The instrument is short and conceptually narrow. Its principal legal concept is "determination of a network" , a statutory act by the Minister to identify, by reference to schedules, which pieces of land transport infrastructure form the National Land Transport Network (s 5). The determination operates by naming linear assets (roads and railways), sometimes describing routes in sequential segments ("from... to... then..."), and sometimes including intermodal terminals and port precincts ("to and within...").

Key textual mechanics and concepts to note from the instrument itself:

• Determination as listing: The instrument effects the designation by listing each road and railway in Schedules 1 and 2. The network is not defined generically; instead, specific corridors, motorways, interchanges, terminals and rail links are enumerated in jurisdictional and divisional order. The text in s 5(2)(a) and (b) makes clear that the network "consists of the following", so the list is intended to be exhaustive for the Network as determined by this instrument.

• Existing and proposed infrastructure: Both schedules repeatedly use the phrase "existing and proposed", and several items are explicitly labelled "the proposed [project name]" (for example, proposed M12 Motorway, proposed Sydney Gateway, the proposed East West Link, proposed Perth Freight Link, proposed Mackay Ring Road Stage 2, and the proposed inland rail connection from Melbourne to Brisbane). The instrument therefore treats certain projects that may not yet be constructed as forming part of the National Land Transport Network.

• Spatial inclusions: Many entries include not only through routes but also "to and within" specific facilities, expressly covering internal port tracks, intermodal terminal areas and loops (for example, "Flemington Station to and within Chullora intermodal terminal"; "Dynon intermodal terminal and the Port of Melbourne"; "Port Adelaide Inner Harbour and Outer Harbour (including the rail loop)"). This language indicates the instrument encompasses terminal areas and not purely linear through-routes.

• Jurisdictional sweep: The schedules are organised by jurisdiction (states and territories) and by cross-jurisdictional corridors (Part 9 in Schedule 1; Part 7 in Schedule 2). The instrument thus covers major national corridors linking capital cities, ports and national freight arteries.

• Repeal mechanism: Schedule 3 repeals the National Land Transport Network Determination 2014 in its entirety. The instrument therefore is constructed to be the current and singular list of network components, replacing the prior instrument.

• External statutory definitions: The instrument explicitly references the NLTA for definitions of "road" and "railway" (the note under s 5). That cross-reference is a signal that interpreting whether a given physical asset qualifies requires reading the NLTA definitions in s 4(1), not only the natural meaning of the words as used in the Determination.

Because the instrument is a schedule-based list rather than a standards or regulatory regime, its primary operational concept is the conferral of "listed" status. The legal and practical consequences of that status are not stated here and must be determined from the NLTA and other instruments/regulations that rely on a Ministerial determination of the National Land Transport Network.

The instrument identifies infrastructure assets rather than actors, but from the list of assets one can identify categories of affected parties that are directly implicated by the designation. The instrument itself does not prescribe duties or rights for these parties, but the named assets connect to them operationally and administratively.

• Commonwealth Minister and department: The instrument is made by the Minister (Michael McCormack) under s 5 of the NLTA (see s 3 Authority). The department responsible for administration of the NLTA will centrally record and maintain the official Determination and its schedules. The decision and its administration are for Commonwealth executive actors to document and communicate.

• State and territory road and rail authorities: The lists nominate specific motorways, highways, arterial roads, port access roads, interchanges, freeways, and rail lines that lie within state and territory jurisdictions (examples: M4 Western Motorway, Tullamarine Freeway, North-South Motorway, Bruce Highway, Stuart Highway, Great Northern Highway). The state and territory transport agencies that own, manage, maintain or plan these assets will be directly implicated, because the Determination identifies infrastructure for a national list and may be relevant to any Commonwealth-state interactions under the NLTA or other instruments.

• Port and intermodal terminal operators: Multiple items include links "to and within" ports and intermodal terminals (for example, Port Botany, Moorebank intermodal terminal, Dynon intermodal terminal, Port of Melbourne, Port Kembla, Port of Brisbane, Port of Townsville, East Arm Port at Darwin). Operators of those facilities should take note because the Determination explicitly incorporates terminal trackage and internal access as part of the network.

• Project proponents and contractors for proposed projects: Several entries are explicitly "proposed" projects (e.g., proposed M12 Motorway, Sydney Gateway, East West Link, Perth Freight Link, Mackay Ring Road Stage 2, proposed inland rail connection). Sponsors, bidders and contractors involved in planning, financing, constructing, or operating those projects will be affected by their designation as part of the National Land Transport Network, to the extent that other statutory or contractual instruments tie network status to funding, approvals or regulatory processes (which must be checked in the NLTA and related instruments).

