226 Minister may give directions to the Pricing Authority—functions in relation to hospitals

(1A) This section applies in relation to the functions of the Pricing Authority mentioned in subsection 131(1) and the powers that may be exercised by the Pricing Authority for or in connection with the exercise of those functions. (1) The Minister may, by legislative instrument, give directions to the Pricing Authority in relation to the performance of its functions and the exercise of its powers.

(2) The Minister must consult the Ministerial Council before giving a direction under subsection (1). (3) A direction under subsection (1): (a) must be of a general nature only; and (b) must not be a direction to change: (i) a particular national efficient price for health care services provided by public hospitals; or (ii) a particular efficient cost for health care services provided by public hospitals. (4) The Pricing Authority must comply with a direction under subsection (1).
