National Parks and Wildlife (Hunting) Regulations 2011

The regulations operate through a compact set of core concepts and delegated powers.

Definitions and basic labels

• The instrument defines a small set of terms. Regulation 3 identifies the Act as the National Parks and Wildlife Act 1972, personal watercraft as a jet ski or similar motorised vessel designed to be operated by a person standing, sitting astride or kneeling on the vessel but not seated within it, and it explains that protected ducks and protected game are ducks or protected animals of species to which an open season applies. These definitions are the primary textual anchors internal to the regulations (regulation 3).
• The regulations repeatedly use the phrase protected animal and related terms such as protected game. The regulations do not set out a definition for protected animal within the text supplied, rather they treat the label as a legal category relevant to open seasons. Readers must therefore treat that label as deriving from, or to be understood in the context of, the Act and any notices under it; the regulations themselves define the shorthand terms protected ducks and protected game only in relation to an open season (regulation 3).

Instrument of control: prohibitions, conditions and permissions

• The regulatory approach is prohibition-plus-exemption. Several activities are prohibited unless the instrument expressly allows them or the Minister gives written permission: using protected animals as decoys (regulation 4), taking certain parrots other than by firearm without a permit (regulation 5), damaging trees or nests for hunting (regulation 6(1)) unless the Minister gives written permission (regulation 6(2)), and a range of specified practices during an open season (regulation 8(1)).
• Ministerial discretions operate as the primary mechanism for exceptions and implementation. The Minister may issue permits allowing alternative methods for taking particular species (regulation 5), may require and approve a waterfowl identification test (regulation 7), may give written permission to damage trees or nests (regulation 6(2)), may approve non-toxic shot materials (regulation 8(1)(g)) and determines the form and lodging requirements for hunting surveys (regulation 9(2)). The Director is named as the recipient of change-of-address notifications (regulation 10).

Open season overlay

• Several provisions apply specifically to an open season declared under section 52 of the Act. Regulation 8(1) explicitly states that the listed restrictions are additional to restrictions set out in the open-season notice. That creates an overlay: the statutory open-season notice sets the baseline legal permissions and restrictions for a species and place, and regulation 8 supplies a uniform set of additional restrictions that apply across open seasons.

Offence architecture and sanctions

• The regulations standardise sanctioning for offences created within the instrument: each enumerated offence carries a maximum penalty of $1,250 and an expiation fee of $160. Those figures recur at regulations 4, 5, 6, 8, 9 and 10. The instrument thus communicates a capped financial penalty regime for the contraventions it defines.

Operational detail: weapons, shot and conduct

• Regulation 8(1)(d)-(e) sets specific technical limits on firearms: protected game must be shot with a smooth-bore firearm no larger than 19 mm (12 gauge), capable of being raised and held at arm's length and fired from the shoulder without other support, and shot must not exceed a diameter of 4.1 mm. Regulation 8(1)(g) stipulates that protected ducks may be shot only with steel, bismuth, molybdenum or other non-toxic shot approved by the Minister. Those are concrete, mechanically enforceable limits on tools used in hunting.

Reporting and record obligations

• Regulation 9 places conditional reporting obligations on permit-holders to complete and lodge hunting surveys, with the survey form determined by the Minister (regulation 9(2)). Regulation 10 imposes an ongoing notification duty to inform the Director of address changes within 14 days. These provisions create ongoing compliance tasks for permit-holders.

Taken together the concepts show a regulatory design that mixes bright-line technical constraints on tools and conduct with discretionary administrative requirements and permissions exercised by the Minister and with standard monetary sanctions for contraventions.

The regulations identify discrete groups of persons and activities subject to direct obligations or prohibitions. The legal impacts fall on individuals and entities engaged in hunting-related activity, permit applicants and holders, and those in physical control of hunting equipment or game within the regulated settings.

