#### 3A Meaning of made available as a public weighbridge (1) A weighbridge is made available as a public weighbridge if: (a) it is open for use by or on behalf of the public; or (b) it is available for use for a charge. (2) A weighbridge is not made available as a public weighbridge if the weighbridge is used by a person who owns or who has contracted to operate the weighbridge: (a) for the purpose of determining the consideration in an agreement between the person and another person; or (b) for purposes that do not involve another person. (3) The regulations may prescribe other circumstances in which a weighbridge is taken not to be made available as a public weighbridge for the purposes of this Act.
