Native Title (Approved Exploration etc. Acts - New South Wales) (Petroleum) Determination 2000

This Determination, made by the Attorney‑General under subsection 26A(1) of the Native Title Act 1993, declares a specific class of petroleum exploration and related acts in New South Wales to be "approved exploration etc. acts" for the purposes of the Native Title Act (opening paragraph). The operative material is Schedule 1, which divides into Part 1 (interpretation) and Part 2 (the class of acts). Mechanically, the Determination does three things.

First, it defines which petroleum titles and title variations issued under the Petroleum (Onshore) Act 1991 (NSW) qualify for approval under the Native Title Act. Those acts are limited to grants and renewals of exploration licences and special prospecting authorities that qualify as "low‑impact" under Division 6 of Part 3 of the Petroleum (Onshore) Act, and to a particular form of variation that converts an existing exploration licence to a low‑impact prospecting title (Part 2, cls 5-9).

Second, it attaches definitional and procedural constraints to the meaning of "low‑impact" for the purposes of the Determination. A "low‑impact exploration licence" or "low‑impact special prospecting authority" for this Determination must be subject to a condition barring prospecting operations on land where there are registered native title bodies corporate or registered native title claimants unless those operations are in accordance with an access arrangement, must accord those registered bodies or claimants the same rights, including procedural rights, they would have if they held fee simple in the land, and for certain acts must have had notice served on the representative Aboriginal/Torres Strait Islander body not less than four months before grant or variation (Part 1, cls 1-3).

Third, the Determination cross‑references the Petroleum (Onshore) Act for key terms and dispute resolution mechanisms. It borrows the meanings of "prospecting operations", "registered native title body corporate", "registered native title claimant" and "representative Aboriginal/Torres Strait Islander body" from the Petroleum (Onshore) Act (Part 1, cl 4). It also defines "access arrangement" as an arrangement under Part 4A of the Petroleum (Onshore) Act that is either agreed between the licence/authority holder and the registered native title bodies or claimants, or determined by an arbitrator who can decide whether the holder is entitled to a right of access (Part 1, cl 3).

The Determination therefore operates by classifying a circumscribed set of NSW petroleum acts as "approved" under the Native Title Act, conditional on procedural protections for registered native title interests and cross‑referenced access and arbitration pathways contained in the NSW petroleum regime (Schedule 1, Parts 1-2). It commences on gazettal, as noted in the instrument (Notes).

The Determination rests on a narrow glossary and a short list of structural concepts drawn from the Petroleum (Onshore) Act (NSW) and the Native Title Act. The primary concepts and their operational meanings in this instrument are:

• Approved exploration etc. acts: The Determination itself declares specific acts listed in Part 2 to be approved exploration etc. acts under s 26A(1) of the Native Title Act, by the Attorney‑General's determination (opening paragraph, Part 2, cls 5-9). The Determination does not create a general power, it specifies a class of acts that meet the approval criteria.

• Low‑impact exploration licence and low‑impact special prospecting authority: These are licences or authorities that, for the purposes of this Determination, satisfy three conditions. First, the title must be subject to a condition that forbids prospecting on land where there are registered native title bodies or claimants except pursuant to an access arrangement (Part 1, cls 1(a), 2(a)). Second, each registered native title body corporate or registered native title claimant must have the same rights, including procedural rights, with respect to the making and enforcement of the access arrangement as if it were the fee simple holder (Part 1, cls 1(b), 2(b)). Third, for grants and certain conversions, notice of the application for grant or variation must have been served on any representative Aboriginal/Torres Strait Islander body for the area at least four months before grant or variation (Part 1, cls 1(c), 2(c)).

• Access arrangement: Defined specifically as an access arrangement under Part 4A of the Petroleum (Onshore) Act (NSW). It must be one of two types: an arrangement agreed between the licence/authority holder and each registered native title body corporate or claimant, or an arrangement determined for those parties by an arbitrator who has power to decide whether the holder is entitled to a right of access to the land (Part 1, cl 3).

• Reliance on NSW petroleum definitions: The Determination imports operational definitions from the Petroleum (Onshore) Act for "prospecting operations", "registered native title body corporate", "registered native title claimant", and "representative Aboriginal/Torres Strait Islander body" (Part 1, cl 4). This ties the Determination’s scope and operation directly to the NSW petroleum statutory framework.

