National Parks and Wildlife (Kanku-Breakaways Conservation Park) Regulations 2013

The Regulations operate around a small set of organising concepts: the Park, the Board, permissions/permits, designated areas, offences and enforcement, and specific exemptions and transitional arrangements.

Definitions and institutional framework (reg 3)

• "Park" is defined as Kanku‑Breakaways Conservation Park (reg 3).
• "Board" is defined as the Kanku‑Breakaways Conservation Park co‑management board continued under separate co‑management boards regulations (reg 3); the legislative history confirms the Board’s continuation under the National Parks and Wildlife (Co‑management Boards) Regulations 2016.
• Several Indigenous‑related definitions are explicit: the Antakirinja Matuntjara Yankunytjatjara people are defined by reference to the Federal Court native title determination (reg 3); AMYAC (the corporation) is defined by reference to the Corporations (Aboriginal and Torres Strait Islander) Act 2006 (reg 3). The preamble records these people’s traditional ownership and native title (Preamble cl 2-4) and that the Park will be co‑managed (Preamble cl 4).

Permissions and delegations

• Many activities are prohibited unless the Board grants written permission or a lease, licence or agreement (regs 21, 23-26, 28-31, 34, 35, 38-40, 45-46). Reg 49 sets the formality: permissions must be in writing, may be conditional, can be varied or revoked at any time, and may be published in the Gazette to apply generally (reg 49(1), (4)). Conditions may include alcohol prohibitions (reg 49(2)).
• The Board’s powers to set aside areas (for roads, tracks, aircraft landing, camping, generators, recreational activities, etc.) are exercised by Gazette notices (regs 19(1)-(2), 20, 21(1), 23(1), 27(1), 31).

Exemptions and limits

• Antakirinja Matuntjara Yankunytjatjara people are explicitly exempt from the entry fee requirement (reg 18(2)).
• Wardens and certain employees are not subject to the regulations insofar as they perform their official functions (reg 17).
• Specific statutory exceptions are preserved, for example Aboriginal persons taking animals under s 68D of the Act are not subject to the general firearms and device prohibitions in regs 29(2) and 34(2).

Offences, penalties and enforcement mechanics

• A general offence catches contraventions of the Regulations (reg 51(1)), with a maximum penalty and expiation fees differentiated by contravention type (reg 51(1)-(2)). Certain named contraventions are prescribed offences for s 73A of the Act (reg 50).
• Specific enforcement powers are conferred on wardens and authorised persons: removing obstructing vehicles and recovering costs (reg 21(5)), capturing or destroying unprotected animals and requiring owners to remove animals within seven days (reg 37), and seizing and impounding abandoned property with sale after notice and lapse of time (reg 43).

Operational continuity and constraints

• The co‑management agreement is a recurring touchstone: the Board must not act inconsistently with that agreement (regs 19(4), 49(3)) and the definition of "nominating body" for Board appointments is tied to the co‑management agreement (reg 3).
• A transitional provision continues licences, permits or written permissions issued under the Act or the former National Parks and Wildlife (National Parks) Regulations 2001 in relation to the Park (Schedule 1).

Taken together, the Regulations combine detailed behavioural prohibitions, a structured permissioning regime principally exercised by the Board, and enforcement tools to support compliance, all framed by the co‑management context with specific Indigenous recognition and exemptions.

These Regulations affect a set of distinct actors, with legal entitlements and obligations prescribed differently for each group.

The Board and nominated bodies

• The Board is the primary decision maker under the Regulations. It sets fees for entry (reg 18(1)), publishes opening hours and closures (reg 19(1)-(3)), designates areas (reg 20), grants or refuses permissions (reg 49), and enforces rules through wardens and authorised persons (regs 21(5), 37, 43).
• Nominating bodies are defined in reg 3 and, under the co‑management agreement, nominate persons for appointment to the Board. The Regulations constrain the Board by requiring consistency with the co‑management agreement (regs 19(4), 49(3)).

Antakirinja Matuntjara Yankunytjatjara people and AMYAC

• The Regulations explicitly recognise native title and traditional ownership (Preamble cl 2). Antakirinja Matuntjara Yankunytjatjara people are exempt from the entry fee requirement (reg 18(2)). The AMYAC entity is defined (reg 3) and is a named stakeholder in the co‑management arrangements in the Preamble (Preamble cl 4).

