National Transport Commission (Model Rail Safety (Amendment No. 1) Bill) Regulations 2008

The model amendments centre on a limited set of recurring legal constructs: duties of rail transport operators, scope of “rail safety work”, the role of the Rail Safety Regulator, accreditation and registration regimes, audit and reporting powers, competence of rail safety workers, and incident and emergency management obligations.

Rail safety duties: The amendments preserve the core rule that rail transport operators have statutory duties under s 28 (the content of which is not fully reproduced here), and then extend those duties to certain contractors by inserting s 28A. Section 28A(1) treats non‑employee persons who undertake railway operations on or in relation to an operator’s infrastructure or rolling stock as subject to the operator’s duties “in relation to matters over which the operator has control or would have control if not for any agreement purporting to limit or remove that control”. Subsection 28A(2) then makes the contractor/person responsible to comply with those duties in respect of the railway operations they undertake.

Scope of rail safety work: The Bill amends the definition/description of activities that are rail safety work by reordering and expanding the list of activities in s 28(3) and by amending s 8(2) to allow regulations to prescribe classes of work not to be rail safety work (Schedule 1, s 4; s 28(2)-(4) amendments). Draft notes indicate jurisdictions may adopt zero‑tolerance or prescribed concentration approaches for alcohol/drugs and may use different defined terms such as “prescribed concentration”.

Accreditation, registration and procedural safeguards: The model amends accreditation processes (sections 31, 34, 37, 38, 44-53) to refine application requirements, variation mechanisms, suspension and withdrawal procedures, and to require written representations in key steps (for example, ss 44(3), 45(4)(a)(ii), substituted wording in ss 52-53). It also imposes a duty on the Rail Safety Regulator to issue a registration notice for private siding managers (s 56(3)) and enables public inspection of prescribed particulars (s 56(4)).

Regulator powers: The Rail Safety Regulator’s powers to seek information are broadened by substituted s 72. The regulator may require, by written notice, that an operator provide information about measures to promote rail safety, matters including financial capacity or insurance arrangements relevant to rail safety or accreditation, and any information prescribed by regulation. There is also a standing prescribed reporting obligation in s 72(3). Audits are formalised in substituted s 75, enabling audit programs and inspections whether under a program or not.

Competence and evidence of competence: Substituted s 68 requires operators to ensure each rail safety worker has the competence to carry out the relevant work. Competence is to be assessed against AQTF qualifications and units where they apply, or otherwise by prescribed provisions, and AQTF certificates are admissible as evidence of claimed qualifications (s 68(2)-(3)).

Incident and emergency management: The Bill changes terminology and reporting protocols: section 62 is amended to adjust the trigger language for security incidents, s 63 renames emergency plans to “emergency management plans” and adds unspecified penalties, and s 73 replaces “notifiable” with “certain” incidents and strengthens the formality (removing “form and” and requiring compliance with requirements under s 73(3)).

Form and prescription: Multiple amendments empower the regulator and the regulations to prescribe forms, times, particulars, and penalties (for example, s 162 is amended to include forms and to leave certain elements “[to be specified]”), while remaining model drafting leaves many substantive details to local adoption.

Taken together, the main conceptual thrust is to widen regulator information and audit reach, formalise procedural steps and written processes, extend operator duties to some contractors on a control test, and anchor competence assessments to recognised national training standards where available.

Primary public bodies and private parties affected by the model amendments are:

• Rail transport operators: Entities running railway operations are the central addressees of duties. The substituted and new provisions repeatedly require operators to hold accreditation (where required), maintain management systems, ensure worker competence, respond to regulator notices and audits, and provide prescribed information (ss 28/28A, 57, 59, 68, 72). The regulator may suspend or vary accreditation (ss 44-45), and operators will bear the compliance cost of written representations, reporting, audits and potentially unspecified penalties.

• Non‑employee contractors who undertake railway operations on or in relation to an operator’s infrastructure or rolling stock: New s 28A brings such persons within the scope of ss 28 duties “in relation to matters over which the operator has control or would have control if not for any agreement purporting to limit or remove that control” (s 28A(1)). Those contractors and “any employees of the person” must comply with extended duties (s 28A(2)). This expands the set of actors potentially liable under operator duties and may place compliance obligations on contractors who previously considered themselves outside the legislative duty net.