• Types of acts approved: The list is precise. It includes the grant and renewal of exploration licences to which Division 2 of Part 3 of the Petroleum (Onshore) Act applies, where the title is a low‑impact exploration licence under Division 6 (cl 5 and 6), the grant and renewal of special prospecting authorities under Division 4 of Part 3, where those authorities are low‑impact under Division 6 (cl 7 and 8), and the variation of conditions under clause 15 in Part 3 of Schedule 1 to the Petroleum (Onshore) Act to convert an exploration licence to a low‑impact prospecting title (cl 9).

The Determination allocates legal effects and procedural duties across a limited set of actors, creating direct obligations or opportunities for specific parties while leaving other actors outside its mechanical scope.

• The Attorney‑General: The instrument is a statutory determination made by the Attorney‑General under subsection 26A(1) of the Native Title Act 1993. The Attorney‑General is the decision‑maker who, under that Commonwealth provision, declares the class of acts in Part 2 to be approved exploration etc. acts (opening paragraph). The Determination itself does not delegate the decision further; it enumerates the covered acts.

• Title holders and applicants under the Petroleum (Onshore) Act: Holders of exploration licences and special prospecting authorities and applicants for those instruments are the primary operational subjects. For a grant or renewal to be included in the approved class, the title must be a "low‑impact" licence or authority that carries the condition barring prospecting operations on land subject to registered native title bodies or claimants except in accordance with an access arrangement (Part 1, cls 1(a), 2(a); Part 2, cls 5-8). Consequently, licence and authority holders must ensure their titles include that condition and that access arrangements are in place before prospecting operations can legally occur on land where native title interests are registered.

• Registered native title bodies corporate and registered native title claimants: The Determination expressly protects procedural and substantive participation rights for these groups. Each registered native title body corporate, or registered native title claimant, must have the same rights, including procedural rights, with respect to making and enforcing the access arrangement as if it were the holder of the fee simple in the land (Part 1, cls 1(b), 2(b)). That equality of rights is a defined entitlement within the Determination’s framework.

• Representative Aboriginal/Torres Strait Islander bodies: For certain grant or variation events, notice must be served on any representative body for the area that includes the land covered by the licence or authority not less than four months before grant or variation (Part 1, cls 1(c), 2(c)). The requirement thus engages representative bodies as a procedural checkpoint prior to some grants and conversions.

• Arbitrators and dispute resolution mechanism: The access arrangement concept includes binding determination by an arbitrator who has power to determine whether the holder is entitled to a right of access to the land concerned (Part 1, cl 3(b)). This brings arbitrators within the decision‑making chain where parties fail to agree.

The Determination imposes, and clarifies, a small number of defined duties and rights deriving from its conditioning of "low‑impact" petroleum titles and the access arrangement mechanism. The duties and rights flow from the textual conditions in Part 1 and the list of included acts in Part 2.

Duties on title holders and applicants

• Condition forbidding prospecting except under an access arrangement: For a licence or authority to be treated as "low‑impact" under this Determination, it must be subject to the condition that the holder is not authorised to carry out prospecting operations on land where there are registered native title bodies corporate or registered native title claimants except in accordance with an access arrangement between the holder and each such registered native title body corporate or claimant (Part 1, cl 1(a), cl 2(a)). The immediate duty is to ensure titles carry that condition and that prospecting operations comply with it.

• Notice duty for certain grants and conversions: For grants of exploration licences (cl 5) and special prospecting authorities (cl 7) and for conversions of existing licences to low‑impact titles (cl 9), the Determination requires that notice of the application for grant, or for the variation to convert the licence, be served on any representative Aboriginal/Torres Strait Islander body for the area at least four months before the grant or variation (Part 1, cls 1(c), 2(c)). The duty is one of timely service of notice to the representative body.

Rights accorded to registered native title bodies and claimants

• Equivalent rights to fee simple holder for access arrangement making and enforcement: Each registered native title body corporate, or each registered native title claimant, is to have the same rights, including procedural rights, regarding the making and enforcement of the access arrangement as that body corporate or claimant would have if it were the holder of an estate in fee simple of the land concerned (Part 1, cls 1(b), 2(b)). This is an express substantive right embedded in the Determination; it covers both the negotiation phase and the enforcement phase of access arrangements.

