103 Duty of responsible entity
(1) This section applies where a responsible entity offers a freight container to an operator for transport in this jurisdiction by a vehicle or combination. (2) The responsible entity must ensure that the operator or driver of the vehicle or combination is provided, before the start of the transport of the freight container in this jurisdiction, with a complying container weight declaration relating to the freight container. (3) The responsible entity is guilty of an offence if the responsible entity engages in conduct that contravenes subsection (2). (4) The offence is an offence of absolute liability. (5) The person charged with an offence under this section has the benefit of the reasonable steps defence.
