National Registration Regulations

The Regulations focus on administrative implementation rather than policy definitions. Their core concepts, as they appear in the instrument, are:

• Formal linkage to the Act: Reg 2 defines “the Act” and every operative provision is expressly tied to particular sections of the Act (Reg 3 refers to s 11; Regs 4 and 5 refer to s 17(2); Reg 6 refers to s 22). The Regulations therefore operate as detailed procedural complements to those statutory powers in the Act.

• Declaration by officers: Reg 3 and the Schedule prescribe the precise declaration text that must be taken from officers executing powers under s 11. The Schedule sets out an attestation form to be signed by the officer and witnessed by a Justice of the Peace or similar official. The declaration establishes commitments to perform duties faithfully, not to desert duty, not wilfully to alter or sign untrue documents, and not to divulge information except as allowed by the Act (Schedule, Declaration by Officer under Section 11).

• Prescribed property value threshold: Reg 4 fixes the monetary criterion “prescribed value of property” as Five hundred pounds for the purposes of s 17(2). The threshold is expressed in sterling (Five hundred pounds) and applies only for the purpose explicitly named in the regulation.

• Property census mechanics: Reg 5 is the most operationally detailed provision. It sets out an end-to-end process for persons required to complete property census forms: obtain the forms, fill in all particulars in accordance with instructions, sign (except in the corporate case), and transmit within the time specified by the Proclamation that directs the census (Reg 5(1)(a)-(d)). Reg 5 also contains rules specific to companies and corporate bodies: the form must be signed by the company’s “legal representative”, defined as secretary, manager, director or other principal executive officer (Reg 5(2)). It requires separate forms where property is held on behalf of others or where the person is an agent of an absent person (Reg 5(3)). It requires separate forms for shares or debentures owned by persons outside Australia when the company’s secretary or other prescribed officer is required to supply forms in respect of those holdings (Reg 5(4)-(5)).

• Postal delivery as the default channel: The Regulations use Australia Post infrastructure as the default distribution and transmission channel. They require notification of address change by a card obtained from a post office (Reg 6), authorise the Commonwealth Statistician to prepare posters and envelopes for distribution at post offices (Regs 7-8), authorise circular letters of instruction to Postmasters (Reg 9), and require acknowledgments by Postmasters to be on cards designed by the Commonwealth Statistician (Reg 10).

• Administrative correction and instruction: The Commonwealth Statistician is expressly empowered to send circular letters to persons who have filled forms incorrectly (Reg 11). This allocates to the Statistician an active role in clarifying and correcting returned forms.

Each of these concepts is implemented by short, specific regulatory statements rather than by broad delegation. The Regulations therefore operate as a toolkit of administrative instruments, form wording, thresholds, signature rules and postal processes, targeted at the practical task of taking a property census and carrying out certain registration functions under the Act.

The Regulations create obligations, procedural steps and administrative interactions that affect several identifiable groups. The text itself specifies who is affected in each provision; the key categories are:

• Natural persons required to complete property census forms under s 17(2) of the Act. Reg 5(1) addresses “every person who is required to fill in and furnish to the Commonwealth Statistician a form or forms in pursuance of sub-section (2.) of section 17 of the Act.” Those persons must obtain, complete, sign (unless a company) and transmit the forms in accordance with instructions and within the Proclamation time limit (Reg 5(1)(a)-(d)).

• Companies and other corporate bodies. Reg 5(2) places specific obligations on companies or corporate bodies when they are required to complete the property census: the form must be signed by the company’s “legal representative” (defined as the secretary, manager, director or other principal executive officer). Reg 5(4) imposes a further rule on the company’s secretary or other prescribed officer when filling in forms about shares or debentures owned by persons outside Australia: the secretary must fill and furnish a separate form for those holdings. Reg 5(5) resolves gaps where a company has no secretary, by prescribing the manager, or if there is neither secretary nor manager, a director, as the prescribed officer for the purposes of Reg 5(4). Thus corporate officers with statutory duties are directly affected.

