National Reconstruction Fund Corporation (Priority Areas) Declaration 2023

Three main conceptual features structure the instrument: definitional scope, functional framing of priority areas, and linkage to the Act.

1. Definitional scope (s 4)

• The instrument supplies a suite of definitional building blocks. Some definitions are simple labels (for example aircraft, ship, rail vehicle, road vehicle, railway, space object). Others are deliberately expansive. Notably, “manufacturing products” is defined to include developing, providing logistics, distributing, producing, selling, after‑market services and maintaining products (s 4, manufacturing products). That definition reaches beyond physical production to cover pre‑ and post‑production activities. Similarly, “processing” is defined broadly to include refining, recycling, treating, preparing, transforming or modifying (s 4, processing).
• The definitions of “mineral”, “animal”, “plant”, “animal product”, “plant product” and “produce of a primary industry” are precise and functional. For example, “mineral” covers naturally occurring substances in the earth’s crust and substances dissolved or suspended in water on or within the earth’s crust; it also expressly includes substances that may be extracted or produced from those sources (s 4, mineral). “Primary industry” is defined by an enumerated list of activities, including agriculture, forestry, fishing, horticulture and aquaculture (s 4, primary industry).
• Some entries incorporate external statutory meanings. “Horticultural product” is given the same meaning as in the Horticulture Marketing and Research and Development Services Act 2000 (s 4), creating an explicit cross‑statutory linkage.

2. Functional framing of priority areas (s 5)

• The instrument does not name industries in a single label; it describes priority areas as bundles of activity. For example, the “Value‑add in resources” priority area covers: manufacturing products for use in or in connection with the mining industry; manufacturing products for use in or in connection with processing minerals; and processing minerals (s 5(1)). Thus the priority area covers both downstream processing and supply‑chain components that serve mining and mineral processing.
• The “Value‑add in agriculture, forestry and fisheries” mirrors that structure for primary industries, extending to manufacturing products for use in connection with a primary industry, and processing produce of a primary industry (s 5(2)).
• The “Transport” priority area covers manufacturing of aircraft, road vehicles, rail vehicles, ships and products for use in or in connection with those modes (s 5(3)). The instrument’s definitions for rail vehicle and railway are specific (s 4).
• The “Medical science” priority area is defined by manufacturing products for therapeutic use; “therapeutic use” is itself defined in detail to include a broad set of medical and physiological functions (s 4 and s 5(4)).
• “Renewables and low emission technologies” is framed around manufacturing products for use in renewable generation, transmission, distribution or storage, greenhouse gas emissions reduction, energy efficiency, recycling, waste reduction and resource recovery (s 5(5)).
• “Defence capability” is product‑oriented, covering manufacturing products that are wholly or primarily for use in or in connection with defence (s 5(6)).
• “Enabling capabilities” lists advanced technologies and capabilities , artificial intelligence, quantum technologies, autonomous systems, robotics, biotechnologies, positioning/timing/sensing technologies, advanced manufacturing and materials technologies, advanced information and communication technologies, space objects or related products, and “other advanced technologies” (s 5(7)).

3. Linkage to the Act (s 3 and s 5)

• Each priority area is declared explicitly “for the purposes of the Act” (s 5). The instrument is made under s 6 of the Act (s 3), so the conceptual role of the instrument is to supply the Act with the operational definition of “priority areas”.
• The instrument is therefore not freestanding policy; it is a statutory declaration that will be read into the Act’s regime wherever the Act refers to priority areas.

Together, these concepts mean the instrument is primarily a classificatory tool that supplies the Act with expansive operational definitions of sectors and activities. The combination of broad, activity‑based formulations and inclusive definitions such as “manufacturing products” and “processing” may extend the Act’s reach into upstream and downstream services, logistics and non‑production activities, depending on how the Act applies the priority classification.

The instrument’s text identifies categories of industrial activity and supplies definitions that determine who falls within those categories for the purposes of the National Reconstruction Fund Corporation Act 2023. The instrument itself does not create obligations or financial entitlements, but it defines the population of persons, firms and activities that will be treated as “priority areas” under the Act. Accordingly, the group affected comprises entities and activities whose conduct falls within the definitions and descriptions in s 4 and s 5. Concretely:

• Operators and manufacturers in the mining and minerals chain. Section 5(1) includes manufacturers of products for use in or in connection with the mining industry, manufacturers for use in or connection with processing minerals, and entities involved in processing minerals. The definition of “mineral” in s 4 is broad and includes substances occurring in the earth’s crust and substances dissolved or suspended in water on or within the earth’s crust, and anything that may be extracted or produced from those substances. Mining industry actors, mineral processors, equipment suppliers and contractors that manufacture or supply products to those sectors are therefore within the declared scope when the Act refers to priority areas.