• Local councils and local road authorities: Many entries reference urban roads, connectors and terminal access routes (e.g., Evans Street, Macquarie Street, General Holmes Drive, Berrimah Road). Local government authorities responsible for those segments will be connected operationally to the network list.

• Freight, logistics and supply-chain businesses: By naming intermodal terminals and port access, the Determination identifies corridors of national freight significance. Freight operators, stevedores, rail operators, trucking firms and logistics planners will need to note which routes are formally included, particularly where network designation triggers eligibility for particular programs or administrative processes under other laws (see the comment in the last paragraph of the "What it does" section; the instrument does not itself create such programmes).

• Users indirectly affected by planning and prioritisation: Although the instrument does not itself change tolling, pricing or user charges, the listing of certain routes and the removal of the 2014 Determination may influence future planning priorities, construction timetables and public funding decisions made under the NLTA (those consequences, however, must be ascertained in the NLTA and implementing programs). Parties that participate in planning, environmental approvals, or public consultations for listed routes are therefore also interested stakeholders.

• Legal and compliance teams: Because the Determination replaces the 2014 instrument in whole (Schedule 3), corporate, state and local compliance teams must check whether any projects previously included in the 2014 Determination have been omitted or altered in the 2020 list and consider any downstream contractual or statutory consequences.

The instrument itself does not impose obligations on any of these parties, nor does it specify any enforcement or penalty regime. Consequently, affected parties should read this Determination together with the National Land Transport Act 2014 and any implementing instruments or funding agreements that rely on the Ministerial determination to identify the practical legal consequences of a corridor's inclusion or omission.

The Determination is a naming instrument; it does not, on its face, confer express rights or create express duties in its own text. The instrument's operative provisions are limited: it determines the National Land Transport Network by listing roads and railways in Schedules 1 and 2 (s 5), it commences on 1 July 2020 (s 2), and it is made under the authority of s 5 of the NLTA (s 3). The instrument does not articulate obligations, funding entitlements, approval processes, enforcement mechanisms, or other rights and duties.

However, two mechanical legal features within the instrument are relevant for practitioners assessing duties and rights against the broader statutory landscape:

1. Determination as a statutory act under the NLTA (s 3 Authority; s 5 determination): The instrument is made under the NLTA. Any operative duties or rights that attach to being "part of the National Land Transport Network" must be found in the NLTA or subordinate instruments under the NLTA. The Determination is the statutory vehicle that identifies what assets fall within the scope of the NLTA's network provisions. You should therefore consult the NLTA for provisions that reference a Ministerial determination of the network to identify specific duties (for example, duties relating to funding, project approvals, or regulatory requirements) and rights (for example, eligibility for Commonwealth financial assistance). The Determination itself does not contain those clauses.

2. Inclusion of "proposed" projects and internal facilities: Because the instrument explicitly includes both "existing and proposed" roads and railways, and language such as "to and within" certain terminals, one mechanical consequence is that the Determination purports to identify, in advance, specific projects and internal terminal infrastructure as part of the network estate. If the NLTA or other instruments provide for particular rights or duties contingent on being within the National Land Transport Network, those rights/duties would mechanically become applicable to listed proposed projects and to internal terminal trackage once they are defined by reference to the Determination. The Determination therefore functions as a definitional trigger for any statutory or contractual regime that establishes rights and obligations by reference to the network list.

Because the instrument does not contain its own enforcement provisions, the "Key duties and rights" arising from this Determination are necessarily derivative: they exist if and to the extent that other statutory provisions or contractual instruments tie their operation to inclusion in the Ministerially determined Network. The instrument is the primary, up-to-date record of what is included in the network; exercising or enforcing rights or duties will require reference to the NLTA and to any implementing regulations, funding agreements or instruments that regulate conduct, payments or approvals for listed roads and railways.

Practically, relevant duties and rights to investigate in the NLTA and related material include matters such as: which parties are eligible to receive Commonwealth grants for works on listed corridors; whether the Commonwealth acquires certain administrative functions over parts of listed corridors; whether listed corridors attract particular design, safety or operational standards by statute; and whether listing changes the legal ownership or maintenance responsibilities. None of those consequences are spelled out in the Determination; the Determination's role is the definitional one , it identifies the assets that any such external provisions will refer to.

