What it does
This short Act winds up a trust named in its Preamble, reallocates the trust’s assets, and sets out how the transferred money is to be held and used. Mechanically, on the day the Act commences the trusts established by the Deed of Trust referred to in the Preamble are revoked (section 4). The Minister must, as soon as practicable after commencement, divide the funds contained in the Preservation Fund into two equal parts and transfer one part into the Heritage Fund and the other part into a Heritage Account to be established by the Hobart City Council (section 5(1); section 6(1)). The Minister has express discretion to choose the form and manner of those transfers (section 5(2)).
The Act imposes use restrictions on each half. Funds transferred into the Heritage Account are to be applied for financial or other assistance in relation to places within the city of Hobart that are either heritage listed under a planning scheme or entered in the Tasmanian Heritage Register (section 5(3)). Funds transferred into the Heritage Fund must be applied for the provision of financial or other assistance for the purposes of the Historic Cultural Heritage Act 1995 (section 7(1)). The Act also places negative restraints: funds in the Heritage Fund may not be used for the purposes set out in section 13(a) or (b) of the Historic Cultural Heritage Act 1995 (section 5(4)), and funds in the Heritage Account may not be used to pay administration costs, including salaries, allowances, expenses or other obligations incurred in the administration of the Heritage Account (section 5(5)).
The Act creates an indemnity for persons who administer or intend to administer the former trusts in good faith, preventing the institution or continuation of actions against them for that administration (section 8(1)). That indemnity does not preclude actions to compel a person to perform duties imposed by this Act or to enforce a right of redemption over property that immediately before commencement was subject to the trust (section 8(2)). Administrative responsibility for the Act is assigned, until changed under the Administrative Arrangements Act 1990, to the Minister for Primary Industries, Water and Environment and the Department of Primary Industries, Water and Environment (section 9).