• Agents and trustees: Reg 5(3) requires a person who holds property on behalf of another, or who is the agent of a person absent from Australia, to fill in and furnish a separate form in respect of the property of each such person. This places trustee-like or agency-like persons under an obligation to prepare distinct returns for each underlying beneficial owner or principal.

• Officers executing powers under s 11 of the Act. Reg 3 and the Schedule require such officers to make a formal declaration in the prescribed wording. The Schedule requires signature by the officer and witnessing by a Justice of the Peace or a Commissioner for Declarations/Affidavits, which imposes a formal attestation procedure on those officers before they execute duties.

• The Commonwealth Statistician and Postmasters. The Regulations confer operational tasks on the Commonwealth Statistician: preparing posters, envelopes and circular letters, and sending circulars to correct incorrect forms (Regs 7-11). Postmasters and persons in charge of postal receiving offices are required to accept and process the tools produced by the Statistician: display posters, make available envelopes, receive circulars of instruction, and use acknowledgement cards designed by the Statistician (Regs 7-10). This makes postal personnel and the postal network part of the administrative chain.

• Persons required to notify change of address under s 22 of the Act. Reg 6 prescribes the exact mechanism , obtain and transmit a post office card to the Commonwealth Statistician , thereby affecting all persons falling within s 22.

The Regulations do not introduce new categories of persons beyond those defined or referenced in the Act; they add procedural obligations and specify which corporate officer counts as the signatory or prescribed officer. The effect is to shift certain administrative activities onto private individuals, company officers and the postal service, with the Commonwealth Statistician responsible for providing standardised forms, posters and guidance.

The Regulatory text sets out specific duties and some procedural entitlements tied to administrative processes. The principal duties and the limited rights or procedural protections that appear in the Regulations themselves are as follows.

Duties:

• Duty to obtain forms: Reg 5(1)(a) requires any person required to furnish a property census form under s 17(2) of the Act to obtain, or cause to be obtained, the relevant form(s).

• Duty to supply full particulars: Reg 5(1)(b) requires that persons fill in and supply, in accordance with the instructions contained in or accompanying the form(s), all the particulars specified therein.

• Duty to sign: Reg 5(1)(c) requires the person (except in the case of a company or corporate body) to sign his name to the form. For companies, Reg 5(2) requires signature by the company’s legal representative (secretary, manager, director, or other principal executive officer).

• Duty to transmit within statutory window: Reg 5(1)(d) requires transmission to the Commonwealth Statistician within the time specified in the Proclamation directing the census, and in accordance with the accompanying instructions.

• Duty to return separate forms in several circumstances: Reg 5(3) requires separate forms where a person holds property on behalf of others or is an agent of an absent person. Reg 5(4) requires the secretary or prescribed officer of a company to fill and furnish a separate form in respect of shares or debentures of the company owned by persons outside Australia. Reg 5(5) specifies succession rules for the prescribed officer if the company lacks a secretary.

• Duty to notify change of address by specified method: Reg 6 requires notification under s 22 to be by obtaining a card from a post office and transmitting it to the Commonwealth Statistician.

• Duties of postal staff and the Statistician: Regs 7-11 impose procedural duties and powers on the Commonwealth Statistician and require Postmasters and persons in charge of postal receiving offices to implement acknowledgement cards and receive envelopes and circulars. The Statistician has duties to prepare and supply posters, envelopes, circular letters, and acknowledgement cards, and to send circular letters when forms appear to have been filled in incorrectly (Regs 7-11).

Rights and procedural features:

• The Regulations confer on recipients certain forms of administrative assistance and standardisation: the Commonwealth Statistician may prepare and make available posters, envelopes and circulars to assist persons in complying (Regs 7-9).

• Acknowledgement of receipt: Reg 10 requires acknowledgments by Postmasters or persons in charge of postal receiving offices to be on cards designed and made available by the Commonwealth Statistician. This creates a procedural right to an acknowledgement card when papers or forms supplied by the Statistician are deposited with postal authorities.