• Primary industry operators and agriprocessing firms. Section 5(2) covers manufacturing for use in or in connection with a primary industry and processing produce of a primary industry. The instrument defines “primary industry” by reference to agriculture, maintenance of animals for commercial purposes, forest operations, fishing, hunting or trapping, horticulture and aquaculture (s 4). The definition of “produce of a primary industry” links to animal products and plant products as defined in s 4. This affects farmers, processors, equipment and inputs suppliers, and related manufacturers and service providers when they manufacture products for those sectors or process their outputs.

• Transport manufacturers and supply chains. Section 5(3) covers manufacturing of aircraft, road vehicles, rail vehicles or ships and products for use in or in connection with those modes. The definitions in s 4 specify rail vehicle (including trams), railway (guided by parallel rails or a single rail) and road vehicle (explicitly excluding rail vehicles). Manufacturers, component suppliers, systems integrators, maintenance and after‑market service providers for those vehicles and vessels will be within the priority description when the Act applies.

• Medical and therapeutic manufacturers. Section 5(4) declares as a priority area manufacturing products for therapeutic use. The instrument defines “therapeutic use” broadly to include prevention, diagnosis, treatment, physiological influence, contraception, pregnancy testing and replacement or modification of anatomy (s 4). Manufacturers of pharmaceuticals, medical devices, diagnostics, biologics, medical software and technologies that have therapeutic uses will fall within the declared area, as will associated developers and service providers if their activities meet the “manufacturing products” definition.

• Renewable energy and low‑emission technology makers. Section 5(5) covers manufacturing products for use in renewable energy generation, transmission, distribution or storage, greenhouse gas emissions reduction, energy efficiency, recycling, waste reduction and resource recovery. This captures technology developers, equipment manufacturers, storage developers, and other supply‑chain actors who manufacture such products.

• Defence manufacturers. Section 5(6) includes manufacturing products that are wholly or primarily for use in or in connection with defence. Defence contractors, system integrators, specialised component makers and related entities will be within scope where the Act applies.

• Developers of enabling capabilities. Section 5(7) lists advanced and enabling technologies such as advanced manufacturing, materials, artificial intelligence, advanced information and communications, quantum technologies, autonomous systems, robotics, positioning/timing/sensing technologies, biotechnologies, and space objects or related products. The definition of “space object” in s 4 covers objects whole or part of which go beyond 100 km above mean sea level, or parts of such objects. This captures a wide range of technology developers, software and hardware manufacturers, and systems providers working in those fields.

Who is not directly affected by this instrument? Because the instrument’s stated effect is limited to “for the purposes of the Act” (s 5), actors who are not engaged in activity described by the definitions and who do not seek to fall within a priority area as the Act uses that term are not affected directly by this instrument alone. The instrument does not extinguish or amend other statutory regimes and does not by itself alter general corporate or taxation obligations.

Operationally, affected parties are those that will be subject to any future Act‑based authorisations, funding, criteria or interventions that the National Reconstruction Fund Corporation Act 2023 provides for and that depend upon the classification of “priority areas.” The instrument determines the textual boundary the Act will use when deciding which industries, projects, products or activities are priority‑area activities.

The instrument itself does not create specific duties, regulatory rights or monetary entitlements. It is a declaratory instrument that defines terms and identifies priority areas for use under the National Reconstruction Fund Corporation Act 2023. Its legal operation is to supply the Act with definitions and classifications which the Act will then use to allocate rights, duties or benefits if the Act so provides. The instrument therefore functions as an enabling and interpretative text rather than a source of standalone obligations.

Key legal features relevant to duties and rights are these:

• No standalone duties or penalties in the instrument. The instrument contains no provisions that impose duties, licensing conditions, registration requirements, or criminal or civil sanctions. It provides definitions and declarations only (see s 4 and s 5). Consequently, any legally enforceable duties or rights that hinge on a project or entity being in a “priority area” must be found in the Act itself or in subordinate instruments made under the Act.