• Rail safety workers: Individuals who perform rail safety work are the object of competence requirements under substituted s 68. Operators must ensure workers are competent, and AQTF qualifications can serve as evidence (s 68(1)-(3)). The amendments to s 31 adjust who must be accredited or is exempt, with a new sub‑section excluding certain accredited operators from application of s 31(1) (see Schedule 1, amended s 31).

• Rail Safety Regulator: The regulator gains formal powers to require information in a specified manner and to demand prescribed periodic reports (s 72), to audit operations (s 75), and to issue/withdraw registration and accreditation notices (ss 44, 56). The regulator is also given discretion to prescribe forms, times and particulars (s 162 amendment).

• Rail infrastructure managers of private sidings and persons registering private sidings: The regulator must issue a notice of registration to managers who register a private siding (s 56(3)) and may be required to make prescribed particulars available for public inspection (s 56(4)), bringing private siding managers into a transparent register regime.

• Bodies corporate and natural persons: Many penalty provisions are framed for both natural persons and bodies corporate, although monetary/sanctioning particulars are left blank in the model. Hence both individuals and corporate operators are potential targets of enforcement (see repeated “Penalty: In the case of a natural person: In the case of a body corporate:” entries).

• Training and certification providers: The model links competence assessments to the Australian Quality Training Framework (AQTF) and Skilling Australia’s Workforce Act 2005 (s 68(2)(a)(i)), so providers and the content of nationally recognised training are implicated insofar as proof of AQTF qualifications will be used as evidence.

• Insurers and financiers: Because s 72(1)(b) explicitly allows the regulator to request information “including matters relating to the financial capacity or insurance arrangements” of an operator, firms providing insurance or credit to operators may find their arrangements subject to regulatory scrutiny as part of accreditation or ongoing reporting.

• Regulators and legal advisers in each jurisdiction: The Schedule includes multiple “Draft Note” and “Local variations” annotations, indicating jurisdictions will need to adapt the model to local OHS regimes, prescribed concentrations, penalty levels and forms. Legal and regulatory advisers will therefore be required to interpret and fill in placeholders when implementing the model.

Finally, because the Schedule is an adopted model rather than statute on its own, the real‑world impact depends on each jurisdiction’s adoption and local drafting choices; the prefatory note stresses the model “does not, of themselves, have any legal effect” until enacted (Schedule 1 prefatory note).

Duties created or clarified by the model amendments can be grouped into operator duties, contractor duties (via extension), worker competence duties, information/reporting duties, emergency/incident management duties, and procedural rights in accreditation processes.

Operator and contractor duties

• Core operator duties remain rooted in s 28 (the Principal Bill). The model inserts a new s 28A that extends those duties to non‑employee persons who undertake railway operations on or in relation to an operator’s rail infrastructure or rolling stock, and to their employees, “in relation to matters over which the operator has control or would have control if not for any agreement purporting to limit or remove that control” (s 28A(1)-(2)). Mechanically, this means an operator cannot avoid statutory duty by contracting out railway operations where the operator retains de facto control, and the contractor must also comply with the duties in respect of the operations it undertakes.

Competence obligations

• Section 68, as substituted, requires operators to ensure each rail safety worker who will carry out rail safety work has the necessary competence (s 68(1)). Competence must be assessed by reference to AQTF qualifications and units where they apply, or otherwise to prescribed provisions, and by reference to the worker’s knowledge and skills considering safety (s 68(2)). AQTF certificates are evidence of qualifications (s 68(3)). Thus operators must put in place competence assessment procedures and retain evidence.

Management system and accreditation duties

• Section 57 is amended to make clear that management system obligations apply to railway operations for which accreditation is required (s 57(1)-(2) amendments). Operators that must be accredited must develop and maintain a management system for the relevant operations.

Information, reporting and audit duties

• Section 72 is central: the Rail Safety Regulator may, by written notice, require operators to provide specified information, about safety measures, and matters including financial capacity or insurance arrangements, that the regulator reasonably requires, and may require prescribed information at prescribed times or at least once yearly where not prescribed (s 72(1)-(3)). Subsection 72(2) makes compliance with such notice mandatory, subject to penalty (unspecified). Audits are authorised in substituted s 75, which allows the regulator to prepare annual audit programs and inspect operations whether or not under an audit program (s 75(1)(b)-(c) and inserted s 75(5)).