• Opportunity to be corrected: Reg 11 permits the Commonwealth Statistician to send circular letters of instruction to persons who have apparently filled forms incorrectly, creating a procedural mechanism for correction rather than immediate penalty in the Regulation text.

• Declaration procedural formality: Reg 3 and the Schedule require the officer’s declaration to be made in a specified form and witnessed by an authorised official (Justice of the Peace or Commissioner for Declarations or Affidavits). This prescribes a formal attestation step and provides a record that the officer made the required declaration.

What is not in the Regulations:

• The Regulations do not themselves specify penalties, fines or criminal sanctions for failure to comply with the duties they set out. The Schedule sets expectations about wilful alteration, signing untrue documents or divulging information, but without prescribing sanctions in the Regulations. Any enforcement provisions or criminal liability would be located in the parent Act. The Regulations therefore primarily create procedural duties and administrative processes rather than framing the full enforcement regime.

These duties drive administrative behaviour by private persons, corporate officers, postal staff and the Commonwealth Statistician, and create a standardised interface, forms, instructions and postal mechanisms, for implementing the Act’s registration and property census functions.

The Regulations themselves are operational and procedural; they do not set out penalties or detailed enforcement mechanisms within the text supplied. The instrument’s treatment of misconduct is limited to the language of the officer’s declaration in the Schedule and to the process provisions that enable administrative correction. The text contains the following markers relating to enforcement:

• Declaration language referencing wrongdoing: The Schedule (Declaration by Officer under Section 11) contains attestation language by which an officer promises not to “wilfully or without lawful authority alter any document or form under the said Act, or wilfully sign any untrue document or form, or, except as allowed by the said Act, divulge the contents of any form filled in in pursuance of the said Act, or any information furnished in pursuance of the said Act.” That passage makes clear the Act contemplates those acts as wrongful but does not itself set the penalty; the Schedule is a statutory declaration form, not a schedule of sanctions.

• Administrative correction and instruction: Reg 11 authorises the Commonwealth Statistician to send circular letters of instruction where it appears forms have been incorrectly filled in. This is an administrative remediation power allowing correction rather than immediate sanction. It implies a regulatory preference for giving notice and instruction to fix errors where practicable.

• No penalties provided in the Regulations: No fine, imprisonment, or civil penalty is specified in any regulation in the supplied text. The Regulations therefore leave the actual enforcement measures, penalties and prosecution pathways to the provisions of the parent Act or other relevant legislation. Practically, that means one must consult the National Registration Act 1939 for specific offences and sanctions, because the Regulations do not themselves create or quantify penalties.

• Use of postal acknowledgements as an evidentiary mechanism: Reg 10 requires acknowledgments of papers and forms to be on cards designed by the Commonwealth Statistician and used by Postmasters. While the Regulation does not state how these acknowledgement cards are used in enforcement, they create a standard record of transmission which could be relied on in later enforcement or dispute about compliance.

• Delegation to administrative officials: The Regulations give the Commonwealth Statistician powers to prepare materials and to send corrective circulars (Regs 7-9, 11). These are administrative tools rather than enforcement sanctions. The presence of such powers suggests enforcement will involve administrative follow-up and correction in many cases, with penalties (if any) determined by Act provisions not reproduced here.

In short, the Regulations create procedural obligations and mechanisms for administrative support and correction but do not themselves specify penalties. For enforcement consequences, recourse must be had to the National Registration Act 1939, which is frequently the place where criminal or civil sanctions would be located. The Regulations do, however, shape enforcement logistics by prescribing acknowledgement mechanisms, formal declarations by officers and the time and manner of returns, which will matter in proving compliance or non-compliance under any enforcement regime in the Act.