Primary affected persons

• Persons hunting protected animals or intending to hunt during an open season: the bulk of the behavioural rules in regulation 8 apply to anyone who hunts protected game during an open season, including prohibitions on vessel-based hunting while underway, the use of devices to rouse game, scattering grain to entice game, specifications about firearms and shot, and the prohibitions on retaining alive or selling game carcasses (regulation 8(1)-(2)).
• Permit applicants and holders: applicants for permits to hunt protected ducks may be required to sit and pass an identification test approved by the Minister (regulation 7). Holders of open-season hunting permits may be required to complete and lodge hunting surveys as specified by the Minister (regulation 9), and all permit-holders or those holding any permit issued under the regulations must notify the Director of address changes within 14 days (regulation 10).
• Persons handling or intending to use particular species: regulation 5 focuses on those who might take Galahs or Little Corellas, prohibiting means other than shooting unless a Ministerial permit allows otherwise. Regulation 4 explicitly targets those who would use a protected animal as a decoy or to assist hunting.

Secondary affected parties and market impact

• Owners and operators of vessels, including personal watercraft: personal watercraft are defined (regulation 3) and regulation 8(1)(a) forbids hunting from personal watercraft or any other vessel while it is underway, affecting hunters who might otherwise hunt from boats or jet skis. That prohibition interacts with owners/operators who provide access or hire vessels for hunting or recreation.
• Firearms dealers, ammunition suppliers and manufacturers: the technical constraints on firearms and shot (regulation 8(1)(d)-(g)) affect what weapons and ammunition may be lawfully used for hunting protected game and protected ducks. The requirement that protected ducks be shot only with specified non-toxic shot materials approved by the Minister (regulation 8(1)(g)) creates a demand constraint that may require suppliers to stock compliant materials where duck hunting is practised.
• Landowners and occupiers: regulation 6 prohibits damaging trees or nests for the purpose of hunting indigenous vertebrates; landowners who host hunting activity must ensure visitors do not destroy vegetation or nests, or must obtain Ministerial written permission where such damage is contemplated (regulation 6(2)).
• Persons who might acquire or sell game carcasses: regulation 8(1)(j) prohibits selling the carcass of any protected game taken during an open season, whether taken by the person or another. That forecloses commercial markets for such carcasses in the open-season context.

Who decides and who enforces

• Ministerial authority: the Minister is the primary decision-maker under the regulations, with power to issue permits, to require and approve waterfowl identification tests, to approve non-toxic shot, and to grant written permission to damage trees or nests (regulations 5, 6(2), 7, 8(1)(g), 9(2)).
• Director’s administrative role: the Director is the designated recipient for written address notifications from permit-holders (regulation 10).
• Enforcement actors: the text prescribes offences and expiation fees but does not in itself set out detailed enforcement powers, inspections or seizure powers; enforcement of the offences and collection of penalties will occur through the mechanisms applicable to offences under the Act and subordinate legislation.

Who pays

• Persons who contravene the specified offences are the ones who bear financial liability in the form of maximum penalties up to $1,250 or expiation fees of $160 (regulations 4, 5, 6, 8, 9, 10). Administrative costs associated with seeking permissions, tests, and compliance paperwork fall to permit applicants and permit-holders.

Overall, the regulations affect hunters, their equipment suppliers, landholders who host hunting, and those involved in the supply chain for game products, with discrete roles for the Minister and Director in administering permissions, tests and forms.

The regulations set out a small number of clear positive duties, negative prohibitions and delegated rights relating to hunting activity. Below is a structured summary of the principal legal obligations and actionable entitlements.

Negative obligations (things a person must not do)

• Use a protected animal for the purposes of hunting, whether as a decoy or otherwise (regulation 4). Contravention attracts a maximum penalty of $1,250 and an expiation fee of $160.
• Take Galahs or Little Corellas by any means other than shooting with a firearm, unless acting in accordance with a permit issued by the Minister (regulation 5). Same penalty structure.
• Cut down, lop branches from, otherwise destroy or damage any tree, or destroy, damage or disturb an indigenous vertebrate’s burrow or nest for the purposes of hunting (regulation 6(1)), unless acting with the Minister’s written permission (regulation 6(2)). Same penalty structure.
• During an open season declared under section 52 of the Act, hunters must not:
  • Hunt protected game from a personal watercraft or any other vessel while it is underway (regulation 8(1)(a));
  • Use engine driven vessels, personal watercraft, aircraft (including model planes), agricultural gas guns, bird scarers or other noisy devices to rouse protected game so it may be hunted (regulation 8(1)(b));
  • Scatter grain or other material or use any other means (other than a bird caller or decoy) to entice protected game into an area for hunting (regulation 8(1)(c));
  • Take protected game with a firearm that is not a smooth-bore no larger than 19 mm (12 gauge) and capable of being raised and fired from the shoulder at arm’s length without other support (regulation 8(1)(d));
  • Shoot protected game with shot whose diameter exceeds 4.1 mm (regulation 8(1)(e));
  • Be in possession of a firearm or shot prohibited by the above while in the course of hunting protected game, or while in a game reserve or any other area in which the person intends to hunt protected game (regulation 8(1)(f));
  • For protected ducks, shoot except with steel, bismuth, molybdenum or any other non-toxic shot approved by the Minister (regulation 8(1)(g));
  • Possess shot prohibited under regulation 8(1)(g) while hunting protected ducks or while in a game reserve or other area in which the person intends to hunt protected ducks (regulation 8(1)(h));
  • Retain alive any protected game taken during the open season except in accordance with the written permission of the Minister (regulation 8(1)(i)); or
  • Sell the carcass of any protected game taken during the open season (regulation 8(1)(j)).

