National Parks and Wildlife (Mamungari Conservation Park) Regulations 2019

Several organising concepts appear repeatedly and determine how the regulatory regime operates. The first is the Board as regulator and permissioning authority. The Board sets fees for entry (regulation 6(1)), publishes opening hours and closures in the Gazette (regulation 7(1) and (2)), sets aside areas for particular uses and may impose or vary conditions (regulation 8), and grants or refuses written permissions and permits that may be conditional and revocable (regulation 38).

The second concept is a closed system of permissions. A large number of activities are forbidden unless the Board has given written permission, a lease, licence or agreement authorisation, or the activity is otherwise specifically permitted by the regulations (for example, certain Aboriginal practices) (see regulations 9, 11, 12, 13, 15, 16, 17, 18, 20, 23, 24, 27, 28, 29, 34, 35). Permission must be in writing and may be published in the Gazette, and conditions attached to permissions are enforceable (regulation 38).

Third, the regulations distinguish traditional owners and Aboriginal persons in particular ways. The entry fee requirement does not apply to a traditional owner (regulation 6(2)). There are targeted exceptions to firearms and devices for taking animals where an Aboriginal person acts for the purpose of taking animals in accordance with section 68D of the Act (regulations 18(2) and 23(2)). The Board’s actions must not be inconsistent with the co-management agreement and the composition and remit of the Board is tied to that agreement (regulations 3, 7(4), 38(3)).

Fourth, enforcement and administrative remedies are organised around wardens and authorised persons. Wardens may remove vehicles that obstruct roads or tracks and can seize and impound abandoned property (regulations 9(5) and 32(2)). Wardens or authorised persons can capture, sell or destroy unprotected animals which are not under control and not present with written permission (regulation 26). Wardens may give directions which must be complied with (regulation 37).

Fifth, the regulations deploy both criminal penalties and expiation fees for contraventions. Regulation 40 supplies a general offence rule with a maximum penalty of $1 000, while certain contraventions attract different expiation fees or higher maximum penalties (for example regulation 34 carries a maximum penalty of $5 000). Regulation 16, 17 and 18 specify maximum penalties and expiation fees for certain device and weapon offences.

Finally, transitional continuity is addressed. Existing permissions, permits and notices issued under the revoked 2004 regulations continue in force on commencement, but remain subject to variation or revocation by the Board under the new rules (Schedule 2).

These concepts combine administrative discretion, written permissioning, targeted exemptions, and an enforcement apparatus that includes expiation, civil debt recovery for costs, and seizure powers. The result is a Park managed predominantly through Board-driven rulemaking and individualised written permissions.

The regulations affect multiple categories of persons and entities, with concrete and differing obligations and exemptions. Primary affected groups are Park visitors, commercial operators, researchers, traditional owners and Aboriginal persons, leasers and licensees, wardens and Board staff, and owners of vehicles or animals.

Visitors: Every person entering or remaining in the Park is subject to payment of an entrance fee where the Board sets a fee (regulation 6(1)), and must obey the Park rules unless specifically exempted. A visitor in a vehicle must display the entrance fee receipt or permit in the windscreen or in a prominent position (regulation 10). Visitors face specific prohibitions unless they have written permission, including camping (regulation 13), swimming or diving in Park waters (regulation 19), certain recreational activities (regulation 20), use of drones and aircraft entries and drops (regulation 11), use of vessels (regulation 12), and possession of firearms or explosives (regulation 18).

Commercial operators and others conducting specified activities: Activities undertaken for fee or reward, commercial filming, conducting tours, competitions, selling or hiring goods, providing services for profit or fundraising are all prohibited without a lease, licence or agreement under the Act or another Act (regulation 34). Those persons must secure a formal instrument (lease, licence or agreement), or obtain written permission included in such an instrument.

Researchers and scientific personnel: Entry to carry out scientific research requires permission from the Board (regulation 29). Scientific experiments conducted for non-consensual purposes require formal authorisation under regulation 34 where they are captured by that list.