Visitors and the public

• General visitors, campers, drivers, aircraft operators, recreational users, researchers and commercial operators are all regulated. Visitors must pay fees where set (reg 18(1)), display receipts/permits in vehicles (reg 22), comply with opening hours and closures (reg 19(1)-(5)), and obtain written permissions for multiple activities (regs 21, 23-26, 28-31, 34, 35, 38-40, 45-46).
• Tour clients have a narrow exception to the vehicle display requirement where the vehicle is owned or controlled by the tour operator (reg 22(4)).

Commercial operators and service providers

• Commercial activities such as filming for commercial purposes, conducting tours for fee or reward, selling or hiring goods, providing services for reward, and other profit‑making activities require a lease, licence or agreement (reg 45). Failure to secure these carries a higher maximum penalty (reg 45).
• Tour operators are treated distinctly in reg 22(4) regarding vehicle permit display.

Wardens, Department employees and authorised officers

• Wardens and certain employees are not subject to these Regulations for actions in performance of their functions (reg 17). Wardens retain enforcement powers , they can remove vehicles (reg 21(5)), capture/destroy animals (reg 37), and seize/impound property (reg 43).

Owners of animals, vehicles and property

• Owners whose animals stray into the Park without permission face obligations: wardens may capture, dispose of or destroy animals, but must serve a notice to a claimed owner requiring removal within seven days before disposal (reg 37(1)-(3)). Costs of capture/disposal are debts due to the Board (reg 37(4)-(5)).
• Owners of vehicles or other property abandoned or left unattended for more than 24 hours are exposed to seizure, impoundment, payment of costs before release, and potential sale if costs are not paid within one month (reg 43(1)-(5)).

Researchers, scientists and educators

• Scientific research requires Board permission (reg 40). Prior permits under the former National Parks and Wildlife (National Parks) Regulations 2001 continue in force (Schedule 1), but any ongoing or new research needs to comply with reg 40.

Aboriginal persons engaging in traditional activities

• The Regulations preserve statutory exceptions for Aboriginal persons taking animals under s 68D of the Act: the prohibitions on firearms (reg 29(1)(a)) and devices for taking animals (reg 34(1)) do not apply to such Aboriginal persons (regs 29(2), 34(2)). The Regulations reference that statutory exception rather than define it.

Regulatory intermediaries

• Lease, licence and agreement holders under this or other Acts are given express pathways to undertake certain activities that would otherwise be prohibited (regs 26(2)(a), 35(2), 36). This means businesses or entities holding a formal instrument under the Act or another statute have defined rights subject to their instrument’s terms.

In short, the Regulations create differentiated legal positions: the Board as regulator and permitter; Indigenous beneficiaries with specific exemptions and a co‑management role; visitors bound by conduct and permit requirements; commercial operators subject to licensing rules; wardens with enforcement roles; and licensees under other Acts who retain rights per their instruments. Each group faces different compliance obligations and exposure to penalties for non‑compliance.

The Regulations allocate duties, permissions and discrete rights across actors, largely through mandatory prohibitions subject to Board permission, express exemptions, and procedural formality for permissions.

Duties to obtain permission and to display permissions

• A pervasive duty is to obtain the Board’s permission in writing before undertaking listed activities. Examples include driving off designated roads (reg 21(1)), using aircraft or parachuting/dropping objects from aircraft (reg 23), camping (reg 24), using chainsaws (reg 26(1)), operating generators (reg 27(1)), deploying metal/mineral detectors (reg 28), possessing firearms/explosives (reg 29(1)), swimming or diving in Park waters (reg 30), engaging in specified recreational activities (reg 31), conducting scientific research (reg 40), and many others.
• Permissions must be in writing and may be included in leases, licences or agreements, or (if not published in the Gazette) be a permit (reg 49(1)). Permissions can be conditional and may be varied or revoked at any time (reg 49(1)). Conditions may include prohibiting possession or consumption of alcohol (reg 49(2)). Permissions may be applied to individuals or generally via Gazette publication (reg 49(4)).

Entry and fee duties

• Persons must not enter or remain on the Park unless they have paid the appropriate fee set by the Board, unless they are Antakirinja Matuntjara Yankunytjatjara people (reg 18(1)-(2)). The Board sets fees; the Regulations do not fix amounts.

Duties of care, compliance and obedience

• Persons must drive with due care, not recklessly and comply with traffic signs and speed limits set by the Board (reg 21(3), (2), (7)). Vehicles must be registered and insured to be driven in the Park (reg 21(6)).
• Visitors must display receipts or permits in the vehicle in a prescribed manner (reg 22(1)-(3)), unless the vehicle is owned or controlled by a tour operator when the visitor is a client (reg 22(4)).
• Persons must comply with signs and notices displayed by the Board in the Park (reg 47), and must obey reasonable directions from wardens (reg 48).