• Interpretive effect for the Act. Because each priority area is declared “for the purposes of the Act” (s 5), the instrument determines how the Act will identify which activities are in scope. Where the Act conditions a right or duty on the recipient or subject being in a priority area, those conditions will be interpreted by applying the definitions and formulations in this instrument. In that sense, the instrument shapes the entitlement map of the Act: who may be eligible for any Act‑based programs, or who may be subject to obligations triggered by priority‑area status.

• Broad definitions expand the potential class of beneficiaries or regulated entities. The definition of “manufacturing products” is inclusive of non‑production activities such as developing products, providing logistics, distributing, selling, providing after‑market services and maintaining products (s 4). If the Act confers rights (for example, access to funding, investment criteria or procurement preferences) or imposes duties on manufacturers within priority areas, those rights and duties will apply to the wider set of activities encompassed by this definition. Conversely, if the Act restricts certain conduct within priority areas, those restrictions will apply across the expanded set of activities the instrument defines as manufacturing.

• Specificity for particular sectors. The instrument supplies specific definitions that refine the scope of certain priority areas. For example, “therapeutic use” is defined to cover prevention, diagnosis, treatment, physiological processes, contraception, pregnancy testing and anatomical replacement or modification (s 4). If the Act provides differential treatment for projects in the medical science priority area, those project boundaries will be determined using that definition.

• Cross‑statutory reference narrows or aligns meaning. “Horticultural product” is to have the same meaning as in the Horticulture Marketing and Research and Development Services Act 2000 (s 4). That cross‑reference imports the horticulture statute’s settled meaning into the Act’s priority area regime, so any duties or rights in the Act that apply to horticultural products will use that external statute’s concept.

In practice, duties and rights will depend on the Act’s operative provisions and any decisions, guidelines or instruments issued under the Act that rely on the priority area classification. For compliance and eligibility purposes, entities should assume that the instrument’s definitions are the interpretive key the Act will use wherever the Act depends on priority‑area status. Entities that wish to claim rights conferred by the Act as holders of a priority activity or who may be subject to duties triggered by priority‑area status must therefore map their operations to the instrument’s definitions, and retain contemporaneous evidence showing how their activities fit the textually supplied categories.

The instrument contains no penalty, enforcement, sanction or inspection regimes. It is a declaratory instrument that provides definitions and lists priority areas “for the purposes of the Act” (s 5). There are no provisions in the instrument that create offences, civil penalties, enforcement mechanisms or administrative sanctioning powers. Accordingly:

• There are no enforcement mechanisms in the instrument itself to compel compliance with the definitions, or to punish incorrect self‑classification. The role of the instrument is limited to classification and interpretation for the Act.

• Any enforcement, penalty, compliance, monitoring or dispute resolution mechanism that depends on priority‑area designation will be located in the National Reconstruction Fund Corporation Act 2023 or instruments made under that Act, not in this instrument. This instrument supplies the textual basis for deciding whether a person or activity falls within a priority area; enforcement follows only if the Act attaches consequences to that classification.

• Because the instrument was made under section 6 of the Act (s 3), enforcement and penalties with respect to conduct related to priority areas must be sought in the Act itself. The instrument does not modify or create separate enforcement powers outside the Act.

• Administrative discretion: the instrument is a declaration made by Ministers (the signatures are recorded). It does not create an explicit administrative process for determining disputed classification. How disputes about whether an activity falls within a declared priority area are resolved will depend on procedures and powers contained in the Act, or on ordinary administrative law and statutory interpretation principles applicable to decisions made under the Act.

• Practical implication for regulated entities: entities should not assume this instrument provides any compliance relief or creates any compliance obligations beyond its definitional role. Those seeking to rely on priority‑area classification for funding or other benefits must consult the Act to see whether eligibility rules, application processes or enforcement measures apply and how they will be enforced.

In short, the instrument supplies the Act with its prioritisation vocabulary. It does not itself assert coercive powers or penalties. Enforcement issues are matters for the Act and for implementation instruments, guidance and administrative decision‑making that the Act may authorise.

The instrument interacts with other legislation in two distinct ways: by operating as an interpretive instrument for the National Reconstruction Fund Corporation Act 2023, and by making an explicit cross‑statutory reference. The instrument’s text limits its direct legal interaction to these forms.