Positive duties (things a person must do)

• Applicants for permits to hunt protected ducks must, if required by the Minister, sit for and pass a waterfowl identification test approved by the Minister (regulation 7).
• Holders of an open-season hunting permit must, if required by the Minister, complete a hunting survey in the form and manner specified and lodge it with the Minister within the period specified on the form (regulation 9(1)-(2)).
• Holders of hunting permits issued under these regulations must notify the Director in writing of any change of address within 14 days of the change (regulation 10).

Rights, discretions and administrative entitlements

• The Minister has the right to issue permits that authorise actions otherwise prohibited by the regulations, for example permits allowing taking Galahs or Little Corellas by means other than shooting (regulation 5), and to grant written permission to damage trees or nests for hunting purposes (regulation 6(2)).
• The Minister may require and approve the content of a waterfowl identification test that prospective duck hunters must pass as a condition of a permit (regulation 7).
• The Minister determines the form of any hunting survey required of permit-holders (regulation 9(2)).
• The Minister may approve other non-toxic shot materials beyond steel, bismuth and molybdenum for use on protected ducks (regulation 8(1)(g)).
• Permit-holders have the administrative right to apply for permissions, to sit tests if required, and to comply with survey requirements in the forms provided.

Scope and limits of duties and rights

• Several duties attach conditionally: the waterfowl test obligation applies only if the Minister requires it (regulation 7); the hunting-survey obligation applies only if the Minister requires it (regulation 9(1)); and exemptions to property or nest-damage prohibitions are available only through the Minister’s written permission (regulation 6(2)). That places considerable operational weight on Ministerial discretion to set compliance thresholds and information flows.
• The regulations standardise penalties for contraventions (maximum $1,250 and expiation $160) across the enumerated offences (regulations 4, 5, 6, 8, 9, 10). The instrument therefore communicates consistent financial consequences for failure to meet duties or for breaching prohibitions.

Practical compliance implication of rights and duties

• Obligations relating to firearms and ammunition are both prescriptive and immediate (for example dimensions and material of shot). Administrative duties are dynamic and depend on Ministerial directions (tests and surveys). Permissions are required in writing from the Minister for a small set of otherwise prohibited actions (regulation 5 and regulation 6(2)). The Director is the named recipient for one discrete administrative obligation, the change-of-address notice (regulation 10).

The regulations create a consistent monetary penalty framework for contraventions and identify the Minister and Director as administrative actors, while enforcement mechanics beyond the imposition of penalties are not detailed within the instrument.

Penalty structure

• The instrument prescribes a uniform maximum monetary penalty of $1,250 and an expiation fee of $160 for each enumerated offence within the regulations. That sanction applies explicitly to:
  • Using a protected animal for hunting (regulation 4);
  • Taking Galahs or Little Corellas by means other than shooting without a Ministerial permit (regulation 5);
  • Cutting down or damaging trees or destroying burrows or nests for hunting (regulation 6(1));
  • Contravening any of the further restrictions that apply during an open season (regulation 8(2));
  • Failing to complete and lodge a hunting survey if required by the Minister (regulation 9(1)); and
  • Failing to notify the Director in writing of a change of address within 14 days (regulation 10).