Obligations related to environmental protection and resource non‑removal

• Persons must not remove soil, rock, minerals, wood, mulch, fossils or archaeological remains (reg 39(a)), dig or disturb soil (reg 39(b)), or intentionally disturb dead vegetation, fossils or archaeological remains (reg 39(c)), without Board permission.
• Littering, depositing noxious substances, or polluting waters is prohibited (regs 41, 42). Taking exotic plants or bringing plants into the Park is constrained (reg 38).

Rights linked to leases, licences and agreements

• Persons entitled to use the Park under a lease, licence or agreement may bring animals into the Park subject to their instrument’s terms (reg 35(2)). A suite of activities (commercial filming, tours, competitions, selling/hiring goods, fund raising, keeping bees, scientific experiments, profit‑making activities) are permitted only under a lease, licence or agreement under this or another Act (reg 45).

Warden and Board powers and duties

• Wardens or authorised persons may remove vehicles obstructing access and recover removal costs as a debt (reg 21(5)). They may capture, sell, dispose of or destroy unprotected animals not under control or lacking permission (reg 37(1)(c)-(d)), subject to procedural requirements to notify owners (reg 37(2)-(3)) and recover costs as a debt (reg 37(4)-(5)). Wardens may seize and impound abandoned property (reg 43(2)) and impose costs on owners for release (reg 43(3)), and the Board may sell property after specified time limits (reg 43(4)-(5)).

Defences and exemptions

• It is a defence to an offence under the Regulations if the defendant proves they acted in response to an emergency and the court finds the action was reasonable in the circumstances (reg 51(2)).
• Wardens and Department employees are not subject to the Regulations when performing official duties (reg 17).
• Aboriginal persons acting under s 68D of the Act are exempt from certain prohibitions concerning firearms and devices used for taking animals (regs 29(2), 34(2)).

Procedural constraints tied to co‑management

• The Board cannot close the Park or act in a way inconsistent with the co‑management agreement (reg 19(4), reg 49(3)). This creates an internal statutory constraint on exercise of discretion and ties the Board’s duties to the co‑management framework.

Other rights and obligations

• The Regulations preserve prior licences, permits and written permissions in force immediately before commencement (Schedule 1), giving continuance rights for incumbents.
• Certain contraventions are prescribed offences for the purposes of s 73A of the Act (reg 50), meaning breaches of those particular provisions may have consequences under the parent Act as well as under the Regulations.

These duties and rights create a layered compliance environment: routine visitor obligations (fees, display, obey signs), conditional commercial and recreational permissions (requiring leases/licences or written permissions), and targeted enforcement powers for wardens and the Board with procedural protections (notice periods, ability to sell after time lapses, defence for emergencies).

The Regulations establish a mix of criminal penalties, expiation mechanisms and administrative enforcement powers directed at ensuring compliance. They also create financial liabilities recoverable as debts for specific enforcement actions.

Penalty structure and expiation fees

• A general offence provision makes contraventions of the Regulations punishable: maximum penalty $1,000, with expiation fees varying by contravention (reg 51(1)). The expiation fee matrix distinguishes more serious contraventions: reg 51(1)(a) lists alleged contraventions (e.g. reg 18, 21, 25, 29(1)(a), 44(a) or (b), or 48) attracting a $150 expiation fee; all other contraventions attract $75 (reg 51(1)(b)). For specific regulations, separate maximum penalties and expiation fees are stated: e.g. generators (reg 27(1)) and metal/mineral detectors (reg 28) carry maximum penalties of $1,000 and expiation fees of $150. The activities listed in reg 45 require a lease/licence and carry a higher maximum penalty of $5,000 and an expiation fee of $315.
• These figures determine the immediate monetary exposure for contraventions and create an administrative route (expiation) to resolve alleged breaches without prosecution.

Designated "prescribed offences"

• Regulation 50 prescribes particular offences for the purposes of s 73A(1) of the National Parks and Wildlife Act 1972. The contraventions designated are: reg 18 (entry fee), reg 19(5) (entering during closure), specified elements of reg 21 (driving/towing, speed, care, obstruction, and registration/insurance), reg 22 (display of receipts/permits), and reg 24 (camping). Being "prescribed" under s 73A of the Act links these contraventions to the enforcement architecture of the parent Act; practitioners must consult the Act to see the consequential or methodical implications under s 73A.