The Regulations are explicitly framed as subordinate instruments to the National Registration Act 1939; Reg 2 defines “the Act” and the operative provisions implement particular sections of that Act. The text supplied indicates specific points of interaction:

• Direct statutory implementation: The Regulations implement specified procedural aspects of particular sections of the Act. Reg 3 gives the form of declaration required by section 11 of the Act. Reg 4 fixes the “prescribed value of property” for sub-section (2) of section 17 of the Act. Reg 5 prescribes the mechanics for completing the census of property mandated by s 17(2). Reg 6 prescribes the method for notifying change of address under s 22. Thus the Regulations operate by specifying the detail the Act either left to regulation-making power to determine or by giving form to statutory obligations.

• Administrative law layering: By delegating tasks and powers to the Commonwealth Statistician and to Postmasters, the Regulations create administrative interfaces that will intersect with the broader administrative law framework (for example, rules about delegation, record-keeping and procedural fairness) as applied to officials acting under the Act. The Regulations themselves do not articulate appeal or review mechanisms; such remedies would be found in the Act or in general administrative law. The Regulations, however, shape the factual matrix upon which any administrative decision would be reviewed (for example, whether a person transmitted a form within the Proclamation period, whether a Postmaster recorded an acknowledgement on the Statistician card, whether the Statistician sent a corrective circular).

• Evidence and procedural record: Reg 10’s requirement that acknowledgements be on Statistician-designed cards, and Reg 8’s provision that envelopes be made available at post offices, create standardised administrative artefacts. Those artefacts will interact with other laws where proof of compliance or service is required in subsequent proceedings. The Regulations therefore influence evidential relationships in broader legal contexts by prescribing the form of acknowledgements and transmission.

• Company law and officers’ duties: Reg 5(2) defines “legal representative” in corporate contexts for the purposes of the property census , a definition that operates in the narrow scope of these Regulations but which interacts functionally with corporate governance structures. The choice of secretary, manager, director or principal executive officer as the signatory ties census obligations to individuals who hold statutory positions under company governance, potentially creating compliance obligations that overlap with officers’ duties under company law (for example, record-keeping and corporate representation). The Regulations do not assert supremacy over company law; they merely allocate the signatory role to particular corporate officers for the limited purpose of completing census forms.

• Postal law and practice: The Regulations turn to the postal network as the default delivery mechanism and instruct Postmasters and postal receiving offices to receive, display and acknowledge Statistician materials. While the Regulations do not amend postal statutes, they interact operationally with established postal services and their staff, imposing duties on Postmasters to use Statistician-provided cards and to display materials, thus linking the practical operation of the Regulations to the statutory framework and operational rules governing postal staff at the time.

• Confidentiality and offences in the Act: The Schedule’s prohibition on officers divulging form contents “except as allowed by the said Act” demonstrates direct textual interaction: confidentiality regimes and any lawful disclosures are governed by the Act. The Regulations therefore defer to the Act for the substantive rules on lawful disclosure and the legal consequences of unauthorised disclosure.

Because the Regulations are narrow and procedural, their interaction with other laws is by designed delegation and practical interconnection rather than by creating standalone legal effects. To understand crimes, penalties, rights of review, or the full confidentiality regime, one must read the parent Act alongside these Regulations. The Regulations shape the administrative facts and form that will be relevant under other statutes and common law processes but do not, on their own, displace or determine substantive legal remedies and sanctions.

The document supplied is a single Statutory Rule dated 6 July 1939 and labelled “1939. No. 55.” It contains no express amendments, repeal provisions, or later alteration notes within the text provided. The Regulations themselves include a notation that they were notified in the Commonwealth Gazette in July 1939 and contain the printer’s authority line (By Authority: L. F. Johnston, Commonwealth Government Printer, Canberra), but the instrument as supplied does not record any subsequent amending instruments, revocations, or consolidations.

What the text does reveal about the instrument’s lifecycle is limited to:

• Date and identification: The Regulations are dated 6 July 1939, identified as Statutory Rules 1939, No. 55, and noted as “REGULATIONS UNDER THE NATIONAL REGISTRATION ACT 1939” (front matter). The signature block shows approval by the Deputy of the Governor-General and the Minister of State for Defence, which is the formal signature process for Statutory Rules at that time.