Arbitration and dispute resolution powers

• Arbitrator power to determine entitlement to right of access: The Determination’s definition of "access arrangement" includes arrangements determined by an arbitrator who has the power to determine whether the holder of the licence or authority is entitled to a right of access to the land concerned (Part 1, cl 3(b)). The right to have an arbitrator adjudicate the entitlement to access is thereby incorporated into the framework and provides a route when agreement cannot be reached.

The Determination does not itself prescribe penalties, sanctioning regimes, or enforcement procedures in statutory form. Its text confines the instrument to a declaratory and classificatory role, specifying which petroleum acts are to be treated as approved exploration etc. acts and the conditions those titles must meet (opening paragraph; Schedule 1, Parts 1-2). The practical implications for enforcement therefore arise indirectly through two channels: the conditions attached to titles and the dispute resolution and statutory regimes the Determination cross‑references.

Indirect enforcement channels

• Statutory enforcement under the Petroleum (Onshore) Act (NSW): The Determination requires that low‑impact licences and authorities be annotated with a condition restricting prospecting operations except under an access arrangement (Part 1, cls 1(a), 2(a)). Any enforcement of that condition , whether through licence suspension, cancellation, civil penalty, or other regulatory remedy , will depend on the enforcement provisions of the Petroleum (Onshore) Act and subordinate instruments. The Determination does not itself specify the sanctions for breach.

• Enforcement via access arrangements: Access arrangements under Part 4A of the Petroleum (Onshore) Act are the procedural vehicle for lawful access to land with registered native title interests (Part 1, cl 3). Such access arrangements may include enforcement mechanisms and remedies, but the content and enforcement of those arrangements derive from Part 4A and the agreement or arbitration outcome, not from the Determination itself.

• Arbitration outcomes: The Determination contemplates arbitrator determinations of entitlement to access (Part 1, cl 3(b)). The Determination does not specify the enforcement mechanics for an arbitration award, but arbitration decisions determined under the processes referenced can be expected to have enforcement pathways provided by the relevant statutes and arbitration regime referenced in Part 4A of the Petroleum (Onshore) Act.

Matters not addressed by the Determination

• No penalties or offences in the Determination text: The Determination contains no schedule of fines, no criminal offences, and no administrative penalty framework. It does not specify who enforces compliance, what remedies are available to a registered native title body for breach beyond the right to enforce access arrangements, or how regulatory breaches are to be prosecuted.

This Determination is explicitly cross‑referential. It operates at the intersection of the Native Title Act 1993, the Petroleum (Onshore) Act 1991 (NSW), and the Acts Interpretation Act 1901. Its text repeatedly imports terms, dispute resolution routes, and procedural requirements from the NSW petroleum statute while deploying the Commonwealth Native Title Act as the authorising head of power for the Attorney‑General’s determination.

Primary cross‑references and their functional role

• Native Title Act 1993 (Cth): The Determination is made under subsection 26A(1) of the Native Title Act 1993, which is cited in the opening paragraph as the statutory basis for the Attorney‑General’s authority to determine that a class of acts is approved exploration etc. acts. The Determination therefore binds its operative classifications to the legal architecture and purposes of the Native Title Act, and has effect for the purposes of that Act (opening paragraph).

• Petroleum (Onshore) Act 1991 (NSW): The Determination repeatedly relies on the Petroleum (Onshore) Act for substance. It limits the class of approved acts to particular grants, renewals and variations under sections and divisions of that Act (Part 2, cls 5-9). It imports the definitions of key terms used in the Determination from that Act (Part 1, cl 4). It defines "access arrangement" as an arrangement under Part 4A of the Petroleum (Onshore) Act, including arrangements determined by an arbitrator with specific powers (Part 1, cl 3). Practically, this means the Determination is operationally effective only when read in tandem with the NSW petroleum statutory scheme.

• Acts Interpretation Act 1901 (Cth): The Determination includes commencement and interpretative notes that refer to the Acts Interpretation Act 1901. It notes that the Determination commences on gazettal, with statutory references provided (Notes), and cites paragraph 10A(a) of the Acts Interpretation Act 1901 as to how a reference to the short title of a State Act is to be construed (Notes). This ties the interpretative handling of references to the usual federal acts interpretation rules.

