What it does
This legislative instrument, the National Redress Scheme for Institutional Child Sexual Abuse Assessment Framework 2018, provides the mandatory formula for calculating the dollar amounts of redress payments and the counselling and psychological component under the National Redress Scheme. It is made under section 32 of the National Redress Scheme for Institutional Child Sexual Abuse Act 2018. The instrument replaces any discretion the Scheme Operator might otherwise have with a rigid, tariff-based matrix. For redress payments, it sets base amounts for three categories of sexual abuse (penetrative abuse: $90,000; contact abuse: $40,000; exposure abuse: $10,000) and then permits up to three add-on amounts: $5,000 for related non-sexual abuse, $5,000 for institutional vulnerability, and up to $50,000 for extreme circumstances (the last only available for penetrative abuse). The total is the sum of the base amount plus any applicable add-ons. It also independently quantifies the counselling and psychological component as a separate, much smaller sum ($5,000 for penetrative abuse; $2,500 for contact abuse; $1,250 for exposure abuse). Critically, only one category of abuse applies per person even if multiple instances occurred, because “relevant sexual abuse” is defined as all sexual abuse within the scheme’s scope for which one or more participating institutions are responsible - a single, aggregate classification. The instrument does not address eligibility, application processes, or funding arrangements; those are governed by the Act. Its function is purely mechanical: to replace case-by-case damages assessment with predetermined, fixed sums. This creates certainty for both applicants and institutions but at the cost of individualised justice, because the tariff cannot capture the full variation in harm across survivors.