Expiation option and maximum penalty

• For each listed offence the instrument specifies an expiation fee ($160) in addition to the maximum penalty. The regulations themselves set the monetary figures but do not elaborate the procedural mechanics for payment of expiation fees, the circumstances in which the expiation option may be exercised, or the consequences of non-payment. Those procedural features are typically handled through the regulatory enforcement framework under the Act and general legislative practice, but the supplied text does not set out those enforcement processes.

Enforcement agents and administrative actors

• The Minister is the central administrative authority responsible for grant of permits, approvals of tests and shot materials, and the issuance of permissions that create exceptions to prohibitions (regulations 5, 6(2), 7, 8(1)(g), 9(2)). Those delegated powers make the Minister a hub for both permissions that avoid offences and for forms and tests that can be used as compliance tools.
• The Director is identified as the recipient of change-of-address notifications (regulation 10) and therefore participates in record-keeping and permit administration.
• The regulations do not themselves identify policing, inspection or seizure powers, nor do they specify which agency or officer will administer enforcement. Those operational enforcement mechanisms are governed by the Act and other statutes and protocols, but are not set out in this instrument.

Scope of offences and evidentiary implications

• Several offences are framed broadly in spatial and temporal terms. For example, it is an offence to be in possession of a firearm or shot prohibited under regulation 8 while “in the course of hunting protected game or while within a game reserve or within any other area in which he or she intends to hunt protected game” (regulation 8(1)(f)). The phrase “intends to hunt” and the spatial extent “any other area” introduce factual questions that would bear on evidentiary burdens in enforcement proceedings.
• Likewise, offences that criminalise possession as well as use mean that seizure-of-equipment cases may arise (for example, possessing prohibited shot while in a game reserve), but the instrument itself does not set out powers to seize or processes for testing shot or determining compliance on the spot.

Administrative compliance and penalties

• Permit-related administrative non-compliance also carries the same penalty level as substantive hunting offences. Failing to complete a Minister-required hunting survey (regulation 9(1)) or failing to notify the Director of an address change (regulation 10) are penalised at the same monetary rates. That equal treatment signals that procedural lapses are penalised alongside substantive hunting misconduct.

Limits and absence of other enforcement detail

• The regulations are precise about monetary sanctions but do not provide procedural detail on how expiation fees are to be processed, how inspections are to be conducted, or whether surcharges or civil remedies apply. For enforcement practice, one must look to the enforcement provisions in the Act and other administrative procedures outside the text supplied here.

The regulations operate as subordinate legislation under the National Parks and Wildlife Act 1972 and explicitly cross‑refer to provisions of that Act. The instrument also reflects interaction with other statutory instruments via Ministerial notices and approvals.

Subordination to the Act

• Regulation 3 defines the term Act as the National Parks and Wildlife Act 1972, signalling that the regulations are made under and are intended to operate within the statutory framework established by that Act. Multiple provisions in the regulations operate only in the context of open seasons declared under the Act, most notably regulation 8 which applies to open seasons declared by notice under section 52 of the Act (regulation 8(1)). This means that the permissions, prohibitions and offences created by the regulations are engaged in contexts established by the Act.

Dependence on Act-based notices and permits

• The instrument explicitly recognises the Act’s open-season notices as source of baseline rules. Regulation 8(1) states that the listed restrictions “apply to an open season declared by notice under section 52 of the Act (in addition to the restrictions set out in the notice)”, creating a layered regulatory interaction: the open-season notice under the Act provides species‑ and locale‑specific conditions, and the regulations add a uniform set of additional restrictions across open seasons.
• Permits referenced in the regulations (for example, permits to hunt during an open season and permits that can authorise taking particular species by non-standard means) are those associated with the Act and the regulatory regime established under it. The regulations therefore presuppose and depend on the Act’s permit-making architecture.

Ministerial and administrative cross-links

• The Minister’s power to approve tests, forms and shot materials, and to grant written permissions under the regulations, creates points where administrative instruments or determinations external to the regulations will govern day-to-day compliance. For example, the Minister may approve a waterfowl identification test (regulation 7), may determine the hunting-survey form (regulation 9(2)), and may approve particular non-toxic shot types (regulation 8(1)(g)). Those approvals, once issued, will operate alongside the regulations to define lawful behaviour.

