Native Title Act 1994

The Act introduces several key concepts, most of which derive directly from the Commonwealth Native Title Act 1993 and are incorporated by reference. Section 5 provides that words and expressions used in the ACT Act have the same meanings as in the Commonwealth Act. This includes definitions of “native title”, “past act”, “category A past act”, “category B past act”, “category C past act”, “category D past act”, “non‑extinguishment principle”, and “past act attributable to the Territory”. Because the ACT Act does not repeat these definitions, a reader must consult the Commonwealth Act to determine which specific classes of governmental acts fall into each category.

Past act attributable to the Territory is the central concept of Part 2. It refers to any legislative or executive act done on behalf of the Territory before 1 January 1994 that would have been invalid due to native title had the Mabo doctrine been recognised at the time. The Commonwealth Act defines this term, and the ACT Act relies entirely on that definition.

Category A past acts (Commonwealth Act s 229) are typically grants of freehold, commercial leases, or public works (other than those covered by s 229(4)). Under s 8(1), these acts extinguish native title fully, subject to the special rule for public works. For a public work that falls within Commonwealth Act s 229(4), the extinguishment is confined to the actual location of the work, and for certain works (those under s 229(4)(a)) the extinguishment is deemed to have occurred on 1 January 1994. This backdating is significant: it means native title holders cannot claim that the work’s construction after that date gave rise to a right to compensation under the Commonwealth Act.

Category B past acts include most residential and agricultural leases. Where such an act is inconsistent with native title rights, the native title is extinguished only to the extent of the inconsistency. For example, if a lease grants exclusive possession over part of an area, native title rights such as the right to camp or hunt are extinguished for that part, but might survive on unleased parts.

Category C and D past acts cover most exploration and mining licences. They do not extinguish native title; instead the non‑extinguishment principle applies. This means that native title rights continue, but cannot be exercised in a way that conflicts with the valid act. Once the act ends (for example, the licence expires), native title revives fully.

Non‑native title rights and interests are defined in s 9(3) as rights or interests arising under legislation, common law, or equity that are not native title. These include, for example, statutory fishing rights, common law riparian rights, or easements. The Act preserves these rights and provides that the extinguishment provisions in s 8 do not affect them. This ensures that validation of past acts does not inadvertently remove existing non‑native title rights held by Aboriginal people or Torres Strait Islanders.

Confirmation of rights under Part 3 deals with the Crown’s ownership of natural resources and water, and with public access. These provisions are declaratory: they do not create new rights but confirm what the Crown and the public already had at the end of 1993. The confirmation does not extinguish native title (s 13), so native title rights to hunt, fish, or gather may coexist with Crown ownership, subject to any future valid acts.

The primary groups affected by the Act are:

Aboriginal peoples and Torres Strait Islanders who hold or claim native title rights and interests in relation to land and waters in the Australian Capital Territory. For them, the Act is mostly a limiting instrument. Part 2 validates past acts that may have extinguished or impaired native title, meaning that many potential claims to compensation or invalidity are foreclosed. The Act does not create a claims mechanism; that is left to the Commonwealth Act. However, s 8(5) provides a limited protection: the extinguishment of native title under the Act does not, by itself, give any right to eject or remove Aboriginal persons who reside on or exercise access over land covered by a pastoral lease that has been validated. This provision appears intended to prevent a pastoral leaseholder from using the validation as a basis for evicting Aboriginal occupants who had been living on the leasehold land under traditional or customary arrangements. But it only excludes the extinguishment as a ground for removal; other legal grounds (such as trespass or breach of lease) remain available.

The Crown in right of the Territory is the principal beneficiary. Section 11 confirms the Crown’s ownership of natural resources and its right to control water flows. This provides legal certainty for the Territory’s management of minerals, petroleum, forests, and water resources, and for the grant of licences and leases over those resources. The confirmation is retroactive in effect, as it “confirms” existing rights that might have been called into question after Mabo.

The public benefits from the confirmation of access to waterways and public places under s 12. This ensures that public rights to navigate, fish, swim, and recreate on water bodies, and to use public places that existed as at 31 December 1993, are not affected by native title claims. The confirmation does not extinguish native title, but it clarifies public rights that might otherwise be uncertain.

Pastoral leaseholders are directly affected by the validation of their leases. The Act validates any past grants, regrants, or extensions of pastoral leases that may have been invalid due to native title. This gives them secure title. However, s 8(5) means they cannot rely on the extinguishment of native title to evict Aboriginal residents who were already on the land.

Holders of other interests validated by Part 2 - such as freehold grantees, lessees, licensees, and public works authorities - receive the security of knowing that their titles are not open to challenge on native title grounds.

