National Vocational Education and Training Regulator (Data Provision Requirements) Instrument 2020

NVR registered training organisation (RTO): An organisation registered under the Act to deliver VET services, defined in section 3 of the Act. The instrument extends obligations to applicants for registration via paragraph 5(2), meaning that the data must be provided as part of the application process before any right to operate exists.

AVETMISS data: The Australian Vocational Education and Training Management Information Statistical Standard, a set of data elements maintained by the National Centre for Vocational Education Research (NCVER). The standard is referenced online and updated from time to time. Section 7 requires RTOs to provide this data “as required under the National VET Provider Collection Data Requirements Policy”, which itself is an external policy endorsed by the Ministerial Council and updated without legislative amendment.

National VET Provider Collection Data Requirements Policy: A policy forming Part B of the National VET Data Policy, endorsed by the Ministerial Council on 24 November 2017 and updated from time to time. This policy dictates the specific AVETMISS data elements and submission schedules. The instrument provides no definition of what the policy requires; compliance therefore depends on accessing and interpreting an external document that can change at Ministerial Council direction.

Financial Viability Risk Assessment Requirements and Fit and Proper Person Requirements: These are defined in section 3 of the Act. The instrument requires RTOs to provide any information needed to assess compliance with these requirements (paragraphs 8(1)(c) and (n)), and imposes a duty under subsection 8(3) to report any event that results in non compliance “as soon as practicable”. The terms of these requirements are not set out in this instrument; they are separate legislative instruments or policies.

Quality indicators: Agreed by the Ministerial Council, these are the metrics against which RTOs must report annually by 30 June for the previous calendar year. The instrument does not list the indicators; they are defined externally and can be changed without amending the instrument.

VET Quality Framework: Defined in section 3 of the Act to include the requirements of this instrument. As a result, any decision or obligation under the Act that references the VET Quality Framework incorporates the data provision requirements. This includes registration decisions under section 17 and ongoing compliance under sections 21 and 22.

Incorporation by reference: The instrument repeatedly relies on external documents “as in force or existing from time to time”. Section 191A of the Act authorises this practice, which means that changes to the AVETMISS standard, the National VET Provider Collection Data Requirements Policy, or the quality indicators take effect for RTOs without notice or amendment to this instrument. This creates a dynamic regulatory environment where the exact scope of obligations is not fixed in a single publicly accessible document, increasing compliance risk and search costs for RTOs, particularly smaller providers with limited legal resources.

The primary direct subjects are NVR registered training organisations, which are typically private businesses (including sole traders, partnerships, companies, and incorporated associations) as well as some government or community based entities. The instrument also applies to applicants for registration under Part 2 of the Act by virtue of paragraph 5(2). This means that even before an organisation is permitted to deliver VET services, it must compile and provide the data listed in section 8. The decision to register is contingent on compliance with this instrument as part of the VET Quality Framework.

Inside each RTO, executive officers and high managerial agents are identified as individuals whose names and contacts must be provided (paragraph 8(1)(j) and (k)). Their conduct also matters for the Fit and Proper Person Requirements. The instrument indirectly affects trainers and assessors, because their credentials, supervisory arrangements, and working with children check details must be documented and provided on request (paragraph 8(1)(o)(ii) and (iii) and paragraph 8(1)(x)). The compliance burden falls on the RTO, but the data concerns individuals who may not have direct control over the organisation’s reporting practices.

The instrument also affects third parties with whom RTOs contract. Where training is delivered through a contract with another organisation (excluding employment contracts, leases, or hire arrangements), the RTO must provide details of that organisation’s ABN, contact details, contract terms, services to be provided, location, and which party retains VET records (paragraph 8(1)(u) and (v)). This can expose commercially sensitive relationships to the Regulator and may raise privacy or confidentiality concerns for subcontractors.

Students are indirectly affected: the AVETMISS data and quality indicator reporting include student level data (enrolment, outcomes, satisfaction). For overseas students, the instrument cross references the Education Services for Overseas Students Act 2000, requiring details of approvals held. Students under 18 attract additional data obligations concerning working with children checks and management policies.

Commonwealth, state, and territory governments that fund VET are interested in the data produced, and the instrument asks whether the RTO intends to apply for or receives such funding (paragraph 8(1)(t)). This information may be used to allocate public funds or to monitor compliance with funding agreements, but the instrument does not restrict how the Regulator uses the data.

The compliance burden is not uniform: small RTOs with lean administrative resources will face proportionally higher costs to maintain the systems needed to respond quickly to Regulator requests and to track changes for the update obligations under subsection 8(2). The instrument does not provide for cost recovery or exemption based on size.