Wardens’ and authorised persons’ enforcement powers

• Removal and recovery: Wardens may remove vehicles left in contravention of obstruction rules and the Board may recover costs as a debt from owners (reg 21(5)).
• Capture, disposal and destruction of animals: For unprotected animals in the Park not under control or permitted, a warden or authorised person may capture and dispose of the animal by sale or other means, or destroy it (reg 37(1)(c)-(d)). Where ownership is claimed, the warden must serve notice requiring removal within seven days before disposing or destroying the animal (reg 37(2)-(3)). Costs are a debt due by the owner and carcasses/animals will not be surrendered until costs are paid (reg 37(4)-(5)).
• Seizure and impoundment of abandoned property: Wardens can seize and impound vehicles or personal property left unattended for more than 24 hours (reg 43(2)). The Board may require payment of seizure, impounding and keeping costs before returning property (reg 43(3)). If costs are not paid after one month, the Board may sell or otherwise dispose of the property (reg 43(4)-(5)). If owner is unknown, sale may proceed after one month from seizure (reg 43(5)).

Administrative closure and conditions

• The Board can close the Park, or parts of it, for management reasons, cultural activities, fire risk, public safety or other reasons contemplated by the co‑management agreement, subject to publication in the Gazette and the constraint that closure must not be inconsistent with the co‑management agreement (reg 19(3)-(4)). Entry during closure is an offence unless Board permission is obtained (reg 19(5)).
• The Board may set aside areas for particular activities by Gazette notice and impose conditions; failing to comply with a condition is an offence (reg 20).

Procedural defences and exceptions

• An express statutory defence is available: it is a defence if the defendant proves they acted in response to an emergency and the court finds the action reasonable in the circumstances (reg 51(2)). This defence may operate in prosecutions for contraventions caught by reg 51 or other specific provisions where prosecution proceeds rather than expiation.
• Wardens and certain employees are exempt from the Regulations in relation to performing their functions (reg 17), which delineates enforcement from regulated conduct.

Financial recovery as debt

• The Board can recover costs of removal of obstructing vehicles (reg 21(5)) and costs of capturing/disposal of animals as debts (reg 37(4)). These are civil recovery mechanisms alongside the criminal/administrative penalty regime.

Operational enforcement notes

• Expiation provides an administrative option to settle alleged breaches; maximum penalties remain for unresolved or prosecuted matters. Practitioners should note that some contraventions carry the higher expiation fees and that reg 50’s prescribed offences connect to the parent Act’s enforcement apparatus.

In sum, the Regulations combine criminal penalties, expiation fees, administrative closures and written permissions with concrete enforcement tools (removal, impoundment, capture, sale, destruction and debt recovery). The Board and wardens are empowered to take direct action and to recover costs, and a statutory emergency defence is available for reasonable emergency conduct.

The Regulations are subordinate legislation made under the National Parks and Wildlife Act 1972 (the Act) and they expressly reference and interact with a number of other statutory instruments and arrangements.

Parent Act and s 73A linkage

• The Regulations exist under the Act (see reg 3 definition and the top matter) and they build out offence and permission regimes within that Act’s framework. Regulation 50 specifically prescribes certain Regulation contraventions as "prescribed offences" for the purposes of s 73A(1) of the Act. Practitioners must therefore refer to s 73A of the Act to understand criminal procedure, evidentiary consequences or broader enforcement measures that apply once an offence is prescribed.

Co‑management agreement and Co‑management Boards Regulations

• The Board is continued as the co‑management board for the Park under the National Parks and Wildlife (Co‑management Boards) Regulations 2016 (reg 3; Legislative history). The Regulations require the Board not to act inconsistently with the co‑management agreement (regs 19(4), 49(3)). The co‑management agreement governs nomination and appointment processes for Board membership (reg 3), and the Preamble records the Park’s intended co‑management by the Antakirinja Matuntjara Yankunytjatjara people, the District Council and the Minister (Preamble cl 4).

Other Acts referenced directly

• Fire and Emergency Services Act 2005: Reg 25(2) makes it an offence to light or maintain a fire in contravention of that Act. This creates a direct compliance cross‑link: fire activity in the Park must comply with the Fire and Emergency Services Act as well as these Regulations.
• Corporations (Aboriginal and Torres Strait Islander) Act 2006: Reg 3 uses this Commonwealth Act to define AMYAC (reg 3).
• Native title determination: The definition of Antakirinja Matuntjara Yankunytjatjara people is by reference to the Federal Court native title determination in Native Title Claim SAD 6007/98 on 11 May 2011 (reg 3). This embeds native title recognition within the regulatory framework.
• Other Acts and statutory instruments: The Regulations repeatedly provide for activities to be undertaken pursuant to a lease, licence or agreement "under this or any other Act" (regs 26(2)(a), 35(2), 45 and others). This creates legal space for instruments under other statutes to authorise activities that would otherwise be prohibited.