Interaction with other regulatory statutes (as signalled within the legislative history)

• The legislative history records that certain provisions were omitted under the Legislation Revision and Publication Act 2002 (for example r 2 and Sch 2 were omitted under that Act as indicated in the legislative history). That indicates an administrative interaction between the regulations and the statutory regime governing revision and publication of legislation, and the legislative history section names that Act as affecting the form of the regulations. The regulations themselves do not otherwise identify interactions with criminal procedure law, firearms controls, environmental protection statutes or other regulatory regimes; those interactions will exist in practice and are governed by the provisions of those other Acts, but they are not set out in the text supplied.

Operational cross-checks required

• Because the regulations rely on terms and mechanisms established in the Act (open-season notices, the definition and legal effect of “protected animal,” permits and enforcement processes), practitioners must reconcile the regulations with the Act to understand full legal effect. The instrument also delegates to Ministerial approvals and notices the content of key compliance requirements, which means that up-to-date compliance requires reference to any Ministerial approvals, open-season notices and forms issued under the Act and these regulations.

In short, the regulations are a compact subordinate instrument that assumes and depends on the Act for its scope and on Ministerial or notice-based instruments to fill in practical details. The supplied text does not itself set out interactions with other Acts beyond the references noted.

The legislative history supplied with the regulations records their origin, subsequent variations and specific amendments or omissions affecting particular provisions. The entries in the legislative history are concrete administrative milestones and show iterative adjustments since commencement.

Commencement and principal instrument

• The National Parks and Wildlife (Hunting) Regulations 2011 were made as the principal regulations in 2011 (Regulation No 188) and the Gazette notice is recorded as Gazette 28.7.2011 p3169 with a commencement date for r 2 given as 1 September 2011 (legislative history entry: 2011 No 188; commencement 1.9.2011: r 2).

Subsequent variations and commencement dates

• The legislative history records a sequence of annual or near-annual variations with Gazette references and commencement dates:
  • 2012, No 70, Gazette 31.5.2012 p2313, commencement 1.7.2012 (r 2).
  • 2013, No 63, Gazette 6.6.2013 p2138, commencement 1.7.2013 (r 2).
  • 2014, No 169, Gazette 19.6.2014 p2738, commencement 1.7.2014 (r 2).
  • 2015, No 125, Gazette 18.6.2015 p2724, commencement 1.7.2015 (r 2).
  • 2016, No 89, Gazette 23.6.2016 p2230, commencement 1.7.2016 (r 2).
  • 2017, No 174, Gazette 22.6.2017 p2465, commencement 1.7.2017 (r 2).
  • 2018, No 124, Gazette 21.6.2018 p2337, with Schedule 2 (clauses 2 & 3) commencing 1.7.2018 (r 2).

Recorded provision variations, deletions and substitutions

• The legislative history contains a table of provisions varied and how they were varied. Notable recorded changes include:
  • Regulation 2 was omitted under the Legislation Revision and Publication Act 2002, with effect from 1 July 2012.
  • Regulation 11 was deleted by 124/2018 Schedule 2 clause 2, effective 1 July 2018.
  • Schedule 1 underwent multiple substitutions over successive instruments: clause 2 was substituted by 70/2012 r 4 (1.7.2012), substituted by 63/2013 r 4 (1.7.2013), substituted by 169/2014 r 4 (1.7.2014); Schedule 1 more generally was substituted by 125/2015 r 4 (1.7.2015), substituted by 89/2016 r 4 (1.7.2016), substituted by 174/2017 r 4 (1.7.2017), and later deleted by 124/2018 Sch 2 cl 3 (1.7.2018).
  • Schedule 2 was omitted under the Legislation Revision and Publication Act 2002 with effect 1 July 2012.

Historical consolidated versions

• The legislative history also lists historical consolidated versions or snapshots of the regulations as at specified dates: 1 July 2012, 1 July 2013, 1 July 2014, 1 July 2015, 1 July 2016 and 1 July 2017. Those entries indicate that the regulations were maintained and republished in consolidated form at those dates to reflect the cumulative effect of amendments up to those points.

Editorial notes in the legislative history

• The legislative history includes a note that references in the legislation to other legislation or instrument titles, or bodies or offices, are not automatically updated in the publication program and therefore some references may be obsolete. It also directs readers to the Index of South Australian Statutes or the legislation website for further information relating to the Act and subordinate legislation.

