#### 18KA Requirements if purchaser present when measurement made (1) If: (a) a person sells an article for a price determined by reference to the measurement of the article; and (b) the article is not packed in advance ready for sale; and (c) the purchaser is present when the measurement is made; the person must either: (d) ensure that the measuring process, and any reading or information displayed by the measuring instrument, is readily visible to the purchaser; or (e) give the purchaser a written statement of the measurement at the time the article is given to the purchaser. (2) A person commits an offence if the person contravenes subsection (1). The physical elements of the offence are set out in that subsection. Penalty: 200 penalty units. (3) A person commits an offence of strict liability if the person contravenes subsection (1). Penalty: 40 penalty units. > Note: For strict liability, see section 6.1 of the Criminal Code.