The Determination itself contains no penalties, fines, enforcement powers, or criminal or civil sanctions. Its text is confined to identification and repeal matters: name and commencement (items 1-2), authority (item 3), the statement that the instrument amends or repeals instruments listed in Schedule 3 (item 4), the determination of the network (item 5), the detailed Schedules of roads and railways, and the repeal of the 2014 Determination in Schedule 3.

Because the instrument does not authorise enforcement measures, any enforcement or penalty regime related to the National Land Transport Network must be searched for in the National Land Transport Act 2014 and in other statutes or subordinate instruments that reference a Ministerial determination of the network. The Determination functions as the authoritative list to which those other statutory enforcement provisions would refer, but it does not itself create or apply sanctions.

For practitioners who must advise on compliance risks or exposure to enforcement, the immediate implications to check are:

• Whether any regulatory duties in the NLTA or other laws are triggered by designation, and whether those laws impose penalties for non-compliance. The Determination is the instrument that defines the spatial perimeter for such rules.

• Whether any contractual arrangements (for example, Commonwealth-state funding agreements, maintenance contracts, or lease arrangements with port authorities) reference the National Land Transport Network Determination for eligibility or obligations. Enforcement in such cases would be contractual, not statutory under this Determination.

• Whether any offences in other statutes (for example, rail safety legislation, transport safety or heavy vehicle compliance regimes) apply differently or are administered differently when a corridor is part of a national network. The Determination itself is neutral on that point; practitioners must map the Determination's listed corridors against the statutory definitions that trigger enforcement.

In short, this instrument is not an enforcement instrument: it is a designation instrument. The presence or absence of penalties depends on the wider statutory regime, not on this Determination. The Determination's relevance for penalties is therefore second-order: it sets the boundaries of where statutory duties and offences will apply, if those duties and offences are defined by reference to the National Land Transport Network.

The Determination is expressly made under the National Land Transport Act 2014 (s 3 Authority), and the instrument itself cross-references the NLTA for definitions (note under s 5). Therefore, the primary interaction to analyse is between this Determination and the NLTA. The Determination is a schedule-based executive instrument that performs the definitional task the NLTA requires: identifying the specific roads and railways that constitute the National Land Transport Network. Consequently, any statutory provision that operates "if" an asset is part of the National Land Transport Network will rely on this Determination to define the perimeter.

Important aspects to consider about interactions:

• Definitions and meaning: The instrument notes that "railway" and "road" are defined in subsection 4(1) of the NLTA. That cross-reference means that interpreting whether a listed feature qualifies under the labels used in Schedules 1 and 2 requires reading the NLTA definitions. The Determination does not redefine terms; it relies on the NLTA's statutory vocabulary.

• Downstream legislative triggers: The Determination will interact with any NLTA provisions and subordinate instruments that reference the existence of the National Land Transport Network or which condition rights, eligibility for funding, approval pathways, or administrative powers on inclusion in the network. For example, if the NLTA provides for Commonwealth financial assistance for works on the National Land Transport Network, then this Determination identifies the corridors eligible under that statutory filter. The Determination itself does not specify those financial arrangements; the NLTA and any subsequent funding rules or Commonwealth-state agreements will set the terms.

• Repeal and continuity: Schedule 3 repeals the 2014 Determination in full. That repeal has the legal effect of ending the operative life of the 2014 list. Any piece of legislation, regulation, contract or administrative practice that referenced the 2014 Determination as the authoritative list of network roads and railways will need to be read against the new list. Practically, cross-references in other instruments that mention "the National Land Transport Network Determination 2014" may now fail, or require dynamic interpretation if they simply rely on the Minister's determination as the relevant list. Practitioners should check whether any statutory or contractual instruments expressly identify the 2014 Determination by name or whether they instead reference "the Minister's determination" or a defined phrase, in which case the 2020 Determination now occupies that role.

• Overlap with state and local legal regimes: The Determination lists assets that are primarily within state or local ownership and control. Where state-based infrastructure planning, safety, environmental, land-use, or maintenance regimes apply, the Determination does not displace state law unless other Commonwealth provisions in the NLTA or other statutes grant the Commonwealth concurrent or exclusive powers. The Determination is a federal instrument listing assets; it does not itself alter property rights or day-to-day regulatory administration carried out by state agencies.