Incident reporting and emergency management

• Section 62 is amended to rephrase triggers for security incidents and to carry an unspecified penalty. Section 63 renames “emergency plan” to “emergency management plan” and adds penalties. Section 73 replaces “notifiable” with “certain” in its heading, removes the requirement to use a prescribed form in s 73(1), and inserts an express penalty‑backed obligation to comply with requirements under s 73(3) (see substituted s 73 and new s 73(5)).

Procedural rights and requirements in accreditation processes

• Amendments to ss 44 and 45 alter the suspension/variation regime, allowing conditions and restrictions, modifying notice wording to permit partial suspensions or suspensions in respect of specified railway operations (s 44(1)(a)(i) changes and s 45(2) changes), and inserting an express provision that the regulator may withdraw a suspension by written notice (new s 44(3)). The Bill also standardises the right to make representations into a right to make written representations in key steps (for example, ss 44(4)(a)(ii) -> written representations; s 45(4)(a)(ii) -> written representations). The regulator must consider representations made under s 53(b) (s 53(2)(c) insertion).

Rights of operators and regulated parties

• Operators have procedural rights to make written representations prior to adverse action (as amended in ss 44, 45). Accredited operators and exempt operators are carved out from certain applications of s 31 by the new sub‑section 31(2), protecting those operators from some procedural obligations. The Rail Safety Regulator has discretionary rights: to require information (s 72), to audit (s 75), to suspend or vary accreditation (ss 44-45), and to issue or withdraw notice of registration (s 56).

Notice and document rights

• The model requires the Rail Safety Regulator to issue registration notices when private sidings are registered (s 56(3)), and it empowers prescribed particulars of registration to be made available for public inspection (s 56(4)). Section 46 is amended to specify the documents an operator must produce when required by the regulator, including current accreditation or exemption notices and notices of registration for private sidings, and “any other document prescribed by the regulations for the purposes of this section” (s 46 substituted wording).

Penalties and compliance obligations

• Many duties are backed by penalties, but the model generally leaves the penalty quantum unspecified and to be filled in at a local level, as shown repeatedly by the placeholder “Penalty: In the case of a natural person: In the case of a body corporate:” appearing across multiple substituted and inserted sections (e.g. s 28A, s 59, s 62, s 63, s 68, s 72, s 73).

In short, the model shifts duties to capture contracted operators where control exists, increases the regulator’s information and audit reach, formalises competence assessment against AQTF standards, and tightens accreditation procedural steps into written processes, while leaving many enforcement details for local prescription.

The model amendments expand the Rail Safety Regulator’s enforcement toolkit while leaving many penalty particulars unspecified. The enforcement mechanisms set out in the model are a mix of administrative, documentary, audit, accreditation and penal levers.

Penalty provisions

• Multiple sections, when amended or inserted, are followed by the formulaic penalty placeholder “Penalty: In the case of a natural person: In the case of a body corporate:”, without numerical amounts or gradations specified (examples include s 28A, s 59, s 62, s 63, s 68, s 72, s 73, s 146, s 160). This indicates the model contemplates criminal or civil penalties but defers specification of quantum and type to local drafting or later regulations.

Administrative enforcement powers

• The Rail Safety Regulator’s capacity to compel information and documents is central to enforcement. Substituted s 72(1) authorises the regulator, by written notice, to require operators to provide information “in a manner and form approved by the Rail Safety Regulator” on or before a specified date, including information about safety measures and financial capacity or insurance arrangements. Subsection 72(2) requires compliance with such notices, subject to penalty. Subsection 72(3) adds a standing prescribed reporting obligation at prescribed times or at least once a year if no times are prescribed.

• Section 46 (amended) lists documents the regulator may require, including current notices of accreditation, exemption notices, and registration notices for private sidings, and “any other document prescribed by the regulations” (s 46(1)(a)-(c) substituted). Failure to produce documents when lawfully required can be the basis for further administrative action.

Audit and inspection powers

• Substituted s 75 broadens the regulator’s powers: the regulator “may audit the railway operations of a rail transport operator” and may prepare and implement an audit program for each year to inspect railway operations, and may inspect operations for purposes of an audit whether or not under a program (s 75(1)(a)-(c)). The insertion of an express audit program mechanism expands routine oversight capacity.

Accreditation suspension, variation and withdrawal

• Sections 44 and 45 amendments refine the regulator’s ability to suspend or vary accreditation. The regulator may suspend accreditation, including in part, or in respect of specified railway operations (s 44(1)(a)(i) and s 45(2) amendments). New s 44(3) allows the regulator to withdraw a suspension by written notice. Procedural fairness is formalised by replacing “make representations” with “make written representations” in several places (ss 44(4)(a)(ii), 45(4)(a)(ii)), so regulated parties must present submissions in writing within any prescribed timeframe.