Traditional owners and Aboriginal persons: Traditional owners are explicitly exempt from the fee requirement (regulation 6(2)). Aboriginal persons have specific exceptions allowing possession and use of firearms, and devices for taking animals, where they act in accordance with section 68D of the Act (regulations 18(2) and 23(2)). The Board must not act in a way inconsistent with the co-management agreement for the Park, which links Board powers to the Maralinga Tjarutja Land Rights framework (regulations 3, 7(4), 38(3)).

Wardens and authorised officers: Wardens are empowered and granted duties, including removal of obstructing vehicles (regulation 9(5)), seizure and disposal of animals (regulation 26), impoundment of abandoned property (regulation 32), and giving directions that must be complied with (regulation 37). However, regulation 4 excludes wardens and Department or Board employees from the regulations when performing their functions, which affects the reach of the rules against those officers.

Owners of vehicles and personal property: Owners risk the costs of removal or impoundment where vehicles are left obstructing or abandoned (regulations 9(5), 32). The Board may sell or otherwise dispose of seized property after notice and specified time periods, and recovery of impounding and seizure costs is treated as a debt due to the Board (regulations 9(5), 32(3) to (5)).

Owners of animals: Persons who bring animals into the Park must have Board permission (regulation 24). If an unprotected animal is found unowned and not present under permission, a warden or authorised person may capture, sell, dispose of or destroy the animal and recover costs from the owner where ownership is established (regulation 26).

Minister and public authorities: For particular animal protections the Minister’s permission is required, for instance to take or molest an unprotected animal or intentionally damage a nest or burrow (regulation 21). The Fire and Emergency Services Act 2005 remains applicable with respect to fires (regulation 14(2)). The regime therefore sits alongside and in part defers to other statutory decision makers for specific functions.

In sum, visitors and commercial actors bear the principal compliance burdens in the form of permissions, fees and display obligations, while the Board and wardens exercise closure, permissioning and enforcement powers. Traditional owners and certain Aboriginal activities have express carve-outs or different procedural routes. Owners of vehicles, animals or property parked or left in the Park carry financial exposure for removal and impounding.

The regulations allocate specific duties, powers and rights to multiple actors.

Board duties and powers: The Board sets entry fees (regulation 6(1)), publishes opening hours and can close the Park or parts of it for specified management reasons or cultural activities (regulation 7(1), (3)(a) and (b)), and may set aside parts of the Park for particular activities with conditions published in the Gazette (regulation 8). The Board grants permissions, which must be in writing and may be conditional, revoked or varied (regulation 38(1)). The Board also determines whether to permit the use of aircraft, vessels, camping, fires during a ban, use of generators where not in vehicle, possession of weapons, and many other activities (regulations 11, 12, 13, 14, 16, 18). The Board may recover costs for removal of vehicles and impounded property (regulations 9(5), 32(3)).

Warden powers and duties: Wardens are authorised to enforce the regulations, remove hazardous or obstructing vehicles (regulation 9(5)), seize and impound property abandoned for more than 24 hours (regulation 32(2)), and capture, sell, dispose of or destroy unprotected animals that are unowned and not present with permission (regulation 26(1)(c) and (d)). Wardens may give directions about use, conduct and safety in the Park that must be complied with (regulation 37). However, wardens are exempt from the regulations when performing their functions (regulation 4).

Visitor duties: Visitors must pay the entry fee if set by the Board (regulation 6(1)), observe opening hours and closures and absent Board permission must not enter when the Park is closed (regulation 7(5)), and must obey signs and notices displayed (regulation 36). Visitors in vehicles must display entrance receipts or permits in the windscreen or a prominent outward-facing position (regulation 10). Visitors must not undertake many activities without permission, including camping, use of generators, chainsaws, metal detectors, swimming, boating, use of aircraft, commercial activities, and other enumerated acts (regulations 11 to 20, 27 to 29, 34, 35).