• Interaction with project approvals and procurement rules: For projects listed as "proposed" in the schedules, this Determination will be the formal record that the project corridor forms part of the National Land Transport Network. If particular approvals, procurement or funding processes in the NLTA or elsewhere make a project's classification contingent on being part of the national network, this Determination will be the reference point. The determination itself does not provide approvals or procurement authorisations.

• Administrative practice and guidance: Departments and agencies that administer the NLTA, Commonwealth funding or transport policy are likely to treat the Determination as authoritative. Administrative policies, grant guidelines and eligibility rules that reference "the National Land Transport Network as determined by the Minister" will need to align with the lists contained in Schedules 1 and 2. However, because this instrument does not itself articulate those policies, those administrative instruments must be consulted to see how the Determination is operationalised.

In sum, the Determination operates as a definitional tool that the NLTA and other laws will refer to. Its interaction with other laws is therefore mapping-focused: identify which external rules rely on the Minister's determination of the network, then apply this instrument's lists as the baseline for coverage. The Determination does not itself create or modify those downstream rules; it merely supplies the set of roads and railways to which they will apply.

The instrument is self-contained and short on explicit amendment history, but it contains two operative temporal facts relevant to amendment and continuity:

1. Commencement and date: The Determination is dated 25 June 2020, and it commences on 1 July 2020 (see heading and s 2 Commencement). That establishes the legal effectivity date for the listed designations.

2. Repeal of the 2014 Determination: Schedule 3 states that the whole of the National Land Transport Network Determination 2014 is repealed (Schedule 3,Repeals). The note at item 4 also states that each instrument specified in Schedule 3 is amended or repealed as set out in the applicable items in the Schedule concerned, and that any other item in a Schedule has effect according to its terms. Because Schedule 3 contains only the 2014 Determination and prescribes its repeal, the 2020 Determination is in practice replacing the 2014 list entirely. The text therefore effectually updates the Ministerial list as of commencement.

There is no other in-instrument amendment history provided (for example, the instrument does not list prior amendments to itself, nor does it cite earlier determinations beyond the 2014 instrument it repeals). The Determination does not contain a schedule of minor amendments during its life; to determine any subsequent amendments to the 2020 Determination one must consult the Commonwealth Gazette, departmental registers, or later amending instruments under the NLTA.

Practitioners should therefore treat the 2020 Determination as the operative instrument from 1 July 2020 forward, replacing the 2014 instrument. If other instruments or contracts make reference to the 2014 Determination by name, those references may now be stale; the correct approach is to identify whether external instruments reference "the Minister's determination" generically (and thus continue to operate by picking up the existing Ministerial determination) or whether they fix the 2014 Determination corporeally. Where necessary, administrative or contractual amendments might be required to update cross-references.

Because the Determination is a schedule-based list, typical amendment practice would be to replace the schedules or issue a fresh instrument that re-lists and adjusts entries; the 2020 Determination follows that model by issuing a comprehensive, updated list and repealing its predecessor. There is no transitional provision in the instrument about the status of works in progress, rights or obligations that arose under the 2014 Determination , any such transition rules would need to be located in the NLTA or in the texts of the specific agreements or regulatory instruments affected.

The instrument contains no judicial decisions, references to litigation, or citations to cases. Within the text of the Determination itself there is no litigation history recorded. Schedule 3 repeals the National Land Transport Network Determination 2014 in its entirety, but the instrument does not reference any administrative or judicial disputes associated with that prior instrument.

For practitioners seeking litigation history relevant to the content or consequences of this Determination, two practical points arise from the instrument's form:

• Direct litigation about the Determination's text: Because the instrument is a Ministerial instrument identifying listed corridors, any legal challenge to the Determination's validity, to the Minister's power to make it under s 5 of the NLTA, or to the process by which it was made would need to be brought by reference to administrative law principles (for example, judicial review of administrative action), challenging the decision-making process, jurisdictional limits, or failure to consider relevant matters. The Determination itself provides no factual or procedural recitations to advance or repel litigation; it is a list. Any litigation-related material that speaks to the Minister's power or to whether particular entries meet statutory definitions would need to be located in external records (for example, departmental decision memoranda, consultation records or the NLTA legislative history).

• Indirect litigation about downstream consequences: Litigation that arises from the downstream effects of being on or off the National Land Transport Network (for example, disputes over funding eligibility, procurement decisions, obligations tied to network inclusion, or property and land-use claims) will depend on the NLTA and on the specific contractual or statutory frameworks that rely on the Minister's Determination. This Determination is the formal instrument that defines the perimeter, so it may be an evidentiary document in such disputes, but the instrument itself does not contain enforcement or adjudicative procedures.