Implications from the recorded amendments

• The amendment entries show that Schedule 1 and various clauses were the focus of successive variations, and that by 2018 some parts (such as r 11 and Schedule 1, Schedule 2) were either deleted or omitted under the Legislation Revision and Publication Act 2002. The regulation text provided to this analysis reflects these amendments as summarised in the legislative history.

Taken together the legislative history gives a clear administrative timeline of the instrument’s lifecycle from its 2011 commencement through to the 2018 entries, with changes to particular schedules and clauses recorded with dates and Gazette references.

The text of the regulations and the accompanying legislative history supplied here do not record or reference any judicial decisions, litigation, appellate rulings, or case law interpreting the regulations. No cases are cited within the instrument or its legislative history. The legislative history is focused on statutory amendments, replacements and omissions and does not include judicial outcomes.

Practical consequences for legal work

• Because the supplied material contains no litigation history, there are no judicially articulated principles, evidentiary rulings or appellate constructions in this text to rely on when advising clients. That means practitioners wishing to understand how the prohibitions, permissions, and technical specifications have been applied in practice must search court and tribunal records, and administrative decision repositories, outside the provided text.
• The absence of litigation references in this instrument does not mean that enforcement will not occur or that there are no relevant decisions under the Act or related statutes. It simply means that the regulations’ text and its legislative-history annex do not include recorded cases. For precedent and interpretative guidance, one must consult external legal databases and administrative records documenting prosecutions, regulatory decisions, or civil proceedings arising under the Act and these regulations.

Points of likely judicial contest (based on the regulation text)

• The instrument creates a number of factual-practice points that are the kinds of issues that could give rise to litigation, for example:
  • The meaning and temporal/ spatial scope of being “in the course of hunting” or being in “any other area in which he or she intends to hunt protected game” (regulation 8(1)(f) and (h)).
  • Evidentiary questions about possession offences where prohibited shot or prohibited firearms are found in a vehicle, on a vessel or in personal possession.
  • Challenges to administrative exercise of discretion by the Minister where permissions have been refused, or to the form and content of Ministerial approvals or tests required under regulations 7 and 9.
• None of those potential lines of litigation are recorded in the supplied text.

Advisory note for practitioners

• To establish whether there is an existing body of case law interpreting any of these regulations, practitioners must consult external case law databases, tribunal decisions, and prosecution files. The absence of any litigation history in the instrument itself is a neutral administrative fact recorded in the legislative-history appendix.

The regulations are compact but contain textual features and delegated discretions that create compliance traps and practical uncertainties. The list below flags issues that frequently arise in practitioner advice and operational compliance, grounded explicitly in the text.

1. Ministerial discretion creates conditional and moving compliance targets

• Several obligations apply only if the Minister requires them: the waterfowl identification test (regulation 7) and the hunting-survey requirement (regulation 9(1)). The Minister also approves the test and determines the survey form (regulation 7, regulation 9(2)). That means compliance duties can change over time and depend on active Ministerial directions or instruments. Practitioners must not assume permanent, unchanging administrative requirements; they must check current Ministerial directions.

2. Broad possession offences capture preparatory conduct and presence

• Regulation 8(1)(f) and (h) criminalise possession of prohibited firearms or shot while “in the course of hunting” or “within a game reserve or within any other area in which he or she intends to hunt protected game”. The combination of possession plus intent or location can lead to enforcement where the person is merely preparing to hunt or present in a zone where hunting is contemplated. The terms “intends to hunt” and “in the course of hunting” are factual and may be contested in enforcement proceedings.

3. Technical firearm and ammunition specifications

• The weapon and ammunition limits are precise: smooth-bore diameter not exceeding 19 mm (12 gauge) and shot diameter not exceeding 4.1 mm (regulation 8(1)(d)-(e)). Practitioners and clients must ensure the precise technical compliance of firearms and shot. The regulations also require non-toxic shot for ducks, limited to specified materials unless the Minister approves others (regulation 8(1)(g)). There is potential for confusion if imported or less-common shot materials are used without Ministerial approval.

4. “While it is underway” for vessels

• The prohibition on hunting from personal watercraft or any other vessel while it is underway (regulation 8(1)(a)) depends on the meaning of “underway”. The regulations do not define that term. There may be operational uncertainty about whether a vessel anchored but drifting, or a vessel under slight propulsion, is “underway”. Enforcement can raise factual disputes here.