Interaction with prior subordinate legislation

• Schedule 1 preserves licences, permits or written permissions issued under the Act or the National Parks and Wildlife (National Parks) Regulations 2001 in relation to the Park that were in force immediately before commencement. This ensures continuity and prevents abrupt loss of rights held under earlier subordinate legislation.

Overlap with local government

• The Preamble records the District Council of Coober Pedy had been the care, control and management authority prior to the Park’s constitution and the area was dedicated as a reserve in 2001 (Preamble cl 1). Although the Regulations do not create a detailed legal interplay with local government instruments, the historical footprint and the co‑management arrangement with the District Council mean local government practices and approvals may be relevant in practice.

Practical consequences for combined compliance

• For an applicant or operator, compliance requires attention to: (a) Board permissions and conditions under these Regulations, (b) any relevant lease or licence under the Act or other Acts, (c) statutory obligations under other Acts explicitly referenced (e.g. Fire and Emergency Services Act 2005), and (d) the terms of the co‑management agreement which can constrain Board action (regs 19(4), 49(3)).
• The Board’s power to publish permissions in the Gazette (reg 49(4)) and to set hours/closures by Gazette notice (reg 19(1)-(3)) means that gazetted instruments may be an important source of enforceable obligations alongside these Regulations.

Taken together, the Regulations are embedded in a mesh of statutory instruments: the National Parks and Wildlife Act 1972 (including s 73A implications), the co‑management boards regulations and agreement, Commonwealth corporate and native title references, and other South Australian statutes such as the Fire and Emergency Services Act. Practitioners must read these Regulations in that statutory context to assess full compliance obligations and enforcement consequences.

The Regulations’ legislative history is recorded in the instrument and shows initial commencement in 2013 and subsequent variation in 2016 that implemented co‑management arrangements and renamed the Park.

Primary entries

• Principal regulations: National Parks and Wildlife (Breakaways Conservation Park) Regulations 2013, Gazette 1.8.2013 p3401, commenced 1 August 2013 (noted as r 2 in the Legislative history).
• Variation: 2016, No 231, Gazette 22.9.2016 p3870, with commencement stated as 22 January 2017 immediately after commencement of the National Parks and Wildlife (Co‑management Boards) Regulations 2016 (Legislative history r 2).

Recorded amendments and specific changes

• The Preamble was amended: clause 5 was inserted by regulation 231/2016 r 4, effective 22.1.2017. Clause 5 reflects that the Park’s name was altered to Kanku‑Breakaways Conservation Park (Preamble cl 5) and that co‑management arrangements were intended (Preamble cl 4).
• Part 1 amendments: regulation 1 was varied by 231/2016 r 5 (22.1.2017). Regulation 2 was omitted under the Legislation Revision and Publication Act 2002 (22.1.2017). The definition of "Board" and "Park" in regulation 3 were substituted by 231/2016 r 6(1) and r 6(2) respectively (22.1.2017).
• Part 2 (not included in the current text) was deleted by 231/2016 r 7 (22.1.2017). The Legislative history notes former title and that the instrument was formerly the National Parks and Wildlife (Breakaways Conservation Park) Regulations 2013; the change of name and references reflect this edit.

Practical effects of amendments

• The 2016 variations implemented co‑management by formally continuing the co‑management board and adjusting definitions and the regulatory structure to align with the National Parks and Wildlife (Co‑management Boards) Regulations 2016. The substitution of definitions for Board and Park (reg 3) indicates a legal shift to a co‑management model embedded at the regulatory level and the Preamble records native title recognition and community parties.
• Insertion of Preamble cl 5 to record the name change to Kanku‑Breakaways Conservation Park reflects a formal renaming (Preamble cl 5) and appears in the Gazette (note: Gazette 19.11.2015 p4979 is cited in the Preamble).

Continuity provisions

• Schedule 1 ensures licences, permits or written permissions issued under the Act or the former National Parks and Wildlife (National Parks) Regulations 2001 in relation to the Park remain in force according to their terms. This was retained in the instrument and is relevant for incumbents impacted by the 2013 and 2016 changes.