Rights and exemptions: Traditional owners are exempt from paying an entrance fee (regulation 6(2)). Aboriginal persons have specific rights to possess firearms or devices for taking animals when acting in accordance with section 68D of the Act (regulations 18(2) and 23(2)). A person conducting a tour may be treated differently with respect to display of permits where the tour operator's vehicle is used (regulation 10(4)). A person may also rely on an emergency defence if they prove they acted in response to an emergency and the court finds the action reasonable (regulation 40(2)).

Procedural form and conditions of permission: Permissions must be in writing, and may be included in a lease, licence or agreement; unless published in the Gazette a permission will be a permit and may be conditional, varied or revoked by the Board at any time (regulation 38(1)). Conditions may include prohibition on possession or consumption of alcohol (regulation 38(2)). A permission may apply to individuals or, if Gazette-published, generally or to a class of persons (regulation 38(4)).

Financial duties: The owner of a vehicle removed for obstructing must pay costs of removal, recoverable as a debt to the Board (regulation 9(5)). Costs of capturing, disposing of or destroying animals are a debt due by the owner and carcasses will not be surrendered until costs are paid (regulation 26(4) and (5)). Seizure and impounding costs must be paid before property is returned; unclaimed property may be sold after one month (regulation 32(3) to (5)).

Compliance and enforcement duties: Individuals must obey reasonable directions from wardens, comply with signs and notices, and adhere to any conditions attached to Board permissions (regulations 36 and 37 and 38(5)). Failure to comply constitutes an offence subject to fines or expiation fees in most instances (regulation 40).

Ministerial powers: The Minister retains a gatekeeping role for certain animal protections, specifically permission to take or molest an unprotected animal or intentionally damage a nest or burrow (regulation 21(1) and (2)).

In sum, duties flow primarily from visitors and operators to obtain and display written permissions, avoid prohibited activities without authorisation, and comply with wardens and signs. The Board carries broad regulatory and fee-setting powers, while wardens exercise on-the-ground enforcement and seizure authorities. Several statutory exemptions and a narrow emergency defence are preserved.

The regulations combine criminal offences, expiation fees and non-criminal administrative remedies, with enforcement roles assigned to wardens and authorised persons and decision-making residing with the Board and the Minister in specified contexts.

Criminal penalties and expiation scheme: Regulation 40 provides the general offence rule, making contravention of most provisions an offence with a maximum penalty of $1 000. Regulation 40 also sets expiation fees: certain contraventions (including entry without paying the fee in regulation 6, vehicle and speed offences in regulation 9, lighting fires contrary to bans in regulation 14, some weapon offences and failure to obey wardens in regulation 37) attract an expiation fee of $150, while other breaches attract $75. Regulation 16, 17 and 18 additionally specify maximum penalties and expiation fees for the use of generators and alternators (maximum penalty $1 000, expiation $150), metal detectors (maximum penalty $1 000, expiation $150), and possession or use of firearms and explosives (maximum penalty $1 000, expiation $150). Regulation 34 carries a higher maximum penalty of $5 000 and a specified expiation fee of $315 for commercial activities done without a lease, licence or agreement.

Specified prescribed offences: Regulation 39 and Schedule 1 list contraventions that are "prescribed for the purposes of the definition of prescribed offence in section 73A of the Act." The schedule lists a selection of regulations, including entry offences, closure breaches, vehicle rules and camping provisions (for example regulations 6, 7(5), 9(1), 9(2), 9(3), 9(4), 9(6), 10(1), 10(2) and 13). This treatment indicates that contraventions of those specified provisions are treated as prescribed offences under section 73A of the base Act, which will affect the legal consequences created by that section.

Enforcement powers: Wardens and authorised persons are granted operational powers to remove or cause removal of vehicles left obstructing roads or tracks, with recovery of the removal costs from the vehicle owner as a debt to the Board (regulation 9(5)). Wardens may seize and impound vehicles and other personal property left unattended for more than 24 hours (regulation 32(2)), and the Board may require the owner to pay seizure, impounding and keeping costs before returning the property; if costs are unpaid after one month the Board may sell or otherwise dispose of the property (regulation 32(3) to (5)).