• Gazette notice: A footnote indicates that the instrument was “Notified in the Commonwealth Gazette on July, 1939” (end of Reg 5(2) notation), consistent with standard practice for statutory instruments.

• No internal amendment clauses: There are no clauses reserving power to amend specific thresholds other than by subsequent instrument; Reg 4 simply sets the prescribed value at Five hundred pounds. The Regulations do not provide for periodic review or automatic indexation.

• No repeals or savings: The supplied text does not include any repeal or saving provisions, so as presented it appears as the original instrument without further revision history included.

Given the absence of any amending instruments, revocation schedules, or marginal notes to the contrary in the text provided, the amendment history cannot be detailed beyond observing that this is the 1939 instrument in its original printed form. Any subsequent amendments, if they exist, are not recorded within the supplied document and would have to be identified by reference to official legislative databases, consolidation texts or subsequent statutory instruments outside the supplied material.

For the purposes of an analysis limited to the supplied Regulations, the operative amendment history is silent: the document should be treated as the standalone 1939 Regulations, with no internal indication of later amendment or repeal.

The Regulations as provided contain no references to judicial decisions, no annexed case citations and no indication of litigation that challenges or interprets their provisions. The Schedule and Regulations do not refer to any court rulings, and no cases are named anywhere in the text.

Consequently, based solely on the instrument supplied:

• There is no litigation record set out in the Regulations themselves. The text contains no report of any legal proceedings, adjudications, or judicial interpretations that bear on the meaning or application of these Regulations.

• The instrument does not specify dispute resolution routes or appeal procedures beyond the administrative processes it supplies (for example, corrective circulars from the Commonwealth Statistician under Reg 11), and it does not reference tribunals, courts or judicial review. Any adjudicative history, case law interpreting the form of declaration in the Schedule or the prescribed procedures in Reg 5 would lie outside the instrument and is not reflected in the text provided.

• If a reader requires judicial interpretation or litigation history, that material would need to be located in court reports, official law reports, or consolidated statutory histories beyond the Regulations. The supplied text neither claims nor presumes any judicial gloss; it is purely a statutory regulatory instrument.

Within the bounds of this document alone, therefore, there is no litigation history to summarise or cite. Any assertion about how courts have interpreted, enforced or dealt with these Regulations would be outside the evidential basis of the supplied text.

The Regulations are brief and procedural, but their specific wording creates a number of practical pitfalls for compliance and for administrative actors. The instrument’s own language identifies several potential sources of confusion or operational risk; these are set out below with precise cross-references.

• Strict signature rules and the company exception (Reg 5(1)(c)-(2)). Natural persons must sign their forms, but companies must have their forms signed by the company’s “legal representative,” which the Regulations narrowly define as the secretary, manager, or a director or other principal executive officer (Reg 5(2)). Failure to use one of these prescribed officers risks non-compliance. Conversely, an individual who signs a company form but is not a “legal representative” under Reg 5(2) may produce an invalid return under the Regulations’ terms.

• Separate forms for holdings on behalf of others and absent principals (Reg 5(3)). Persons holding property on behalf of multiple beneficial owners must submit separate forms for each beneficial owner. Similarly, an agent of an absent person must submit a separate form for that absent person. A single composite return will not satisfy the Regulation’s command. This can materially increase the administrative load for trustees, executors, custodians and agents.

• Separate forms for overseas beneficial owners of company securities (Reg 5(4)). When the company secretary is required to return forms about shares or debentures owned by persons outside Australia, the secretary must provide a separate form for those overseas owners distinct from the company’s own property return. If a company has no secretary, Reg 5(5) designates the manager or a director as the prescribed officer , but the chain of substitution must be observed strictly.

• Timing tied to an external Proclamation (Reg 5(1)(d)). The deadline for transmission is the time specified in the Proclamation directing the census. That deadline is external to the Regulations and may be short or otherwise restrictive. Compliance will therefore depend on monitoring the relevant Proclamation; failure to do so could produce late returns despite correct completion.