Because no cases or litigation are named in the Determination, a practitioner requiring litigation history must search external sources (court databases, administrative review decisions, or other records) for any contested matters that involved the 2014 Determination or challenges to Ministerial determinations under the NLTA. The Determination itself gives no record of any prior or pending proceedings.

The Determination's structure and language produce several practical "gotchas" for practitioners advising clients, drafting contracts or negotiating funding proposals. These are matters where attention to precise wording and process is necessary, because the instrument is a definitional tool and downstream legal effects are determined elsewhere.

1. "Existing and proposed" covers unbuilt projects: The Schedules repeatedly include "existing and proposed roads" and "existing and proposed railways." Several items are explicitly labelled "the proposed [project]". Because designation is achieved by listing, a "proposed" route is, in the text of this Determination, part of the Network. If downstream statutory provisions or funding rules confer benefits or trigger duties on roads/railways by virtue of being on the National Land Transport Network, those benefits/duties could be held to apply to the "proposed" items once they are on the list. Practitioners must check implementing instruments to see whether inclusion of a proposed project in the list has immediate legal effect or only prospective effect upon construction.

2. "To and within" language includes terminal and internal trackage: Multiple entries include terminal areas and internal port/intermodal trackage ("to and within..."). Parties that operate internal terminal rail or road systems should be aware that the Determination does not limit its capture to the external corridor; it can include internal loops and terminals. Where licencing, safety regulation or funding eligibility depends on network inclusion, internal facility operators should confirm whether that creates regulatory obligations or funding rights.

3. Repeal of 2014 Determination may remove prior inclusions: Because the 2014 instrument is repealed in full (Schedule 3), any corridors previously listed only in the 2014 Determination but omitted from the 2020 list will cease to be part of the National Land Transport Network as defined by the Ministerial instrument. If contractual or statutory rights were contingent on being in the 2014 Determination, that contingent status may be lost. Legal counsel should cross-check the 2014 list against the 2020 list to identify deletions and consider transitional contractual or statutory consequences.

4. Names, routes and interchange descriptions matter: Many entries describe routes by reference to junctions, intersections and sequential segments (for example, "M4 Western Motorway from its junction with the Westlink M7 Motorway at Eastern Creek to its junction with the WestConnex M4 Widening at the interchange with the A44 Great Western Highway at Granville"). Slight differences in naming or junction references could produce interpretive disputes about the precise spatial extent of the listed asset. Practitioners should treat the text as primary and map the descriptions to plan drawings and cadastral or highway network datasets when exact geographic coverage matters.

5. Cross-jurisdictional corridors require coordination: The Determination lists corridors that traverse multiple jurisdictions (for example, M31 Hume Motorway from Glenfield to the Hume Freeway at Wodonga). The Determination does not allocate administrative responsibility between the Commonwealth and states. Parties should be alert to how administrative responsibilities for those corridors are allocated in the NLTA or in separate intergovernmental agreements.

6. Gauge and rail classifications specified: Schedule 2 is particular about gauge (standard, dual, narrow, broad). Where rail safety, interoperability, or funding arrangements hinge on gauge or rail classification, those distinctions in the Determination are significant. For example, "standard gauge railway", "narrow gauge", and "dual gauge" appear in different entries. Practitioners should map these textual classifications against physical infrastructure specifications in technical schedules and contracts.

7. No express transitional provisions: The Determination repeals the 2014 instrument but contains no transitional provisions about projects underway, contractual entitlement continuity, or previously allocated funding. That absence leaves open potential legal uncertainty where parties relied on the 2014 Determination for eligibility or compliance. Parties should review their contracts and funding instruments to determine whether express references to the 2014 Determination require amendment or clarification.

8. Reliance on NLTA definitions: Because the instrument points to subsection 4(1) of the NLTA for the meanings of "road" and "railway", parties must not assume that common parlance definitions apply. The precise statutory definitions in the NLTA may carry inclusions or exclusions that materially affect whether a listed feature is captured. Practitioners must read the NLTA definitions before advising on scope.

9. Administrative recordkeeping: The instrument’s lists are detailed and long. Maintaining accurate corporate and agency registers that reconcile the Determination’s textual route descriptions with GIS layers, as-built plans and land tenure records is an administrative requirement that can be non-trivial. Misalignment between contractual descriptions and Determination text can create downstream disputes.

