What it does
This determination sets out the method for calculating the amount of the National Self-exclusion Register cost recovery levy that each licensed interactive wagering service provider must pay. It also designates three specific levy periods and the percentage of the ACMA’s recoverable costs that can be collected in each period. The levy is imposed by the National Self-exclusion Register (Cost Recovery Levy) Act 2019 (the Act). This determination is made under subsections 9(1) and 11(1) of that Act. In practice, the ACMA uses the levy to recoup the costs of establishing and operating the BetStop register, which allows individuals to exclude themselves from all licensed interactive wagering services.
The calculation method in section 6 uses a simple proportional formula: A = (B ÷ C) × D. For a given levy period, A is the amount payable by one provider. B is the total number of individuals specified in all requests for access made by that provider during the levy period. C is the total number of individuals specified in all requests for access by all providers during the same period. D is the total amount of costs that the ACMA can recover under section 10 of the Act for that levy period. The result is that each provider pays a share of the total recoverable costs equal to its share of the total number of individuals checked against the register.
The determination also establishes three designated levy periods in section 7, each with an applicable percentage that caps the proportion of costs that can be recovered. Designated levy period 1 runs from the proclaimed start day (21 August 2023) to 30 June 2024, with an applicable percentage of 30 per cent. Designated levy period 2 is the 2024-2025 financial year at 35 per cent. Designated levy period 3 is the 2025-2026 financial year at 35 per cent. The total across the three periods is 100 per cent, meaning the full amount of recoverable costs will be collected over three years, but the first period collects 30 per cent, and the second and third each collect 35 per cent. This phased approach spreads the cost recovery and may reflect the fact that the register’s fixed establishment costs were larger in the initial period, or that the government wanted to avoid a large upfront levy. The determination was varied in 2023 (F2023L01074), which amended the definition of designated levy periods and adjusted the percentages, but the current text shows the three periods as described.