Incident reporting and emergency enforcement

• Sections 62 and 63 adjustments alter triggers for reporting security incidents and attach penalties for failures to have emergency management plans and report incidents, although the penalty detail is left unspecified. Section 73(5) imposes an express penalty‑backed obligation to comply with requirements under s 73(3).

Other enforcement-oriented provisions

• Section 56(3) requires the regulator to issue a notice of registration for private siding managers, and s 56(4) allows prescribed particulars of registration to be made available for public inspection if the regulations prescribe, which creates reputational and transparency pressure on registrants.

Implications of unspecified penalties and prescription

• The repeated placeholder penalties mean the model communicates enforcement intent but leaves the severity, classification (criminal v civil), and scale of sanctions to be determined at the jurisdictional drafting stage. This produces uncertainty for regulated parties until local regulations or statute fill in those fields. It also allows jurisdictions to calibrate enforcement severity to local policy choices, but at the cost of initial ambiguity for national operators about exposure.

Practical enforcement sequence

• The practical sequence implied by the model is: the regulator issues written notices requiring documents or information (s 72), conducts audits and inspections (s 75), may vary, suspend or withdraw accreditation (ss 44-45) subject to written representations, and may apply penalties for non‑compliance with information notices, reporting duties, competence requirements, and emergency planning obligations (placeholder penalties across ss 59, 62, 63, 68, 72, 73).

In sum, the model strengthens administrative enforcement through information, auditing and accreditation levers, while deferring hard penal calibration to implementing jurisdictions. The repeated shift to written process requirements also alters how regulated parties engage with enforcement, privileging documented submissions and records.

The Schedule makes several explicit cross‑references to frameworks outside the Principal Bill and anticipates local alignment with occupational health and safety regimes, training frameworks and regulatory instruments.

Interaction with training and skills legislation

• Substituted s 68(2)(a)(i) references “any qualification and any units of competence recognised under the Australian Quality Training Framework within the meaning of the Skilling Australia’s Workforce Act 2005 of the Commonwealth”. The model therefore treats AQTF recognised qualifications as primary evidence for assessing rail safety worker competence, linking rail safety compliance to nationally recognised vocational training schemes and Commonwealth legislation governing national training. Section 68(3) further provides that a certificate purporting to be issued under the AQTF is evidence of those qualifications. This integration aligns competence requirements with existing national training recognition systems.

Interaction with occupational health and safety (OHS) laws

• The draft note appended to new s 28A explicitly signals local variations to maintain consistency with OHS legislation: “Note: Local variations for consistency with OHS legislation” (Schedule 1, new s 28A note). This shows the drafters intended the rail safety operator‑contractor control linkage to be read and adapted to existing workplace safety duties in each jurisdiction, so that overlapping obligations are coordinated.

Interaction with regulatory instruments and forms

• Amendments to s 162 expand the list of matters regulations may cover, explicitly adding “forms for the purposes of this Act” and permitting prescription “[or convenient - local variations]”, and leaving some numerical elements “[to be specified]” (s 162 amendments). This cross‑links the Act to subordinate regulation making for particulars, forms, timeframes and penalty amounts, and thereby anticipates a two‑tier compliance structure: statute sets duties, regulations operationalise them.

Interaction with intergovernmental processes

• The Schedule’s prefatory materials make clear the model Bill was prepared for national consistency and approved by inter‑governmental bodies: the Principal Bill dates are recorded as the Model Provisions dated 10 April 2006, approved by the Australian Transport Council on 2 June 2006, and the Bill in this Schedule was approved by the Transport Agency Chief Executives (“TACE”) on 24 November 2006 (Schedule 1 note and footnote 1). The instrument is made under the National Transport Commission Act 2003. The model is therefore intended for inter‑jurisdictional consistency and adaptation under formal inter‑governmental processes.

Interaction with accreditation, registration and private property law

• The amendment mandating notices of registration for private sidings (s 56(3)) and the potential public availability of registration particulars (s 56(4)) interact with regulatory transparency and private property administration. The model treats private siding registration as a regulated step, with notice and potential public inspection, thereby intersecting with property holders’ obligations and registry practice in other laws.

