173 Indemnity not affected by certain matters
(1) An indemnity under this Division is not affected merely because a vehicle or combination was in fact not a heavy vehicle or heavy combination. (2) An indemnity under this Division is not affected merely because a vehicle or combination was in fact not subject to a particular category of breach of a mass, dimension or load restraint requirement.