Animal enforcement powers: If an unprotected animal in the Park is not under the control of any person and is not present with written permission, a warden or authorised person may capture and dispose of the animal by sale or otherwise, or destroy it (regulation 26(1)(c) and (d)). If someone claims ownership, notice must be served requiring removal within 7 days before disposal or destruction (regulation 26(2) and (3)). Costs of capture and disposal are a debt due by the owner and carcasses will not be surrendered until those costs are paid (regulation 26(4) and (5)).

Direction and notice enforcement: Persons must obey notices, signs and directions of the Board and wardens (regulations 36 and 37). Failure to comply is an offence, and certain contraventions are listed among the prescribed offences (Schedule 1).

Procedural protections and defences: The regulations provide a statutory emergency defence to charges under these regulations where the defendant proves they acted in response to an emergency and the court finds the action reasonable (regulation 40(2)). Permissions must be in writing and conditions are enforceable (regulation 38(1) and (5)), offering a procedural route to lawful activity. The Board must not grant or refuse permission if doing so would be inconsistent with the co-management agreement (regulation 38(3)), which limits arbitrary decision-making to the extent that an inconsistent decision would conflict with that agreement.

Financial enforcement and debt recovery: Monetary recovery is supported via the debt mechanism for vehicle removal and costs associated with animals and seized property, creating an administrative pathway to recover enforcement costs (regulations 9(5), 26(4) and 32(3)). The Board may sell unclaimed property after specified notice and time periods (regulation 32(4) and (5)).

In short, enforcement is mixed and layered: direct policing and on-the-spot measures by wardens; criminal charges with maximum penalties and expiation fees; administrative cost recovery and sale of impounded property; and specific procedural layers such as written permissions, Gazette notices and an emergency defence. The Board and wardens are the primary enforcers, and several provisions channel consequences into civil debt recovery as well as criminal enforcement.

The regulations operate as subordinate legislation under the National Parks and Wildlife Act 1972, and they expressly incorporate, reference and defer to multiple other statutory instruments and agreements.

Primary Act linkage: The regulations are made under the National Parks and Wildlife Act 1972 (regulation 1 heading) and rely on that Act for the general delegation of regulation-making power. Regulation 5 prescribes qualifications for wardens for the purposes of section 20(1) of the Act, indicating an explicit cross-reference and operational dependency. Regulation 39 refers to section 73A of the Act, prescribing certain contraventions for the definition of prescribed offence in that section.

Co-management and land rights: The Park, the Board and the term traditional owner are defined with reference to the Maralinga Tjarutja Land Rights Act 1984 and the co-management agreement (regulation 3). The Board must not close the Park if doing so would be inconsistent with the co-management agreement (regulation 7(4)) and must not grant or refuse permission if that would be inconsistent with the co-management agreement (regulation 38(3)). This structures the Board’s discretion around the co-management framework established under the Land Rights Act and the co-management agreement.

Other South Australian Acts: The regulations require compliance with the Fire and Emergency Services Act 2005 concerning fires in the Park (regulation 14(2)), and recognise assistance dogs under the Dog and Cat Management Act 1995 (regulation 24(4)). These cross-references preserve the primacy of other statutory safety and animal control regimes in those subject areas.

Commonwealth and interstate employees: Regulation 5 prescribes that persons who have completed police training in the Commonwealth, a State or Territory, or who are employees of the Australian Border Force or customs officers of the Commonwealth Department of Immigration and Border Protection satisfy warden qualification requirements, and that employees from equivalent wildlife conservation administrative units of other States or Territories count where employed within two years before appointment. That links the regulation to Commonwealth and other State/Territory personnel training and roles.

Leases, licences and agreements: Some activities are explicitly permitted only pursuant to a lease, licence or agreement under the Act or any other Act (regulation 34). This means that other statutory instruments that grant leases or licences may authorise activities that would otherwise be prohibited under these regulations.

Ministerial permissions: For taking or molesting an unprotected animal, and intentionally damaging nests or burrows, ministerial permission is required (regulation 21). That preserves a direct role for ministerial authorisation under the primary statute or related instruments.

