What it does
This Determination, titled National Health (Pharmaceutical Benefits Scheme‑ class of pharmaceutical items - Subsection 99ACA(3) Determination 2017 (PB 82 of 2017), records a discrete, instrument‑level change to prices applying to a specified class of Pharmaceutical Benefits Scheme items. It is made under subsection 99ACA(3) of the National Health Act 1953 (see s 4 of the Determination) and was executed by an Assistant Secretary, Pricing and Policy Branch, Technology Assessment and Access Division, Department of Health, acting as delegate of the Minister for Health (instrument signature block, dated 19 September 2017). The instrument commences on the date it is registered on the Federal Register of Legislation (s 2).
Mechanically, the Determination does two things. First, it revokes the earlier Determination made under subsection 99ACA(3) (PB 59 of 2007) (s 3). Second, it declares that the class of pharmaceutical items listed in the Schedule has taken a 12.5 percent administrative price reduction (s 6 and Schedule). The instrument defines "administrative price reduction" as a non‑statutory price reduction that has been agreed under section 85AD of the National Health Act 1953 (s 5). The Schedule identifies each listed component drug and the relevant manner of administration to which the 12.5 percent administrative reduction applies.
The Determination does not itself set out legislative amendments to the National Health Act 1953. It is an exercise of delegated authority under the Act to identify a class of items that have had an administrative price reduction applied. The document therefore functions as a formal record, as of the commencement date, that the specific listed component drugs and manners of administration in the Schedule have been subject to a 12.5 percent administrative price reduction, as defined and as agreed under section 85AD of the Act.