Resource users such as fishers and water users are affected by s 11(3), which confirms that existing fishing access rights prevail over any other public or private fishing rights. This appears to give priority to commercial or recreational fishing licences over, for example, any native title right to fish, but s 13 preserves native title so the interaction may require further interpretation.

The Act imposes very few direct duties. It is primarily declaratory and validating. The key rights it creates or confirms are as follows.

Crown rights: Section 11 confirms three categories of Crown rights: ownership of all natural resources (including minerals, petroleum, timber, and other subsoil assets); the right to use, control, and regulate the flow of water; and the priority of existing fishing access rights over other fishing rights. These are rights held by the Territory government against the world, including against native title holders. They are not qualified by any duty to consult or compensate, other than what might arise under the Commonwealth Act.

Public rights: Section 12 confirms public access to and enjoyment of waterways, beds and banks or foreshores of waterways, and public places as at 31 December 1993. This provides a statutory guarantee of continued access, which cannot be defeated by a native title determination. The right is to access and enjoyment, not to exclusive use, and it coexists with any native title (s 13).

Aboriginal rights preserved: Section 9 preserves beneficial reservations and conditions in past acts that are for the benefit of Aboriginal people or Torres Strait Islanders. Even if the past act would otherwise extinguish native title, any reservation or condition that benefits Aboriginal people remains unaffected. Similarly, s 9(2) preserves any non‑native title rights and interests held by Aboriginal people (such as statutory land rights or equitable interests). Section 8(5) creates a right not to be removed from pastoral lease land solely because native title has been extinguished. This right attaches to “any Aboriginal persons who reside on or who exercise access over land or waters covered by a pastoral lease the grant, regrant or extension of which is validated by section 7”. It is a negative right: it prevents the leaseholder or the Crown from using the extinguishment as a basis for removal.

No duties on private persons: The Act does not require individuals or corporations to take any positive steps. It does not establish a registration system, impose reporting obligations, or create compliance procedures. The only “duty” is a passive one: to recognise that certain past acts are valid and that native title may have been extinguished or suspended according to the category of the act.

The Act’s rights are largely defensive or declaratory. They clarify what rights exist but do not create new substantive entitlements for most parties. For example, a pastoral leaseholder’s rights are not created by this Act (they arise from the lease itself) but their validity is secured. A native title holder’s rights are not created either, but the Act limits their scope by extinguishing or suspending them in relation to many past acts.

The Native Title Act 1994 (ACT) contains no offence provisions and therefore no penalties for non‑compliance. The republication front matter includes a note about penalty unit values (individual $100, corporation $500), but this is a standard editorial note applied to all republished ACT laws; it does not imply that this particular Act creates any punishable conduct. The Act’s provisions are all either declaratory (confirming existing rights) or validatory (deeming past acts valid). They do not require anyone to do or refrain from doing anything, so there is nothing to enforce through criminal sanctions or civil penalties.

Enforcement under this Act therefore rests on the ordinary processes of law. If a person or government agency acts inconsistently with the Act’s provisions, an affected party may seek a declaration from a court about the validity of a past act or the effect on native title. For example, if the Crown attempts to dispose of a natural resource in a manner that contradicts s 11, or if a public authority blocks access to a waterway contrary to s 12, a native title holder or member of the public could challenge that action. But the Act itself does not specify a remedy. Any remedy would be sought under the Commonwealth Native Title Act 1993 (which provides for native title determinations, compensation, and future act regimes) or under general administrative law.

The Act’s interaction with the Commonwealth Act’s enforcement mechanisms is indirect. For instance, if a past act is validated under the ACT Act, a native title holder cannot later claim that the act was invalid under the Commonwealth Act. The National Native Title Tribunal and the Federal Court would take the ACT validation as a given fact in any determination. Therefore, the Act’s real enforcement mechanism is pre‑emptive: it removes the potential for litigation over the validity of past Territory acts.

The lack of penalties does not mean the Act is toothless. Its legal effect is automatic and self‑executing: validation occurs by force of the statute, without any need for a court order. If the Act says a past act is “valid and to be taken always to have been valid”, that is the legal position unless and until a court declares otherwise. In practice, uncertainty could arise if there is a dispute over whether a particular past act is “attributable to the Territory” or falls into a particular category. Such disputes would be resolved under Commonwealth native title law, not through a penalty regime.