• Primary link with the National Reconstruction Fund Corporation Act 2023. The instrument is made under s 6 of the Act (s 3), commences immediately after the Act commences (s 2(1) and commencement table), and expressly declares the listed activities to be priority areas “for the purposes of the Act” (s 5). Therefore the instrument is to be read together with the Act. Any provision in the Act that predicates eligibility, funding, decision‑making, restrictions, or administrative action on whether an activity or project is within a “priority area” will be interpreted using the definitions and descriptions in this instrument. The instrument does not stand alone; its legal function is to populate the Act’s references with content.

• Cross‑reference to horticulture statute. The instrument explicitly makes “horticultural product” have the same meaning as in the Horticulture Marketing and Research and Development Services Act 2000 (s 4). This is an express statutory incorporation by reference. Where horticultural products are implicated, the meaning from that 2000 Act will be imported into the priority area definitions. Practically, this means certain horticulture‑related disputes or technical definitions already resolved under the horticulture Act will be read into the interpretation of the National Reconstruction Fund’s priority areas.

• Potential conceptual overlap with other regimes. The instrument’s definitions for “manufacturing products” and “processing” are expansive. Where other statutes regulate manufacturing, processing, or particular product classes (for example therapeutic goods, transport safety or defence procurement statutes), there may be conceptual overlaps in the types of entities or activities captured. The instrument does not purport to alter or displace those other regulatory regimes. It supplies the Act’s internal definition of “priority areas,” which will sit alongside other statutory frameworks that regulate product safety, approvals, procurement or export controls. Entities operating across regimes will therefore be subject to multiple statutes acting in parallel: this instrument will not substitute for sectoral licensing or approvals required under other legislation.

• No express repeal, amendment or inconsistency clause. The instrument contains no provision purporting to repeal or amend other laws, nor a savings clause limiting other statutes. It therefore operates within the standard inter‑statutory landscape: it classifies activities for the Act but does not change the legal effect of other statutory regimes.

• Administrative and interpretive consequences. Because the instrument is an instrument made by Ministers under the Act, it may be used by administrators, tribunals or courts to interpret the Act’s scope. The degree to which the instrument binds administrative decision‑makers or is accorded deference will depend on the Act’s text and general principles of statutory interpretation, but those matters are outside the instrument’s text. Practitioners should treat the instrument as the Act’s designated taxonomy for “priority areas,” and be alert to any instances where other legislation defines similar terms differently. Where definitions conflict, resolution will require reference to the primary statutes and to principles for resolving statutory inconsistency.

In sum, the instrument’s explicit legal interface is primarily with the National Reconstruction Fund Corporation Act 2023. It imports a horticulture definition from another Act and creates definitional content that may overlap conceptually with other statutory regimes without purporting to modify them.

The instrument contains a short commencement table and a note about amendments but, as provided in the text here, it appears in its original form and records no subsequent amendments. Relevant chronological and amendment information in the instrument is:

• Dates and signatories. The instrument is signed and dated by the Minister for Industry and Science and the Minister for Finance. Ed Husic’s signature is dated 16 May 2023; Katy Gallagher’s signature is dated 25 May 2023. Those signatures evidence ministerial authorisation at the stated dates (cover page).

• Commencement. The instrument’s commencement clause states that the whole of the instrument commences “immediately after the commencement of the National Reconstruction Fund Corporation Act 2023” (s 2(1) and the commencement table). The commencement table contains a note: “This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument” (s 2 table note). That note is an editorial provision commonly used in legislative instruments to record that the presented commencement table is historical and will not be updated within the instrument text as amendments occur; it does not record amendments themselves.

• No amendments recorded in the instrument text. The instrument as provided contains no schedules, later‑dated variations, revocations or amendment clauses. It is therefore the original declaration as made under s 6 of the Act. Any amendments to the instrument, if made later, would appear as separate instruments or as entries in the Federal Register of Legislation; they are not present in the text at hand.

• How the instrument would be amended. The instrument is made under the authority of s 6 of the Act (s 3). Changes to the priority areas as recorded here would therefore require a new instrument or variation made under the Act’s delegated power. The instrument itself does not set out an internal amendment mechanism.

• Administrative footnote. The commencement table’s note that the table will not be amended to deal with later amendments is administrative. It signals that a published version of the instrument may be updated to show amendments elsewhere, but the internal table will remain as originally published.

For practical purposes, readers should treat the instrument’s content as the original declaration dated May 2023. Any subsequent changes to the list or to the definitions would be recorded in amending instruments made under the same Act; those are not present in this document.

The instrument does not record any litigation history. There are no cases, appeals, or tribunal decisions referenced in the text. It is a statutory declaration made under s 6 of the National Reconstruction Fund Corporation Act 2023 and the instrument itself contains no annotations or notes indicating legal challenges.

