172  Repayment of recovered amount to participating institutions and participating jurisdictions   If:  (a) the Commonwealth recovers an amount under this Part (other than paragraph 167(2)(a)); and  (b) all or part of the amount relates to either or both of the following payments:  (ii) a counselling and psychological services payment; and  (c) a participating institution or participating jurisdiction has paid funding contribution in relation to that payment; then the Commonwealth must repay the institution or jurisdiction so much of that funding contribution as the Operator considers relates to the amount recovered.