• Method of transmission and postal reliance (Regs 6-10). Several obligations require obtaining, filling and transmitting forms via the postal network: change of address notifications must be made using a post office card (Reg 6); envelopes and forms are to be made available at post offices (Regs 8 and 10); acknowledgements by Postmasters must be on Statistician-designed cards (Reg 10). Where postal infrastructure is interrupted, delayed, or where persons are remote from post offices, the Regulations provide no alternative channel within the text supplied. That reliance on postal mechanisms may create logistic compliance issues for remote persons or for time-sensitive returns.

• Obligation to follow instructions contained in or accompanying the forms (Reg 5(1)(b)). The duty to “fill in and supply … in accordance with the instructions contained in or accompanying” the forms makes the instructions part of the legal obligation; poorly drafted instructions could therefore be a source of error, but the Regulations give the Statistician discretion over those instructions. The form’s instructions are not reproduced in the Regulations; they will be binding on the person completing the form.

• No penalties in the Regulations (Reg 3 Schedule and general text). The Schedule references wrongful acts by officers (wilful alteration, signing untrue documents, unauthorised divulgence) but the Regulations do not specify sanctions. A person or officer may therefore assume there is administrative flexibility, but any actual sanctioning power would derive from the Act. Practitioners should therefore consult the Act to identify the consequences of non-compliance.

• Requirement for witnessed declaration (Reg 3 and Schedule). The declaration is to be attested “Before me” with space for signature of a Justice of the Peace, Commissioner for Declarations or Commissioner for Affidavits. If an officer signs the declaration without the required witness, the declaration will not match the Schedule’s prescribed form, and the officer may be non-compliant with Reg 3.

• Ambiguity about scope of “legal representative” expression (Reg 5(2)). The definition lists several officer types, but “other principal executive officer” is a somewhat open-ended category. That phrasing could generate disputes about who qualifies, especially in non-standard corporate structures. The Regulations provide no further guidance on that phrase.

• Administrative dependency on the Statistician’s corrective letters (Reg 11). Where forms appear incorrectly filled in, the Statistician “may” send circular letters. The discretionary nature of that power suggests a person who receives no corrective circular may still be non-compliant. Reliance on receiving corrective instruction is therefore risky.

These are not legal conclusions about liability, but practical operational pitfalls the regulatory text itself creates. The Regulations place the onus on persons, company officers and postal staff to observe narrow procedural requirements and to rely on the Commonwealth Statistician’s forms and instructions. Because the Regulations provide little internal flexibility or alternative transmission routes, failures in signature, separate-form allocations, witnessing, or timing tied to external proclamations are likely to be the most frequent compliance traps.

The Regulations state precise procedural steps and roles; compliance therefore depends on following those steps in the order and manner the text prescribes. The checklist below is a practical compliance playbook based entirely on the regulatory text.

1. Identify whether you are required to act under the Act:

   • Determine whether you are a “person who is required to fill in and furnish … a form … in pursuance of sub-section (2.) of section 17 of the Act” (Reg 5(1)). If so, the steps below apply.
   • Determine whether you are required to notify a change of address under s 22 of the Act; if so, Reg 6 applies.

2. Obtain the correct form(s):

   • Obtain, or cause to be obtained, the relevant form(s) for the property census as required by Reg 5(1)(a). Forms are to be made available by the Commonwealth Statistician and (per Regs 7-9) may be distributed via post offices. If unable to obtain a form, contact the Commonwealth Statistician or the local post office.

3. Read and follow instructions that accompany the form(s):

   • Fill in and supply all particulars required “in accordance with the instructions contained in or accompanying” the form(s) (Reg 5(1)(b)). The instructions are legally part of the obligation.