5. Definition gaps in the instrument itself

• The regulations rely on terms such as protected animal and game reserve that are not defined in the text provided. Regulation 3 defines the Act and a few terms but not all the substantive categories used. Practitioners and compliance officers must cross-reference the Act for those definitions to determine legal categorisation of species and places.

6. Selling carcasses prohibited even if taken by someone else

• Regulation 8(1)(j) forbids selling the carcass of any protected game taken during an open season “whether by that person or some other person”. That clause can catch dealers or third-party sellers who obtain carcasses from other persons. Businesses should assume that trade in such carcasses is unlawful under the regulation without specific Ministerial permission or other legal authority.

7. Damage to vegetation and nests needs written permission

• Regulation 6 makes it an offence to cut down or damage trees, or to destroy or disturb burrows or nests for the purpose of hunting, unless the activities are carried out with the Minister’s written permission (regulation 6(2)). Landholders or managers who facilitate hunting activities must ensure written permission is in place if any damage is contemplated or else prohibit such conduct.

8. Administrative default sanctions equal to substantive offence penalties

• Administrative lapses, such as failing to lodge a Minister-required hunting survey (regulation 9(1)) or failing to notify the Director of a change of address within 14 days (regulation 10), carry the same maximum penalty and expiation fee as substantive hunting offences. That parity raises enforcement risk for paperwork failures.

9. Expiation fee is small relative to maximum penalty but available

• Each offence lists an expiation fee of $160 alongside a maximum penalty of $1,250 (for example regulations 4, 5, 6, 8, 9, 10). The regulations do not state the circumstances in which an expiation may be paid, nor the effect of paying it on other enforcement actions. Practitioners should verify administrative procedures for expiation under the Act and the agency’s practice.

10. The “retain alive” and “sell” prohibitions create custodial and commercial risks

• Regulation 8(1)(i) prevents retaining alive any protected game taken during the open season except with written Ministerial permission, and regulation 8(1)(j) forbids sale of carcasses. These rules interact with any attempted captive-keeping or commercialisation schemes and require advance Ministerial permissions for lawful retention or sale. Failure to secure written permission exposes persons to the standard penalties.

11. Permission and form requirements may change over time

• Because the Minister determines tests, approves shot types and sets survey forms (regulations 7, 8(1)(g), 9(2)), the operational paperwork and technical compliance obligations may be amended administratively. Practitioners should verify the currency of approvals, forms and notices before advising clients or engaging in activities.

12. Legislative-history deletions and omissions

• The legislative history records deletions and omissions (for example, r 2 omitted under the Legislation Revision and Publication Act 2002, the deletion of r 11 and substitutions to Schedule 1). Practitioners should be alert that historical versions differ and that earlier or later versions of the regulations may have had different compliance obligations. Always consult the current consolidated instrument alongside the history entries.

In practice, the most frequent compliance pitfalls will be failing to check current Ministerial approvals and open-season notices, carrying or using non‑compliant shot or firearms, damaging trees or nests without written permission, and overlooking administrative duties tied to permits.

Complying with the regulations requires attention to both substantive conduct rules and conditional administrative requirements. The following practical checklist is grounded in the text of the instrument and identifies concrete steps for hunters, permit applicants, landholders and administrators.

Before hunting: permissions, permits and tests

• Confirm whether the hunting activity occurs within an open season declared under section 52 of the Act. Regulation 8 applies specifically to open seasons declared under the Act and operates “in addition to the restrictions set out in the notice” (regulation 8(1)). Obtain and read the relevant open‑season notice under the Act to identify any species‑ and location‑specific conditions.
• If planning to take Galahs or Little Corellas by means other than shooting, apply for a permit from the Minister. Regulation 5 permits non‑shooting means only where a Ministerial permit authorises them.
• If applying for a permit to hunt protected ducks, check whether the Minister currently requires sitting and passing a waterfowl identification test. If so, be prepared to take and pass a Minister‑approved test as a permit condition (regulation 7).
• Confirm Ministerial approvals for non‑toxic shot materials for use on protected ducks. Regulation 8(1)(g) allows steel, bismuth and molybdenum and any other non‑toxic shot approved by the Minister. Use only approved shot types.

