under reg 9 of the Native Title (Prescribed Bodies Corporate) Regulations 1999 (s 7(2)(n)). Tenth, include a copy of the ILUA itself (as required by the Act). Eleventh, compile all documents into an application and lodge it with the Native Title Registrar. For objectors to an alternative procedure agreement, compliance means using Form 1 in Schedule 1 exactly. The form must be filled in with the objector’s name, address, address for service, representative details (if any), the notification day from the Registrar’s notice, a statement of reasons why registration would not be fair and reasonable, and any other relevant information. The objector must sign and date the form. Completing the objection promptly within the notification period is critical. The Regulations do not specify a period, but the Act does. It is wise to also check the Native Title Act for any additional notice requirements. Practically, both applicants and objectors should retain legal advice or consult a representative body to ensure all prescribed documents are included, as missing items will result in the application being rejected or delayed. The costs of compliance include professional fees for mapping, legal advice, and obtaining register extracts.