Intersections and potential gaps

• Because many penalty amounts and some procedural specifics are left for local prescription, the model relies on implementing regulations and local legislation to define enforcement severity and precise procedural timelines. The model’s draft notes permitting “local variations” for zero drug tolerance regimes, choice of the defined term (“prescribed concentration” v “relevant concentration”), and the insertion of “[to be specified]” placeholders create necessary points of intersection with local criminal codes, OHS statutes, administrative law standards and training recognition systems.

Overall, the model is expressly designed to be adopted alongside and consistent with existing Commonwealth and state systems for training, OHS and regulatory administration, but it requires jurisdictions to complete the regulatory architecture (forms, penalties, precise definitions) and to resolve overlaps through local variation.

The Schedule itself sets out the immediate amendment package and provides its provenance. The material in the instrument records these steps and dates:

• Principal Bill provenance: The Schedule identifies the “Principal Bill” as the Rail Safety Bill, being the Model Provisions dated 10 April 2006 and approved by the Australian Transport Council on 2 June 2006 (Schedule 1, cl 2). That establishes the original model provisions to which these amendments apply.

• TACE approval: A footnote attached to Schedule 1 records that the Bill (the amendments) “was approved by the Transport Agency Chief Executives ('TACE') on 24 November 2006, in accordance with the guidelines developed under clause 11.2 of the Inter‑Governmental Agreement for Regulatory and Operational Reform in Road, Rail and Intermodal Transport.” It also states that on approval by TACE, “the amendments made by the Bill became part of the Rail Safety Bill referred to in section 2.” This records the inter‑governmental endorsement of the amendments.

• Making and registration of the Regulations: The outer instrument bears the signature and date marking: made by the Governor‑General on the advice of the Federal Executive Council, dated 20 March 2008, and registered as Select Legislative Instrument 2008 No. 34. The regulation’s commencement clause (regulation 2) declares these Regulations “commence on the day after they are registered.” Thus the formal registration and commencement date in the federal register is 2008.

• Draft notes and local variation flags: Throughout the Schedule several amendments include “Draft Note” or “Note” text indicating certain provisions are intended to be adapted by jurisdictions (examples: insertion after s 28(2)(c) a Draft Note about zero concentrations; s 4 amendment including “Draft Note: Local variations if interpretation legislation does not require a reference to ‘class of work’ to be included”; s 28A note referencing OHS). These notes indicate the amendment history includes an explicit intention that some wording be tailored post‑model adoption.

• Editorial and consequential amendments: The Schedule contains a long list of structural edits encompassing Part headings, cross‑references and small drafting fixes (for example, changing “Division” to “Part” in a note, correcting cross‑references in Part 6, and editorial substitutions across multiple sections). These are part of the amendment history recorded in the Schedule as intended to harmonise the Principal Bill.

• Penalty placeholders and regulatory prescription: The repeated replacement of “Penalty:” with the expanded formula “Penalty: In the case of a natural person: In the case of a body corporate:” across several sections indicates the model’s amendment history includes moving to dual‑category penalty notation while leaving numeric amounts or categorisations to implementing legislation or regulations.

The instrument does not itself record later amendments, consequential regulations, or the dates on which jurisdictions adopted the model. It records the origin and federal registration of the model amendments and flags the expectation of local adaptation in several places. Users should therefore treat the Schedule as a dated model package produced in 2006-2008, subsequently made available as a registered model regulation for jurisdictional adoption.

The instrument contains no litigation history. It names no judicial decisions, and no cases are cited in the text of the Regulations or in Schedule 1. The model is a drafting instrument and not a judicial opinion, and the Schedule explicitly indicates that “they do not, of themselves, have any legal effect” until adopted by jurisdictions (Schedule 1 prefatory note). Consequently, there are no cases, appeals, or judicial interpretations embedded in this instrument to report.

Practitioners should therefore note that, as of the text contained in this instrument, there is no in‑text precedent or authoritative judicial interpretation to rely upon. Any litigation history relevant to these amendments will instead come from subsequent local legislative enactment and litigation under those enacted provisions, which the Schedule does not record. Where a jurisdiction adopts the model with local variations, decisions interpreting those enacted provisions will provide the litigation history; none is contained in this model Schedule.

Several drafting and practical traps emerge from the model when translating it into operational compliance or legal advice. These “gotchas” are grounded in the instrument’s text and the mechanisms it establishes.