Because this instrument is a definitional and classificatory text, litigation that might arise in relation to it would likely take one of two forms:

• Challenges to administrative decisions under the Act that depend on priority‑area status. If the Act authorises decisions that hinge on whether an activity is in a declared priority area, disputes about that classification could arise in administrative law proceedings. Those disputes would be litigated against the decision‑making exercise under the Act, relying on the instrument’s text as the interpretive basis for “priority area” status.

• Judicial review of the instrument or of decisions made under the Act. A person affected by a decision under the Act could seek judicial review on traditional grounds (for example jurisdictional error, procedural fairness, or unreasonableness). The instrument itself does not include internal appeal procedures, so such review would be brought against the primary decision or administrative act that relied on the instrument.

None of those potential litigation pathways, or any completed litigation, is recited in the instrument. As a practitioner, to identify any actual litigation one would need to consult court records and decisions concerning the Act and administrative decisions under it. The instrument’s text contains no record of such cases.

Practical pitfalls and interpretation traps are concentrated in the instrument’s broad definitions and in the fact that it is a descriptive instrument whose legal consequences depend entirely on the Act. The principal “gotchas” to watch for are these:

• Broad scope of “manufacturing products.” The definition of “manufacturing products” is not confined to physical production. It expressly includes developing products, providing logistics, distributing, selling, providing after‑market services and maintaining products (s 4). That means firms that provide pre‑production research and development, logistics and distribution services, or after‑market maintenance could be treated as “manufacturing” for the purposes of the Act. Entities that do not ordinarily think of themselves as manufacturers should not assume they are outside the Act’s definitions.

• “Products for use in or in connection with” language extends reach. Many priority area descriptions cover “manufacturing products for use in or in connection with” a sector (see s 5(1)-(3), (5)-(6)). That phrase can include components, subsystems, software, or services that support the primary equipment or process. The instrument’s definition of “products” to include equipment, components, software and technologies (s 4) multiplies this effect. Practitioners should map component suppliers, software firms, systems integrators and service providers to these phrases.

• Processing is broadly defined. “Processing” includes refining, recycling, treating, preparing, transforming or modifying (s 4). This breadth means recycling and resource‑recovery activities are expressly within the renewables and low emission technologies priority area (s 5(5)), and that intermediary processing steps for agricultural or mineral outputs can be captured as processing minerals or processing produce of a primary industry (s 5(1)-(2)).

• “Therapeutic use” covers a broad array of medical activities. The instrument defines “therapeutic use” to include contraception, pregnancy testing and replacement or modification of anatomy (s 4). That could bring into the medical science priority area a wider range of products than a narrow pharmaceutical definition would suggest. Diagnostic and consumer health products with therapeutic uses may therefore be implicated.

• Space objects definition has a precise threshold. “Space object” is defined by reference to travel beyond 100 km above mean sea level and includes parts of such objects even if they travel only part of the way (s 4). Entities working on suborbital or launch‑related systems should check whether their hardware or components fall within this material threshold if they expect the Act to treat them as within the space enabling capabilities priority area.

• Cross‑statutory dependence for horticulture. The instrument makes horticultural product have the same meaning as in the Horticulture Marketing and Research and Development Services Act 2000 (s 4). That external source may contain technical definitions or exemptions that materially affect whether a given product is a horticultural product for the purposes of the National Reconstruction Fund. Users must consult that other Act to resolve borderline horticulture classification issues.

• “Defence” phrasing uses “wholly or primarily for use in or in connection with defence.” The qualifier “primarily” may require a factual assessment when products have both civil and defence applications. The instrument does not lay down a test for primary use; such a test, if needed, will be supplied by the Act or by administrative guidance.

• No standalone governance or dispute process in the instrument. The instrument does not provide adjudicative procedures, appeal processes, or administrative decision rules for disputes about classification. Where the Act gives decision‑making power to an administrative body, there may be significant factual and legal uncertainty about borderline cases, and no immediate procedural clarity in this instrument itself.

• Reliance risk. Since the instrument is made under the Act and commences only after the Act, any actors planning investments or project designs on the basis of priority status should be cautious about assuming that being declared a priority area will automatically confer funding or preferential treatment. The instrument does not itself commit funds or set eligibility criteria; those are matters for the Act and the implementation instruments made under it.

