126 Infringement penalty
(1) The infringement penalty for an offence is:
(a) the amount specified in Column 2 of Schedule 1 or 2 for the offence; or
(b) if an amount is not so specified for the offence—the amount prescribed by the regulations as the amount of the infringement penalty for the offence.
(2) The infringement penalty prescribed by the regulations for an offence must not exceed 20% of the maximum penalty that could be imposed on an individual by a court in respect of the offence. (3) An infringement penalty may not be prescribed by the regulations for an offence if Schedule 1 or 2 indicates that an infringement notice is not available for the offence.
Note: This clause is consistent with the in‑principle endorsement given by the Australian Transport Council in November 2000.