How to trace amendments

• The Legislative history section in the Regulations provides the instrument numbers (201/2013 and 231/2016), Gazette references and commencement dates, enabling practitioners to locate the amending texts in the South Australian Government Gazette and the consolidated legislation database.

In short, the Regulations were enacted in 2013 and varied in 2016, the latter variation aligning the instrument with co‑management arrangements and altering definitions and structure. The Legislative history identifies precise amending instruments and commencement dates that are necessary for instructing clients on rights or obligations created by particular versions of the Regulations.

The Regulations’ text and accompanying Legislative history include no reference to judicial decisions or litigation concerning their interpretation or application. The instrument names no cases and provides no annotated judicial history. Therefore, as a source document, these Regulations do not supply any precedential material.

Practical implications of the absence of litigation history within the instrument

• No settled statutory interpretation recorded in this instrument: Users and advisers will need to rely on the ordinary meaning of the text, the parent Act, the co‑management agreement, Gazette notices, and any administrative guidance from the Board or Department for operational interpretation.
• Enforcement practice will depend largely on Board policy, warden practice and prosecutorial discretion under the Act. Absence of recorded cases in the instrument suggests practitioners should review Board Gazette notices, administrative decisions and any public enforcement outcomes to understand how provisions are applied in practice.
• Where s 73A links (reg 50) to the Act, any litigation relating to s 73A in the Act would be relevant; because the Regulations do not themselves record litigation, counsel and practitioners will need to consult case law on the parent Act and any appellate decisions that interpret the Act’s enforcement framework.

Evidence base for contested matters

• Where a party seeks to challenge Board action, revocation of permission, seizure of property, sale of impounded goods, destruction of animals, or a penalty,an absence of prior judicial treatment in the Regulations means legal arguments will typically draw on: the Act (procedural powers, review avenues), administrative law principles, the co‑management agreement (as a contractual/administrative source of constraints), and any factual records such as Gazette notices or permits. The Regulations’ express procedural steps (e.g. notice periods in reg 37 and reg 43) will be focal points in any challenge.

Recommendations for litigation readiness

• Preserve documentary trail: grants of permission must be in writing (reg 49(1)), so administrative decisions are recorded. Applications, notices (Gazette and personal/postal service), and seizure/impoundment records are likely to be determinative facts in any dispute.
• Investigate the co‑management agreement: because the Board must not act inconsistently with it (regs 19(4), 49(3)), the agreement will be central in any judicial review or statutory consistency argument.
• Review s 73A procedures in the Act: because reg 50 prescribes certain offences for s 73A, any enforcement under those provisions may implicate the Act’s enforcement regime, making relevant any established case law on s 73A or on the Act more generally.

In sum, the Regulations themselves provide no litigation history. Practitioners should prepare to rely on the statutory text, the co‑management agreement and administrative records, and must check external case law on the parent Act or related administrative decisions for authoritative interpretive guidance.

The Regulations contain multiple operational details that can catch clients unprepared. Below are concrete pitfalls and their statutory bases.

Written permissions only and variation/revocation risk (reg 49)

• All permissions under these Regulations must be in writing and may be varied or revoked by the Board at any time (reg 49(1)). That creates legal risk for operators relying on verbal assurances or informal practices. A commercially significant permission can be withdrawn, and permission conditions may be imposed after grant. If a client needs operational certainty, a one‑time permit is not necessarily durable.

Co‑management agreement constraint (regs 19(4), 49(3))

• The Board is constrained by the co‑management agreement; it "must not" grant or refuse permissions in a manner inconsistent with the agreement. Conversely, the co‑management agreement may limit what the Board can do administratively, and the text leaves open how inconsistency will be determined. Parties should obtain and scrutinise the co‑management agreement before relying on Board practice.

Display of permits: technical prescribed location (reg 22)

• Receipts or permits must be displayed on the inside of the windscreen on the side opposite the driver's position, or, if impossible because of vehicle design, in a prominent position facing outwards so it can be easily read by someone standing beside the vehicle (reg 22(3)). Failure to comply is an offence (reg 22; reg 50 prescribes reg 22 as a s 73A offence). Tour clients in vehicles owned/controlled by the tour operator are excepted (reg 22(4)), but tour operators should ensure vehicle display compliance.

Divergent expiation fees across contraventions (reg 51)

• The expiation fee applicable to an alleged contravention varies depending on the provision alleged to be breached (reg 51(1)). Misidentifying the correct expiation fee or the appropriate offence could create administrative or evidentiary complications.

