164 Evidence regarding measuring and weighing
Note: It is intended that each jurisdiction will enact a provision for evidence to be obtained and given in a court that is based on weighing and measuring devices being in proper working order and properly operated, and associated matters, to the extent that the jurisdiction’s existing law does not already make appropriate provision. This might also cover intelligent transport system equipment. Reference might be made to the Transport Act 1983 (Vic) s 217 (Powers of officers authorized by Roads Corporation); the Land Transport Act 1998 (NZ) s 147 (Evidence of accuracy of weighing devices and sites); and Environment Protection Act 1970 (Vic) s 59AB (Evidence).