Mechanics of interaction

• Conditioning rather than supplanting: The Determination does not itself replace the substantive conditions or definitions in the Petroleum (Onshore) Act; instead it conditions the approval under the Native Title Act on compliance with specified elements that are themselves defined by and administered under the Petroleum (Onshore) Act (Part 1, cl 3-4; Part 2, cls 5-9). The two statutes therefore operate in a layered fashion, with the Determination functioning as a Commonwealth determination that signals when particular State‑law acts will be treated as approved under the Native Title Act.

The source document itself contains minimal material on amendment history. The Determination is dated 17 October 2000 and bears the signature of Daryl Williams, Attorney‑General (opening paragraph). The instrument’s note on commencement states that it commences on gazettal, with cross‑references to the Acts Interpretation Act 1901, section 48, and the Native Title Act 1993, section 214 (Notes). There is no further text in the provided source indicating any subsequent variations, revocations, or later instruments that amend the Determination.

Interpretative references relevant to amendment and currency

• Acts Interpretation Act 1901, paragraph 10A(a): The Determination includes a note citing paragraph 10A(a) of the Acts Interpretation Act 1901, which it quotes as providing that a reference to the short title of a State Act is to be construed as a reference to the Act as originally enacted and as amended from time to time (Notes). Functionally, this means that references in the Determination to the Petroleum (Onshore) Act 1991 should be read, for interpretative purposes, to include that Act as amended.

• Commencement on gazettal: The Determination contains a formal note that it commences on gazettal (Notes). The Determination does not state the date of gazettal in the text supplied, it provides the instrument date of 17 October 2000. Practitioners should therefore check the Commonwealth Gazette entry and any subsequent notices for the exact commencement date and for any later amendments or revocations not contained in the instrument text.

Absence of amendment entries

• No amendment schedule in the Determination itself: The Determination does not include a schedule of amendments, transitional provisions beyond the single conversion clause (cl 9), or a sunset clause. Clause 9 contemplates conversion of pre‑existing licences by variation under clause 15 in Part 3 of Schedule 1 to the Petroleum (Onshore) Act, but it does not specify transitional timing aside from the four‑month notice requirement where applicable (Part 1, cls 1(c), 2(c); Part 2, cl 9).

• No subsequent variations recorded in the source: The supplied text contains no record of later determinations altering this instrument. If users require confirmation of amendment history or revocation, they will need to consult the Commonwealth Gazette archives, the records of the Attorney‑General’s Department, or the legislative instrument registers for any subsequent determinations or notices.

The Determination text supplied does not include any litigation history, references to judicial decisions, or citations of cases. It names no judicial authorities and provides no account of challenges, appeals, or court orders relating to this particular instrument. The Determination is a statutory administrative instrument made under s 26A(1) of the Native Title Act and the text itself contains no statement as to whether it has been the subject of litigation.

Implications for research and advice

• No cases cited in the instrument: Because the Determination contains no judicial citations, users must search external legal databases, court records or the Federal Court’s native title listings if they require authoritative judicial treatment of the instrument or disputes concerning its application. The Determination’s operative phrases, including the definition of "access arrangement" and the condition equating native title parties’ rights to those of a fee simple holder, could be the subject of litigation, but the supplied text does not record such litigation.

• Necessity of external searches for precedent: To identify whether courts have construed the Determination, or whether disputes have arisen over the meaning of "same rights" as fee simple holder, the four‑month notice requirement, or the scope of arbitrator powers under Part 4A of the Petroleum (Onshore) Act as invoked in this instrument, independent case research is required. The Determination itself provides no internal litigation narrative or examples.

• Procedural disputes likely to arise in other forums: Given the Determination’s reliance on arbitration and access arrangements under the Petroleum (Onshore) Act, disputes about entitlement to right of access, enforceability of access arrangements, or compliance with notice obligations could be litigated under State or Commonwealth jurisdiction depending on the legal issue, but such litigation would need to be located outside this instrument.

In summary, the Determination, as supplied, contains no litigation history. Practitioners seeking case law must consult external sources to determine whether courts have interpreted or applied the Determination since its making.

The Determination is concise but contains several discrete features and potential traps for practitioners and licence holders when read on its own. These are matters that can affect timing, scope, and the legal status of operations under the instrument.