Transitional continuity and prior law: Schedule 2 preserves permissions, directions, authorisations, permits or notices issued under the revoked National Parks and Wildlife (Unnamed Conservation Park,Maralinga Tjarutja Lands) Regulations 2004, which continue in force and may be varied or revoked under regulation 38. Schedule 3 revokes the 2004 regulations, effecting a statutory transition in regulatory instruments.

Interaction with criminal and civil consequences: Several contraventions are prescribed for the purposes of section 73A of the Act by regulation 39 and Schedule 1. The regulations also create debts due to the Board for costs of removal or disposal, which intersect with civil debt recovery procedures outside the criminal enforcement machinery.

In practice, users of the Park must engage with multiple legal texts: the National Parks and Wildlife Act 1972 for the underlying legal authority and definitions, the Maralinga Tjarutja Land Rights Act 1984 and the co-management agreement for ownership, Board remit and traditional owner matters, and other Acts such as the Fire and Emergency Services Act 2005 and the Dog and Cat Management Act 1995 for subject-specific obligations. Permissions under these regulations may be issued as or included in leases or licences under other Acts, creating a web of intersecting instruments.

The document provides a short legislative history and transitional detail for the 2019 instrument. These regulations are the National Parks and Wildlife (Mamungari Conservation Park) Regulations 2019, numbered 190 in the 2019 South Australian regulations (Gazette 18.7.2019 p2754), and they commence on the day they are made under regulation 2 (commencement). The legislative history block records the principal regulations year and number and repeats the Gazette entry and commencement reference.

The regulations expressly revoke the National Parks and Wildlife (Unnamed Conservation Park,Maralinga Tjarutja Lands) Regulations 2004 by Schedule 3. Schedule 2 contains transitional provisions stating that any permission, direction, authorisation, permit or notice granted under the revoked 2004 regulations in relation to the Park that was in force immediately before commencement will continue in force in accordance with its terms, but may be varied or revoked under regulation 38 of these new regulations. This transitional continuity preserves existing authorisations while placing them under the new Board permissioning framework.

There is no material in the document about subsequent amendments after 2019, nor any textual amendments or historical iterations beyond noting the 2004 revocation. The regulations include specific mechanisms that anticipate future change by the Board, notably powers to vary or revoke Gazette notices and permits at any time (regulations 7(2), 8(2) and 38(1)). The Board’s discretion to vary or revoke permissions means the operational application of these regulations may shift through executive decisions without amendment to the regulations themselves, subject to constraints imposed by the co-management agreement (regulation 38(3)).

Because the regulations are subordinate to the National Parks and Wildlife Act 1972, any future amendments to that Act or to the Maralinga Tjarutja Land Rights Act 1984, or changes to the co-management agreement, could also alter how these regulations function in practice. The instrument explicitly ties the Board’s powers to the co-management agreement and the Maralinga Tjarutja Land Rights Act (regulation 3), so changes to those documents will have operational effect.

In summary, the 2019 regulations replaced the 2004 instrument, preserved existing authorisations through a transitional schedule, and give the Board broad administrative authority to modify hours, permissions and conditions without legislative amendment. The legislative history as provided is limited to the 2019 enactment and the revocation of the 2004 regulations; no later amendments are recorded in the source document.

The source text contains no cases, judicial decisions or litigation history. The regulations list only their own legislative history, commencement facts and the revocation of the 2004 regulations. There is no mention in the text of court challenges, disputes, precedent-setting decisions or interpretations by courts regarding these regulations or the Board’s decisions.

The absence of litigation material in the instrument itself means that any practitioner seeking judicial guidance will need to consult case law beyond the text of the regulations, including jurisprudence interpreting the National Parks and Wildlife Act 1972, the Maralinga Tjarutja Land Rights Act 1984, co-management agreement disputes, and any administrative law challenges to Board decisions or exercises of powers by wardens. The regulations do, however, create specific statutory constructs that invite potential legal challenge or judicial review, for example:

• Discretionary powers of the Board to grant, vary or revoke permissions and to close parts of the Park, where the Board must act consistently with the co-management agreement (regulations 7(3), 8, 38(1) and 38(3)). Judicial review could be sought if a decision is alleged to be inconsistent with the co-management agreement or otherwise unlawful.