Duty to provide AVETMISS data (section 7): The RTO must provide AVETMISS data as required under the National VET Provider Collection Data Requirements Policy. This is an ongoing obligation, not a one off task. The policy dictates the frequency and format of submissions. Because the policy is incorporated by reference and can be updated, the duty is dynamic.

Duty to provide data on request (section 8(1)): Upon request from the National VET Regulator, the RTO must provide any of the 28 categories of information listed in paragraphs (a) through (zb). The Regulator may specify a timeframe. No lower limit on the timeframe is stated, so in theory the Regulator could demand data within a very short period. The duty is triggered solely by the Regulator’s request; there is no requirement that the request be reasonable or proportionate.

Duty to update certain categories as soon as practicable after a change (section 8(2)): The RTO must notify the Regulator of changes to information provided under paragraphs (1)(a), (d), (e), (f), (g), (h), (j), (k), (p), (q), (r), (s), (t), (u), (v), (w), and (x) (the latter only in respect of whether training is delivered to students under 18). The trigger is an “event” that changes the details. The standard “as soon as practicable” is vague and creates legal uncertainty: an RTO that notifies a week after a change might be considered compliant or not depending on the Regulator’s interpretation.

Duty to report non compliance with Financial Viability Risk Assessment Requirements or Fit and Proper Person Requirements (section 8(3)): This is a mandatory self reporting obligation. If an event occurs that results in non compliance with either requirement, the RTO must provide details “as soon as practicable”. This is a strict duty; there is no materiality threshold. Even a technical or temporary non compliance must be reported.

Duty to provide annual quality indicator summary (section 9): By 30 June each year, the RTO must provide a summary report detailing performance during the previous calendar year against the quality indicators agreed by the Ministerial Council. The indicators are not defined in the instrument, so the RTO must look to external sources to know what to report.

Rights of the RTO: The instrument does not confer any rights on the RTO. There is no right to refuse a request, no right to be informed of the purpose of the data collection, no right to challenge the proportionality of a request, and no right to have data kept confidential (though the Act may contain protections not mentioned here). The RTO’s only meaningful right is to seek judicial review of a decision to cancel or impose conditions for breach, but that depends on the Act, not this instrument.

The instrument itself does not prescribe penalties. Instead, non compliance constitutes a breach of a condition of registration under sections 21 and 22 of the Act. The Act provides enforcement powers to the National VET Regulator, including the power to cancel or suspend registration, impose additional conditions, issue infringement notices, and seek civil penalties. The maximum civil penalty under the Act is not specified in this instrument, but it can be substantial. Additionally, providing false or misleading information could attract criminal liability under the Criminal Code (e.g., section 137.1 of the Criminal Code Act 1995 (Cth)).

The Regulator has discretion to decide what action to take for non compliance. The instrument does not set out any graduated enforcement framework. Breaches can range from a single missing update to systemic failure to maintain requested data. Because the update obligations under subsection 8(2) are triggered by any change and must be reported “as soon as practicable”, even minor administrative delays could technically constitute a breach, potentially exposing the RTO to enforcement action.

The annual reporting requirement under section 9 is also a condition of registration. Failure to submit the summary report by 30 June could lead to sanctions. The quality indicators are externally defined, so an RTO that reports using the wrong metrics or a different format may be deemed non compliant.

The Regulator’s data request power is broad, and refusal to provide requested data could be seen as a breach of section 8(1). There is no express statutory right to challenge a request before it must be complied with; the RTO would have to comply under protest and then seek review if penalised.

The instrument does not provide a defence of reasonable excuse for failing to provide data. However, the Act may contain defences that are not mentioned here. Given the extensive list of data categories, an RTO that cannot locate certain records (e.g., historical certificates of incorporation) may find itself in breach through no fault of its own.

This instrument is made under the National Vocational Education and Training Regulator Act 2011 and forms part of the VET Quality Framework. It interacts with several other Commonwealth Acts through paragraph 8(1)(m), which asks whether the RTO, its executive officers, or high managerial agents hold similar roles in applications under the Education Services for Overseas Students Act 2000, the Tertiary Education Quality and Standards Agency Act 2011, or the Australian Education Act 2013. This cross referencing allows the Regulator to coordinate oversight with ASQA, TEQSA, and the Department of Education, and to identify risks across the tertiary education sector.