10. No express funding or construction authority: The Determination does not itself authorise construction or expenditure. Parties should not construe inclusion as an automatic grant of funds or construction approval; they must identify the separate funding and approval instruments that deliver those legal effects.

Being alert to the foregoing matters will reduce the risk of unexpected consequences when the Determination interfaces with contracts, approvals, funding arrangements and regulatory obligations.

Because the Determination itself is a designation instrument and does not create obligations, compliance in the immediate sense consists of acknowledging the Determination as the current authoritative list of the National Land Transport Network as of 1 July 2020, and then taking practical steps to align administrative, contractual and planning activities with that status. The following checklist is focused, practical and grounded in the text of the Determination and the statutory cross-reference to the NLTA.

1. Confirm effective date and authority:

   • Note the Determination’s commencement date (1 July 2020, s 2) and that it is made under s 5 of the National Land Transport Act 2014 (s 3). Treat this instrument as the operative determination from that date.

2. Reconcile lists:

   • Map the entries in Schedule 1 (roads) and Schedule 2 (railways) against your organisation’s asset registers, contracts, project lists and GIS layers. Pay particular attention to the exact textual descriptions that define junctions, interchanges and "to and within" terminal components.

3. Check for proposed projects:

   • Identify entries labelled "proposed" in Schedules 1 and 2 (for example, proposed M12 Motorway, Sydney Gateway, proposed East West Link, Perth Freight Link, proposed Mackay Ring Road Stage 2, proposed inland rail connection). For each proposed item, determine whether any of your agreements, funding claims or statutory applications require amendments or additional approvals now that the project corridor is formally included in the Determination.

4. Review contracts and funding instruments referencing the 2014 Determination:

   • Because Schedule 3 repeals the 2014 Determination in full, check whether any contracts, grants, or approvals you are party to expressly refer to the 2014 Determination. If so, evaluate whether the contractual language requires amendment to reference the Minister’s current determination (the 2020 Determination), and whether the repeal affects entitlements or obligations.

5. Consult the NLTA for downstream effects:

   • The Determination cross-references subsection 4(1) of the NLTA for relevant definitions. Any substantive rights, duties, funding eligibility, or regulatory effects that depend on network inclusion must be identified in the NLTA and in regulations or administrative instruments that implement it. Obtain and review the NLTA provisions that reference the "National Land Transport Network" to identify compliance obligations.

6. Coordinate with state and local authorities:

   • For infrastructure segments that are within state or local control, notify or confirm with the relevant state/territory agency the implications of the Determination for planning, maintenance, and approvals. Where state roads are included in the national list, clarify who will administer any Commonwealth commitments tied to the network.

7. Update administrative records and notices:

   • Ensure departmental or corporate registers reflect the 2020 Determination as the authoritative list from 1 July 2020. Where internal processes rely on a defined network (for example, eligibility filters for project prioritisation), update those processes to reference the 2020 Determination.

8. Engage port and terminal operators:

   • Where the Determination includes "to and within" port and intermodal terminals, reach out to terminal operators to map responsibilities for internal trackage, safety compliance, and maintenance. Those operators may be required to coordinate with government entities for network-level planning.

9. Prepare for mapping and technical alignment:

   • Translate the narrative route descriptions into GIS datasets and engineering reference points. Because the Determination describes routes in sequential textual terms ("from its junction with ... to ... then ..."), convert these into precise geographic descriptions for procurement specifications, environmental approvals and construction contracts.

10. Seek legal clarification for contentious items:

• If a corridor’s inclusion raises contested issues (for example, if physical limits or naming discrepancies produce conflicting interpretations), obtain legal advice referencing the NLTA definitions and any available administrative records of the Minister’s decision to support an interpretation.

11. Monitor for subsequent amendments:

• The instrument itself does not indicate any mechanism for future amendment, but the Minister retains the power to make determinations under the NLTA. Monitor departmental publications and the Commonwealth Gazette for later determinations or amending instruments that might alter the network list.

12. Document transitional impacts:

• For projects or contracts relying on the 2014 Determination, document any transitional consequences arising from the repeal in Schedule 3, and prepare amendments or claims where contractual reliance is affected.

By following these concrete steps , anchored to the Determination’s textual features (commencement s 2; authority s 3; identification s 5; schedules 1-3) and by consulting the National Land Transport Act 2014 for substantive legal effects , agencies, contractors, ports, and other affected parties can align their operational, contractual and regulatory practices with the updated Ministerial list of National Land Transport Network assets.