4. Determine the correct signature authority:

   • If you are an individual (not a company or corporate body), sign your name on the form (Reg 5(1)(c)).
   • If you are a company or corporate body, have the form signed by the company’s “legal representative,” defined as the secretary, manager, or a director or other principal executive officer (Reg 5(2)). If the company has no secretary, the manager is the prescribed officer for the purposes of Reg 5(4); if there is neither a secretary nor a manager, a director is the prescribed officer (Reg 5(5)).

5. Provide separate forms where required:

   • If you hold property on behalf of other persons, or are the agent of a person absent from Australia, fill in and furnish a separate form for the property of each such person (Reg 5(3)).
   • If you are the secretary or prescribed officer of a company and are required to fill in forms in respect of shares or debentures owned by persons outside Australia, file a separate form for those holdings distinct from the company’s own property return (Reg 5(4)). Ensure the correct prescribed officer signs as required by Reg 5(5) where the company lacks a secretary.

6. Observe the Proclamation deadline and method of transmission:

   • Transmit the completed form(s) to the Commonwealth Statistician “within the time specified in the Proclamation by which the census is directed to be taken” and in accordance with the form instructions (Reg 5(1)(d)). The timing is set by the external Proclamation; check it carefully.

7. Use the prescribed channels for address notification:

   • If you must notify a change of address under s 22, obtain a card provided for that purpose from a post office or postal receiving office, fill it in, and transmit it to the Commonwealth Statistician (Reg 6).

8. Retain evidence of transmission and acknowledgement:

   • Where forms are transmitted via post offices, obtain the acknowledgement card provided and stamped by the Postmaster or person in charge (Reg 10). These cards are designed by the Commonwealth Statistician and serve as evidence of lodging materials for the Act’s purposes.

9. Respond to corrective circulars:

   • If the Commonwealth Statistician sends circular letters of instruction concerning apparently incorrectly filled forms, follow the instructions promptly (Reg 11). The Statistician may issue such circulars; respond to them to regularise any errors.

10. Officers making declarations under s 11:

    • Officers occupying roles under s 11 must make the formal declaration in the Schedule (Reg 3 and Schedule). Execute the declaration in the precise wording provided and have it witnessed by a Justice of the Peace, Commissioner for Declarations, or Commissioner for Affidavits as indicated in the Schedule. The declaration must be dated and the witness’s signature appended.

11. Work with Postmasters and the Statistician:

    • Take note that the Commonwealth Statistician may prepare posters (Reg 7), make envelopes available at post offices (Reg 8), and furnish circulars to Postmasters (Reg 9). Use materials provided by the Statistician to ensure conformity with form, instructions and acknowledgement processes.

12. Where doubt remains, consult the Act:

    • The Regulations do not set penalties or define the full enforcement regime. If unsure about the consequences of non-compliance, or where the Regulations touch on matters reserved to the Act (for example confidentiality exceptions referenced in the Schedule), consult the National Registration Act 1939 for offences, sanctions and provisions governing permitted disclosures.

Practical tips drawn from the Regulation text:

• Maintain a documentary trail: keep copies of completed forms, postal acknowledgement cards (Reg 10), and any circulars received from the Statistician (Regs 9, 11). The Regulations create specific documentation mechanisms that anticipate later proof of compliance.

• Anticipate multiplicity of returns: prepare for multiple separate forms where property is held for others or where foreign beneficial owners are involved (Regs 5(3)-(4)).

• Ensure authorised signatory availability: companies should ensure that a properly authorised “legal representative” (Reg 5(2)) is available to sign within the Proclamation period; if the company lacks a secretary, ensure the manager or director is ready to act under Reg 5(5).

• Use the posted forms and envelopes provided: the Statistician is empowered to produce forms, envelopes and posters; using the official versions will align you with the instructions that form part of the legal obligation (Regs 7-8).

The Regulations prescribe a tight, documentary process. Compliance comes down to obtaining and following the correct official form and instructions, applying the correct signature rules, filing separate returns where required, and transmitting within the Proclamation deadline using the procedures the Commonwealth Statistician and Postmasters support.
