191 Authority to take proceedings
> > (1) Subject to subsection (1A), any legal proceedings for an offence against, or to recover any charge, fee or money due under, this Act or the regulations or the [Threatened Species Conservation Act 1995](/view/html/repealed/current/act-1995-101) or the regulations under that Act may only be taken by a police officer, the Secretary or by a person duly authorised by the Secretary in that behalf, either generally or in any particular case.

> > (1A) Proceedings for an offence under this Act may be instituted in the Land and Environment Court in its summary jurisdiction only by the following persons—
> >
> > > (a) the Secretary,
> >
> > > (b) an officer of the Service authorised by the Secretary for the purposes of this section.

> > (2) In any proceedings referred to in this section the production of an authority purporting to be signed by the Secretary shall be evidence of the authority without proof of the Secretary’s signature.