The instrument also references the Education Services for Overseas Students Act 2000 in paragraph 8(1)(s), requiring details of approvals held or applied for. An RTO offering training to overseas students must comply with the ESOS Act and the National Code of Practice for Providers of Education and Training to Overseas Students. The data provided under this instrument may be shared with the ESOS regulator.

Corporations law is relevant via the requirement to provide ACN (paragraph 8(1)(e)) and certificate of incorporation (paragraph 8(1)(b)). The definitions of executive officer and high managerial agent are taken from the Act, which may cross reference corporations law concepts of officer and agent.

The instrument incorporates by reference the National VET Provider Collection Data Requirements Policy, the AVETMISS standard, and the quality indicators agreed by the Ministerial Council. Section 191A of the Act allows these to be updated without amending this instrument. This means that changes to those external documents automatically become binding on RTOs. There is no requirement for the Minister or regulator to publish notice of changes in the Federal Register of Legislation or to give transitional periods. This creates a risk that RTOs may be unaware of updated obligations.

The instrument does not interact directly with privacy legislation. The Act may contain provisions protecting VET student records (defined in section 3 of the Act), but this instrument does not mention the Privacy Act 1988. The data collected includes personal information (names of executive officers, working with children check details), and the Regulator’s handling of that data would be subject to the Privacy Act if the Regulator is an agency covered by that Act. However, the instrument gives no guidance on data retention, use, or disclosure.

State and territory laws on working with children checks are referenced in paragraph 8(1)(x). The RTO must provide details about which of its personnel hold checks “required to hold one under a law of a state or territory”. This means the RTO must navigate varying state requirements and produce evidence on request.

This instrument was made on 20 November 2020 by Senator the Hon Michaelia Cash, Minister for Employment, Skills, Small and Family Business. It commences on 1 March 2021, as stated in the table in section 2. The instrument repeals and replaces the Data Provision Requirements 2012 in their entirety (Schedule 1).

No subsequent amendments are reflected in the source text provided, which is the instrument as originally made. The instrument does not contain a sunset clause or review date. However, because it incorporates by reference external policies that may be updated from time to time, the practical effect can change without legislative amendment.

The 2012 instrument was the first iteration. The 2020 instrument appears to expand the data categories (for example, the addition of paragraph (za) concerning information technology requirements under subsection 211(2B) of the Act). It also restructures the update obligations to include more categories under subsection 8(2).

The instrument does not include transitional provisions for RTOs that were already registered under the 2012 regime. There is no grace period for existing RTOs to adjust their systems to the new requirements. The commencement date of 1 March 2021 applies uniformly.

The instrument is a legislative instrument subject to tabling and disallowance under the Legislation Act 2003. However, the use of incorporation by reference means that substantive changes to data obligations can occur without further disallowance.

The instrument itself does not record any litigation history. There are no references to court cases or tribunal decisions. This is typical for a legislative instrument; any litigation would challenge decisions made under the Act citing this instrument.

Potential legal issues that could arise include: challenges to the lawfulness of a data request as ultra vires the Act, disputes over whether a particular data category falls within the scope of the instrument, claims that the Regulator has acted unreasonably in demanding information within an impossibly short timeframe, or arguments that the incorporation by reference of external policies without sufficient notice breaches procedural fairness.

Because the instrument is a condition of registration, disputes may arise during enforcement actions where the Regulator alleges non compliance. An RTO could defend itself by arguing that the data requested was not relevant to the VET Quality Framework, or that the update obligation was not triggered because the change was not an “event” within the meaning of the instrument. The term “as soon as practicable” may also be litigated, as it imports a standard of reasonableness that courts can interpret.

There may also be challenges based on the instrument’s interaction with the Act’s provisions on natural justice and merits review. The instrument does not provide an internal review mechanism for data requests. An RTO subjected to a disproportionately burdensome request may seek judicial review under the Administrative Decisions (Judicial Review) Act 1977, but success would depend on establishing that the Regulator had taken into account irrelevant considerations or acted unreasonably in a Wednesbury sense.

No specific cases are known from the source, so none can be cited. But the broad discretionary power creates a fertile ground for future litigation, particularly as the Regulator expands data gathering under this instrument.

Vague update timeline: Subsection 8(2) requires updated details “as soon as practicable”. This is subjective. An RTO that updates within two weeks could be considered timely by one regulator but late by another. The instrument provides no safe harbour or definition.

No ceiling on requests: The Regulator can request data under section 8(1) repeatedly. There is no limit on frequency, and no threshold such as “reasonable grounds”. A small RTO could be subject to multiple requests in a short period, with no right to object.