The Act is explicitly subordinate to and integrated with the Commonwealth Native Title Act 1993. Section 4 defines “Commonwealth Native Title Act” as that Act. Section 5 imports all definitions from the Commonwealth Act. Section 6 and s 10 state that Parts 2 and 3 respectively are enacted in accordance with specific provisions of the Commonwealth Act (ss 19 and 212). This means the ACT Act operates as a complementary piece of legislation, filling the gap left by the Commonwealth Act for past acts attributable to the Territory. The Commonwealth Act sets out the national framework for native title; the ACT Act applies that framework within the Territory by validating Territory acts and confirming Territory rights.

Relationship with the Commonwealth Act’s validation regime: The Commonwealth Act, in its original form, validated past acts attributable to the Commonwealth and the states, but each state and territory needed to enact its own validation legislation for its own past acts. The ACT Act does exactly that. It is modelled on the same categories and principles. If the Commonwealth Act is amended, the definitions incorporated by s 5 will automatically change (since s 5 refers to “the Commonwealth Native Title Act” as amended from time to time). However, the ACT Act’s specific provisions (ss 7‑9, 11‑13) would not automatically change; they would need amendment.

Relationship with the Legislation Act 2001 (ACT): The republication notes indicate that the Legislation Act 2001 applies and that the Parliamentary Counsel can make editorial changes under Part 11.3. Section 2 (the commencement provision) was omitted by such an editorial change, meaning the Act’s commencement is now governed by the Legislation Act 2001. This is a technical interaction but is irrelevant to substantive rights.

Interaction with land and resource laws: Sections 11 and 12 confirm Crown ownership of natural resources and public access. These provisions sit alongside ACT laws governing mining (e.g., the Mining Act 1992), water (e.g., the Water Resources Act 1998), fisheries (e.g., the Fisheries Act 2000), and public lands (e.g., the Territory Plan). The confirmation does not repeal or modify those laws; rather, it provides a foundational statement that the Crown’s rights are not diminished by native title. For example, if the Water Resources Act gives the Crown power to grant water licences, s 11(2) confirms that this power always existed despite any native title claim. Similarly, s 12 confirms that public access to waterways is not impaired, which may affect any exclusive native title claims over riverbeds.

Interaction with native title determinations: When the Federal Court or the National Native Title Tribunal determines whether native title exists in an area in the ACT, it must take into account the validation and extinguishment effects of this Act. Part 2 of the Act, read with the Commonwealth Act categories, will determine whether a particular past act has extinguished native title (Category A or B) or merely suspended it (Category C or D). This is a critical interaction: native title holders cannot assert rights inconsistent with a validated Category A past act.

Preservation of other rights: Section 9(1) provides that nothing in s 8 affects any reservation or condition in a past act that benefits Aboriginal people or Torres Strait Islanders. This means that if a past lease or grant contains a condition reserving access for traditional hunting, that condition survives. Section 9(2) preserves any non‑native title rights and interests held by Aboriginal people, such as statutory land rights under the Aboriginal Land Rights Act 1976 (Cth) or common law equitable interests. Section 13(b) provides that the confirmations under Part 3 do not affect any law that confers benefits only on Aboriginal people or Torres Strait Islanders, such as the Aboriginal and Torres Strait Islander Heritage Protection Act 1984 (Cth) or any ACT heritage laws.

Interaction with the ACT Human Rights Act: While not mentioned in the text, the interaction is indirect. The validation of past acts could be argued to affect native title holders’ right to property under s 19 of the Human Rights Act 2004 (ACT), but that Act postdates this republication (it commenced in 2004). As the source does not mention it, no further comment is possible.

According to endnote 4 of the republication, the Act has been amended only once since its enactment in 1994. The sole amendment is the omission of section 2 (the commencement provision), made by the Legislation (Consequential Amendments) Act 2001 (A2001‑44), amendment 1.2909, which commenced on 12 September 2001. The omission was an editorial change under the Legislation Act 2001, part 11.3. Section 2 originally provided the commencement date for the Act; its removal means the Act’s commencement is now governed by the generic provisions of the Legislation Act 2001 (s 73, which deems an Act to commence on the notification date unless otherwise specified). The original commencement date was 1 November 1994, as noted in the legislation history.

The Act has not been substantively amended in any other respect. No new provisions have been inserted, and no sections have been repealed or substituted. The amendment history confirms that the Act remains largely as originally enacted in 1994. This is noteworthy given the significant developments in native title law at the Commonwealth level, including the 1998 amendments to the Commonwealth Native Title Act. The ACT Act has not been updated to reflect those changes. For instance, the Commonwealth Act now contains detailed provisions regarding future acts, registration of indigenous land use agreements, and compensation; none of these are mirrored in the ACT Act because it deals only with past acts and confirmation of rights. The lack of amendment suggests either that the ACT government considers the Act adequate for its limited purpose, or that any necessary updates have been handled through the Commonwealth Act’s direct operation.