• Enforcement and seizure powers vested in wardens and authorised persons, including seizure and disposal of animals, impoundment and sale of property, with associated debt recovery (regulations 26 and 32), which could give rise to disputes about procedural fairness, notice and appropriate compensation.

• Application of expiation fees and criminal penalties under regulation 40, including the definition and scope of prescribed offences under regulation 39 and Schedule 1 in relation to section 73A of the Act, potentially raising questions about statutory interpretation and appropriate penalty levels.

• Boundaries and rights of traditional owners and Aboriginal persons under the carve-outs in regulations 6(2), 18(2) and 23(2), and the effect of the co-management agreement on Board powers, which could lead to disputes about indigenous rights and permissions.

Because the text does not identify any litigation, practitioners must search external legal databases and court registries for any cases involving these regulations, the Board, or related co-management matters. Administrative law principles, such as procedural fairness, jurisdictional error, unreasonableness, and compliance with statutory limits, are likely to be the framework within which any judicial review would proceed. For matters involving seizure or disposal of property and debt recovery, civil remedies and actions in State courts would be relevant. For criminal prosecutions under regulation 40 or specified offences with expiation options, summary prosecutions and contested expiation proceedings would be the mechanism. None of that litigation history is contained within the instrument itself.

The regulations contain multiple features that can produce practical compliance traps or create operational uncertainty if not carefully managed.

Wide Board discretion and written-permit centrality: Many common activities are forbidden unless the Board gives written permission (regulations 11, 12, 13, 15 to 20, 23, 24, 27 to 29, 34, 35). The need for written permission that may be conditional, varied or revoked at any time (regulation 38(1)) means that persons may lawfully begin an activity only to have permission revoked later. Practitioners should note the Board may publish permissions in the Gazette or issue permits; if not published, they must be retained in writing (regulation 38(1) and (4)).

Display and formality requirements: A small technical requirement carries substantive enforcement risk. Receipts and permits must be displayed inside the windscreen on the side opposite the driver, or if impossible, in a prominent outward-facing position (regulation 10(3)). Failure to display correctly is an offence and some display-related breaches are listed among prescribed offences under regulation 39 and Schedule 1, exposing the person to the expiation fee associated with regulation 40. Tour clients are exempt where the vehicle is owned or controlled by the tour operator (regulation 10(4)), but individual visitors in operator-provided vehicles should verify whether the operator has complied with display obligations.

Ambiguity about who is "subject" to the regulations: Regulation 4 removes wardens from being subject to the regulations when performing their functions and excludes Department or Board employees from the regulations when performing employment duties. This exclusion may create perceived asymmetry in enforcement; it may also create arguments about the limits of regulatory reach against officers exercising statutory powers. Practitioners should note that the exclusion applies only to officers acting in their official capacity, not to their private conduct.

Overlap with other Acts and the co-management agreement: The Board must not act inconsistent with the co-management agreement (regulations 7(4) and 38(3)). Where the co-management agreement grants rights that appear to conflict with Board conditions, the agreement, as referenced in regulation 3, will control. Users must check the co-management agreement and the Maralinga Tjarutja Land Rights Act 1984 for rights, exemptions and obligations that interact with these regulations.

Seizure and debt recovery can impose unexpected bills: Owners of vehicles left obstructing can be charged removal costs recoverable as a debt to the Board (regulation 9(5)). Abandoned property impoundment and the requirement to pay seizure and keeping costs before return, as well as the Board’s power to sell after one month if the owner does not pay or cannot be found (regulation 32(3) to (5)), can be commercially significant. For animals, capture and disposal costs are recoverable as a debt and carcasses will not be returned until costs are paid (regulation 26(4) and (5)). Those provisions create immediate cash exposure.