1. Penalties left unspecified create transitional uncertainty

• Many penalty entries are placeholders with no amounts specified. Until a jurisdiction prescribes penalty quantum and classification, operators and contractors will not know the precise sanction exposure for non‑compliance (see repeated “Penalty: In the case of a natural person: In the case of a body corporate:” entries). This uncertainty complicates risk assessment and cost forecasting.

2. Extension of duties to contractors hinges on a control test that references agreements

• New s 28A extends operator duties to non‑employee contractors in relation to matters “over which the operator has control or would have control if not for any agreement purporting to limit or remove that control.” This creates a legal focus on the practical allocation of control and on the form and substance of contractual clauses that attempt to “purport” to remove control. Parties may face disputes about whether an agreement lawfully divested control or merely purported to do so, with consequential liability for both operator and contractor. Lawyers should advise clients to re‑examine contracts and operations to identify retained control points.

3. Written representations requirement changes procedural practice

• The replacement of “make representations” with “make written representations” in several sections alters the mode of engagement with the regulator. Previously, oral submissions or meetings may have been acceptable; the model forces regulated parties to prepare written submissions within any notice periods, creating administrative cost and potential evidential advantages for the regulator. Failure to deliver timely written representations risks procedural disadvantage.

4. Audit powers are broad and not limited to audit programs

• Substituted s 75 allows inspections for audit purposes “whether or not under an audit program” and empowers annual audit programs. This grants the regulator latitude to inspect outside planned audits, which may increase the frequency and unpredictability of inspections.

5. Competence standard linked to AQTF but other paths remain

• Section 68 makes AQTF qualifications evidence of competence where applicable, but it also contemplates alternative prescribed provisions where AQTF does not apply. Operators should not assume AQTF certification is the only route; they must identify when AQTF applies and where bespoke or prescribed competence standards will be required.

6. Information requests include financial capacity and insurance

• Section 72(1)(b) allows the regulator to require information “including matters relating to the financial capacity or insurance arrangements” of an operator. Operators should expect to supply commercially sensitive information, and may need to anticipate confidentiality, commercial‑in‑confidence handling, and potential disclosure risks.

7. Local variations and draft notes change substance across jurisdictions

• The Schedule repeatedly includes “Draft Note” and “Note: Local variations”, and leaves placeholders “[to be specified]”. The model therefore permits, and expects, differences across jurisdictions in crucial areas such as drug/alcohol thresholds, penalty amounts, forms and timelines. National operators must track local enactments closely.

8. Rewording of s 28 activities changes coverage

• The reordering and expansion of the verbs describing rail safety work (e.g. inserting “repair”, “decommissioning”, placing “use” in different positions) may affect the statutory scope of what constitutes rail safety work and therefore who is required to be accredited, and what management systems must cover. Practitioners should map their activities to the revised list.

9. “Certain” incidents replaces “notifiable” incidents

• Changing the heading from “notifiable” to “certain” (s 73(1) heading) and the removal of prescribed form requirements may alter thresholds for reporting, or at least the administrative regime for how incidents are communicated. Parties should check the regulations for newly prescribed incident lists and reporting formats, and not assume continuity with previous “notifiable” definitions.

10. Evidence provision is limited to AQTF certificates as evidence, not conclusive proof

• Section 68(3) states an AQTF certificate “is evidence” of qualifications, not conclusive proof. Opposing parties or the regulator may still challenge competence on other grounds, requiring operators to maintain broader evidence beyond certificates (training records, on‑the‑job assessments, competency matrices).

These “gotchas” are structural consequences of the model’s drafting choices. In implementation, they will be resolved,or compounded,by each jurisdiction’s local variations, specified penalties and regulations.

Compliance under this model requires both immediate legal fixes to allocate and record responsibilities and an operational programme to respond to the model’s expanded information, audit and competence requirements. The following checklist is based on the Schedule’s text and is structured into contractual, organisational, documentation, training, reporting and regulatory engagement tasks.

1. Contract and control‑point review

• Identify all contracts with non‑employee persons or entities that undertake railway operations on or adjacent to your infrastructure or rolling stock. For each contract, evaluate whether the operator retains actual control over matters connected to safety. Because s 28A extends duties where the operator has control or would have control but for an agreement “purporting to limit or remove that control”, operators should:
  • Document and, where necessary, restructure arrangements so that responsibilities and controls are clear.
  • If intending to transfer responsibility, ensure contracts genuinely transfer relevant operational control and that this is supported by practical arrangements (not merely a clause).
  • Maintain evidence of delegated authorities, control matrices, and supervision arrangements.