Continuity of prior permissions (Schedule 1) but written permission requirement

• Schedule 1 continues prior licences/permits in force immediately before commencement. However, any new permissions must meet the writing requirement in reg 49(1). Parties with pre‑existing authorisations should confirm their instruments remain valid and whether any reissuance is required under the current framework.

Board revocation and closure power by Gazette notice (regs 19(1)-(3), 20)

• The Board’s power to close the Park or set aside parts of it is exercised by Gazette notice (reg 19(1)-(3), reg 20). Clients who do not check Gazette notices risk being in breach (e.g. entering during a closure is an offence reg 19(5) and is prescribed under reg 50). Operational planning must include monitoring of Gazette publications.

Debt recovery for removal and animal disposal costs (regs 21(5), 37(4))

• Costs incurred by the Board in removing obstructing vehicles (reg 21(5)) and in capturing/disposal of animals (reg 37(4)) are recoverable as debts. The debt recovery regime is civil, but non‑payment prevents return of seized property or carcasses (reg 37(5), 43(3)). Owners must be vigilant about notices and cost demands to avoid loss.

Seizure and sale procedures and time limits (reg 43)

• Vehicles and property left unattended for more than 24 hours may be seized and impounded (reg 43(1)-(2)). If costs are unpaid after one month, the Board may sell the property (reg 43(4)-(5)). This timeline is short; owners must act promptly or risk disposal of property.

Aboriginal exceptions tied to another statute (regs 29(2), 34(2))

• The Regulations exempt Aboriginal persons acting under s 68D of the Act from certain prohibitions (regs 29(2), 34(2)). Because the Regulations do not define s 68D, parties must consult the Act to confirm whether a particular activity falls within that statutory exception. Misreading the exception could lead to inadvertently contravening firearms or device prohibitions.

Overlap with other Acts, especially fire laws (reg 25(2))

• Lighting fires in the Park must comply with the Fire and Emergency Services Act 2005 (reg 25(2)). Fire bans or restrictions imposed under that Act may be separately enforceable and carry their own sanctions.

Permitted activities by lease/licence require a formal instrument (reg 45)

• Activities listed in reg 45 (filming, tours for fee, selling goods, fund raising, keeping bees, scientific experiments for profit, etc.) are allowed only pursuant to a lease, licence or agreement under this or another Act. Verbal arrangements or informal commercial arrangements are insufficient; formal instruments are required.

Seizure of animals and claims process (reg 37)

• Where an animal is to be disposed of or destroyed, a warden must serve notice if they know or have reason to believe someone claims ownership; the owner has seven days to remove the animal (reg 37(2)). If the owner is unknown and whereabouts are unknown, notice may be published in a newspaper circulating throughout the State (reg 37(3)(b)). Practically, owners should monitor notices and register claims promptly.

Permission publication may create general classes (reg 49(4))

• Permissions published in the Gazette may apply generally or to a class of persons (reg 49(4)). A Gazette notice could, therefore, create broader entitlements or obligations affecting many users; failing to review Gazette notices could miss general permissions or conditions.

Emergency defence limited and burden on defendant (reg 51(2))

• The emergency defence requires the defendant to prove they acted in response to an emergency and for the court to find the action reasonable. The evidentiary burden rests on the defendant and "reasonable" is fact‑dependent; this can be a difficult threshold in practice.

In sum, the Regulations contain numerous procedural and technical requirements that can easily be overlooked. Practitioners should flag the writing/formality requirements, the Board’s wide discretionary variation/revocation powers, the short timelines for impoundment and sale, debt recovery mechanisms, and the necessity of checking Gazette notices and the co‑management agreement.

Compliance under these Regulations requires early administrative steps, active monitoring, documentary habit, and engagement with the Board and co‑management structures. Below are practical, legally grounded steps a client should take.

1. Identify legal status and roles

• Determine whether you or your client are an Antakirinja Matuntjara Yankunytjatjara person (as defined by reg 3) or another stakeholder; Antakirinja Matuntjara Yankunytjatjara people are exempt from the entry fee (reg 18(2)), which materially affects cost compliance. If representing AMYAC or a nominating body, confirm roles in the co‑management agreement (reg 3; Preamble cl 4).

2. Check existing instruments and transitional rights

• Review any existing licences, permits or written permissions that were in force immediately before these Regulations commenced; Schedule 1 preserves those instruments in force "in accordance with its terms". Confirm whether the instrument requires reissue, amendment, or registration under the Board’s current practice.