Ministerial permission for certain animal activities: Regulation 21 requires Ministerial permission to take or molest an unprotected animal or intentionally damage a nest or burrow. That restriction is distinct from other permissions issued by the Board, and failure to differentiate the source of required permission could lead to unlawful acts despite having Board authorisation.

Aboriginal and traditional owner exceptions are narrow and conditional: The exemptions for Aboriginal persons to possess firearms or devices for taking animals apply only where the activity is carried out in accordance with section 68D of the Act (regulations 18(2) and 23(2)). The entry fee exemption is for a traditional owner only (regulation 6(2)). Practitioners must map these exceptions against the National Parks and Wildlife Act and the Maralinga Tjarutja Land Rights Act to confirm scope.

Specified prescribed offences and legal consequences: Regulation 39 lists particular contraventions treated as prescribed offences for section 73A of the Act. This can carry legal consequences under the Act beyond mere penalties or expiation fees; users should not assume all contraventions have identical legal and evidentiary consequences.

Emergency defence narrowness: The emergency defence in regulation 40(2) requires the defendant to prove they acted in response to an emergency and that a court finds the action reasonable. This is a fact-sensitive, court-determined defence and should not be relied upon except where clear emergency circumstances exist.

Transitional permits may be varied or revoked: Permissions carried over from the revoked 2004 regulations remain in force on commencement (Schedule 2), but may be varied or revoked under the new regulation 38. Operators relying on prior authorisations should verify whether the Board has modified those permissions.

Higher penalties for commercial activity without formal authorisation: Regulation 34 sets a maximum penalty of $5 000 and an expiation fee of $315 for commercial or profit-making activities done without the required lease, licence or agreement. Commercial operators should ensure they hold the appropriate statutory instrument before offering services or goods for reward.

Collective implications: Because many common activities are captured by the permissioning regime and the Board has broad conditional authority, frequent or ongoing users of the Park, tour operators and researchers face administrative friction and potential regulatory uncertainty unless they obtain written permissions and maintain current evidence of authorisation.

In practice, the most common "gotchas" will be failure to obtain the correct form of permission, failure to strictly comply with display and location conditions, and misreading the narrow scope of exceptions for Aboriginal persons and traditional owners. These are compounded by debt recovery mechanisms for removal and seizure which produce immediate financial liabilities.

To comply with these regulations an individual or organisation must adopt both procedural and substantive steps that reflect the Board-centred permissioning system and on-the-ground enforcement by wardens.

1. Determine whether activity requires Board permission or a lease/licence: Before entering the Park for camping, commercial activity, filming, research, use of aircraft or vessels, use of generators, chainsaws, metal detectors, firearms or taking animals, consult the regulations (notably regulations 11 to 20, 23 to 29 and 34) to identify whether written permission, a lease, licence or agreement under the Act or another Act is required. Commercial activities and services for fee or reward require a lease, licence or agreement (regulation 34).

2. Obtain written permission and keep it accessible: All permissions must be in writing and may be included in a lease, licence or agreement under the Act or another Act; unless published in the Gazette permissions must be carried in the form of a permit (regulation 38(1) and (4)). If permission is granted, retain an original or copy of the written permit on your person and in the permitted vehicle, and ensure any conditions are understood and complied with (regulation 38(5)). Where permissions are Gazette-published, check the Gazette notices for scope.

3. Check Gazette notices and Board publications for hours, closures and set-asides: The Board publishes opening hours, closures and areas set aside for particular activities in the Gazette (regulations 7(1) and 8(1)). Before visiting, review recent Gazette notices and Board communications to confirm whether the Park or parts of it are open or subject to special restrictions.

4. Display receipts and permits as required: If you enter the Park in a vehicle, ensure the receipt for the entrance fee or the permit authorising entry is displayed on the inside of the windscreen on the side opposite the driver, or, where that is impossible, in a prominent outward-facing position (regulation 10(1) to (3)). If you are camping in or near the vehicle you travelled in, ensure the camping permit is displayed continuously while camping (regulation 10(2)). Tour operators should ensure that their vehicles carry the necessary display so clients are not individually required to do so (regulation 10(4)).