The legislation history notes that the original Act was notified on 1 November 1994 and commenced the same day. The only later enactment affecting it is the 2001 consequential amendments law, which was a standard omnibus bill adjusting various ACT statutes to account for the commencement of the Legislation Act 2001. No other amending laws are listed.

The practical implication is that the Act is now a relatively static piece of legislation. Those researching native title in the ACT must rely heavily on the Commonwealth Act for modern concepts such as the future act regime, the right to negotiate, and the National Native Title Tribunal’s processes. The ACT Act’s role is limited to validating historic acts and confirming Crown rights; it does not purport to be updated for contemporary native title practices.

The provided text of the Act does not contain any reference to litigation history. The endnotes and amendment history do not mention any court decisions that have interpreted or applied the Act. This is not surprising for a small, targeted Act. The Act’s provisions are largely declaratory and validating, and they interact with the much larger Commonwealth native title regime. Most native title litigation in the ACT would likely be brought under the Commonwealth Act, with the ACT Act being invoked as a subsidiary source of validation.

Nevertheless, the Act could be expected to arise in litigation in the following ways. First, in a native title determination application, the Court would need to determine whether a particular past act is “attributable to the Territory” and which category it falls into. The Act does not provide a definition of that term, so the Court would look to the Commonwealth Act. Disputes could arise about whether a particular act is a “past act” (i.e., done before 1 January 1994) or a “future act” (after that date), and whether it is attributable to the Territory or to the Commonwealth. The validity of a lease granted by the Commonwealth over land that later became the ACT might be disputed. The Act’s s 7 says a past act attributable to the Territory is valid: if the act is attributable to the Commonwealth, the ACT Act does not apply and the Commonwealth Act’s own validation would need to be considered.

Second, s 8(5) could be litigated if a pastoral leaseholder seeks to evict Aboriginal residents. The provision says extinguishment “does not by itself give any right to eject or remove” such persons. The phrase “by itself” suggests that if there is another independent ground for removal (e.g., breach of lease terms or a court order), the extinguishment can be used as an additional justification. Courts would need to interpret what “by itself” means and whether the section creates a statutory immunity or merely prevents the leaseholder from relying solely on the extinguishment.

Third, the confirmation provisions in Part 3 could be tested if there is a dispute about public access. For example, if a waterway is subject to a native title claim that asserts exclusive rights, the confirmation of public access under s 12 would be relevant. The section says access is “confirmed”, but s 13 says this does not extinguish native title. The coexistence of public access and native title could lead to litigation over whether native title rights (e.g., to exclude others) survive despite the confirmation.

Because the source text provides no litigation history, it would be speculative to name any cases. The Act’s limited scope and its reliance on Commonwealth definitions mean that most judicial consideration of related issues would occur under the Commonwealth Act, with the ACT Act cited as a backdrop. Researchers should check the Federal Court database for any native title determinations in the ACT that reference this Act.

Practitioners should be alert to several traps in this Act that could catch the unwary.

1. Definitions are not in the Act. Section 5 provides that words and expressions have the same meanings as in the Commonwealth Native Title Act 1993. This means a lawyer cannot interpret the ACT Act without having the Commonwealth Act open on the same desk. The categories of past acts, the concept of “attributable to the Territory”, and the non‑extinguishment principle are all defined in the Commonwealth Act. Assuming that a category A act always extinguishes native title is dangerous: s 8(1) expressly excludes Commonwealth Act s 229(4) acts, which are subject to a different rule. The ACT Act does not reproduce that rule, so one must read the two Acts together.

2. The backdating provision in s 8(2)(b). For certain public works (those covered by Commonwealth Act s 229(4)(a)), the extinguishment is deemed to have occurred on 1 January 1994. This backdating means that even if the public work was constructed after 1 January 1994, it is treated as if it extinguished native title on that date. This defeats any argument that the construction was a “future act” requiring compliance with the future act regime, including the right to negotiate. Native title holders cannot claim compensation for the period between 1 January 1994 and the actual construction date, because the extinguishment is backdated.

3. The limited scope of s 8(5). The protection against ejection from pastoral lease land is narrow. It only applies to “any Aboriginal persons who reside on or who exercise access over land or waters covered by a pastoral lease the grant, regrant or extension of which is validated by section 7”. It does not apply to Aboriginal persons on other types of land (e.g., freehold or residential leasehold). It also only prevents removal “by itself” because of the extinguishment; if the pastoral leaseholder has another legal basis for eviction (e.g., breach of lease, trespass, or a court order), the extinguishment can be used as an additional ground. The phrase “by itself” invites litigation over what constitutes a separate ground.

