91A Interim protection of areas having significant values
> > (1) The Secretary may recommend to the Minister the making of an interim protection order in respect of an area of land—
> >
> > > (a) which has, in the Secretary’s opinion, natural, scientific or cultural significance, or
> >
> > > (b) on which the Secretary intends to exercise any of the Secretary’s powers, authorities, duties or functions under this Act or the [Threatened Species Conservation Act 1995](/view/html/repealed/current/act-1995-101) relating to fauna, native plants, threatened species, populations or ecological communities or critical habitat of endangered species, populations or ecological communities, or
> >
> > > (c) that is critical habitat or the habitat of a threatened species, population or ecological community.

> > (2) After the commencement of Part 11 of the [Biodiversity Conservation Act 2016](/view/html/inforce/current/act-2016-063), a recommendation for the making of an interim protection order may not be made except in relation to areas of cultural significance.