Equipment and ammunition compliance

• Use only a smooth‑bore firearm whose diameter does not exceed 19 mm (12 gauge) for taking protected game, and ensure that the firearm is capable of being raised and held at arm’s length and fired from the shoulder without other support (regulation 8(1)(d)). Confirm the firearm’s bore specifications with the manufacturer or a qualified firearms dealer.
• Ensure shot used for protected game does not exceed a diameter of 4.1 mm (regulation 8(1)(e)).
• Do not possess firearms or shot that are prohibited under regulation 8(1)(d) or (e) while in the course of hunting protected game, or while in a game reserve or any area in which you intend to hunt (regulation 8(1)(f)). That includes removal of prohibited ammunition from the hunting environment.

Conduct during open seasons and on land/water

• Do not hunt protected game from a personal watercraft or any other vessel while it is underway (regulation 8(1)(a)). Note that personal watercraft are defined in regulation 3.
• Do not use engine‑driven vessels, personal watercraft or noisy devices such as agricultural gas guns, bird scarers, aircraft (including model planes) to rouse protected game (regulation 8(1)(b)).
• Do not scatter grain or other material to entice protected game into an area for hunting (regulation 8(1)(c)). Only a bird caller or decoy is permitted for that narrow purpose under regulation 8(1)(c).
• Do not retain alive any protected game taken during the open season except with written Ministerial permission (regulation 8(1)(i)), and do not sell carcasses of protected game taken during the open season (regulation 8(1)(j)).
• Do not use a protected animal as a decoy or otherwise for hunting (regulation 4).

Vegetation, nests and land impacts

• Do not cut down, lop branches from, destroy or otherwise damage any tree, or destroy or disturb burrows or nests for the purposes of hunting indigenous vertebrate animals unless you hold the Minister’s written permission under regulation 6(2). If tree or nest disturbance is planned, obtain the written permission before acting.

Administrative obligations and records

• If the Minister requires it, complete and lodge a hunting survey in the form and manner specified by the Minister within the period stated on the form (regulation 9(1)-(2)). Keep copies of completed surveys and proof of lodgement.
• If you hold a hunting permit or any permit issued under these regulations and your address changes during the permit’s currency, notify the Director in writing of the new address within 14 days (regulation 10). Keep records of that written notice and any acknowledgement.
• Keep written copies of any Ministerial permissions or approvals on site while engaged in the activity to evidence lawful authorisation (for example written permission to damage trees, Ministerial permit allowing non-shooting means, Ministerial approval for alternative non-toxic shot).
• Maintain documentary evidence of the type and calibre of firearms and shot carried; consider retaining receipts or manufacturer documentation as proof of compliance with the technical specifications in regulation 8(1)(d)-(e).

Avoiding prosecution risk

• Treat the expiation fee levels specified in the regulations as the administrative penalty schedule but check enforcement practice in relation to payment and consequences before relying on the expiation option (each offence lists expiation fee $160). Understand that procedural breaches (failing to lodge a survey, failure to notify a change of address) carry the same maximum monetary penalty as substantive offences.
• Where operational facts are borderline (for example, whether a vessel is “underway”, whether a person is “in the course of hunting” or merely present in an area), adopt a conservative approach: avoid actions that could be construed as preparatory to hunting unless clearly authorised.

Monitoring and updates

• Because the Minister approves tests, shot types and determines forms, subscribe to or monitor Ministerial notices, the relevant departmental website and the open-season notices under the Act. Those approvals and notices will change the practical compliance landscape even where the regulations remain formally unchanged.

Engage early with authorities where necessary

• If planned activities require damage to vegetation or retention of live game, apply in advance for written permission from the Minister under regulation 6(2) or regulation 8(1)(i) as applicable. Keep the written permission available while acting under it.
• If uncertain about whether a proposed activity is prohibited, seek written clarification or a permit from the Minister before proceeding. The regulations create express permissions, and acting without them converts conduct into an offence.

Record-keeping checklist

• Copies of permits and Ministerial permissions and approvals;
• Proof of passing any required waterfowl identification test;
• Completed hunting surveys where required, with proof of timely lodgement;
• Records of changes of address sent to the Director and proof of postage or electronic lodgement;
• Receipts and technical specifications for firearms and ammunition to evidence compliance with bore and shot size requirements.

Following the steps above aligns day-to-day conduct with the prohibitions, technical equipment rules and administrative obligations set out in the regulations (regulations 4-10).