2. Management systems and accreditation readiness

• Review or create management systems for all railway operations that require accreditation under the Act (s 57 amendments). Ensure systems explicitly cover operations in which the operator is required to be accredited and operations that are contracted out but remain subject to operator control.
• Ensure processes exist to support accreditation applications, variations and to respond to suspensions, including procedures to prepare written representations within prescribed timeframes (ss 34, 37, 44, 45, 53).

3. Competence and training

• Implement competence assessment procedures aligned with substituted s 68:
  • Map roles to AQTF qualifications and units where available; obtain and retain AQTF certificates (s 68(2)(a)(i)-(3)).
  • For roles not covered by AQTF, identify applicable prescribed provisions and develop documented assessment criteria based on knowledge and skills required for safe execution (s 68(2)(a)(ii)-(b)).
  • Keep contemporaneous records demonstrating competence assessments, refresher training, and on‑the‑job assessment outcomes.

4. Documentation and forms

• Prepare to produce documents specified in s 46 on request: current notice of accreditation or exemption, notice of registration for private sidings, and any other prescribed document. Maintain a central, indexed document repository for regulatory requests.
• Anticipate prescribed forms under s 162 amendments; where forms are later specified, incorporate them into the document repository and ensure staff know how to complete them.

5. Reporting and information supply

• Draft and test processes to respond to written notices under s 72 within specified timeframes:
  • Create template responses and document packs for common regulator requests (safety measures, financial capacity, insurance arrangements).
  • Develop a secure channel for submitting information in the “manner and form approved by the Rail Safety Regulator”.
  • If regulatory prescription for periodic reporting is enacted, set calendar reminders and allocate internal responsibility for timely submission (s 72(3) and s 59 amendments concerning frequency).

6. Emergency management and incident reporting

• Update emergency management plans to comply with the renamed and possibly revised s 63 requirements. Maintain evidence of plan currency, drills and staff training on the plan.
• Establish an incident reporting protocol aligned to the revised s 62 and s 73 requirements; ensure staff can identify incidents that trigger obligations and that reports are prepared in the prescribed manner (s 73(5) introduces a penalty‑backed compliance duty).

7. Audit readiness

• Prepare for both scheduled and unscheduled audits under substituted s 75:
  • Maintain audit trails, records of safety performance, maintenance logs, training records and contract oversight documentation.
  • Conduct internal audits against expected regulator auditing standards and maintain corrective action registers.

8. Insurance and financial resilience

• Given s 72(1)(b) includes financial capacity and insurance arrangements within the scope of information the regulator may request, ensure insurers’ contact details, policy particulars and proof of cover are current, readily accessible and that any confidentiality issues are cleared with insurers where regulator disclosure may be required.

9. Procedural rights and responses

• Update governance processes to prepare written representations where the regulator proposes adverse actions (s 44, s 45). Assign legal or compliance owners responsible for drafting timely, evidence‑based representations.

10. Monitoring of local variations and regulations

• The model anticipates “local variations” and leaves many elements for regulation. Create an internal legal monitoring process to:
  • Track the jurisdictional adoption of the model, any local drafting variants, the publication of forms, and the prescription of penalties.
  • Map differences between jurisdictions if the operator works across states and territories, since local differences may impose different compliance requirements.

11. Confidentiality and engagement with regulator

• Prepare confidentiality protocols for handling requests for commercially sensitive information, e.g. insurance and financial capacity data, and decide in advance how to assert or negotiate confidentiality protections with the regulator where appropriate.

12. Record keeping and evidence practice

• Adopt a conservative approach to evidence: do not rely solely on AQTF certificates. Retain broader evidence of on‑the‑job competence, supervision records, assessment rubrics and training logs, because s 68(3) treats AQTF certificates as evidence but not conclusive proof.

13. Legal review of specific drafting choices

• Seek jurisdiction‑specific legal advice once local implementing instruments are published to identify penalty levels, forms, and any substantive local variations to thresholds such as drug/alcohol concentration regimes highlighted in the draft notes to s 28.

Taken together, compliance requires a blend of contractual housekeeping, robust documentation, training and competence frameworks, timely reporting and clear lines of responsibility for regulator engagement. Because the model leaves substantive detail to local enactment, staying current with jurisdictional implementation is essential.