5. Ensure vehicle and operator compliance: Do not drive vehicles except on roads or tracks set aside by the Board and obey variable speed limits set by the Board (regulation 9(1) and (2)). Drive with due care and ensure motor vehicles are registered and insured as required (regulation 9(6)). Avoid leaving vehicles that obstruct other vehicles, as the Board may remove obstructing vehicles and recover costs as a debt (regulation 9(4) and (5)).

6. Respect fire rules and other statutory obligations: Do not light fires in contravention of a Board-imposed ban (regulation 14(1)) and comply with the Fire and Emergency Services Act 2005 where applicable (regulation 14(2)). Do not leave fires unattended (regulation 14(3)). For any activity that intersects other Acts, such as assistance dogs under the Dog and Cat Management Act 1995 (regulation 24(4)), ensure compliance with those statutes.

7. Manage animals and plants lawfully: Do not bring animals into the Park without Board permission except as authorised via lease, licence or agreement (regulation 24). If you find an unprotected animal not under someone’s control, note that a warden may seize, sell or destroy it after serving notice if ownership is claimed (regulation 26). Do not remove or bring plants without permission, except that dead plants intended as human food are permitted to be brought in (regulation 27).

8. Prepare for inspection and directions: Wardens can give directions concerning use, conduct and safety of the Park which must be complied with (regulation 37). Have permits and identification available to present to a warden and follow any reasonable directions immediately.

9. Maintain records and budget for costs: Keep written proof of any Board permissions, receipts of fees paid, and correspondence showing any conditions. Budget for potential removal or impounding costs and understand that these are recoverable as a debt by the Board (regulations 9(5), 26(4) and 32(3)). For commercial operations, ensure leases, licences or agreements expressly authorise the contemplated activity and keep copies of those instruments on-site.

10. For Aboriginal persons and traditional owners: Confirm entitlement to exemptions by reference to section 68D of the National Parks and Wildlife Act 1972 and the definitions under the Maralinga Tjarutja Land Rights Act 1984. Traditional owners are exempt from entrance fees (regulation 6(2)), and Aboriginal persons have specific exceptions for firearms and devices for taking animals when acting in accordance with s68D of the Act (regulations 18(2) and 23(2)). Obtain supporting documentation or written confirmation where necessary.

11. For researchers and scientific projects: Obtain a written permit from the Board before entering for scientific research (regulation 29), and ensure any experimental work that could be classified as an activity in regulation 34 is authorised by lease, licence or agreement as applicable.

12. Avoid commercial exposure: Commercial operators should secure a lease, licence or agreement under the Act or another Act prior to conducting filming, tours for fee, competitions, selling or hiring goods, providing services for reward, fundraising or profit-making activities (regulation 34). The penalty exposure is substantially higher for unauthorised commercial operations (regulation 34).

13. Responding to seizure or impoundment: If property or a vehicle is seized, the owner must pay seizure and keeping costs before return; where the owner does not pay within one month after notification, the Board may sell the property (regulation 32(3) to (5)). For animals seized or destroyed, costs are a debt and carcasses are not returned until costs are paid (regulation 26(4) and (5)). If you are notified, act promptly to claim or remove the property where entitled.

14. Use the emergency defence cautiously: If you act in an emergency, be prepared to establish the facts that the action was in response to an emergency and that it was reasonable (regulation 40(2)). This is an evidentiary defence requiring a court finding.

15. Liaise with the Board and verify permissions: For activities that are not obviously captured, consult the Board in writing to obtain either a permit or confirmation that permission is not required, retain the Board’s written response and, where feasible, seek publication of general permissions in the Gazette if a class or broader authorisation is intended (regulation 38(4)).

Following these steps will reduce exposure to criminal penalties, expiation fees and administrative debt recovery. Maintaining written permissions, complying with display and conduct obligations, and promptly resolving any seizure or impoundment actions are the practical keys to compliance under these regulations.