3. Obtain written permissions where required

• For activities listed as requiring permission or a lease/licence (regs 21, 23-26, 28-31, 34-40, 45-46), apply to the Board and secure written permission or an appropriate lease/licence/agreement. Written permissions are compulsory (reg 49(1)). Where possible, seek conditions in the permission that provide clarity on variation/revocation processes and seek to limit discretionary revocation, noting the Board's statutory right to vary/revoke (reg 49(1)).

4. Monitor Gazette notices and Board publications

• The Board publishes opening hours, closures, and area designations in the Gazette (regs 19(1), 20). Permissions can also be published in the Gazette to apply generally (reg 49(4)). Set up a system to monitor the Gazette and Board notices to capture closures (reg 19), designated areas (reg 20), and general permissions or prohibitions.

5. Fee payment and receipt display

• Pay any entry fee set by the Board before entry (reg 18(1)) unless exempt (reg 18(2)). Ensure receipts or permits are displayed in the vehicle in the prescribed manner: on the inside of the windscreen opposite the driver, or, if impossible, in a prominent outward‑facing position (reg 22(1)-(3)). Tour operators should ensure vehicles they own or control display permits when carrying clients to avoid confusion under reg 22(4).

6. Vehicle compliance and driver conduct

• Ensure motor vehicles are registered and insured before driving in the Park (reg 21(6)). Drivers must comply with Board‑fixed speed limits and traffic signs, and must not drive recklessly (reg 21(2)-(3), (7)). Avoid leaving vehicles in positions that obstruct others; removal and cost recovery by the Board are authorised (reg 21(4)-(5)).

7. Avoid prohibited conduct or secure suitable authorisation

• For activities such as camping (reg 24), use of chainsaws (reg 26), generators (reg 27), metal detectors (reg 28), firearms (reg 29), swimming/diving (reg 30), recreational activities (reg 31), and scientific research (reg 40), either avoid the activity or secure express written permission. Note statutory exceptions for Aboriginal persons under s 68D of the Act for taking animals (regs 29(2), 34(2)) and verify eligibility under the Act before relying on the exception.

8. Comply with environmental and resource‑protection rules

• Do not remove soil, rock, fossils, wood, mulch, or archaeological remains without permission (reg 39). Observe littering and pollution prohibitions (regs 41-42). If bringing plants into the Park, ensure plants are dead and intended for human consumption, as required by reg 38(2).

9. Plan for animal or property contingencies

• If you bring animals into the Park under a lease/license, ensure terms permit entry and include any required controls (reg 35(2)). If an animal strays into the Park without permission, the warden may impound, sell or destroy it after notice (reg 37). Owners should monitor for notices and remove animals within seven days if notified (reg 37(2)). Avoid abandoning vehicles or property for more than 24 hours (reg 43(1)); prompt collection avoids seizure and potential sale after one month (reg 43).

10. Prepare for enforcement and disputes

• Keep documentary records: permissions in writing, fee receipts, Board correspondence, and any notices issued by wardens. If served with a notice to pay costs (reg 37(4), 43(3)) or informed of seizure/impounding, act within the statutory timelines to avoid sale. Where enforcement is contemplated or executed, consider whether the emergency defence (reg 51(2)) may apply and assemble contemporaneous evidence showing necessity and reasonableness.

11. Commercial and research operations: secure formal instruments

• For commercial activities listed in reg 45, obtain a formal lease, licence or agreement under this or another Act before commencing. For scientific research, obtain written permission (reg 40) and ensure research activities comply with any conditions.

12. Engage the co‑management framework

• Where the co‑management agreement or the Board’s composition is relevant, engage with the co‑management process early. The Board is bound by the co‑management agreement and cannot act inconsistently with it (regs 19(4), 49(3)), so negotiating rights or conditions through that agreement or via nominating bodies may be strategic.

13. Legal review and risk assessment

• For complex or high‑value operations, commission a legal review of the Board’s powers, the co‑management agreement, relevant leases/licences, and the intersection with other statutory regimes (notably the Fire and Emergency Services Act 2005 and the provisions of the National Parks and Wildlife Act 1972). Confirm applicable expiation fees and the risks of prosecution versus expiation.

Following these steps will materially reduce the risk of contravening the Regulations. The central compliance themes are: secure written permissions, document everything, monitor Gazette notices, and seek formal instruments for commercial activity. Where doubt remains about the Board’s likely exercise of discretion, consider seeking enforceable terms under a lease, licence or co‑management agreement to provide greater predictability.