Incorporation by reference without notice: The AVETMISS standard, the National VET Provider Collection Data Requirements Policy, and the quality indicators can change without amendment to this instrument. RTOs must monitor these external sources to stay compliant. Missing a change could result in breach.

Applicants must comply before registration: Paragraph 5(2) extends the instrument to applicants. This means an entity seeking registration must compile the full set of data under section 8(1) even though it has no revenue or students yet. The cost of compliance can be a barrier to entry.

Contractual relationships exposed: Paragraphs 8(1)(u) and (v) require detailed information about third party training contracts, including the subcontractor’s ABN, contact details, contract terms, and which party retains records. Commercially sensitive arrangements must be disclosed, and the Regulator may share this with other agencies.

Automatic self reporting of non compliance: Subsection 8(3) requires reporting of any event causing non compliance with Financial Viability or Fit and Proper requirements “as soon as practicable”. There is no materiality threshold. A temporary cash flow issue could trigger the duty, potentially leading to regulatory scrutiny.

Annual reporting on externally defined indicators: Section 9 requires reporting against quality indicators agreed by the Ministerial Council. The instrument does not list the indicators. RTOs must identify them each year from Council decisions, which may not be widely publicised.

Working with children checks across jurisdictions: Paragraph 8(1)(x) requires details of working with children checks for any trainer, assessor, or staff member required to hold one under state or territory law. This means an RTO operating across multiple states must collect and provide check specific evidence for each jurisdiction.

IT capability evidence: Paragraph 8(1)(za) requires information about the RTO’s ability to meet IT requirements under a legislative instrument made under subsection 211(2B) of the Act. That instrument is not named. RTOs must locate it separately.

Public liability insurance: Paragraph 8(1)(zb) requires a copy of documentation demonstrating public liability insurance coverage. The instrument does not specify minimum cover amounts. The Regulator may reject inadequate cover as not demonstrating compliance.

No exception for hardship: There is no exemption for RTOs that cannot afford the administrative systems to track and report changes. The instrument applies to all NVR registered training organisations regardless of size or resources.

Start by understanding the full set of data obligations. An RTO should download and read the current versions of the AVETMISS standard, the National VET Provider Collection Data Requirements Policy, and the quality indicators agreed by the Ministerial Council. Because these can change, assign a person or team to monitor updates on the NCVER and Department of Education websites.

Establish a data repository containing all documents and information listed in section 8(1). This includes certificates of incorporation (current and historical), constitutions, ABN/ACN certificates, business name registrations, address details for all sites, list of executive officers and high managerial agents, contact details for public enquiries and the chief executive, previous registration identifiers, details of any other applications under specified Acts, information needed for Financial Viability and Fit and Proper assessments, full list of Training Packages and courses with training and assessment strategies, evidence of trainer credentials and supervisory arrangements, evidence of facilities and equipment, licensing authorisations, information about online/distance/offshore delivery, overseas student approvals, government funding details, third party contracts, fee collection policies (especially prepaid fees over $1,500), under 18 student policies and working with children checks, financial records management systems, AVETMISS compliance systems, IT capability evidence, and public liability insurance documentation.

Maintain this repository in an organised, up to date manner. For each category that is subject to the update duty under subsection 8(2), set up a monitoring system to detect changes. When a change occurs (e.g., a new executive officer is appointed, a physical address changes, a new contractor is engaged), the update must be communicated to the Regulator “as soon as practicable”. Aim to notify within a short period (e.g., 5 business days) to reduce the risk of non compliance.

For the AVETMISS reporting under section 7, ensure that the RTO’s student management system can capture the required data elements and that the organisation submits data in accordance with the National VET Provider Collection Data Requirements Policy. Establish a schedule to submit on time.

For the annual quality indicator report under section 9, collect data throughout the calendar year (January to December) and compile the summary report by the following 30 June. Identify which quality indicators apply from the Ministerial Council and ensure the report matches the required format.

Train staff on these obligations. Executive officers and high managerial agents should be aware that their personal details must be provided and updated. Trainers and assessors should know that their credentials and working with children checks must be documented and available.

Monitor compliance with the Financial Viability Risk Assessment Requirements and the Fit and Proper Person Requirements continuously. If any event occurs that results in non compliance, prepare a detailed notification and submit it as soon as practicable. This may involve consulting with accountants or legal advisors.

Finally, document all steps taken to comply. If a dispute arises, having a clear record of compliance efforts can assist in defending against allegations of breach. Consider engaging legal counsel to review the RTO’s compliance program, particularly given the incorporation by reference risks and the breadth of the Regulator’s request power.
