#### 150 Minister to be corporation sole for certain purposes 150 Minister to be corporation sole for certain purposes > > (1) For the purposes of the exercise and performance of the Minister’s authorities, duties and functions under Part 4A and this Part and under any other provisions of this or any other Act that are identified (by those provisions) for the purposes of this section, the Minister is hereby constituted a corporation sole under the name of “Minister administering the [National Parks and Wildlife Act 1974](/view/html/inforce/current/act-1974-080)”. > > > (2) The corporation sole constituted by this section— > > > > > (a) has perpetual succession, > > > > > (b) shall have an official seal, > > > > > (c) may take proceedings and be proceeded against in the corporate name, > > > > > (d) may, in accordance with this Act (or with such provisions of any other Act as are identified as referred to in subsection (1)), purchase, exchange, hold, dispose of and otherwise deal with property, and > > > > > (e) may do and suffer all other things that a body corporate generally may, by law, do and suffer and that are necessary for or incidental to the purposes for which the corporation sole is constituted. > > > (3) The seal of the corporation sole so constituted shall not be affixed to any instrument or document except in the presence of the Minister, and the Minister shall attest by the Minister’s signature the fact and date of the affixing of the seal. > > > (4) All courts and persons acting judicially— > > > > > (a) shall take judicial notice of the seal of the corporation sole so constituted that has been affixed to any instrument or document, and > > > > > (b) shall until the contrary is proved presume that seal was properly affixed. > > **s 150:** Am 1983 No 183, Sch 3 (46); 1996 No 142, Sch 1 \[45\]; 1998 No 92, Sch 3 \[1\] \[2\].