1. Narrow coverage to "low‑impact" titles only (Part 2, cls 5-8): The Determination approves only those exploration licences and special prospecting authorities that qualify as "low‑impact" under Division 6 of Part 3 of the Petroleum (Onshore) Act and that are in accordance with that Division. Acts outside Division 6 , that is, non‑low‑impact exploration or prospecting , are not included. Licence applicants should not assume that a standard exploration title is approved for the purposes of native title law simply because it is an exploration licence; it must meet the Division 6 low‑impact criteria and the specific conditions in this Determination.

2. Condition‑based approval, not unconditional legalisation (Part 1, cls 1(a), 2(a)): The Determination’s approval is contingent on the licence or authority being subject to the condition that prospecting operations on land with registered native title interests are not authorised unless in accordance with an access arrangement. If the licence lacks the required condition, the act will not meet the Determination’s definition of "low‑impact" and therefore will not be treated as an approved exploration etc. act under s 26A(1). Administrative oversight in drafting or registering the title condition can therefore nullify the intended approval.

3. Four‑month notice timing (Part 1, cls 1(c), 2(c)): For grants (cls 5 and 7) and conversions (cl 9) the Determination requires notice to be served on the representative Aboriginal/Torres Strait Islander body for the area not less than four months before grant or variation. The Determination distinguishes between grant and renewal: renewals (cls 6 and 8) are listed but the four‑month notice requirement is not expressed in relation to renewals in the text of Part 1. Practitioners should not assume the notice requirement is identical across all listed acts; the Determination ties the 4‑month notice specifically to grants and conversions in the clauses for which cl 1(c) and cl 2(c) apply.

4. "Same rights as fee simple" wording (Part 1, cls 1(b), 2(b)): The Determination requires that each registered native title body corporate or claimant be given the same rights, including procedural rights, regarding the making and enforcement of the access arrangement as if it were the fee simple holder. The phrase is potent but also open to interpretation: the Determination does not define the precise content or limits of "same rights", and it does not specify how disputed claims of entitlement would be reconciled beyond the arbitration mechanism referenced for access arrangements (Part 1, cl 3). Parties should therefore plan for negotiation and possible adjudication of what "same rights" entails in practice.

Compliance under this Determination requires aligning licence and authority forms, administrative timelines, and negotiation/arbitration practices with the Determination’s conditions and the referenced State petroleum procedures. The Determination is short, so compliance steps are correspondingly discrete but must be precise.

1. Ensure the title is a Division 6, Part 3 "low‑impact" title and carries the required condition

• Verify statutory basis: Confirm that the licence or authority you seek to rely on is one of the classes listed in Part 2 , grant or renewal of an exploration licence subject to Division 2 of Part 3 that qualifies as low‑impact under Division 6 (cl 5-6), grant or renewal of a special prospecting authority under Division 4 that is low‑impact (cl 7-8), or a variation to convert an exploration licence to a low‑impact prospecting title pursuant to clause 15 in Part 3 of Schedule 1 to the Petroleum (Onshore) Act (cl 9).

• Attach the mandatory condition: For the title to be treated as a low‑impact title in this Determination, ensure the instrument explicitly states the condition that the holder is not authorised to carry out prospecting operations on land where there are registered native title bodies corporate or registered native title claimants otherwise than in accordance with an access arrangement between the holder and each registered native title body corporate or claimant (Part 1, cls 1(a), 2(a)). That condition must be reflected in the licence or authority instrument or in a legally effective variation.

2. Give registered native title parties the prescribed rights in access arrangements

• Draft access arrangements that accord "same rights" as fee simple: When negotiating an access arrangement, ensure the arrangement provides each registered native title body corporate, or each registered native title claimant, the same rights, including procedural rights, regarding the making and enforcement of the access arrangement as if it were the holder of an estate in fee simple in the land concerned (Part 1, cls 1(b), 2(b)). Prepare to document precisely what rights are being conferred so the arrangement can withstand scrutiny.

• Use the Part 4A framework: The Determination defines "access arrangement" by reference to Part 4A of the Petroleum (Onshore) Act (Part 1, cl 3). Counsel and negotiators should work within that statutory framework when preparing agreements, and ensure the access arrangement either is agreed with each registered native title party or can be determined by an arbitrator under the Part 4A processes.