4. The confirmations do not impair native title, but they clarify rights. Section 13 says that confirmations under Part 3 do not extinguish or impair native title. However, the confirmations might indirectly affect the content of native title. For example, if the Crown’s right to regulate water is confirmed, native title rights to take water may be subject to that regulatory power. A native title holder cannot argue that the Crown has no right to grant water licences; s 11(2) confirms that right. The common law might otherwise have allowed a path for native title to prevail over Crown rights, but the Act closes that possibility.

5. The Act does not cover future acts. A common mistake is to think that because the Act validates past acts, it also governs future dealings with native title. It does not. Future acts in the ACT are regulated entirely by the Commonwealth Act’s future act regime (Part 2, Division 3). This means that any grant of a lease, mining licence, or other interest after 1 January 1994 must comply with the Commonwealth Act’s procedures (including the right to negotiate if applicable). The ACT Act is silent on this; relying on it for future acts would be a serious error.

6. The omission of s 2 (commencement). The 2001 amendment removed the original commencement section. The Act now commences under the Legislation Act 2001. This is a technical trap: a researcher looking at an older version of the Act might not realise that the commencement provision has been deleted, and might assume the Act commenced on a different date. The republication note clarifies this, but the omission could cause confusion in historical research.

7. The Act does not create a right to compensation. Nowhere does the Act provide for compensation for the extinguishment or impairment of native title. The Commonwealth Act does contain compensation provisions (s 17), but those apply to Commonwealth acts and to future acts. The ACT Act’s validation of past acts is not accompanied by any compensation mechanism. Native title holders whose rights were extinguished by a validated past act have no claim under this Act; any claim would have to be brought under the Commonwealth Act, if applicable.

Because the Act imposes no positive duties or prohibitions, “compliance” is not about taking specific actions but about understanding how the Act affects legal rights and obligations. The following steps are relevant for different actors.

For the Territory government and its agencies: The primary compliance obligation is to recognise that past acts attributable to the Territory are valid and have the effects described in Part 2. When managing land or natural resources, government officers should check whether any proposed dealing or decision interacts with a past act that has been validated. For example, if the Crown intends to sell or lease land that was the subject of a pre‑1994 grant, it can rely on that grant’s validity. However, if the land has never been the subject of a past act (i.e., it is vacant Crown land as at 1994), native title may still exist and any future dealing must comply with the Commonwealth Act’s future act regime, not the ACT Act. Therefore, the government must maintain accurate records of past acts to determine whether validation applies.

For native title holders and claimants: To assert or protect native title, one must first identify whether any past acts have extinguished or suspended the native title under this Act. This requires a careful analysis of each past act on the relevant land, its category (A, B, C, or D), and the specific provisions of s 8. For land subject to a Category A freehold grant, native title is likely extinguished entirely. For land subject to a Category C exploration licence, native title subsists but cannot be exercised inconsistently with the licence. Native title holders should monitor any future acts under the Commonwealth Act, as the ACT Act provides no protection for those. They should also note the backdating provision in s 8(2)(b), which may have extinguished claims for compensation for public works.

For pastoral leaseholders: The Act validates their leases. They can deal with the leasehold interest (e.g., transfer, mortgage) free from any fear of invalidity. However, s 8(5) means they cannot rely solely on the extinguishment of native title to evict Aboriginal residents who were on the land before the validation. To avoid liability, leaseholders should ensure that any evictions are based on independent legal grounds, such as breach of a tenancy agreement or trespass, and not solely on the extinguishment.

For members of the public: Compliance requires no positive action. Those who use waterways or public places can continue to do so, as s 12 confirms their access. However, if a native title claim is lodged over an area, the public access right is not affected by the confirmation; it is preserved, but native title also survives (s 13). The coexistence may lead to practical disputes (e.g., over fishing or camping rights), but these are resolved under the Commonwealth Act, not this one.

For legal practitioners: Compliance involves correct cross‑referencing. Any advice on native title in the ACT must consider both the ACT Act and the Commonwealth Act. The definitions in the Commonwealth Act must be checked to categorise past acts. The non‑extinguishment principle under s 8(4) applies only to Category C and D acts; one must verify which category applies from the Commonwealth Act. Practitioners should also ensure they are using the most recent version of the ACT Act, as the omission of s 2 could affect historical questions of when the Act commenced.

In summary, compliance with the Native Title Act 1994 (ACT) is essentially a matter of legal analysis rather than administrative action. The Act operates automatically; the only “compliance” is to take its provisions into account when assessing the validity of past acts and the survival of native title. Failure to do so could result in incorrect legal opinions, invalid dealings, or missed opportunities to protect native title.