• Potential overlap with other regulatory obligations. Entities classified into a priority area for the Act will still be subject to other sectoral laws (for example safety, environmental, export control, therapeutic goods regulation). The instrument does not amend or displace those obligations. Business planning must take the continuing force of other statutes into account.

Being aware of these technicalities will help practitioners and commercial actors map their activities to the instrument’s textual categories before relying on any benefits or obligations that might flow from the Act.

The instrument does not itself create compliance obligations, but it is the definitive source for how the Act will categorise priority areas. Compliance in practice therefore means two things: mapping operations to the definitions in this instrument, and then complying with any obligations, application processes or eligibility criteria found in the Act or in instruments made under the Act. Concrete steps for a business or legal advisor are:

1. Map activity to the instrument’s definitions

• Identify core activities and match them to the instrument’s language. Use the definitions in s 4 to test fit. For example, if a business provides maintenance and after‑market services for mining equipment, the “manufacturing products” definition expressly includes after‑market services (s 4). If a firm recycles materials, the instrument’s definition of “processing” includes recycling (s 4) and recycling is specifically enumerated under renewables and low emissions (s 5(5)). Document the factual basis for classification: contracts, statements of work, product descriptions, system diagrams and invoices showing the nature of the activity.

2. Trace the product or activity linkages

• Where the instrument uses “for use in or in connection with,” document how the product or service interacts with the primary sector. For instance, a software supplier should map how its software is used in mining operations, mineral processing, or vehicle control systems. The instrument’s definition of “products” explicitly includes software and technologies (s 4). Evidence of integration, operational use cases, or procurement documents will assist any eligibility assessment under the Act.

3. Consult the cross‑referenced statute where applicable

• For activities involving horticultural products, consult the Horticulture Marketing and Research and Development Services Act 2000 to confirm whether the product falls within that statute’s definition, because the instrument imports that meaning (s 4).

4. Prepare for multi‑statute compliance

• Being designated as a priority area activity under the instrument will not remove other statutory obligations. Identify related regulatory regimes (therapeutic goods, defence procurement, transport safety, environmental approvals) and ensure concurrent compliance. For medical products with therapeutic use, confirm whether separate regulatory approvals are required under the appropriate health statutes, therapeutic use is broadly defined in the instrument and may encompass products subject to other regulators (s 4 and s 5(4)).

5. Maintain contemporaneous documentary evidence

• Because classification may be contested in administrative decisions under the Act, businesses should retain contemporaneous records that substantiate their position: technical specifications, contract terms, production or service logs, client statements showing use in the relevant sector, and reports that demonstrate primary or predominant use where necessary (for example for defence‑oriented products).

6. Monitor Act provisions and subordinate instruments

• The instrument’s practical effect derives from the Act. To operationalise compliance or eligibility, monitor the National Reconstruction Fund Corporation Act 2023 and any regulations, rules, guidelines, application forms or determinations made under that Act. The instrument’s definitions will be applied by those measures. The instrument itself does not set application windows, decision criteria or reporting obligations.

7. Seek administrative clarification for borderline cases

• Where classification is ambiguous, such as dual‑use products or services that are not obviously manufacturing, seek written guidance or a statement from the relevant administrative body established under the Act. Because the instrument provides no internal dispute resolution procedure, a formal administrative ruling or documented advice from the corporation or decision‑maker under the Act may be critical.

8. Engage legal and technical advisers

• Given the broad and functional drafting, legal and sectoral technical advice will help in applying the instrument’s definitions to complex supply chains and novel technologies (for example AI, quantum technologies, or space components defined in s 5(7) and s 4). Document the legal reasoning for classification, and ensure technical specifications align with that reasoning.

9. Budget for ancillary compliance

• If being in a priority area under the Act imposes reporting, audit or project requirements in the Act or subordinate instruments, budget internal compliance resources accordingly. The instrument does not specify these obligations, so part of compliance planning is to anticipate and resource any obligations the Act could impose on projects designated as priority area activities.

10. Plan for change

• The instrument may be amended by a subsequent instrument made under the Act. Maintain a process to reassess classification in light of future amendments and track any changes to the declared priority areas.

In short, compliance requires using this instrument as the canonical taxonomy for priority areas and then mapping that taxonomy onto the Act and any administrative regimes established under it. The immediate practical task for businesses is factual mapping and evidence preparation; the downstream tasks, applications, contractual arrangements, reporting, depend on the Act’s operative provisions and any implementation instruments.
